CITY OF LAKEVILLE.COUNCIL MEETING
APRIL 19, 1976
The Mayor asked everyone tostand for the flag pledge.
The meeting was called to order by Mayor,Mako and roll call was:. taken.
Presant,.Mayor Mako Councilmen Emond, Zaun, Clarkson and Councilwoman Curry.
Also present was Patrick McGarvey, City Administrator, Roger Knutson,, City
Attorney, and Robert Rosene, Consulting City Engineer.
.76.178 Motion was made by Emond, seconded by Curry to approve the.Agril 5, 1976
Council meeting minutes. Roll call was taken. on .the motion. Ayes, Mako,
Clarkson,,-Emond., Curry. .Nays, :none, 9bstain, Zaun..
76.179 Motion was. made by Emond, .seconded by .Zaun to approve the Council minutes
-of the April 12, 1976 Special Council meeting.
Roll call was taken on the motion. Ayes, Mako, Emond, Clarkson, Zaun, Curry..
The City Council reviewed the list of claims for approval to paq.
76.180 Motion was made by Emond, seconded by Curry to approve the City Claims. for-
payment.
Ro11 call was taken on the motion. Ayes, Emand,'Mako, Curry, Zaun, and
Clarkson.
A list of claims. for the Liquor: Store were reviewed by the Council for approval
to pay..
76.181 `Motion. was made by Emond, seconded ~y Zaun to approve the Liquor Store claims
for payment.
Roll call was taken on the motion... Ayes, Curry, Zaun, Clarkson, Mako and
Emond.
The City Attorney presented Resolution ~~76-20 releasing City claims against
the various Donnay Additions as a part of the settlement-wfth 1st Wisconsin
National Bank.
76.182, Motion was made by Curry, seconded by Zaun to approve and adept Resolution`
x'76-20 releasing the .claims.

The City Attorney recommended the Council adopt Resolution ~ releasing.
$13, 650.52 the City is holding in escrow for the Donnay Additions.
76.183 Motion was. made by Mako, seconded by Curry to adopt Resolution ~ releas-

Mayor Maka opened the .public hearing. on the 210th Street sewer improvement:
The improvement would also include the extension of water utility lines.
The Mayor called on the City Attorney to attest to the legality of the public
hearing., Mr. Knutson stated that the required legal notice was published in
the official City newspaper and letters had been mailed to the property owners
proposed to be assessed if the improvement were made. 'In his opinion it was
a dulyconstituted legal public hearing.

The Mayor called on the City Administrator to explain the limited sewage
treatment capacity from.:the Lakeville treatment plant .owned and. operated
by the Metropolitan Waste Control Commission.-
The City Administrator explained that the M.W,C.C. had notified the City
that as of naw it appeared .they could only provide for an .additional 250'
single family units in their plant. Furthermore, they were requesting the
City to Limit the number of connections during the 12 month period`of`April
1976 to April 1977 0 2j3's of than figure,. or 167::: equivalent connections..

The City Administrator pointed out that this is one of the items the Council
will have to strongly consider in deciding whether. or not to order the pro-
ject.
Mayor Mako called upon Bob Rosene, Consulting City Engineer, to present the
scope of the project and estimated costs. Mr. Rosene reviewed the project
and wrote he costs on the blackboard far: all present to see.
There were several citizens. present who asked questions 'or .commented in re-
gard,to .the. project. Janet Meadows asked about the casteto agricultural
property. Mr. Rosene explained that it would depend upon the front foot
assessment for sewer which is estimated at $15.25 per foot.'-
Bill Martin asked about the water unit charge of $275.. Mr. Rosene explained
what the charge is far.
George Hammer asked about-the time limit to hook up to the. utilities. It was
explained that the present Ordinance requires a hook up within two years after
the utilities are present, but that in view of the sewage treatment capacity
.problem an extension of the two years may. be permitted.
Bob Dunham asked..aboutwho wanted this project.
Mayor Mako explained that some people on 210th Street `had getitioned the
Counclfor sewer.
George Sullivan stated that the people didn't need sewer service, at this time.
.Nancy Martin stated that. they do have a sewer problem and theq would Ike the
.sewer service.-
Terry. Lind a toted that he was not in favor of the project.
Ray Henry said that there is no sewer problem on 209th Street and didn't feel
the ,project was needed.
George Sullivan asked the engineer how many homes could be served bq the pro-
posed 'line. Mr. Rosene answered that approximately .100 homes could be sewer-
ed by the capacity in the line.
Mayor Mako then explained that the 250 connections the sewer board is Iimit-
ing the City to for the Lakeville plant is for all of the City that feeds into
that plant.
76.184 Motion was made by Zaun, seconded by Emond to close the public hearing on 2IOth
Street.
Roll call was taken on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson.
Mayor Mako stated that the decision on this project would be made at the June 7,
1976 .Council meeting.
76.185 Motion was made by Zaun, seconded by Curry to xejectkthe-sanitary sewer-an 215th
Street, and•to continue-the consideration of sewer on 210th Street to June 7,
.1976 Council meeting.
Roll call. was .taken an the motion. Ayes,. Zaun, Curry, Clarkson, Mako and Emond.
.Mayor Mako opened the public hearing on the proposed sewer improvement project
on Rolyoke.~rom 202nd and 205th Street including the Marrinan Addition in the
northeast .quarter of Section 29.

