CITY OT LAKEVILLE ~~CZL.MEETING MARCH 21, 1977 The, meeting was called to order by tfayor Mako at 8:00 P.M. The pledge of alle- giance to the flag was given. Ralf call was taken. Present: Mako, Curry, Clarkson. Absent: Emond and Zaun. 'Also present: Patrick McGarvey, City Administrator; Pat Farrell, City Attorney. 77.126 Motion was made by Curry, seconded_by,Mako to approve. the minutes of the March 7, 1977 Council meeting as amended to include the wording before Motion X77.114 as follows: "The Mayor asked the Administrator if the employees had seen or were aware of the Resolution. The Administrator replied that the subject pertaining to~the use>of sick cave and whether or not the use should be deducted from sick leave when it is used for`,funeral leave for personal uses was discussed during. the course 'af salary negotiations in late January and early February". Roll call was taken on the motion. Ayes, Mako, Curry and Clarkson. Nays, none. Absent, Zaun and Emond. 77.127 Motion was made by Curry, seconded by Zaun to reconsider Resolution ~~77-17 on employee,Ieave benefits and ask the Administrator to discuss the Resolution with the` et~ployees. Roll call was taken on the motion. Ayes, Curry, Zaun and Mako. Nays, Clarkson. 77.128. Motion was 'made `by Zaun, seconded,by Curry to approve the claims far payment as presented. Roll call was taken on the motion: Ayes, Zaun, Clarkson, Mako: and Curry. At this time Mrs. Kraft appeared before the Council concerning the problem with her well which had recently gone, dry. _Mrs.'Kraft inquired as to when the City was planning to extend. City utility services to their party, or if they could extend a long service line across Lion's park from their party "to the nearest Citp water main, at the end of Ao+wland Avenue. The Administrator explained the estimated cost of the two alternatives and the Council directed that:the Administrator and Plumbing Inspector meet with Mrs. Kraft the next day to see what could be doge. Marianne Curry questioned the City Attorney,-Patrick Farrell, about the status of his negotiations with Fisher Construction concerning the settlement and re- par'to a sewer line installed by Fisher at the Middle School tee the Lakeville treatment 'plant. Mr: Farrell replied that he would be working on 'the matter in the next week and would havea recommen.datian soon. The City Administrator read a Joint Resolution with the City 'of ,Apple Valley concerning the limiting of sewer eonnect4ns on the sewer system tributary to the Apple Valley treatment plant. Zt'was explained that the Resolution was necessary due to-the Minnesota Pollution .Control Agency's. refusal to issue any permits far sewer extensions until the Cities can agree.. on limit- ing connections if and when new capacity at the plant is reached before the new Empire Township treatment plant is finished. 7?.I29 Motion was made by Curry, ,seconded by Zaun to'adopt Resolution_No. 77-19 setting forth City policy'on. limiting sewer connections on the system tribu- tary to-the Apple Valley treatment plant. Roll call `was taken on the motion.. Ayes,,Maka,_CUrry,-.Zaun and Clarkson. At this time, Mr. Lawrence Dsllen,'$arr Engineering.. reviewed maps his .firm had prepared showing the flood plain and the flood fringe and :flood wap within the. flood plain for certain drainage areas'n the City of Lakeville. Mr. Dallenexplained hat the study was~requred'and paid for by the Depart ment`of Housing and tTrhan Development as a result of the City's participation in the flood insurance program provided bythe Federal government. Mr. Dallen explained that it is now time for .the .City to study the maps and indicate if they wish to have any changes made' in the flood plain boundary or in-the 'flood fringe boundary within the flood plain. If the City does request ang changes their firm would test the results of the change and in- dicate whether ar not the change can be approved. Mr.'Dallen replied to a question that the Federal government does not have _1_ CITY OF LAKEVILLE COUNCIL MEETING MARCx 21, 1977 any funds for Cities to use to pay for the cost of the land which is within a flood way at this time. The City Council felt that additional areas needed to be studied and asked Mr. Dallen if his firm could include that with the work already completed. Mz. Dallen stated that the City should request it in the form of a Ietter to his firm. 77.130 Motion was made by Zaun, seconded by Curry to write a letter to Mr. Dallen outlining additional areas the City would like to study to determine the flood way. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson and Mako. At'this time the Council reviewed the proposed contract for architectural, services on a proposed new City hall in Aronson Park. After discussing the contract there were several questions Whlch the Council felt they should get the answers on before acting on the contract. 77.131 Motion was made by Zaun, seconded by Clarksen to table consideration of the contract with Ackerberg & Associates on the proposed new City Hall to April 4. