MARCH 1, 1976
.The meeting was called to order by Mayvr Mako at 8c00 P.M. Flag pledge
followed.
Present; Clarkson, Zaun, Curry, Mako and Emond.
Also present; Roger Knutson, City Attorney, Robert Rosene, City Engineer and
Pat McGarvey, City Administrator.
76.95. Motion by Emond seconded by Curry to accept the minutes of the February l7, 1976
meeting as presented. Clarkson, Zaun, Curry, Mako and Emond "aye", motion carried.
76..96 Motion by Zaun seconded by Emond to pay the claims against the.. City. Zaun,
Curry, Mako, Emond and Clarkson "aye", motion carried.
Roger Knutson explained that the First Wisconsin Bank had agreed to sign the
agreement for the swimming pools and in return the City.. would release certain
bonds .that were no .longer needed.
Dean Krause and Butch Carrick presented a check in the amount of $500 to:=help
in the purchase of bleachers in Aronson .Park. This check is from the Lakeville
JC's.
The amendment to ordinance No. ~+2, Sec. 18.2 was reviewed.
Mr. Clarkson felt that this would be spot rezoning and objected to this.
76.97 Motion by Zaun seconded. by Curry to consider the amendment to the ordinance and
the request for the conditional use permit for the recreational center at the
same time. Curry, Mako, Emond, Clarkson-and Zaun "aye", motion carried.
76,98 Motion by Fanond seconded by Curry to drop the requirement for reading the
proposed ordinances twice for this matter only. Mako, Emond, Clarkson, Zaun
and Curry "aye", motion carried.
Mr. Fanum presented a map and a petition containing 500 names of Valley Park
residents who are opposed to the pool hall and recreation center.
76.99 Motion by Clarkson seconded by Emond to accept the petition from the Valley Park
residents who oppose this recreational center. Emond, Clarkson, Zaun, Curry
and Mako "aye", motion carried.
76..100 Motion by Mako seconded by Clarkson to accept the letter from Charles Radke
regarding the. recreational center. Clarkson, Zaun, Curry, Mako and Emond "aye",
motion carried.
A letter and a list of incidents showing how the"Bridge" compared to the "Corner
Pocket" in Apple Valley was presented.
76.101 Motion by Curry seconded by Emond to make this letter and list available to
the press and also made a part of these minutes. Motion was withdrawn.
Letters from various persons who_.approve~of he "Bridge" were presented.
Gary. Huth presented a,letter in support of his application for a permit.
A schedule of conditions for issuing this conditional use permit which is
signed by Paul Donnay of LAD Properties was presented.
76.102 Motion by Clarkson seconded by Zaun to accept these rules .for maintaining the
"Bridge" which is signed by Paul Donnay of LAD Froperties. Zaun, Curry, Mako,
Emond and Clarkson "aye", motion carried.
Mrs. Curry felt there should be a performance bond attached as a condition.
Many of the Valley Park residents present objected to the change in the ordinance
and felt that there would be more vandalism and traffic in their area if a
conditional use is granted for this center.
Mr. Zaun felt. that as there is already a problem in this area, this center
.might tend to compound this problem..

Mr. Mako and Mr. Clarkson felt the same. Mrs. Curry .felt that there is a
social problem of major proportions and that the parents must-face up to the
problem..
Mr. Emond felt that it is unfortunate that an applicant._wth such a good record
should have. requested this permt'at this time but he did not. feel he could
go..along with the rezoning at this time.
Mr, Mako said-that he felt this business would not be allowed to succeed
as the residents in this area would blame it for any incident which happened.
76.103 Motion by Mako to follow the recommendation of the Planning Commission and-
adopt the-amendment to Ordinance X42 as written died for the lack of a second.
Mr. Mako informed the residents of Valley Park that there will:'be a meeting
at the school for discussing the juvenile problem`. in that. area at 7:30 P.M.
on the 8th of March. Thee Police Chief...will be".present for this meeting.'
76.10+ -Motion by Zaun seconded by Garry to deny the. adoption of the amendt~~xrt, to
Ordinance No.-~+2, Sec. 18.2. Curry., Emond, Clarkson and Zaun "aye's, Mako "nay",
motion carried.
76.105 Motion by Mako seconded by Curry to deny the recommendation of` the Planning
Commission to grant a conditional use permit to the "Bridge",-under the present
ordinance as it exists which states there can be no conditional use, permit `for
this type of business. Mako, Emond, Clarkson,;Zaun "and Curry "aye", motion
carried.
Clippings from ,the .Dakota County Tribune.. showing that certain land an the corner
of 185th St. and Hwy #50 were rezoned before Lakeville was incorporated, were
presented to the Council.
76.106 Motion. by Mako seconded by Curry to accept the clippings from the Dakota, County
Tribune which. refer to the rezoning for the records. Emond, Clarkson, Zaun,
Garry and Mako "aye", motion carried.
Mr. Clark, a resident of this area, is opposed. to the rezoning of the additional
four acres as requested.
76.107 Motion by Clarkson seconded. by Curz^y to follow the recommendation of the
.Planning Commission and deny the rezoning of land at-the corner of 185th Street
and Highway #50 for E. Ward and-adopt the various reasons for this denial as
set forth in the Planning Commission `records of February 19, 1976. Glarkson,
Zaun, Curry, Mako'and Emond "aye" motion carried.
A request for sewer hookup by the Queene Anne Tralor Court was discussed.
Mr. Rosene said that thin could be. accomplished by a change order.
76.10$ Motion by Mako seconded by Zaun to receive the letter and ,authorize the staff
to prepare cost estimates for this project and prepare a,small prelimi.n:a,ry report...;
Zaun, Curryy Mako, Emond and Clarkson "aye", motion carried.
A petition for the blacktopping of 175th Street was presented to the Gouneil.
76.109 Motion by Mako seconded by Glarkson to accept the petition for blacktopping
175th Street and place on the agenda for review at the'next meeting. Curry,
Mako, Emond, .Clarkson acid'Zaun "aye", motion carried.
76.110 Motion by Curry seconded by Clarkson to authorize the engineer and staff to
prepare a preliminary report for-the street improvements_in Dakota Heights.

76.111 Motion by Mako seconded by Emond to approve payment request number '4 in the -
amount of $~+0'~#81.37 to Richard Knutson, Inc.... on the Orchard Lake trunks.
Emond, Clarkson,: Zaun, Curry and Mako "aye", motion carried.
..76.112 Motion by Emond seconded by Zaun to accept the. preliminary reports for sewer. and
water extensions to 210th Street, sanitary. sewer on Holyoke Avenue-and 'the sanitary:
..sewer and.-water.. extensions around Orchard Lake. -Clarkson, Zaun, Curry, Mako
and Emond "aye",'motion carried.

Dale Harris was present and asked the Council why they are taking good.
farming land to place a fire station upon. He felt they should use land
that already belongs to the City.
76.113 Motion by Curry.... seconded by Emond to extend this meeting until the agenda
is completed. Curry, Mako, Emond and Clarkson "aye", Zaun "nay", motion carried.
76.11+ Motion by Emond seconded by Curry to accept the-plans and spies for the fire
station and set the bid letting date for 2x00 P.M. on April g. Curry, Mako,
IInond, Clarkson and Zaun "aye", motion carried.
76.115 Motion by Emond seconded by Mako to approve the specs for the fire truck and
set the bid letting date for March 30th at 2:00 P.M. Mako, Emond, Clarkson,
Zaun and Curry "aye", motion carried.
Motion by ~nond seconded by Zaun to adjourn carried unanimously.
