The meeting was called to order by Mayor Jensen at $:00 P.M. Flag pledge
followed. Present; Brandes, Mako, Jensen, Emond and Clarkson.
Also present; Robert Frgaard, City Engineer and Pat .Farrell and Roger Knutson,
City Attorneys,
7+.379 Motion by Mako seconded by Brandes to accept the minutes of the July 1, 197+,
meeting as presented. Bxandes, Mako, Jensen, Emond and Clarkson "aye", motion
carried.
Mr. Ackerman presented his building report for June.
Various matters were discussed including the weeds°on Donnay's property.
'1~e engineer presented his report.
7+.380 Motion by Mako seconded by Brandes to instruct. the engineer to prepare a
feasibility study for the extension of trunk sewer and water to the Orchard
Lake District irxcluding that part of the Crystal Lake District lying west
of 35W at a cost of up to $500.00. Mako, Jensen, Emond, Clarkson ~r~.d Brandes
"aye", motion carried.
Mr. Farrell discussed the joint powers agreement with Burnsville as to the
contract for sewer and water on Oak Shore Drive and it was decided to discuss
this matter after the meeting with Instant Homes.
74.381 Motion by Emend seconded by Mako to follow the recommendation of the Planning
Commission and grant a conditional use. permit to the Evangelical Free Church
to enlarge their church at the corner of Co. Rd. and Co. Rd. 5. Jensen, Emond, ;
Clarkson, Brandes and Mako "aye", motion carried.
74.382 Motion by Emond seconded by Brandes to follow the recommendation of the Planning
Commission and grant the Evangelical Free Church a variance as to side-yard
set backs. Building will be in line with present building. Emond, Clarkson,
Brandes, Mako and Jensen "aye", motion carried.
The representative of the Mpls., Northfield and Southern R. R. explained to the
Council why they had placed the radio tower at the location on .Highway 50
and the entrance to Antlers Park.
:74.383 Motion by Mako seconded by Emond to grant the Mpls., Northfield and Southern R. R.
a conditional use permit for a period of five years for a radio tower. Brandes,
Maka and Emond "aye", Clarkson and Jensen "nay", motion carried.
Pat and John Wren appeared to explain to the Council where they planned on
placing an underground tank and outside storage.
Charles Wright objected to the tank as he felt this would be a hazard and
that the outside storage would be an eyesore.
74.384. Motion by Jensen seconded by Brandes to follow the recommendation of the Planning
Commission and grant Wren, Inc. a conditional use permit for an underground tank
to store diesel fuel on Lot<6 or 7, Sorenson's Addition. Brandes, Mako,
Jensen, Emond and Clarkson "aye",motion carried.
74.385 Motion by Jensen seconded by Clarkson to follow the recommendation of .the.
Planning Commission and grant Wren, Inc. a special use permit for outside
storage for two years subject to the. regulations as specified by the Planning
Commission. Mako, Jensen, Emond, Clarkson and Brandes "aye", motion carried.
74.386 Motion by Mako seconded by Emond to follow the recommendation of the Planning
Commission and grant George D. Bertram a variance to sideyard set-back to build
a garage at 20160 Hambuxg Ave. Variance will be no more than 5 feet.
Jensen, Emond, Clarkson, Brandes and Mako "aye", motion carried.
74.387 Motion BY Mako seconded by Brandes to follow the recommmendation of the Planning
Commission and grant Peter Pemriek a variance to build a garage over 600 sq ft
at 10199 205th. St. W. Emond, Clarkson, Brander, Mako and Jensen "aye", motion
carried..

7+.388 Motion by Matra seconded'by Emond to follow. the recommendation of the Planning
Commission and grant Elwin E. Spear a variance to garage size at 18132 Italy Ave.
Clarkson,-Brandes, Mako, Jensen and Empn.d""aye", motion carried.
Bob-Clark and.Gai1 Davis appeared before the Council forinformation as to lot
size requirement at Wildwood Ponds. Mr. Farrell wi11 review this matter and
bringback a recommendation at next week's meeting.
The hearing on the Lakeridge Plat approval was .reopened. Mr. Robinette reported
that Mr. Grohosk had, not taken any erosion control measures as yet. Joe
WilTamsen verified this fact. It was also asked how this work was bonded.
Mrs. Davis asked the Council if they knew what had happened to Lake Phalen and if
this would happen to_Lake Marion. Mr. Sabatka asked if the permit for excavating
had been given legally. .Nancy. Jensen asked whose responsibility-it was. to enforce-
these controls.
7+•.389 Motion by Ma,ko seconded by Clarkson to deny. the Lakerdge.Plat for`thefollowing
reasons:`l. The"builder is not constructing homes in that development and therefore
his capital investanent wih diminish as lots are sold and the Gity's control
over the plat will diminish proportionately, 2. That as lots are-sold;; to
individuals and builders, the legal complications will become impossible and
3. Enforcement of. any development contract will be practically impossible.
Brandes and Mako "aye",.Jensen, Emond and Clarkson "nay", motion failed.
Mr. Farrell advised the Council that he did not feel these reasons are a legal
basis fora denial of this .plat..
7+.390 Motion by Jensen seconded by Mako that this plat not be approved until there
is an environmental. assessment of the.. area.. Mako, Jensen and Brander "aye",
Clarkson and Emond opposed, motion'earred.
A five minute recess was declared.
John Jones and .John Piercall made a presentation to the Council with a request
that something be done about their complaints regarding their homes. It was
decided to have all ..these building code violations listed and this matter will
be further discussed at 9:30 P.M. on Aug... 5.
7.391 Motion by Clarkson seconded by Mako to accept the bids for Highview Avenue.
Jensen, Emond, Clarkson, Brander and Mako "aye",.motion carried.
7+.392 Motion by Clarkson seconded by Mako to table a decision on Highview Avenue.
until July 15. Emond, Clarkson, Brander, Mako and Jensen "aye", motion carried.
7+.393 Motion by Mako seconded by Emond.to adopt the ordinance fixing the regular
city election etc. as prepared ,by the City Attorney. Clarkson, Brander, Mako,
.Jensen and Emond "aye", motion carried.
74.39+ Motion by Jensen seconded by Clarkson to approve the on and off sale beer licenses
and the set-up license for the .new owner of John's Tavern subject to the necessary
papers being presented by the new owners. Brander, Mako, Jensen, Emond and
.Clarkson.."aye"..,..motion carried.
7+•395 Motion..b'Y Jensen seconded.. by Mako to approve the on sale beer license and the
set up license for the J C's subject to the insurance and fees being presented.

7+.396 Motion by Mako seconded by Emond to .approve the expenditures for the police,
sanitation and the use of Aronson Park fvr the circus of the Panoprog Celebration.

7+•397 .Motion by Emond seconded by Mako-to approve the Lakeville Fire Volunteer"Department's
attached schedule and the amendments to the By-laws. Emond, Clarkson, Brander,
Mako and Jensen "aye", motion carried.