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Mako and Curry. At this time, Mayor Mako requested .the City Administrator to briefly review the recommendations made in a report to the City Council concerning engineer- ing services in the City.,. of Lakeville. The Gity Administrator outlined the four recommendations contained in the report. The recommendations inol;uded determination~.of the present storm sewer agreement with Bonestroo, Rosene, Anderlik and Associates, the agpro- val of an engineering agreement with Consulting ,Engineers Diversified and the authorization to that"firm tb gregare a preliminary report on certain :;proposed street improvements, recbmsnen~ation of a staff City Engineer posi- tion and the abolishment of. the Public 4;orks'Director position. At this time, Mayor Mako read a letter 'from Councilman Emond, who is on vaca- tion, giving his position. on the subject. 77.132; Motion was made by Clarkson, seconded by Zaun to receive Mr. Emond's letter. Roll call was taken on the motion. Ayes, Clarkson, Mako, Curry and Zaun. 7.133 Motion was made by Curry, seconded by Mako to allow the general engineering agreement with Bonestroo, Rosene, Anderlik'and Associates to remain in effect. 'Roll call was taken on the motion. Ay es ,r Mako, Curry, Zaun and Clarkson. 77.134 Motion was made by Zaun, seconded by Mako to direct the City Administrator and City Attorney to meet with the Banestroo firm to-terminate the contract on the storm drainage study. Roll call was taken on the motion. AYes, Curry, Zaun, Clarkson and Mako. 77.135 - Motion was made by Zaun, seconded by Curry to allow the contract with. Bonestroo on the sewer system evaluation survey to pxoceed`to completion. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Mako and Curry. 77.136 Motion was made by Zaun, seconded by Mako. to table 'approval of the Consulting Engineer Diversified engineering agreement to the Mareh 29th Council meeting to allow the City Attarneq to meet with'the engineers and discuss the pro- visions of the contract. Roll call was taken on the motion. Ayes, Clarkson, Mako, Curry and Zaun. Nays;` Curry. ,.77.138 Motion was made by Clarkson, seconded by Mako to extend the Council meeting beyond the 11:00 P.M. adjournment time which had already been past=_ due to the heated discussion concerning the engineering question. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson and, Mako. t 77.139 Motion was made by Mako, seconded by Zaun to direct the City Administrator to meet with the Public Works Committee concerning the job description of the Citg Engineer position and any modification the Committee makes in the description is what is to be advertised. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Nako. Nays, Curry. 77.140 Motion was made by ,Curry, seconded by Zaun that the present Fuble Works Pirector be commended for his job concerning inspection of the sewer in- stallatians and other improvements and for the records he has kept. Roll call was taken on the motion. Ayes, Clarkson, Mako, Curry and Zaun. Item No. ZO on the agenda., the ordering of a preliminary report on street improvements was not acted upon .pending the approvement of the C.E.D. engineering contract. 77`.'141 Motion was made by,Zaun seconded by Curry to receive two. reports from the Park and Recreation 'Direetor'coneerning 1977 swimming program and fees and a change in the fishing bridge to be constructed at Lake Marion near Old 65. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson and Mako. 77.142 Motion was made by ,Zaun, ;,seconded by Gurry to adopt the policy and rates proposed. by the Recreation Director for he 977 swimming programs at the City pool as recommended by the Park and Recreation Committee.> Roll :call was taken on the motion. Ayes., Zaun, Clarkson, Mako and Curry. 77.143 Motion was made by Curry, seconded by Zaun to approve the change in the con- cept proposed for construction of a fishing area near Old 65 at Lake Marion. Roll call was taken on the motion. Ayes, Clarkson, Mako, Curry and Zaun. 77.144 Motion was made by Clarkson, seconded by Curry to approve the installation of street lights as proposed in a memo from the Public Works Director dated March 10, 1977. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun and Clarkson. 77.145 Motion was made by Mako, seconded by Zaun to approve the building plan and site plan for the City Club building to be built in Airlake Park. Roll call was taken on the motion. Ayes, Gurry, Zaun, Clarkson and Maka. 77.146 Motion was made by Curry, seconded by Zaun to receive the minutes of the Planning Commission, Natural Resources Committee, and Park and Recreation Committee meetings. Roll call was taken on the motion: Ayes,-Zaun, Clarkson, Mako and Curry. Item No. 18, appointments to the Youth Advisory Committee with terms estab- d fished, was tabled. 77.148 Motion was made by Zaun, seconded by Clarkson to approve six gravel permits for Denny Dunham, River Warren Aggregates, Chas. M. Freidheim Co., Nordic Square, Midwest Asphalt Corp., Elizabeth Seely. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun and Clarkson. 77.149 Motion was made by Zaun, seconded by Mako to approve pay request ~~6 to Mc- Grand and Frovarp for work on the 1976 drehard Lake Phase I utility project, in the amount of $2,673.99.
