CITY OF LAKEVILLE COUNCIL MEETING
DECEMBER"4, 1978
,..The meeting was called to order at T:30 P.M. by Mayor Lekson. 'The p edge of
allegiance to the flag was given.
Roll call was taken. 'Present: Councilmembers-Spande, Curry, Zaun, Nelson and
Mayor Lekson. Also present: Patrick.McGarvey, City Administrator/Clerk;
Patrick Farrell, City Attorney; 'Darrell Schneider,.City Engineer,
78.563 Motion was made by Zaun, seconded by Nelson~to approve the. minutes of the
November 2(l, 1978 Council meeting.

78.564 Motion was made by Curry, seconded by Zaun to approve the claims for payment as
:presented.

Staff reports.:..
Darrell Schneider advised the Council that. there is going to be on the December
14th Metropolitan Council-Physical Development Committee agenda the .question of
the Metropolitan Waste Control Commission acquiring the Burnsville interceptor
which serves the Crystal Lake district in Lakeville. He advised the Council
that the Metropolitan staff was recommending .against the acquisition hythe
Waste Control Commission and that it could be important for the City to have
~epseseatation at the meeting.
The Engineer also advised the Council it would be necessary for the Gounel to'
approvea five gear- plan to;be suk~m~.~ted to'the Minnesota .:Department of Trans-
portaton _fpr. use-:~in def°~rmining>` road `expen:ditures and State Aid.
78.565 Motion was made by Spande, ascended by Nelsonto-receive the minutes of the
three Advisory Committee myeetings.

At this time Mr. Jerry,;Clayr.presented.`the-preliminary plat of Dodd Terrace, 2nd
Addition.

City. `The staff advised'the Council that a route for the'storm drainage
system and a policy on,st®rm system assessment rates should be considered

cil.
78.566 Motion was made:. by Zaun, seconded by, Curry to approve the preliminary plat of
Dodd Terrace, 2nd Addition as recommended by the Planning Commission:-and Park
`and Recreation Committee.

At this time the City Adminisaetor presented maps and reviewed three areas that
are being considered for. utility improvement projects. in 1979. The first area
concerns the Lake... Marion relief sewer trunk from he vicinity of the Lakeville
Sigh School to the Lamplighter .Apartment .complex. This is the project the City
is expeeting'to receive a Iii~D grant in the amount of $219,400 on. .The steff
recommended that this be the only project in 1979 which a; reliance on unit
connection charges and ppssibly'property tax be used to cover part. of the
financing.
The next area considered for a utility improvement project was in the vicinity
of 1$5th Street. east of Highway 50.
The third area considered for a utility improvement project was in the Orchard
Lake area, west of County Road 5. Consideration was given to cer~apleting the
Orchard Lake sewer and water system around the west end aatd south side of the
lake back to County Road S and a shorter version of'extendin~ utilities west

from County Road 5 to serve a-new largeundevelopedtracts of .land to the west
and southwest of the Queen Anne Trailer'Park property.
.The staff recommended. that the Council authorize preliminary reports at this
time if the timely 1979'development schedule is-expected to be accomplished.
78.567 Motion was made by Curry, seconded by Zaun_:to authorize a preliminary engineer-
ing report on the Lake. Marion relief ;sewer 'subject to the''City receiving of-
ficial notification from the U. S. Department of Housing and Utban Development
that the City would be'rece wing the $219,000 Grant for this project,.

78.568 Motion was made `by Curry, seconded by Zaun to authorize the Gitq Engineer to
prepare a preliminary engineering. report on the extension; of utilities westward
toward orchard Lake to the west boundary of the:Watsthkeproperty, subject to
the developer or developers depos~,ing the estimated cost of the repcsrt with
the City before the Engineer begins his work..

The Council also directed that the staff attempt`to,get the information on the`
possible completion of the Orchard Lake utility 'sys em to the residents in the`
urea and attempt to find out. what the people may want,
;At this time.Mr. Steve Grohoski presented his preliminary .plat of Woodridge
Estates'-Addition to the City. Council.
T e Administrator explained that before this 24 lot plat could be developed on
- 'the north-side of 185th Street 'that a subtrunk'sewer line would have" o be ex--'
tended to the area by the City. Maps were. reviewed showing possible alterna-
tive routes for the pipe and the properties which would be'befited and have
to"face an assessment. The taff recommended the Council authorize a prelim-
inary engineering report on the sewer project'subject- to the. developer or
developers depositing with the City the estimated cost of the report-before
the engineer begins.
78.569 Motion. was: made by" ~pax~de, seconded by Nelson to approve the preliminary plat
of Woodridge Estates Addition subject to the feasibility of sanitary sewer
being provided to the plat.;

78.570 Motion was made by Curry, seconded by Zaun to authorize the Gity Engineers. to
prepare`a preliminary report on the extension of sanitary sewer `to the 185th
Street area east~of Trunk Highway 50; subject to_the developer`or developers
depositing wthkthe City .the estimated cost of`the report before the.Engiueer
begins.

