HomeMy WebLinkAbout11-01-76 CITY OF LAKEVILLE COUNCIL MEETING November 1, 1976 The meeting was called to order by Mayor Mako at 8:00 P.M. :Roll call°was taken. Present: Emond, Curry, Zaun, and Mayor Mako. Absent: Councilman ..Clarkson. Also present: Patrick McGarvey, City.Administrator;.Robert Rosene, Consult- ing City Engineer;.Roger Knutson, City Attorney; James Robinette, Public .Works Director. 76.566 Motion was made by Zaun, seconded by Curry to approve the Council minutes of October 12, 1976 Council meeting. Roll .call was. taken on 'the motion. Ayes, Emond,. Mako,. Curry and Zaun. 76.567 Motion .was made by Curry, seconded by Mako to approve the Council minutes of October 18, 1976.. Roll call was taken on the motion. Ayes, Emond, Mako, and Curry... .Councilman Zaun .abstained as he was not at themeeting. At this `time Councilman Clarkson arrived and took his chair. 76.568 Motion was madeny Emond, seconded by Curry to approve the claims against the City as presented. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. The following staff reports. were .given, The City Engineer reported that the asphalt was in place on l6$th Street. He also reported that the Fire Station 4~2 had been inspected by Mr. Lemberg and City personnel on November 1. The inspection found that there were several items yet to be completed. 76.569 Motion was made by Clarkson, seconded by Curry to extend the completion date on the fire. station through November 12, 1976 and directed the City Adminis- trator to inform the contractor that liquidated damages would begin on-Novem- ber 13, 1976. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. At this time the Mayor 'asked the-.City Administrator to read the resolution which would create a Natural Resources. Committee. The City .Administrator read.-the resolution in full. Councilman Emond .questioned the possibility of providing funding for pro- fessional staffing for. the Committee in the future. Judy Brisky, President of the Dakota County League of Women's Voters spoke in favor of establishing the Committee.. Mrs.Hammer also spoke in favor of adopting the Resolution. Mr. Tom Walsch asked how much.authority .the .Committee .would .have to enforce' laws, or .violations of laws? :Mayor Mako answered that it was being created.. as an advisory committee to the City Council. Pastor Clifton`Trued spoke in favor of establishing the Committee. 76.570 Motion was made by Zaun, seconded by Mako to adopt Resolution #76-64 es- tablishing a Natural Resources Committee. Ages, Zaun, Clarkson, Emond, Mako and Curry. 76.571 -Motion was made bg Emond, seconded by Curry to approve the list of election judges for the.November 2, 1976 election being added to the previously approved list. Roll call was taken on the motion. Ayes, Clarkson, Emond, Mako, Zaun and Curry.; The City Administrator .presented costs to be assessed against the Queen Ann mobile home property for sanitary sewer service. -1- y CITY OF LAKEVILLE COUNCIL MEETING November 1,:1976 76.572 Maton was made by Emond, seconded by Curry"to adopt the assessment roll against the Queen Ann mobile home park property as outlined n the report from the City Administrator. Roll'eall was taken'on the motion. Ayes, Emond, Mako, Curry, Zaun and Clarkson. 76.573 Motion was made by Curry, seconded by Zaun to approve the assessment against the parcel of property owned `by Gary A. Charnstrom for a lateral water assess- ment on 185th Street in the amount of $4,163.52 at 8% interest-for 20 'years. Roll. call was taken on the motion. Ayes, Mako, Curry, Zaua, Clarkson and Emond." At this time Mike Corbut spoke to the Council concerning a dispute with the developer of Woodbury Addition concerning the Gity assessments for water and sewer.. Mr. Gorbut stated that when theypurchased the lot from the developer, Mr. Zaddusaw,'"that the flyer they had received stated that all improvements were in_and paid for. Since the'City assessed the lot for water and sewer :they requested-the Council to hold_the..interestuntil`the dispute could be settled between them and the developer. Roger Knutson, stated that it would not: be possible for he City to abate the interest :and that he would discuss what might be done with Mr. Corbut's attorney. 