The Mayor called upon the City Attorney to attest to the legality of the public
hearing. Mr. Knutson stated that the official notice had been published in the
official Citq newspaper and that. notice. had been mailed to the property owners
proposed to+~be assessed for the improvement. In his opinion, it was a duly
constituted+~legal Public ..hearing.
' The Mayor called upon the City Engineer to explain the `scope of the project
and the estimated costs. Mr. Rosene reviewed the-project and the estimated -

costs which he s ated would include both water main and sewer. laterals to the
property owners involved with thin. hearing. Mr. Rosene outlined on the black-`
board the.:costs.`
The .Mayor then .asked if there :were any comment or questions from those present.
Ed Korba asked about the difference between he front foot costs compared to the' -
210th Street pro3ect.
Mr. Rosene explained that each project costs .vary ..due to soil conditions,
amount of 'assessable .property involved in`the project, the characteristics
°which differ .from gro,ject to projec
Frank Pelach quetions as to who wanted the utility..service.
Walt River asked how other homeowners in the area had ..received water and sewer
at earlier dates, and not the area involved ;in this hearing.
Mayor Mako explained that sewer service was provided from the old village to
an area outside of the village limits at that time and that the developer or
:owners paid for`'it themselves.
Dave Hendricks questioned about the number of benefitted lots on Holyoke.
Mrs. Kraft questioned the figures presented in the sewer assessments.
.,.Mrs. Steberg asked-about the policy that would be-used in assessing her two '
lots•
7b.186 There being:,:no further questions or comments, motion was made by Clarkson,
seconded by Curry to continue the public hearing to May 17,.1976. and to'
direct the City :.Engineer to give alternate costs'forthe location of a
:..sewer line on Holyoke. Avenue at that meeting.

The City Engineer presented a preliminary report on. the costs-for relocating
a portion of Judicial Road.
7b.187 Motion. was made by Emond, seconded by Mako to receive the report,

The Council, staff, and :citizens .then. briefly discussed the proposed reloca-:
tion project.
76.188 Motion was made by Mako, seconded 'by Clarkson to call a public hearing on the
relocation of Judicial Road for May: 10, 1976 at 8:.00 P.M. to be held at-the
Orchard Lake Elementary School.

The Ctq..Administrator recommended that the Council authorize anal direct that.
no parking signs be installed on 168th Street-fromthe railroad viaduct :west.
to a point just past the-Sea Girt Inn.
76.189 Motion was made by Emond, seconded by Zaun to authorize and direct the installa-
tion of no parking signs on 168th Street from the railri~d viaduct west to
a point immediately west of the Sea Girt_Inn. - - _
Roll call was taken on the motion. Ayes, Emand, Clarkson, Zaun, Curry and
Mako .
The City Administrator presented astaff report with re~~mmendatioas on the
construction of a permanent earth dike on,;the rear o€ five lots abutting
Lake Marion: in the Bassetts Addition. Staff recommended that the Council
authorize the work .provided the property ok*ners give the-City an .easement
fox the dike construction, hold the City harmless from any possible damage
claims.:, and agree to pay a`portian of the costs involved.

