CITY OF LAKEVILLE COUNCIL MEETING
JANUARY 12, 1976
The meeting was called tc3 order by Mayor Mako at 8:00 P.M. Flag. pledge followed.
Present; .Clarkson, Zaun, Curry, Mako and Emond.
Also present; Robert Frigaard, City E~ineer, Pat Farrell, City Attorney,
Pat McGarvey, City Administrator and James Robinette, Public Works Director.
Walter King, Jr. was sworn in as Justice of the Peace.
Larry Hazel, John Antolik and Gerald Spande were eworn in as members of the
Planning Commission.
Pastor Trued was sworn in as a member of the Park & Recreation Committee.
Mr. King presented a "Proclamation for Jaycee Week" which was read by the Clerk
and signed by the Mayor.
76.28 Motion by Emond seconded by Zaun to accept the minutes of the January 5, 1976
meeting as presented. Clarkson, Zaun, Curry, Nlako and Emond "aye", motion carried.
76.29 Motion by Emond seconded by Curry to acknowledge receipt of easement and construction
easement from the Mpls., Northfield and Southern Railroad for the Orchard Lake
Trunk Sewer project and authorize the payment of X50.00-for the same. Zaun,
Curry, Mako,Emond and Clarkson "aye", motion carried.
Mr. Farrell reported that the case involving Northwest Bituminous had been
settled and. that Jerry Clay has agreed to take an assessment on lots he owns
in Clays Acres and on 208th St. without having a hearing.
76.30 Motion by Zaun seconded by Emond to authorize the settlement of this lawsuit,
authorize the settlementof X5550 and authorize the Mayor and the Clem to sign
the proper settlement agreement. Clarkson, Zaun, Curry, Mako and`Emond "aye",
motion carried.
Mr. Farrell also reported that the lawsuit involving the Harry S. Johnson Co.
had been postponed to the 25th of February.
There will be a recommendation from the fire committee on the lgth.
Mr. Farrell said he had reviewed the matter of the appointment of a health
officer and said that this-person should. be a qualified person such as a doctor
or nurse. He said that none would have to be appointed at this time but if there.
is an emergency, one could be appointed in a hurry.
The new sidewalk snow removal ordinance was discussed.
76.31 Motion by Curry .seconded by Zaun to send a letter of warning to resident
property owners by the Public Works Director if an emergency snow problem occurs.
Motion was withdrawn.
76.32 Motion by Curry seconded by Emond to set the first reading of the sidewalk
snow removal ordinance for the lgth. Curry and Mako "aye", Emond, Clarkson and
Zaun "nay", motion failed.
Curry suggested that the time limit be extended to 2~ hours.
76.33 Motion by Zaun seconded by Curry to set the 2nd meeting in February. to consider
the snow removal ordinance. Mako, Emond, Clarkson, Zaun and Curry "aye",
motion carried.
76.3+ Motion by Mako seconded by Curry to instruct the maintenance department to
take the proper action to clear the sidewalks on Gerdine Path from 16~Fth St. to
the Parkview School on both sides of the street. Mako "aye", Emond, Clarkson,
Zaun and Curry "nay", motion failed.
The updated ordinance for establishing the Planning Commission was reviewed.
The majority of the Council favored a nine member Commission.
The report on the railroad crossings was discussed.
76.35 Motion by Emond seconded by Curry to accept this report and to follow the
recommendation of the Public Works Director and to order the work as outlined
as to placement of signs and lights subject to the recommendation of the police chief.
Clarkson, Zaun, Curry, Mako and Emond "aye", motion carried.

76.36 Motion by Emond seconded by Zaun to approve the setting of the salaries for
the assistant liquor store managers as shown on the attached sheet.. Zaun,
Curry, Mako, F.niond and Clarkson "aye", motion carried.
76.37 Motion. by ~ttond seconded by Curry to authorize the Mayor and the Clerk to sign the
.indemnity agreement between Long Lake Construction and the Home Indemnity Co.
Curry, Mako, Elnond, Clarkson and Zaun "aye", motion carried.
The proposed tennis courts which will be built in joint participation between
the City and the school were discussed with some proposed changes in the.
agreement.
76.38 Motion by Zaun seconded by Curry to authorize the Mayor .and. the Clerk to sign
the agreement for joint participation in building tennis courts as amended if
-accepted by the 5ehool Board and subject to the approval of the attorney..
76.39 Motion by Clarkson seconded by Mako to amend the above motion to show that
Liquor Store reserve monies will be used to build the courts.
Mako, F~nand, Clarkson, Zaun and Curry-"aye", motion carried.
Vote was then taken on motion 76..38 which is as follows: F~nond, Clarkson,
Zaun, Curry and Mako "aye", motion carried.
76.E-0 Motion by Zaun seconded by Clarkson to reappoint Nlr. Emond and to appoint..
Mrs. Curry to the tennis court committee. Clarkson, Zaun, Curry, Mako and
Emond "aye", motion carried.
Two alternate proposals for upgrading T3ighway 50 and County Road b~ and Dodd
Boulevard were shown to the Council by Mr. McGarvey. The advantages of each
were discussed.
76.E-1 Motion by Clarkson seconded by Curry to recommend to the state that they follow
the alternate two design. plan using the degree of curve of alternate 1.
Zaun, Curry, Mako, E~nond and Clarkson "aye", motion carried. ,
Material regarding the Metropolitan Investment Framework was presented and
a work session was set up to review this.
74.x+2 Motion by nnond seconded by ~-'"rY to appoint Mr. Mako as a director of the
Suburban Rate Authority and Mr. Zaun as alternate director of the Suburban
Rate Authority for the year 1976 and until their successars are appointed.
Curry, Mako, Emond, Clarkson and Zaun "aye", motion carried..
76.43 Motion by Curry seconded by Mako to instruct the Public Works Director to
examine the sanitation problem at the City owned home at Orchard Lake and to take
whatever action is necessary to correct the problem. Mako, E~nond, Clarkson,
Zaun and Curry "aye", motion carried.
Mr. Farrell reported that the lawsuit regarding 35E has been filed and
an environmental impact statement ordered by ~-1-76.
76.x+4 Motion by Mako seconded by Eanond to approve the sanitation license for
Valley Sanitation. Ilnond, Clarkson, Zaun, Curry and Mako "aye", motion carried..
76.x+5 Motion. by Emond seconded by Zaun to approve the On and Off Sale b~:er license
for the Orchard Lake Tavern. Clarkson, Zaun, Curry, Mako and bnond "aye",
motion carried.
76.x+6 Motion by Curry. seconded by Zaun to authorize the administrator to sign the
.contract fora-moving of the house next to the Liquor Store. Zaun, Curry, Mako,
Emond and Clarkson "aye", motion carried.
76.x+7 Motion by k~nond seconded by Clarkson to authorize the signing of the contract
extending the Ceta Title 2 and 6 contracts. Curry,' Mako, F~nond, Clarkson
and Zaun "aye.", motion carried.
