SEPTEMBER 13,.1976
The meeting was called to order by;Mayor Mako; at 7:00 P.M. Roll call was taken.
Present: Mayor Mako, CounciZmembers Curry, Emond, Clarkson and Zaun.
Also present: :.Patrick Farrell:, City Attorney.; Roger Knutson, City Attorney;
Robert Rosene'and-Richard Turner, Consuiting;Engneers; Patrick McGarvey, Citq
Administrator; 3ames_Robinette, Public Works `'Director;`Dave Eveslage, Inspec-
tor'employed by the Engineering £irm.
Mr. Walter Sternberg and his attorney, Mr. Spicer, addressed the Council concern-
ing the .determination of which lots Mr. Sternberg owned in Block 26 in the'Orchard
Lake area'are buildable and which lots. are unbuildable"under various State and
City lawn.
Mr. Knutson reported that`Mr: Goodermont, the Building Inspector, and Mr.:Fri-
gaard had;personahy viewed the area involved and had determined from the two
foot contour maps and high water elevation information from-the D.N.R. that<
Lots 1, 2, 3, 4, and 25 through 33 of Block 26 were buildable lots. They also
reported that Lots 5, through 24 on Block 26 are not buildable under law.
Mr. Rosene reported that there would be no lateral assessment at this time be-
cause the pipe presently .being installed is.a force main, and the .future lateral
extension would have to be constructed 'to serve the buildable lots at which time
an appropriate sewer assessment would be made for the lateral service. None of
the unbuildable lots would be assessed.
Mr. Spicer adv sed the Council. that he was giving the City the signed waiver of
entry forms far the City to enter on Mr. Sternberg's property to'construct a
sewer lift station now that the determination of what the buildable lots were
and the assessment policy had `been resolved between the: parties.
76.450 Motion was. made by Curry, seconded by Zaun determining that.~.ots 1, 2, 3, 4,
and 25 through 33 on Block 26 'are buildable :lots pending receipt of appropriate
written agreements between Mr. Sternberg and the .City by a waiver;of entry and
permanent easement-for the sewer lift station on a-portion'of his property.
Roll call was taken on the motion. 'Ayes, Emond, Mako, Zaun, Curtiy, and Clarkson..
At this time Mayor Mako asked Mr. Rosene to present to the Council his report"
on how the contract was prepared and its requirements, between the City and
`his firm_'for the Sewer Inflow ..Analysis study. The Consulting Engineer presented
reports and data from the Metropolitan Waste Control Commission-and the E.P.A.
concerning the. requirements foraa.Sewer...Inflow Analysis and how the estimate
of work was arrived at .for the Lakeville study.

Marianne Curry raised the ques ion as to whether ox~ not a =irm who lead designed
and supervised the construction of the sewer system/could be expected to be ob-
jective in evaluating its own-work as to inflow analysis. She recommended the
Council terminate .the contract and retain a different firm to perform the sewer
inflow survey.
The Council, Consultant and staff discussed the question_at length.. Councilman
Emond stated that if the Engineer did not perform this work satisfactorily,
`and any of his other work for the City in a satisfactory manner in the future,
he was sure the Engineer would realize that he would be facing the prospect_of
the Council terminating all of his services 'to the Citp, and that he would have
no hesitation to support such a motion'at that time if that-were the case.
76.451 Motion was made by Curry to terminate the contract effective ten days from `the
meeting date for the Sewer Inflow Survey with Bonestroo, Rosene, Anderlik anal
Associates. -Motion died for lack of a second.
76.452 Motion was made by Clarkson, seconded by Zaun to adjourn the Council-meeting.
Roll call was `taken on the motion. Ayes, Emond, Zaun, and Clarkson. Nays,
Mako and Curry