Discussion on the proposal was held ;between the Council, staff, and property
awner$ involved. The Citq Attorney was directed to prepare the easement
documents..
76.190 Motion was made by Curry, seconded by Zaun to 'authorize the C ty to build the
dike provided that the City gets the easements,
signed by all five parties-and a'release from all five parties along with the
.agreement to pay a"portion of the costs up to a maximum of $200.00 per lot.

76.191 Motion was made by Curry, seconded by Mako to continue the Council meeting
beyond the 11100 deadline.
Roll call was taken on the motion. :.Ayes:, Mako, Curry and Zaun. Nays, Emond
'.and Clarkson.
The City Engineer presented a report on the bids for the new fire station.
76,192 Motion was.made by Emond, seconded by Clarkson to receive the bid tabulations.
Roll call was taken on the motion. ,Ayes,'Clarkson,-Zaun, Curry, Mako, Emond.
The City Engineer recommended that the contract be awarded the low bidder,
Robert 0a Westlund Construction Company in the amount of '$107,400.
Motion was made by Mako, seconded by Curry to approve and award the contract
to Robert 0. Westland Construction Company for the 'construction of fire sta-
tion ~2 in the amount. of $107,400.
Roll call was taken. on the motion. Ayes, Emond, Clarkson, Zaun, Curry, Mako.
76.193.. Motion was made by Curry:, seconded by Zaun"to approve the rezoning of Lots
'3, and 4, Block. A, Rhoda_Thomsons Addition as recommended by the Planning
Commission from R-3A to B--3.
Roll call was taken 'on the motion.: Ayes, Emond,-Mako, Curry, Zaun, and Clarkson.
The City Administrator presented a contract to provide planning services-from
Midwest Planning and'Research, Inc. under stage 2 in the City's comprehensive
plan update. The contract is to cover a social profile bf the community,
economic base evaluation and land use utilization and market absorption study,
a physical analysis of the land use and'a detailed. housing inventory. The
cost of the contract is not to".exceed $18,000 for the work described.
76.194 Motion was made by Curry, seconded, by Zaun to approve the contract with Mid-
west Planning and Research., Inc. in the amount of'$I8,000. for planning ser-
vices.
Roll call was taken. on the motion. Ayes., Emond, Mako,. Curry and Zaun. No,

Mr. Clarkson stated he was voting .no because-of the pressure aad requirements
of 'the Metro Council to have'thistype of planning-and not as a reflection on
the Planning Consultant.
The Council reviewed a proposed agreement`to provide amarket-study for the
liquor store from Midwest Planning and Research, Inc.
16.195 Motion was made by Emond, seconded by Clarkson not to enter into Che proposed
....contract. _
Roll call was taken on the motion. Ayes, Bmond,'Zaun and Clarksox~t. :Naps,
Mako and: Curry.
76.196 Motion was made by Mako, econded by Curry to reconsider the Ordinance on
cleaning of sidewalks.
Roll call'was taken on the oration. Ayes, Emond, Mako, Curry and Clarkson.
Nays., :Zaun.
76.197 Motion was made by Curry~to set the time limit for cleaning the sidewalks

at 24 hours. The motion died for lack of a second.
76,198 Motion was made by Emond, seconded by Curry o approve the Fire Fighting
Service Agreement with`the Town. of New Market for 1976.
Roll call was taken on 'the motion. Ay~s, Emond, Mako, Curry, Zaun and
Clarkson.

Mayor Mako_proclaimed April 30, 1976 as Arbor Day in Lakeville.
The City Administrator presented,a recommendation to the Council to combine
the positions of City Administrator,.Clerk/Treasurer. The City, Administrator
also .recommended that the Council establish another Deputy Clerk position and
that Mrs. Hemstrom would fill that position, at a recommended salary of $850
per month,. for the remainder of 1976.
.'...76.199 Motion taas made by Emond, seconded by Zaun to combine the positions of Citg
Administrator-City Clerk-Treasurer and naming Patrick E. McGarvey City Clerk
and further establish the second Deputy Clerk position and appoint Marceline-
Hemstrom to said position at'a salary of $850 per month effective April 20,
1976.

The City Administrator presented letters from two property owners in Forest
Hills requesting sanitary sewer service,
76.200 Motion was made by Emond, seconded bq-Zaun to receive the letters;

76.201 Motion was made by Emond, seconded by Curry to approve a>non-intoxicating
malt liquor license to the Lakeville Softball Association to sell beer at
four tournaments to be held in Aronson Park.

.Emond.
