CITY OF LAKEVILLE COUNCIL MEETIlVG

The meeting was called to order by Mayor Mako at 8:00 P.M. Flag pledge
followed.
Present; Zaun, Curry, Mako and Emond. Absent; .Clarkson.
Also present; Patrick Farrell, City Attorney, Robert Rosene, City Engineer and
Pat McGarvey, City administrator.
76..116 Motion by Zaun seconded by Ealond to accept the minutes of the March 1, 1976
meeting as presented.
"Ayes", Zaun, Curry, Mako and IInond, motion carried.
76.117 Motion by Curry seconded by Zaun to pay the claims against the City.
"Ayes", Curry, Mako,.Fnond and Zaun, motion carried.
76.118 Motion by Emond seconded by Zaun to pay the claims against the Liquor Store.
"Ay;~e", Mako, Emond, Zaun and Curry, motion carried.
Mr. Farrell. reported on the progress made in the matter of acquiring land for
the new fire station. He also requested that the Council authorize the issuance
of a $300 check for an easement.
76.119 Motion by F~nond seconded by Curry to'authorize payment of X300 to the Missouri
.Synod Lutheran Church for an easement for the Phase III-Lake Marion project.
".Ayes", Emond, Zaun, Curry and Mako, motion carried.
Other matters reported by Mr. Farrell were obtaining a blanket easement in the
event of draining of Lake Marion, the Valley Park pool agreement, the overexpenditure
in the H.S.Johnson case in district Court, the Richard Sexton condemnation and
the assessment appeals of Clinton Zweber and James Larson.
Richard Whittier appeared regarding,. the Lion's Club request for a Las degas
Night permit. They also asked for a bingo permit for the ~+th of April,
Mr. Farrell and the Council advised Mr. Whittier that Las Vegas. fund raisers
were illegal.
76.120 Motion by E~ond seconded by Zaun to grant the Lions Club a bingo permit for
the 4th of April, 1976.

Judy Briske appeared regarding the approval of a resolution supporting the
Dakota County Government Study recommendations.
.76.121 Motion by Zaun seconded by F~nond to adopt resolution 76-8, supporting the Dakota
County Government Study recommendations.
"Ayes", Curry, Mako, Emond and Zaun, motion carried.
Mr. Clarkson arrived at 9:00 P.M.
John LaFavor discussed his request for a conditional use permit with the Council.
Mr. Zaun felt that the planner's information should have been passed. on to the
applicant and that platted and unplatted land should be treated differently.
Mrs. Curry felt that the zoning makes it difficult for the small business. man
to make a living and that .this matter should be dealt with in light of the.
economy.
Motion by Mako to follow the Planning Commission recommendation died for the
lack of a second.
76.122 Motion by Curry seconded by_Zaun to follow the Planning Commission .recommendation
and deny John LaFavor's request for a conditional use permit-.for the same reasons
as listed in the planner's recommendations and the attorney's letter.

The final plat of-Dakota Heights 7th Addition was presented for approval.
It was stated that there will be sidewalks on one. side of 176th Street and Ionia Ave.
A turn around was discussed for-Ionia Avenue.

