HomeMy WebLinkAbout09-29-77 'y- CITY OF LAKEVILLE SPECIAL COUNCIL MEETING SEPTEMBER 29, 1977 Orchard Lake School The meeting was called to order at 7:30 P.M. by Mayor Mako. Ro11 call was taken. Present: Emond, Mako, Curry, Zaun and Clarkson. Also present: Patrick McGarvey, City Administrator/Clerk; Dennis Feller, Finance Director; James Robinette, Public Works Director; JoAnn Taft, Deputy Clerk. Also present were Darrell Schneider, Consulting Engineer on the street improve- ment project and Robert Rosene, Consulting Engineer on the. utility improvement project. Also present was Patrick Farrell, City Attorney. Mayor Mako opened the public hearing on the street improvement project. Mr. Farrell attested to the legality of the hearing. Mr. Schneider presented the estimated costs and actual costs on a per foot basis for the street improvement project. The Administrator explained that the project was being assessed fora tee year period at 8X on the unpaid balance, and advised those present that they ceuld pay their principal amount of their assessment any time within 30 days with no interest charged. At this time Mayor Mako opened the meeting for questions or comments from the floor. Mrs. Rosemary Olson presented a written objection to the assessment of their property. Mayor Mako received the written objection and read it. 77.497 Motion was made by Emond, seconded by Zaun to receive the objection from Rose- mary Olson. Roll call was taken on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson. Mrs. Olson questioned why there was a difference in the amount of footage being assessed for the utility project as compared to the street project. Mr. Schneider explained how he had arrived at his figure for assessing the street. Mr. Farrell advised the Council to refer the objection to the City Attorney, as the Olsons were being represented by legal counsel. Mr. Jerry Clay asked how the figures were arrived at for the front foot assess- ment on Jacquard Avenue. Mr. Schneider gave Mr. Clay a written copy of the figures. There were no other objections to any of the street assessments. 77.498 Motion was made by Emond, seconded by Zaun to close the hearing. Roll call was taken on the motion. Ayes, Clarkson, Zaun, Curry, Mako and Emond. Time: 8:00 P.M. 77.499 Motion was made by Emond, seconded by Curry to adopt Resolution X77-62 adopting the assessment roll. Roll call was taken on the motion. Ayes, Zaun, Curry, Mako, Emond and Clarkson. The meeting was recessed until 8:30 P.M. 77.500 Mayor Mako opened the public hearing on the Orchard Lake utility project, Phase I at 8:30 P.M. Mr. Farrell attested to the legality of the hearing. Mr. Rosene presented the estimated costs and the actual costs being assessed. The City Administrator explained that the project is being assessed over a 20 year period at 8X interest on the unpaid balance. At this time Mayor Mako opened the hearing for comments from the floor. Mr. Russ Engle stated that he had been assessed for 240 front feet and felt that was too much considering the configuration of his lot. Staff was directed to look into the matter. Mr. Glenn Nord, an attorney representing Wilfred Warmington who expressed con- cern over the assessment on Mr. Warmington's property on 16$th Street as his property does not actually abut the street right-of-way. He stated his client would like to know where the sewer and water services are located. Mr. Farrell advised Council that he felt the matter could be worked out between himself and Mr. Nord. Mrs. Sandy Goetz presented a certificate of survey of her property on County Road 44 and questioned how he had arrived at the footage to be assessed. The staff was directed to meet with Mrs. Goetz and review the matter and report back to the Council. Mr. Walter Sternberg raised the question of future sewer or septic systems for his lots along County Road 44. The City Administrator advised Mr. Sternberg that his lots along County Road 44 had been assessed for the acreage assessment the year before were not being assessed at all on this project because the sewer pipe going past these lots is a force main and cannot be used to serve the abutting property in that area. The City Administrator further stated that the question of whether or not the lots could accommodate septic systems was not relevant to the hearing being conducted. 77.501 There being no further comments from the floor, a motion was made by Zaun, seconded by Curry to close the hearing. Roll call was taken on the motion. Ayes, Emond, Clarkson, Zaun, Curry and Mako. Time: 9:00 P.M. 77.502 Motion was made by Emond, seconded by Clarkson to adopt Resolution 4677-63 approving the assessment roll. Roll Ball was taken on the motion. Ayes, Clarkson, Zaun, Curry, Mako and Emond. 77.503 Motion was made by Emond, seconded by Zaun to ad3ourn the meeting. Roll call was taken on the motion. Ayes, Zaun, Curry, Mako, Emond and Clarkson.