76.574 Motion was made. by Emond, seconded by Zaun to approve: the filing of a grant to the D.N:R. ff~r snowmobile trails. .Rolf call was taken on .the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. The City Administrator. and Cfty Attorney recommeded the Council approve a Resolution approving the takeover and payment of,the industrial revenue bonds on the Laminated Products, Inc. bond issue. It was explained that the Thera- dyne.Gorporaton was purchasing the building and would. be paying he Trustee. 76.575 Motion was; made by Curry, seconded by Mako to approve Resolution 76-65 auth- oriz ng the transfer of the property and the assigning of the Quit Claim deed. Roll call was taken on the motion.. Ayes, Zaun, Clarkson, Emond,:Mako and Curry. 76.576 Motion was made by Emond, seconded by Gurry to approve Resolution 76-66 con- cerning the improvement o a 300 foot segment of County Road X23 with Dakota County. Rolla call was-taken on the motion. Ayes, Clarkson., Emond, Mako,'Gurry and Zaun. .76.577 `.:Motion was made by Emond, seconded`by Zaun to approve payment to School District 194 for the City's participation in the costs of build ng the new tennis courts at the Lakeville Middle School in the amount of $23,190.52 under the terms of the agreement between the. School District and the Citp. Ro11 call-was taken on the motion. Ayes, Emond,'Mako,`'Curry, Zaun and Clarkson... 76.578 -Motion was made by Clarkson,-_seconded by Zaun to receive the Planning Commission minutes of October 21,...1976. Roll call was taken on the :motion. Ayes, Mako, Curry, Zaun, Clarkson .and Emond. 76.579 :Motion was made by Clarkson, seconded by Zaun to approve the site plan and building plans. for J & E-Manufacturing ,Co. to build anew building in Airlake 'Park and authorize the Building Inspector to issue a building permit. Ralf call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. 76.580 Motion was made by Zaun., seconded by Mako to receive the Park and Recreation Committaeminutes..of October 20, 1976. -Roll call was taken ;on the motion. Ayes, Zaun, Clarkson, Emond,, Mako and Curry. Mayor Mako at this time gave the City Council a report on the State Health Department's work on analyzing. the City water system and quality of water, He also advised the Council that he and the City Administrator and Public -2- ~ ~ • CITY OF LAKEVILLE GOUNCIL'MEETING November 1, 1976 Works Director and Water Superintendent had met with Mr. Lawrence Brimehurst of Serco Laboratoriesconcerning'the testing of the City water at .certain lo- cations by Serco. It was recommended that the Council authorize the`work to `be done by Serco Laboratories. as per the letter presented to the Council from Mr, Brimehurst. 76.581 Motion was made by Clarkson, seconded bq Zaun to approve and authorize Sergio Laboratories totest the City water as per their written proposal at a cost - not to exceed $1,200.. Roll ca11 was taken on the motion. Ayes, Clarkson,`Emond, Mako, Gurry and Zaun. ...76.582 Motion was made;by Curry, seconded by Zaun to appoint`Dr: Peter Frederixon as the City Health Officer. Roll call was taken on the motion.. Ayes, Emond, Mako, Curry, Zaun and Clarksoa. 76.583 • Motion was made by Curry, seconded by Zaun to refer the matter to the, City Attorney, along with the Engineer, on the work or costs of sealing the sewer line from the Lakeville Middle School area-to the Lakeville treatment plant. Roll call was taken on the motion. Ayes, Mako, Curry, Zaun, Clarkson and Emond. 76.584 Motion was made by .Curry, seconded by Clarkson-to send a letter of inquiry to the Dakota County Engineer concerning the possibilities of a Joint Powers ..Agreement betwe~'n the City and the County on engineering matters. Roll call was taken on the motion. Ayes, Curry, Zaun, Clarkson, Emond and Mako. 76'.585 Motion was made by Mako, seconded by Emond to approve an abatement of an assess- ment as recommended by,the County Assessor on the Henry E. .and Susan J. Rice parcel of property.. Roll call was taken on the motion. Ayes, 2aun, Clarkson, Emond, Mako and Curry. 76.586 Motion was made by Clarkson, seconded. by Emond to install a,plate of Lexan for the rear window at the new Fire Station. Ro11 call was taken on the motion. Ayes, Clarkson, Emond, Mako, Curry and Zaun. 76.587 Motion was made by Emond, seconded by Zaun to adjourn the Council meeting. Roll call was taken on the motion.
