REGULAR COUNCIL MEETING
APRIL 5, 1976
-The .meeting was called to order by Mayor Mako at 8:00 P.M. in the. Council
Chambers. in Airlake Industrial Park. Flag pledge followed.
Presents Clarkson, Curry, Mako and Emond. Absent: Zaun..
Also present: Roger Knutson, Gity Attorney, Robert.Rgsene,`City,Engineer,
Pat McGarvey,'City Administrator and Robert Pulscher, Financial Consultant.`
76.146 Motion by.Emond seconded by Curry to accept the minutes of-.the meeting of
March l5, 1976, as presented.. Clarkson, Curry,'Mako and Emond "aye", motion
carried..
r 76.147 Motion by Mako seconded by Emond to accep the minutes of the Special Council
Meeting of March 29, 1976, as presented. Curry, Mako, Emond and Clarkson "aye",
motion .carried.
76.248 Motion by Emond seconded by Curry to pay the claims against the City, copy`
attached. Mako, Emond, Clarkson and Curry "aye",.motion carried.
Mr. Pulscher was present to explain the new proposed `bond issue for the fire
hall and trucks and appertances. He aid that the bid letting would be set
for the 3rd of May at 7:45 P.M. The bond repayment would be-in ten payments
and he recommended only one bond sale. as it would cost: too much to set two sales.
76.149 Motion by Emond seconded by Curry to adopt the 'resolution which is as 'follows:
"RESOLUTION PROVIDING FOR PUBLIC SALE OF $215,000 FIRE HALL AND EQUIPMENT.
BONDS OF 1976".
and setting ,the bid letting. date .for the 3rd of May at 7:45 P.M. ,Clarkson,
Curry, Mako and Emond "aye",.motion carried.
76.150 :Motion by Curry seconded by Clarkson that the Council concurs with the County
.regarding .thee tax forfeited ands in Lyndale Lake Addition and Deer. Park
Addition but to .keep. the lots in Lenihans Addition as they are part of the road.
Curry,:Mako, Emond and Clarkson "aye", motion carried.
~76.I51 Motion by Emond seconded by Curry to approve the mutual aid agreement with
Prior Lake. Mako, Emond, Clarkson and Curry "aye", motion carried.
The proposed agreement with the First Wisconsin National Bank of Milwaukee
regarding the man made lake, swimming pools and various lots in_Valley Park
was- discussed.
76.152 Motion by Clarkson seconded by Curry to authorize the Mayor and the Clerk to
.sign the agreement and enter the agreement with the First Wisconsin National
Bank of Milwaukee for. the lots, swimming pools and release of bonds in Valley
Park. Emond, Clarkson, Curry and Mako "aye", motion carried..
76.153 Motion by Emond seconded by Curry: to-adopt the Resolution No. ?6.16, relating
to the Appropriation of Municipal State Aid Funds for the C.S.A.H: 70 pro;~ect.,'
Clarkson, Curry, Mako and Emond."aye", motion carried.
7b.154 Motion by Emond seconded by .Curry. to authorize the pay. request of Richard Knutson
in the amount of $130,.703.17 on the Orchard Lake Trunks. Curry, Mako, Emond
and Clarkson "aye", motion carried.
76.155 Motion by Emond seeonded,by Clarkson to approve the fee of two foot contour
maps at a fee of $6.50. Mako, Emond, Clarkson and Curry "aye", motion carried.'
The "ORDINANCE REGULATING THE SURFACE WATER USE OF LAKE MARION IN THE CITY OF
LAKEVILLE" was read fox the first time.
76.156 Motion by Curry seconded by Clarkson to give tentative approval of the following-
ordinance:
AN ORDINANCE REGULATING THE SURFACE WATER USE OF LAKE MARION iN'THE CITY
OF LAKEVILLE,
Nand to authorize that it be sent to the DNR for consideration. Emond, Clarkson,
Curry and .Mako "aye", motion carried.
The second reading. of this ordinance will be whew the ordinance. is returned

