HomeMy WebLinkAbout01-03-77 S. CITY OF LAKEVILLE COUNCIL MEETING JANUARY 3, 19:77 The meeting was called to order by Mayor Mako at 8:00 P.M. The pledge of allegiance to the flag was given. Roll call was taken. Present: Emond, Mako, Curry, Zaun, and Clarkson. Also present: Patrick McGarvey, City Administrator; Patrick Farrell, City Attorney; Robert Rosene, Consulting City-Engineer. 77.1 Motion was made by Emond, seconded by Zaun to-approve 'the-Council minutes of December 20, 1976. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. 7~.2 Motion was made by Curry, seconded by Zaun to approve the minutes of the Special Council meeting of December 28, 1976. Ayes Curry, Zaun and Mako... Nays, none: Abstaining, Clarkson and Emond as they were not present at that meeting. 77.3 Motion was made by Emond,. seconded.. by Curry to,approve the claims as presented. Ro1L_call was. taken on the `motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. ,77.4 Motion was made by Emond, seconded by Zaun to adopt Resolution 77-1 listing the official depositories for City funds in 1977, with;the addition of Midwest Federal and Northwestern Bank of Hastings to the`1ist. Roll call' was taken on the .motion. Ayes,,Clarkson, Emond, Curry and Zaun. Nays, none. Abstaining, Mayor Mako as he-owns stock in the Lakeville bank. 77.5 Motion was made by Curry, `seconded bg Zaun to adopt Resolution 77-2 establish- - ing the Committees in the City Gounel. Roll call was taken on the motion. Ayes,;Emond, Mako, Curry, Zaun and Clarkson. 77.6 Motion was made 'by Mako, seconded by Zaun to appoint James Emond as acting Mayor, .Roil call was taken on the motion. 9yes, Mako, Curry, Zaun and Clarkson. Nays, nave. Abstaining, Emond. 77.7 Motion was made by Curry, seconded by Mako to appoint"the Lakeville Times, R. E. Adelman `Publications.Inc., as'the official City newspaper for 1977. Roll call was taken on the motion. Ayes,`Currq, Zaun, Clarkson and Mako. Nays, none. Abstaining, Emond. The City Administrator was directed to°prepare a cost estimate on the print- ing of>Council..minutes. ''77.8 Motion was made, by Curry, seconded by Zaun to appoint Grannis & Grannis as the legal firm to act as City ..Attorney in 1977. Roll call was taken on the motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. 77.9 Motion was made by Curry, seconded ,by Mako to appoint Midwest Planning as the City. Planning Consultant for 1977. Roll call was taken on the: motion. ;.Ayes, Clarkson, Emond, Mako, Curry and Zaun. 77.10 Motion.-was made by Clarkson, seconded by Zaun to reappoint Gerald Spande and Wilmot Campbell to three year terms on the Planning Commission. Roll call was taken on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson. `77.11 Motion was made by Zaun, seconded by Curry to reappoint Jenice Lange and Nancy Enright to three year terms on the Park and Recreation Committee. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. The Couneil discussed the attendance record of some members of the Committee and it was $ecided that the Mayor would contact the individuals concerning ' their `attendance. -1- Y CITY OF LAREVILLE COUNCIL MEETING JANUARY 3,' 1977 .77.12 .Motion was made by Mako, seconded by Zaun to appoint Dr. Joseph Emond as the .Health Officer. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. At this time the-Council discussed the procedure o be used for interviewing and selecting Engineering-Consultants to act as-the .City Engineer and to es- tablish a°list of Engineering Consultants for future City projects. The Council directed the Administrator to send them the resume's`of the firms received to date sothat the. Council could review them by'the January 17th .Council meeting, with each Council member submitting at ,that meeting,a list of hree firms which they would like to interview. It was decided that a firm would need to-be on the list of three Council members or more to be interviewed. .Staff reports: The City Attorney recommended that-the Council authorize the Mayor and Clerk to sign two Quit Claim deeds concerning easements on property owners. The first was to Airlake Park fora sewereasement release and the second to Wren, inc. far a similar.'release. "77.13 Motion was made by Curry,. seconded by Zaun to authorize and approve the Mayor and-Clerk signing a Quit Claim deed between the ..City and Hitchcock Industries; Inc. Roll call was taken onthe motion. Ayes, Zaun, Clarkson, Emond, Mako and Curry. 