HomeMy WebLinkAbout03-07-77 CITY OF LAKEVILLE COUNCIL MEETING MARCH 7, 1977 The meeting was called to order by Mayor Mako at 8:00 P.M. The pledge of allegiance to the flag was given. Roll call was taken. Present: Emond, Mako, Curry, Zaun.. Absent:.:P~:Clarkson. Also present: Patrick"McGarvey, City Administrator; Robert Rosene, Consulting Engineer; .Patrick Farrell, City Attorney; Richard Radermacher, Chief of Police; James Robinette, k'ublie Works Director. 77.105 Motion was made by Zaun,-seconded by Emond to approve the Council minutes of the February 22, 1977 Council meeting. Roll .call was taken on the motion. Ayes, Mako, Curry, Zaun, and Emond. 77.106 Motion wag made by Zaun, seconded by Curry to approve the minutes of the March 1, 1977 Special Council meeting. Roll call was taken on the motion. Ayes, Curry, Zaun, and Mako. Nays, none. Mr Emond abstained as he was not at the meeting. 77.107 Motion was made by Emond, seconded by ,Zaun to approve the claims for payment as ,presented. Roll`ca11 was taken on the motion. Ayes, Zaun, Emond,-Mako and Curry. At this time-Mayor Mako presented Resolution ~{77-14 expressing the City Council's appreciation and thanks to the Lakeville Police Reserve members who were present at the meeting. 77.108 Motion was made by Mako, seconded by. Zaun to adopt Resolution X77-14 expressing the City Council's thanks •to the Lakeville Police Reserve. Roll call was taken on the motion. Ayes, Emond, Mako, Curry and Zaun. At--this time Councilman Clarkson arrived and took kris chair. The City Attorney, Pat Farrell', recommended the Council adopt Resolution ~~77-15 giving approval to the `division of land iai Airlake Park. 77.109 Motion was made by Curry, seconded by Zaun to adopt Resolution x'77-15. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. Mr. Rosene handed out wo memos to the Council.:.. One involved the status of the sanitary sewer in£low study and'the other concerned the status of the U. S. G. S. testing`of .the lakes and report thereon. 77.110: MQ ion was made,by Zaun, seconded by Curry... to accept the Board of Equalization meeting of"the City Council for May 31, 1977 in the Council Chambers beginning at 3:00 P.M. to 7:00 P.M. Roll call was taken on the motion. Ayes, Curry., Zaun, Clarkson,. Emond and Mako. The City Administratar`'presented a-claim=~f iled aga3.nst the City by Russell M. Spence., an ..Attorney. 1 77.111 Motion was made by Zaun, seconded by°Curry to acknowledge=.receipt o€ a claim from Russell M. Spence and refer it to the City insurance company for appro- priate handling. Roll call wars taken on the motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. At this time Mayor Mako read Resolution ~~77-16 concerning the selection of a site for a new City-Hall and retaining Ackerberg'b Associates as the architects for -•a new City Hall. 77.112 Motion was made by Clarkson, seconded by Curry to-.adopt Resolution X77-16 on a new City Hall facility. Roll call was taken on the motion. Ayes, Clarksaa, Emond, Mako, Curry and Zaun. -1- CITY OF LAKEVILLE°COUNCIL MEETING V MARCH -7, 1977 At this time Mayor Mako announced that the interviewing process of consulting engineers was not complete, as the Council had set a meeting for March 9, 1977 to conduct another interview with a consultant. The meeting was to be in the Council Chambers beginning at 5:00 P.M. ..77.113 Motion was made by Curry, seconded by Zaun to receive the minutes of the Youth Advisory Committee and the Natural Resource Committee meetings. Roll call was taken on the motion. Ayes, Emonds Mako, Curry, Zaun and Clarkson. The March 2, 1977 Park and Recreation Committee meeting was cancelled and therefore there were no minutes for the Council to receive. The City Attorney reported to the Council on the status of his work concerning obtaining easements for pedestrian trails to Aronson Park, and Antlers Park. Mr. Farrell suggested a meeting between the land owners, himself and the Mayor. Receipt of the Planning Commission meeting minutes of March 3, 1977 was not acted upon as that meeting was cancelled due to poor weather on March 3. The City Administrator reviawed with the Council Resolution ~~77-17 concerning various types of leaves that City employees have as fringe benefits. Mrs. Curry suggested a change in the working on the reporting of sick leave absence and Council:sugg~sted that the funeral.Ieave be extended to include mother-in-law and father-in-law of the employee. 77.114 Motion was made by Zaun, seconded by Emond to adopt Resolution 977-17 on policy for City employees fox various leaves,, with clarification of wording on the sick leave reporting an the employee and adding mother-in-law and father-in-law to the list for which funeral leave may be taken. Ro11 call was. taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. 