A discussion took. place regarding the matter of no quorum being present
:for the last Planning Commission meeting. It was decided that th'e Mayor
would have a letter sent to the Planning Commission regarding this matter.
Mr. Michaud explained what he had planned for the trail system in Ritter Farm
Park as to keeping the trails open the year around. He felt that these trails
could be used for hiking in the summer.
76.157 Motion by Curry seconded by Clarkson to approve the concept for the trails:
in Ritter Farm Park as proposed by the-Park and Recreation Director,
Clarkson, Curry, Mako and Emond "aye", motion carried.
Mr. Mako said he taould not go along with placing picnic-tables along these 'trails.
Mr. Robert Nelson presented the proposed long range map for bicycle trails in
Lakeville. He said that upon ..acceptance, this could be sent to the State and
will be returned with the S ate's suggestions and..recommendat ons.
76.15$ Motion by Emond seconded by Clarkson to approve the basic concept of the bicycle
trail system as presented. Curry, Mako, Emond and Clarkson"aye", motion carried.
76.159 Motion by Clarkson seconded by Mako to adopt.-the resolution No. 76.17, regarding
the City Council's policy for appointments on advisory committees. Mako, Emond,
Clarkson and Curry "aye", motion carried.
The snow removal ordinance was considered for the second time.
76.160 Motion bq Curry seconded by Emond to adopt the snow removal ordinance.
Mr. Emond said he is not in favor of such a short time limit for removing the
snow.
76.161 Motion by-Emond seconded by Clarkson to amend the snow .removal ordinance to
read "48 hours" instead of ':24 hours".
Upon roll call being taken, the vote was as follows on the amendment: Emond,
and Clarkson "aye", Currp and Mako "nay", motion failed.
Roll call was then taken on Motion 75.160 which is as follows: Curry "aye",
Clarkson, Mako and Emond "nay", motion failed.
This item will be placed on the agenda for April 19.
76.162 Motion by Clarkson seconded by Curry to adopt the resolution-setting water
and sanitary sewer user xates. Curry, Mako, Emond and Clarkson "aye" ,motion
carried.
76.163 Motion by Emond seconded by Clarkson to adopt Resolution 76.19 accepting the
preliminary report for the Dakota Heights and Oak Hills street improvements'
and setting the hearing date for May 3 at 8:30 P.M. Mako, Emond, Clarkson
Curry "aye", motion carried.
76.164 Motion by Clarkson seconded by Curry to approve the list of election fudges.
Emond, Clarkson, Curry and Mako "aye", motion carried.
76.165 Motion by Emond seconded by Curry to set the Board of Equalization meeting for
the 24th of June, 1976 from 3:00 to 7:OD P.M. Clarkson, Curry, Mako and
Emond "aye",emotion carried.
Mrs. Curry asked that the hunting ordinance be reviewed as she has had quite a
few calls regarding this.. matter.
A letter regarding the reforming of the advisory council of the Community
School Program into a more formal committee was discussed .with Mr, Peter Martin,.
He said he .would like the Council to appoint one member from `the Council and
one Lakeville citizen. He also stated that the future meetings would be held
during .the day instead of the evenings.

76.166 Motion by Clarkson seconded by,Mako to approve the:concept o£ this letter and
to appoint Mrs. Curry to, this advisory council of the Community School Program.
Mako, Emond and Clarkson,"aye", Gurry abstained, motion. carried.
Mr. Marek discussed the fire truck bids with the Council and recommended
that the Council award the contract 'to Pierce as they had the best price in
meeting .all specs when all' options are figured in.
76.167 Motion by Emond seconded by Clarkson to accept the bids for the fire truck.
Mako, Emond, Clarkson and Curry "aye", motion carried
76.168 Motion by Emond seconded by Curry to follow the recommendation of the fire
chief and award the contract to the Peirce Company whose total bid is as
follows: Base bid $22,246..00, foam~inducton system $1,200.0 and 110 volt
power inverter $1,385.00 which makes a total bid of $24,831.00. This bid is
in the best interest of the City.: Emond,. Clarkson, Curry and Mako "aye",
motion carried.
Wally Futter appeared before the Council to request that a committee be appointed
to review Lake Marion residents' request for the closing of Lake Marian road.
This will be placed on the -agenda `for the next meeting.
A group of Lake Marion residents who have a flooding problem appeared to ask
what will be done to divert the water away from their. homes.
76.1b9 Motion by Curry seconded by Mako to continue this meeting until the Lake Marion
flooding problems can be solved. Clarkson, Curry, Mako and Emond "ape", motion
carried.
Mr. Rosene showed his mag and explained-what. the water level on Lake Marion is
at the present time and 'that a:temporary solution to keep water.-out of the
basements would be diking with `gravel or sand: bagging.
76.ll0 :.Motion by Curry`secQnded by Emond to divert the Lakeridge water from the pond
into the back :waters of LakeMarion by shaping the ditch. Curry, Mako, Emond
.:and Clarkson "aye",.motion carried.
Further discussion took place regarding a temporary measure for keeping water
out of basements. Mr. Robinette :reported how much. gravel and man power it
would take to do the ditching with grave The concensus was that sand bagging
would have to be done immediately as it is impossible to'drive trucks. on 'the
lawns at this time.
Mrs. Curry. suggested .that-a cement and. rock wall be installed,germanently.
.76.171 Motion by Curry econded by Clarkson to install a 30 foot culvert under`_the
-road south of Highway ~~50 Mako, Emond, Clarkson-and Curry "ape",'motion
carried.
Pumping the swamp was discussed and to keep the road open it was decided to
seal both ends of the culvert from the .road to the:_-Lake.
76.17:2 Motion by Clarkson seconded by Curry to instruct the attorney to revive
negotiations for an easement for the outlet of Lake Marion and to authorize
condemnation proceedings if necessary. Clarkson and Curry "aye", Emond and
Mako: "nay'}~ ..motion failed.
76.173 Motion by Curry seconded by Mako to table the above matter until 2 weeks from
tonight for further information. Clarkson, Curry, Mako and Emond "aqe",
-motion carried.
Jim Christianson from Midwest Planners appeared .regarding amarketing study
for the -Liquor :Store,
Mr. Emond. and Mr. Clarkson `are opposed to sgending the money for.. this study.

76.174 Motion by Mako seconded by Clarkson to table a decision on this matter until
fivemembers of the.Council..are present. Curry, Mako, Errand and Clarkson

76.175 Motion by Emond seconded by Clarkson to accept the petition €ratn L. M. Hazel
for sewer service to 17413 Java Court North. Mako, Emond, Clarkson and
Curry "aye",'.motion carried.
Motion by Emond seconded by Clarkson to adjourn carried unanimously.