77.14 Motion was made by Curry, seconded by Zaun to authorize the Mayor and Clerk to sign a Quit`Claim deed to Wren, Inc. Roll call was taken on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson. Mr. Farrell discussed with the Council the ,problem of an occupation occurring in a°resdential zone. He advised the Council that he would have a recommenda- tion'for the Planning Commissiom and Council concerning the problem. Mr Farrell also said that he :would.: be meeting 'with Fisher Construction Company 'concerning a settlement on the repair of a sewer line from the Lakeville Middle.- School tQ-the Lakev_il-e treatment plant, and would have a recommendation to the Council in January. At this time State Representative Jensen introduced Representative 3ed Suss and Mr. Rod Krass o the City,'Council. Mr. Jensen stated. that Mr. Krass was interested in being appointed as the Representative of District b to he Metropolitan Council. Mr. Krass spoke to the Council concerning his general background and philosphy concerning the Metropolitan Council:. He requested the City .Council to endorse his candidacy. 77.15 After considerable discussion, motion was made by Emond and seconded by Curry to adopt Resolution 77-3 supporting the appointment of Mr. Rod Krass to the Metropolitan £ouncil as the Representative for District 16. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. 77.16 Motion was made by Cxlarkson;~seconded by Curry to adopt Ordinance X103 amend- ing Ordinance ~66,_being an Ordinance regulating the labeling, sale, advertis- ing and display for sale of milk in-the City of Lakeville, prohibiting plastic containers. Motion was made by Curry,.- seconded by Mako to adopt Qrdinance ~~102 providing elected and appointed .officials of the City with Workmen's Compensation Insur- ance..coverage. Roll call was taken on the motion. :Ayes, Clarkson, Emond, Mako, Curry and Zaun. Item 9f 15, `the receipt of the Park and Recreation-Committee minutes of December 8th was not acted upon as the minutes were not ready.°` Item 416, the-adoption of Resolution setting certain salaries for City em- ployees was not acted upon. A special meeting to discuss salaries was set for February 1, 1977 at.4:00 P.M. 77.1 8 ?lotion was made by Curry, seconded by Zaun to order in the street lights on `D'runk Highway 50 as recommended by a memo from the Public Works Director dated December 17, 1976. 'Roll call was taken on the motion. Ayes, Mako, Curry, .:._Zaun, Clarkson and Emond. 77.19 Motion was made by Emond, seconded by Zaun to receive the Resolution from the City of Rosemount concerning the location of a Western County Government Center. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. ` 77.0 Motion was made by Emond, seconded by Curry to reduce the developers bond on the Lakeridge Addition to $2,000 to cover. the remaining street lights to be installed. Roll call was taken on the motion. .Ayes, Zaun, Clarkson, Emond, Mako and Curry. 77.2I Motion was made by Emond, seconded by Zaun toapprove a beer license for the 01' Fiper- Inn.. Roll call was taken on the motion. Ayes, Emond, Mako, Curry, 'Zaun and Clarkson. 77.22 Motion was made by Curry, seconded by Saun to approve sanitation licenses for Bruce's Sanitation, Nisgood Company, and Valley Sanitation Co Roll call was taken on the motion. :.Ayes, Mako, Curry,_Zaun, Clarkson and .Emond. 77.23 Motion was made by Curry,'seconded by Zaun. to approve On=Sale and Off-Sale beer licenses .for. the Sea Girt Inn. Roll call was taken on the motian. Ayes, Curry, Zaun, Clarkson, Emond and Mako. The City Attorney was directed to write a legal opinion an how the City. Council can conduct salary negotiations with City employees as it pertains to the Open Meeting law. 77.24' Motion was made by Mako, seconded by Zaun to establish six additional Council meetings in 1977 for the last Tuesday of .January, March, May,`July, September and November at 4:00 P.M., these meetings being in addition to regular Council meetings on the 1st and 3rd Monday of each month. Roll call was taken on the motion. Ayes, Zaun, Clarkson,-Emond, Mako and Curry. 77.25 Motion was made by Emond, seconded by Zaun to adjourn the Council meeting. Roll call .was. taken on the motion.
