Present: Councilmen Zaun-and Clarkson, and Mayor Mako. Absent: Councilpersons Curry and Emond. I The`City Administrator/Clerk presented the Council with a tabulation of the election results of the November 2, 1976 election.. 76.588 Motion was made by Zaun, eeonded by Clarkson to approve the canvas of the .November 2, 1976 election. Ro11 call was taken on the motion. Ayes, Mako, Zaun and Clarkson. 76.58 Motion was made by Mako, seconded by Zaun to adjourn the special Council meeting. Ro11 call'was taken on the motion. Ayes, Mako., .Zaun and Clarkson. Time, $:00 P.M. At this time Mayor Mako asked all present to stand and pledge allegiance to the flag. Roll call was .taken. Present: Emond, Mako, Curry,. Zaun and Clarkson. Also present: Robert Rosene, Consulting City Engineer; Pat Farrell, City At orney.; Patrick McGarvey, City Administrator; James Robinette, Public ..Works. Director. Also presentwere: Otto Bonestroo and Robert Frigaard of the :Consulting Engineering firm.. At his time Mayor Mako explained to the citizens-present that the intent of the meeting was to give Mr. Rosene his request for a hearing before the City Council.toexplain his views on what had happened 'on various City im- provement projects. Mayor Mako explained that the Council, would make no decision after the presentation at this night's meeting. He further ex- plained after Mr. Rosene had made his presentation, that the Council would ask questions and then the citizens could ask any questions theq wished. At this time Mr. Rosene gave a presentation concerning how they write their specifications, especially when ..they pertain to sanitary sewer or water systems. He explained that their specifications are considered to be per- formance-specifications and that tests are taken'at the conclusion. of the construction work to determine whether or not the work is the standard set forth in the specifications. He explained that it is the primary responsibility, in his opinion, _for the: contractor to supervise his work.' Mr. Rosene reviewed the current Knutson Orchard Lake utility project and the. problems involved with that project. At this point Councilman. Clarkson reQuested_Mr. Rosene-to .explain why".there had been over 20 broken valves or areas in the clay pipe in the Lakeville Hills area on this project. Mr. Rosene explained that he felt most were due to not properly digging the trench,.. especially at the. bell area or in carelessly backfilling over the ....pipe. " Mr, Clarkson also questioned why the Engineer .specified reinforced concrete pipe in .the area `crossing the .swamp east of the Chart House. Mr. Rosene explained that reinforced concrete pipe is used in many areas below the water table or-a swamp, that't would be very expensive to use ductile iron pipe. At this point, Councilman Clarkson, Zaun and Curry asked questions concern- ing the .Orchard Lake gro~ect. They also questioned the installation of the 0-rings on the Middle School line 'and the infiltration problems on the Ipana to Valley. Park sewer line. Mr. Rosene answered these'questons, with the latter answer being that it was.. considered: appropriate to put the reinforced concrete pipe across the swamp`whch, when installed properly, would not be subjec to excessive infiltration-because it was below the swamp. He also stated that the costs involved of the type of material vs.-another `material or another location would have to be weighed `in making ;these decisions. Mayor Mako ques ioned the`on-site inspection policy on the°current projects as compared to previous projects. Mr. Rosene explained that in earlier years their service in the City of Lakeville xesident on-site inspection had not:been°required, but that be- ginning in-1975 the City changed the contract with-the firm and resident inspection `has been requested by the City and provided.' Mrs. Curry questioned about the street project in front of her house and the lack of borings. on the original installation. The question was also raised as to whether or not borings were required on the Valley Park tennis courts before the project began. At -this time, Mr. Fred :Fredrickson,`.who was a former member of the Water and Sewer Committee of the Cty'addressed the Council. Mr. Fredrickson 'stated that in his opinion the. testing and inspection in Lakeville has been more stringent than. in the'City of Bloomington.- ~ Mr. Fredrickson also explained to the Council about the proper installation of 0-rings on sewer pipe. and stated that he personally inspected.the line that had been installed in the Middle School to the treatment plant in the early 1970's as he was an unsuccessful bidder on that project. He stated that at`the time .the line had been finished that'he personally did not observe-any infiltration in the line when he inspected it. Mr. Fredrickson also stated that it was the Water and<Sewer Committee's de- cisions back in the 1960's that resulted-in the current lift station at the Chart House being used with its discharge into the'sewer system and smaller lift stations in the Lake"Marion area as a temporary, and cost saving., measure to buy time until the ultimate additional trunk line is built to serve the northwest `sector of Lakeville. At this time,_the Mayor opened the meeting to questions from citizens pre- sent. Mr. Steve Johnson questioned the location of the fire hydrant on County Road 44 in front of his Meager Beginning Studio building and stated that the fire hydrant had been moved ju t that day. Mr. Tom Smith addressed the Council and stated that he did not feel there was $ inches of rock on Junelle Path after the water and .sewer went in in-front of his home. Mr. Rosene stated that he would inspect. the road with Mr. Smith to determine whether or-not this was sos Dick Whittier questioned about the grade and settlement at the intersection'. of 205th and Bughes Streets. Mr."Frigaard answered stating that there was a flat area in this Bart ofthe.Cty and grades were such that a fast:run- off was not possible. It was agreed that the City would look into the: matter at that earner. Nancy Jensen asked the question of 'what can be done to prevent future problems 'and to prevent additional reassessments. Mr.` Rosene explained that in new plats being approved from here on the City requires the utilities and streets to be in before the houses go in, which was not the case in 'all subdivisions in the past. Gerry Whittier questioned on-site inspection and how it works. It was ex- plained that the Engineering Consultant provides inspection from their em- ployees and that the City personnel also inspect the projects at the end before they are accepted.' Ayes, Emond and Clarkson, Nays, Mako, Curry and Zaun, At this time Marianne Curry stated that the criticism of the Engineering firm was not intended but that she felt elected officials have an obligation to ask questions concerning the performance of Consultants and contractors work- ing for the City when p~o~sl~ms arise. ~ 76.591 Motion was made by Mako, .seconded bg Curry fo adjourn the Council meeting.
