CITY -0F LAKEVILLE SPECIAL COUNCIL MEETING
MAY 17, 1977
The meeting was called to order by Mayor Mako at 7:30 P.M. at the Orchard Lake
Elementary .School.
Roll call was taken. Present: Councilmembers Curry, Zaun, and Mayor Mako.
Absent: Councilmen Clarkson and Emand.
At this time Mayor Mako explained that the meeting would have to be recessed to
8:05 P.M. to allow the School Board elections to close. Mayor Mako explained
that the Council had set the hearing at 7:30 on April 18th :and did not realize
at that time that the School Board elections were being held on the same date
and place and that State Statutes do not allow public meetings to be held dur-
ing the time elections are under way. Mayor Mako apologized to those in attend-
ance for the inconvenience and suggested that during the recess they could view
the various exhibits provided by the Engineering Consultant and the staff would,
be available to answer questions.
Mayor Mako reconvened the Council meeting and public hearing on the proposed
'.street improvement at 8:05 P.M. At this time the Mayor explained the procedure
on how he would conduct the meeting and then requested the City Attorney to
attest to the legality,' of the hearing.
During the recess Councilmembers Clarkson and Emond arrived and took their chair.
The City Attorney, Pat Farrell attested to the legal notice being mailed to the
property owners and being published in the official Gity newspaper.
At this time the .Mayor introduced the City Council members and City staff present
at the hearing. The Mayor pointed out that Mr. Darrell Schneider of Consulting
Engineers Diversified would be the engineer in charge of the project and would
be answering mast of the questions concerning the project.
At this time Mr. Schneider showed slides of the project area and of .the project
costs and construction procedures.
Mr. Schneider explained that the project costs Would be identified by the various
subdivisions involved in the project and that his estimates of the cost for each
area were as shown in the handout material available to the citizens at the pub-
lic hearing.
Mr. Schneider further explained the width of .the new streets would vary depend-
ing upon which addition they were in because of the topography involved in.the
' various areas and the fact that streets are being put. into already developed.
areas and mast be carefully fitted to the existing front yard and driveway
elevations.
During the slide presentation Mr. Schneider explained which streets would be at
the various widths.
At the conclusion of Mr. Schneiders slide presentation the Mayor opened the hear-
ing to questions from the citizens present. The Mayor also stated that there had
been concern expressed as to whether or not there was 8 inches of Glass 5 on the
streets in the project area.. He stated that the City had requested; Mr. Schneider
to check the weight tickets from the previous project and engineering consultant
and that Mr. Schneider had done so.
At this time Mr. Schneider explained what inspection he had done on the repair
of the sewer system in the area and the weight tickets concerning the Class 5
and stated that in his opinion that tonnage as shown on the weight tickets
corresponded closely to his estimate on what tonnage should be there for the
width of the streets involved in the requirement of 4 inches of Class 5 material.
There were approximately 55 citizens present at the public hearing.
At this time the Mayor began acknowledging questions from several of the citizens
concerning the project,
Mr. Joel Frank asked that if Lakeville now requires that streets be built before
an area can be platted. His answer to this question was yes.
Mr. Dick Patten asked the engineer how he will handle the driveway which is Lower
than the surface of the street.. Mr. Schneider explained that survey crews will

have to pay particular attention to those driveway areas and he will attempt to
adjust the street as best he canto eliminate any problem.
Mr. Dave Farmer asked the engineer about the 1,050 ton of Class 5 estimated to
be needed in the Jackson Heights 2nd Addition.
Mr. Schneider explained that if the weather were good through the construction
of the project that there may not be a need for 1,050 ton in Jackson Heights
2nd and that the project would be charged only with the actual amount of Class
5 purchased and placed in the project.
Mr. Bill Jacksan states that he and Mr. Krause had spent $27,000 on putting in
the streets in Jackson Heights 2nd Addition with asphalt in 1974, and that he
felt this was a waste of money and should have been bonded for and then put
in after the utilities were in.
Mr. Harpacks of Jackson Znd asked why he could not get any bill from the sewer
and water project when it was placed at the tavern area on County Road 5 and
in the City park in Jackson 2nd Addition.
.Mrs. Jones on 166th Street asked what the staking line was for in the front of
her house. Mr. Schneider explained that it did not mean any trees were going
to be taken from her property as far as he knew.
IMr.-Dan Bergstrom on 167th St. asked if someone on the City staff could take a
look at the oak trees which appear to be dying on his property and attempt to
save them. The answer was that. the staff would Look at .them.
Other citizens asked about the assessmer_ts on theproject..'
At this time Mr. Schneider explained that the City was proposing to assess the
project aver a ten year period with ten equal principal payments at 8% interest
on the unpaid balance. He explained that the first year's .interest payment
would be for more than one year as it would begin running from the date of the
assessment hearing through 1978.
Mrs. Kramer on .166th Street asked if a two inch layer of asphalt provided a
strong enough street.
Mr. Schneider explained that this is a standard design for a seven ton residen-
tial street with 8 inches of Class 5 and 2 inches of asphalt.
Mrs. Kursh on 167th Street askew why ane-half of the side of a corner lot being
. assessed on a footage basis. She suggested trxat the Council assess the project
on a per Iot or unit basis. Mayor Mako explained that on past projects the City
of Lakeville's policy had been to assess the front footage and one-half of the
side footage on a corner lot with the rest of the project area picking up the
costs of the remaining one-half of the side lot.
Mrs. Perry an Kenreel Avenue asked whether it was wise to place the new City
.street over the sewer lines.
Mr. Schneider explained that he did check all areas where any repair work had
been done by" the sewer and water contractor and that there would be further
inspection before the streets would be placed by the street contractor.
The City Attorney explained that the Citq policy was not to assess you for the
costs of fixing a problem that might occur in the future.
Mr. Terry Gilman of Jackson 2nd Addition explained to the. Council that he had
already paid for asphalt once on the street and did not feel he should be assessed
for it again.
At this time Mr. Schneider explained that the project work would not begin until
July after the plans and specifications had been finished, approved by the City
Council, and the bids have been received by the City and the contract approved.
The process would take to the end of June with the contract let and actual can-
struction beginning in July. Mr. Schneider explained that the project would not
be complete until during the month of September. The project ~ ould be assessed
in Late September or early October.

