e r ' CITY OF LAKEVILLE COUNCIL MEETING FEBRUARY 17, 1976 The meeting was called to order by Mayor Mako at 8:00 P.M. Flag pledge followed. Present; Clarkson, Zaun, Curry, Mako and Emond. Also present; Robert Rosene, City Engineer, Roger Knutson, City Attorney and Pat McGarvey, City Administrator. .76,76 Motion by Zaun seconded by Clarkson to accept the minutes of the February 2, 1976 meeting as presented. Clarkson, Zaun, Curry, Mako and Emond "aye", motion carried. 76.77 Motion by Emond seconded by Curry to pay the claims against the City. Zaun, Curry, Mako, Emond and Clarkson "aye", motion carried. 76.78 Motion by Emond seconded by Clarkson to pay the claims against the Liquor Store. Curry, Mako, Emond, Clarkson and Zaun "aye", motion carried. Mr. Knutson reported that the First Wisconsin Bank had promised to get to the swimming pools as soon as possible but the City did not have the deeds yet. 76.79 Motion by Curry seconded by Zaun to approve the agreement for. the sewer and water easement with Richard and Irene Schultz for the amount of $750 and authorize the Mayor to sign the agreement. This is for the Orchard Lake Project. Ma.ko, Emond, Clarkson, Zaun and Curry "aye", motion carried. 76.80 Motion by Emond seconded by Clarkson to approve the payment of $~-1~5.0~ to Dunham Appraisals, Inc. for the appraisal of various properties. Ernond, Clarkson, Zaun, Curry and Mako "aye", motion carried. 76.81 Motion by Curry seconded by Zaun to pay the claim of Francis Anderson for the Highview to Ipava trunks in an amount up to $2100 for damage to a fence. Clarkson, Zaun, Curry, Mako and Ernond ".aye", motion carried. 76.82 Motion by Zaun seconded by Emond to pay Joe Duffy an amount up to $1500 for. crop damage in re the Highview to Ipava trunk project. Zaun, Curry,. Mako, Emond and Clarkson "aye", motion carried. Mr. Rosene presented the plans for the new fire station which here reviewed. by the Council with the Gouneil suggesting that stronger footings be installed so that another story can be added if necessary. These plans will be taken to the Planning Commission on Thursday. Mr. McGarvey reported on the committee's proposal for Judicial Road. These are as follows: 1. speed limit signs, 2. no parking zone from 170th Street to a point 250' south of; the City Beach on both sides of the road, 3. enlarge the parking. area at the City. beach, emphasis on heavily patrolling the area, 5. the City receiving the preliminary cost and authorizing a preliminary report, 6. a friendly lawsuit be started to find out the ownership of the road. Other long term proposals were: 1. ..post "no parking" signs on the lake side all around the lake,-2. instruct Seagirt Inn to install more parking for off street parking and 3. consider designating a one way street from 170th to 175th "Street. 76.83 Motion by Clarkson seconded by Emond to accept the Council committee report. Curry., Mako, Emond, Clarkson and Zaun "aye", motion carried. Mr. Knutson explained that the City would find the middle of the road and place markers on the side of the travelled road to find out how wide it is. After that :it would be presented to the homeowners and if they did not agree with the findings, they could institute a lawsuit. 76.8+ Motion by Emond seconded by Zaun to adopt points 1, 2, 3, and 6 of the Judicial Road proposals as City policy. Mako, Emond, Clarkson, Zaun and Curry "aye", motion carried. 76.85 Motion by Curry seconded by Zaun to',nstruet the City engineer to prepare an ; alternate road plan for Judicial Road from 168th Street to that portion of vacated Judicial Road at a cost of no more than $5000 and to report back to the ~l) CITY OF LAKEVILLE COUNCIL MEETIlVG FEBRUARY 17, 1976 Council on April 19th. ,Emond, Clarkson, Zaun, Curry and Mako "aye", motion carried, 76,86 Motion by Curry seconded by Mako to follow the recommendation of the Planning Commission and grant Gary Parker a conditional use permit for a period of two years to operate a TV radio repair business in his house located at $710 210th Street including the 'removal of,the present sign under the current sign ordinance. 76.87 Motion by Zaun seconded by Emond to amend the above motion to remove ".-under the current sign ordinance". Clarkson, Zaun, Curry, Mako and Emond "aye", motion carried. Roll call was then taken on motion 76.86 which is as follows: Zaun, Curry, Mako, Emond and Clarkson "aye", motion carried. 76.88.. Motion by Clarkson seconded by Emond to receive the job description: for the assistant chief of police and approve the same. Curry, Mako, Emond, Clarkson and Zaun "aye", motion carried. 76.$9 Motion by Emond seconded by Clarkson to accept the report on the Valley Park swimming pools. Mako, Emond, Clarkson, Zaun and Curry "aye", motion carried. The ordinance establishing a commision to plan for the physical development of the City. etc. was read for the second time. 76.90 Motion by Clarkson seconded by Emond to-adopt Ordinance No. 90, being "An Ordinance Establishing a`.Co^mrnission to .Plan for the Physical .Development of the- City and to Make Recommendations to the City Council in Regard to Land Use Questions. and the :Like". Motion by Curry seconded by Zaun to amend the above. motion for adoption of the by-.laws for the selection process as presented to the Council in a letter dated Dec. q, 1975 with this change, strike No. 5 etc. This motion was withdrawn by the maker and the person who seconded the motion and the administrator was instructed. to place this matter on the March st agenda. Roll call on motion 76.80 was then taken which is as follows: Emond, Clarkson and Mako "aye", Zaun and Curry "nay", motion carried. An ordinance regarding snow removal was presented and will be ©n the agenda for review on the 15th of March. Glenn Nord.. advised the Council that there would be no intoxicating liquor sold in. that portion of the Chart House for wb.ich they are asking a bingo permit and that a reserve officer would be on duty. The Council had no objection to this permit, therefore the bingo game does not need approval. 76.81 Motion by Mako seconded by Curry to appoint Zaun and Clarkson to the health. committee. Zaun, Curry, Mako anal Emond "aye", Clarkson abstained, motion carried. A meeting will be set up to discuss the Liquor Store plans with Mr. Aekerberg. 76.82" Motion by Mako seconded by Emond to follow the recommendation of the Administrator and approve the employment of Susan Sawyer. as of February 9 as a dispatcher.- clerk in the'Pol~e e Department urtbr Ceta funding. Zaun, Curry, Mako, Emond and Clarkson "aye",.motion carried. 76.93 Motion by Emond seconded by Curry to follow the recommendation of the;Administrator and pay the fire chief $350 per month and the training officer $50 per month all retroactive to January 1, 1976. Curry, Mako, F.~ond, Clarkson and Zaun "aye" motion carried. 76.9 Motion by Curry seconded by Clarkson to adopt the resolution. supporting HF 21+3 Change in .Aid Formula. Mako, Emond, Clarkson, Zaun anal Curry "aye", motion .carried. Nirs. G. J.