77.115 Motion was made by Emond, econded_by Zaun to approve the Actual Use Report for Federal Revenue Sharing for. the period of July 1, 1976 to December 31, 1976. Roll call was taken on the motion. Ayes, Curry, Zaun, .Clarkson, Emond and. Mako. The City Council discussed a bi].1 received from the. Lakeville Chamber of Commerce far theecvst of equipment rented 'from the telephone company for installing and removing the'Christmas`decoratons. It-was pointed out that the City had bud- . geted no funds for 1977 for this-service but that the City owned equipment and ..City .employees are provided, that any additional equipment or manpower necessary .for this type of work should be the responsibility of the Chamber. ,'7.116 Motion was made by Curry, seconded by Mako to return 'the bill to the Lakeville Chamber of Commerce from the Central'Telephone company for the installation and removal'of Christmas lights. Ro11 call was taken on the motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. 77.117 Motion was made by Curry, seconded by Clarkson to authorize the repair of the large electric generator not to e~cceed $500 to be`paid out of the 1977 Street Department operating budget, so that emergencg stand-by electrical generation will be available in -the e~vet2t of s power outage. Roil call was taken on the motion. Ayes, Clarkson, Emond, Mako, Curry and Zaun. 77.11$ Motion was made by Emond, seconded by Zaun to receive the 1976 Police Department report. Roll call was taken on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson. The Ctp Council decided to review the Pol~,ce report with the Police Chief and Assistant Police Chief at the work session to be held on March 29, 1977 beginning ~t 4:00 P.M. At this time Mayor Mako announced that there would be a point meeting between the Apple Valley and Lakeville City Councils on the evening of March 30, 1977. At_this`-:time Fire Chief Joe Marek presented a written report and request on the remaining funds left from the 1'976 operating budget of the Fire Department. -2- ~ ~ • w CITYsOF LAKEVILLE COUNCIL MEETING MARCH 7, 1977 Council discussed the request with the Chief. 77.119 Motion was made by Clarkson, seconded by Zaun to authorize the transfer of funds from the 1976 operating budget to the 1977 operating budget to be used as per the written request of the Chief authorizing the increase of the Fire Department 1977 budget as per the written request. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. 77.120 Motion was made by Emond, seconded by Zaun to approve the officers of the Fire Department as presented. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. 77.121 Motion was made by Curry, seconded by Zaun to approve-amendments to the By-Laws of the Fire Department Relief Association with the addition to articles 6, sec- tion 4 by adding the words, "except as hereinafter provided". Roll call:°was taken on the motion. Ayes, Mako, Curry, Zaun. Nays, none. Ab- stain, Emond and Clarkson as they are members of the Fire Department. At this time-the Council discussed the request of the Fire Department to support and request of the State Legislature to raise the maximum retirement benefit per year for Lakeville to $1,000." Mayor Mako asked tie Chief and Mr. Ren Larson who were present if physicals were required for nera membiers, and if the growth in the community and the department continues some type of pay or other retire- . went might not be more appropriate because_many,of the new members would most likely not be able to serve ZO years. ` Mr. Larson answered that the State laic does not provide °for~any early retirement benefits at this time. The Chief stated that physical exgmsthad been used in the paste.-for new. members being admitted tc5 the Department and„Relief Associa- tioa. 77.122 Motion was made by Mako, seconded :by'~Zaun to ddapt Resolution X77-18 requesting the State Legislature to raise the limit of the Lakeville.'~ol~nteer Fire Depart- . went to $1-,000 per"year of service after 20 years of service 'and 50 years of age. Roll call was taken on the motion. Ayes, Curry, faun, and Mako. Nays, none. Abstain, Clarkson and Emond. At ..this time the Council reviewed the proposed Iist of improvements remaining to fully complete the new Fire Station ~~2. The City Administrator pointed out that it would be necessary to transfer up to $3,500 from the building fund to the construction fund of the Fire Station ~2 to provide enough money to make the improvements. 77.123 Motion was made by Curry, seconded by Zaun to authorize the list of improvements presented to complete Fire Station ~~Z and to authorize the transfer of $3,500 from the building fund for this work. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Emond, Mako 'and Curry. 77.124 Motion was made by Mako, seconded by Clarkson to receive a petition from residents 'living in the Lakeville Hills Addition requesting street improvements. Roll call was taken on the motion. Ayes, Clarkson, Emond, Mako, Curry and Zaun. 77.125 Motion was made by Clarkson, seconded by Zaun to adjourn the Council meeting. Roll call was taken on the motion.