76.123 Motion by Mako seconded by Zaun to authorize approval of the final plat of
Dakota Heights 7th Addition and to authorize the Mayor and the Clerk to sign
the development contract and deliver a copy to the developer.
"Ayes", Emond, Clarkson, Zaun, Curry anal Mako, motion carried.
76.12+ Motion by Emond seconded by Curry to approve a bingo permit for All Saints-
Parish for the 2nd of May, 1976...
"Ayes", Clarkson, Zaun, Curry, Mako and Emond, motion carried.
76.125 Motion by Emond seconded by Gurry to approve a bingo permit for the Honeywell
Country Club for each Thursday evening.
"Ayes", Zaun, Curry, Mako, Emond and Clarkson,.. motion carried.
76.126 Motion by Zaun seconded by Clarkson to receive the Park and Recreation minutes
of March 3,.1976•
"Ayes", Curry, Mako, Emond, Clarkson and Zaun, motion carried.,
Motion by Emond seconded by Zaun to approve the mutual aid agreement with Prior
Lake subject to the attorney's review was withdrawn.
76.127 Motion by Emond seconded by Zaun to place the mutual aid agreement with Prior
Lake on the agenda for the 5th of April.
"Ayes", Mako, Emond, Clarkson,. Zaun and Curry, motion carried.
76.128 Motion by Emond seconded by Clarkson to'approve the abatement for R~na1d &
Janet Gilbertson.
"Ayes", Emond, Clarkson, Zaun, Curry and Mako, motion carried.
76.128 Motion by Curry seconded by Zaun to approve the abatement for Charles Tracey.:

:76.130 Motion by Mako seconded by Emond to approve the abatement for James F. & Alice
Larson,
"Ayes", Zaun, Curry, Mako, Emond and Clarkson, motion carried.
76.131 Motion by Zaun seconded by Emond to adopt resolution 76.8, opposing Dakota
County Resolution No. Z0.
"Ayes",:Curry, Mako, Emond, Clarkson and Zaun, motion carried.
76.132 Motion. by Mako seconded by Curry to adopt resolution 76.10 and hold a public
hearing on the proposed extension of water and sanitary sewer laterals around
Orchard Lake on the 12th of April, 1976 at 7:30 P.M. in the Hi$h School cafeteria.
"Ayes", Mako, Emond, Clarkson, Zaun and Curry, motion carried.
The improvement of 175th Street was discussed. Mr. Rosene said that the present.
contour maps could be used with the cost being X2000 plus the cost of borings.
If the state highway dept. took the borings, the cost would be between X500 and
$1000.
76.133 Motion by Clarkson seconded by Zaun to authorize the engineer to eontaet.the
state for the soil borings and to authorize the engineer to do the minimum work
necessary to do the borings between Highway 50 and Ipava Avenue.. This matter
to be tabled until the engineer returns vrith this information.
"Ayes", Emond, Clarkson, Zaun, Curry and Mako, motion carried.
76.13+ Motion by Mako seconded by Emond to .follow the recommendation of the administrator
and grant Richard Connelly On and Off sale beer licenses and a'set up license for
the Orchard Lake Tavern. and to write a letter to the CoLU~.ty Highway Department.
requesting that they post this stretch of Highway 5 as a no parking zone.
"Ayes", Clarkson,. Zaun, Curry, Mako and Emond, motion carried.
76.135 Motion by Curry seconded. by Zaun to adopt resolution Nr. 76.11 and hold a hearing
on proposed extension of water and sanitary sewer on 210th St, on the 18th of
April, 1976..
"Ayes", Zaun, Curry, Mako, Emond and Clarkson, motion carried.
76.136 Motion by Emond seconded by Curry to adopt resolution 76.12 and hold a public
hearing on the 18th of April, .1976, on the proposed extension of sanitary

The first reading of the-Snow Removal ordinance took .place.
The written procedure for making appointments to the committees was discussed.
76.137 Motion by-Clarkson seconded by Mako to hold this meeting over until this matter
is completed..

The written procedure was amended and will be returned on the next agenda.
Mr. Emond discussed the sign on 35W which the City will be using and asked
for recommendations as to the .information to go on the sign.
76.138 Motion by Curry,seec~nded"by E~ond to authorize three memberships to the
Minnesota Planning Association at the cost of $25 for the Planning Commission.

76.139 Motion by Emond seconded by Zaun to authorize the Mayor and the Clerk o sign.
the .fire fighting 'service agreement between the City of Lakeville and Elko.
"Ayes", Clarkson, Zaun, Curry, Mako and Emond, motion carried.
Motion by Mako seconded by Emond to adjourn carried unanimously.