78.571 Motion was made by Zaun, ~~ecbnd'ed ~y Nelson to receive the`repvrt from the City

78.572 Motion was. made by Curry, seconded by Zaun to consider as the first reading an
ordinance adopting the Minnesota Building Code, 1976 Edition and place it on
the December'18th`agenda fore. the. second. reading and .adoption.

The City Council reviewed proposals from two firms for the: codification of City
ordinances.
78.573 Motion :..was. made by Curry,, seconded bq Zaun to table..approval of the agreement
an the codification of City ordinances subject to the City:Administrator and
City Attorney making arecommendation-on which proposal to accept.

78.574 Motion was made by Zaun, seconded by Nelson to<approve the Sewer System Evalua-
ton Survey, Phase I report.

78.575 Motion was made by Nelson, seconded by Zaun to-receive the draft flf the estimated
costs for preparing Phase II of the`SSES xeport from Consulting engineers Diver-
sifted.

Mr. Schneider presented a letter of proposa fore the completion of tl~e City's
storm sewer system comprehensive plan. Mr, Schneider stated that the price
being proposed the report would not be a fancy, multi-colored report.
78.576: Motion was ma.de'by Curry; seconded byZaun to approve. the proposal of Consulting
Engineers Diversified. for Phase II of the storm drainage comprehensive plan for
a price not_to exceed $Y0,000.

Mr. Schneider presented a letter'.c~f proposal for Consulting Engineers Diversified;
to prepare a compreli`ensive transportation plan for the City.
78.577 Motion was made by Curry,~~econded by Zaun to approve the proposed agreement
with Consulting Engineers Diversified. for a~omprehensive. tra~ssportation plan
for ,the Cite fear a cost x~ot'to exceed. $9,500.

78.578 Motion was made by Nelson, seconded by Zaun to ,approve the request of J. P.
Development on the=extension of 100 days'of a deadline for the developer to
sign. the Development Contract of Highview Estates Addition.-
Rolle call was taken on. the motion. Ayes, Lekson, Curry, Zaun, Nelson and Spande.
Councilmen Zaun and Spande gave a report on the Liquor Store Committee on the
.operation of the. Liquor Store for.. the first: three: quarters of 1978. Council-
man Zaun stated that he Committee was estimating a 1978 profit in the range
of $71,000..
The Committee also stated that they would be meeting with the architect and
.the contractor to review the new air conditioning installation and that settle-
went on the costs for-the repar_work,and new installation would be forthcoming.
78.579 Motion was made. by Curry, seconded by 'Spande to extend the Council meeting be-
yond the 1Ds30 adjournment time.
Roll call was taken on the-motion. Ayes,; Curry, Zaun, Nelson, Spande and Lekson.
At this time Mr. Schneider explained tha Pat.Rudger was in the audenceand
had made a request to the City to allow them to'extend.City sanitary..sewer,
water, at:_Upper,196th-Street. Utility and treet extensions would .serve three
lots. -The extension. would `be within the street right-of-way platted years
ago. Mr.-.Schneider explained that the developers would be`responsible for
making.. the improvements under the Development Agreement.
78.580 Motion was made by Curry, seconded by Zaun to authorize thQ Gity staff to pre-
pare a Development Agreement for the extension of utilities and street on
Upper 196th Street to serve the three lots.

The City Administrator presented the Council with the requested transfers in
.the Fire Department budget. fox salaries and car ,expenses for the position of
full time Fire Chief which was needed but filled in 1978 to Capital Improve-
merits..
7$.581 Motion was-made by Curry, seconded by, Spande to authorize the transfer of
$11.,100 from the. salary and :car expense account from the 1978 Fire :Department
budget to the Eapital Outlay account.

78.583 Motion was made by Nelson,. seconded by Spande to authorize. the purchase in the
amount of $6,:125 to Metro Fire Equipment for the purchase of an American Bristol
Air Compressor and accessories.

78.584 Motion was made by Zaun, seconded by Nelson to authorize the purchase in the
amount.. of $Z, 340 to Akin Fire for the purchase of hose.

lot at Ritter Park to aecommoda a expected increased use in the:: park for cross

A plan was also presented for controlling the entrance to the park and charging
a fee for use of the park.'
78.585 Motion was made by Curry, seconded~by`Nelson to adopt 'Resolution 78-91 estab-
lshing..fees for users of Ritter Park cross: country ski trails.'

78.586. Motion was made by Zaun, seconded. by Nelson to approve an agreement to acquire
.grant. money for snowmobile` tra3.l `~~'2 for 1978-79 season maintenance ;from the
Department of Natural Resources:

The Council discussed the advisability of the City establishing a standard set
of specifications for sanitary sewer, ;,water and streets in Lakeville.
78.582 Motion was made by Curry, seconded by Nelson to authorize Consulting Engineers
Diversified to investigate problens with the-operation of the booster station
.and report to the Council.'
