ORDINANCE NQ. 7.75 CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN INTERIM ORDINANCE TER+fPORARILY PROIIIBITING DEVELOPMENT IN A DESIGNATED AREA OF THE CITY THE CITY CQUNCIL t?F THE CITY OF LAKEVII,LE QRDAINS: SECTION 1. Defuutions. The definition in :Minn. Stat. § 462.352, Subd. 15 is adopted by reference. "4ffcial Map". The definition in Minn. Stat. § 462.352, Subd. l0 is adopted by reference. "Subdivision". The definition in Minn. Stat. §.462.352, Subd. 12 is adopted by reference. SECTION 2. Purpose and Intent. The Designated Area is the area of the County Road 70/I-35 interchange. It is. the intent of this ordinance to. allow the City time to undertake the necessary studies. to officially map road alignments in the Designated Area, make other appropriate changes in official controls resulting from the mapped road alignments, and in the interim to protect the planning process and the health, safety, and welfare of the citizens: of the community. 115173x01 i RNK:I 1/10/2004 SECTION 3. Factual Background. • In March of 2002 the City contracted for professional traffic engineering services that included the development of traffic forecasts for the proposed reconstruction of the I-35 /CSAH 70 Interchange. • Dakota County submitted the I-35 !CSAH 70 Interchange Reconstruction Project to the Transportation Advisory Board in 2003 for 2(}07-2008 federal. transportation project funding and: received federal funding in fiscal year 2007. • The City and Dakota County amended its contract for professional engineering services to include the completion of an Interstate Access Request (IAR) in May of 2004. • The City and Dakota County'have held public in€ormational meetings in 3uly of 2002 and October of 2004 to solicit input from property and business owners on the proposed interchange reconstruction.. • The City and Dakota County have included the proposed reconstruction of the I-3S / CSAH 70 Interchange in their current five year Capital Improvements: Programs. • The °City has submitted an application to the Metropolitan Council Right-of-,Way Acquisition: Loan >Fund to acquire 5.2 acres .adjacent to the interchange for a park and pool. lot and future park and ride lot. • The City and Dakota County intend to complete the project layout, necessary environmental. documentation and -final design for the interchange reconstruction by September of 2006.. • The City. and Dakota County plan to complete the .necessary official mapping by :December of 2005 prior to initiating acquisition of Right-of-Way in 7anuary 2~fi.. • The City will need to secure the approval. of Dakota County, the Minnesota Department of Transportation, and ° the Federal Highway Administration for the interchange improvements. SECTION 4. Temporary Prohibition. Pending the. completion of the above referenced. study and adoption of official maps and other appropriate official controls, no application- will be accepted, processed or approved for the following: • .Change in official controls • Plats • Subdivision of Land • The issuance of conditional use permits, interim use permits, variances, and site. plan approval. • The issuance of building permits for new buildings or structures or to expand the foot print of an existing building or structure. 115173v01 2 RNK:11/1012004 • The issuance of permits for new or relocated -free standing signs not. attached to a building. SECTION 5. Exception. The temporary pr€ihibtion set forth. in Section 4 of this ordinance shalt not (1} halt, delay,. or impede a subdivision which has been given preliminary , approval prior to the effective date of this ordinance or, (2) to an application flied prior to the effective date of this ordinance. SECTIQN 6. Effective Date. lfiis ordinance shall take effect from and after -its passage anal shall remain in effect .until the date of the ad©pton of the official maps and :other official controls contemplated hereunder or November 15, 2005, whichever occurs first.