At this time several .citizens complained about the dust in their area and asked
the Council if a coat of oil could be put on the gravel roads until the project
is started.'
Other citizens requested the Engineer. to explain the estimated cost for the drive-
way aprons estimated at $225 for. the asphalt driveway.
Mr. Schneider explained that the estimate was for an asphalt driveway 'from the
.back of the curb to the property line of I6 feet in width. The driveway wider
would cost more or narrower would cost Less. He said he put this in the estimate
as an option to the property owners. This is if the property o~~ers want_`the
driveway apron.
Mr: Ed Perry asked about the width of Renreel Avenue in Lakeville Hills 'Addition.
Mr. Schneider explained that the width would varp 24 to 26 feet.
- Mr. Joel Frank asked if he is going to be assessed for the footage on Jacquard
Avenue to the center of 210th Street. The Mayor stated the staff would look
into that question.
At this point Councilman Emond explained that as far as he is concerned the as-
ghalt or concrete drive aprons can be left off if the property owners do not want
one.
.Mrs. Krause questioned the Council several times concerning the added cost for.
replacing asphalt streets in Jackson Heights 2nd Addition.
Mayor Mako explained. that he did not have all the answers to her questions and
suggested that the .Council members meet with Mr. Jackson and Mr. Krause and any
citizen interested from that area concerning the sequence of events in the de-
velopment and improvements in the 3ackson Heights 2nd Addition. It was decided
to have a meeting set at the conclusion of the public hearing.
.Mrs. Matschke and Mrs. Nozal- both questioned the City Council about the Liquor
Store improvement and where the liquor store money had been spent in the past.
Mayor Mako explained that the Liquor Store project is being paid for by money
derived from operating the liquor stare and that over the past years many parks,
pieces of equipment and City services have been paid for by profits from the
operation of the Lakeville Municipal Liquor Store.. He further stated that the
Liquor Store project was not the subject of the public hearing and that the
questions should concern themselves with the proposed street improvements.
Mr. Purcell of 167th Street questioned why the sodding of lower 167th Park had
not been completed. Mr. Robinette explained that the City Administrator had
directed the Consulting Engineer to see to it that the contractor completed
that part of the work.
77.247 Motion was made by Emond, seconded by Zaun to close the public. hearing. Mayor
Mako asked if there were any objections from the citizens closing the hearing.
There were none..
Roll call was taken an the motion. Ayes, Emond, Clarkson, Curry, Zaun and Mako.
At this time Mr. Schneider explained to the Council that the question of putting
in the driveway aprons was not a strong concern to him and that if some citi-
tens did not choose to have either an asphalt or concrete driveway apron, that
would be fine.
Councilman Zaun .asked who had blacktopped streets in the past in this area and
the answer was that it was just in the Jackson 1st and 2nd Additions, and that.
in the ist Addition the streets were of. poor quality.
Councilman Zaun also stated that the City .had received petitions requesting the
street improvements in these various additions and that after considering the
long range maintenance costs that he felt it was in the best interests of the
.property owners and the City of Lakeville and all the taxpayers that theconcrete
curb and gutter be included.
Councilperson Curry explained that she had reviewed the casts of City mainten-

ance to streets and felt that it was the most cost effective fo include concrete
curb and gutter in street projects.
Councilman Clarkson stated that he endorsed the concrete curb and gutter and felt.
it makes a much more attractive neighborhood and also is a cheaper street to main-

Councilman Emond explained that in the area of the City where he lives he is pay-
ing for an asphalt street for the second time because the first street had. to be
torn up to put in sewer and water utilities and he sympathized with `the residents
who were facing the same prediciment in this area.
77.248 Motion was made by Emond, seconded by Curry to adopt Resolution 77-31 ordering
the Zakeville Hills, Jackson Heights lst and 2nd Addition, and Gola Heights
street improvement projects and authorizing Consulting Engineers Diversified
to prepare plans and specifications for the asphalt streets with concrete curb
and gutter..
Roll .call was taken on the motion. Ayes, Clarkson, Curry, Zaun, Mako and Emond.
77.249 Motion was made by Emond, seconded by Clarkson to adjourn the meeting. Time:
10:20 P.M.
