CITY OF LAKEVILLE COUNCIL MEETING JULY 15~ 1974 The meeting was called to order at 8:00 P.M. by Mayor Jensen. Flag pledge followed. Present;. Brandes, Mako, Jensen and Clarkson. Absent; Emond. Also present;, Pat Farrell and Roger Knutson,-city Attorneys and Robert Frigaard, City Engineer. 74.400 Motion by Mako seconded by Brandes to accept the minutes of the July 8, 1974, meeting as presented. Brandes, Mako, Jensen and Clarkson "aye", motion carried. 74.401 Motion by Mako seconded by Clarkson to pay the claims against the City. Mako, Jensen, Clarkson and Brandes "aye", motion carried. 74:.402 Motion by Brandes seconded by Mako to pay .the claims against the Liquor Store. Jensen, Clarkson, Brandes and Mako "aye", motion carried. 74.403 Motion by Mako seeonded,by Brandes to accept the bids for the seal Coating. Clarkson, Brandes, Mako and Jensen ".aye", motion carried. 74.404 Motion by Mako seconded by Clarkson to award the contract to the low bidder, Allied Blacktop Co., whose bid was X19,700.00. Brander, Mako, Jensen and Clarkson "aye", motion carried. 74.405 Motion by Mako seconded by Brander to authorize the issuance of a duplicate check to Robert T. Laddusaw in the amount of $200.00 to replace check number 10314 dated Aug. 20, 1974 and to waive the bond requirement.. Mako, Jensen, Clarkson and Brander "aye", motion carried. 74.406 Motion by Brander seconded by Clarkson to authorize the clerk to attend the .Affirmative Action Workshop on Aug. 2$, 1974 and to pay the fee of X35.00. Jensen, Clarkson, Brander and Mako "aye", motion carried. 74.407 Motion by Mako seconded by Brander to authorize the payment of $2,444.00 awarded to Eleanore Sullivan and as set forth in the report of .the Commissioners,. a copy of this report is attached to these minutes. Clarkson, Brander, Mako and Jensen "aye'", motion carried. The swirruning pools in Valley Park were discussed. It was felt that the .engineer should inspect the p~aols and take an inventory of the equipment so that the Council will be able to make offer. Someone will also have to appraise the real. estate.. 74.408 Motion by Clarkson seconded by Mako to authorize the engineer to make an inspection of the two swimming pools, in Valley Park and an inventory of the .existing facilities and to include the cost to bring these up to standard. Brander, Mako, Jensen. and Clarkson "aye", motion carried. James Emond arrived at 8:45 P.M. A representative of International Research Services presented prepared material and explained to the Council what they had been doing to expedite the approval of industrial revenue bonds for their project. Various aspects of this request were discussed. The persons requesting the bonds felt that they could not wait for the Minn. Municipal Commission to decide about the proposed annexation of this property to Lakeville. They mentioned. the fact that the underwriter had approved this project and the report contained the latest financial statement. It was mentioned that this Yaeility could be used whenever practicable with the school system. Sewer and water would eventually be needed but not for a few years. Mr. Robert Pulscher said that there is no prior experience with this type of bonds and this makes it difficult to give an opinion. Mr. Maertz said that a preliminary approval resolution is being asked for tonight. Nlr. Farrell said that the annexation would probably take from six to 12 months at the earliest. Mr. Emond and Mr. Clarkson felt that there should be an annexation before any approval is given. Mr. Brander felt that it is not up to the C©uncil to back this company. Mr. Mako and Mr. Jensen felt that this should be tabled"for a week to find out how New Market .felt about annexation of this property by Lakeville. ~1) CITY OF LAK~'VILLE COUNCIL MEETING JULY 15, 197+ 7~+.~+09 Motion by'Clarkson seeonded`by Jensen to table this matter until the proper, petitions and resolutions are passed on to the Minnesota Municipal Commission for'reviewal and their decisions for or against the annexation. Clarkson "aye", Mako, Jensen, ~rnond and Brander "nay", motion failed. 7~+.~+10 Motion by Mako seconded by Clarkson to table this matter until the 22nd of July at 10:00 P.M. for more information to be obtained from. New Market and until a contract is prepared that will contain the manner in which the manure .:will be dirposed and also-.the educational portion and a Planned Unit Development plan. Jensen, E~?ond, Clarkson, Brander and Mako "aye", motion carried. Frank:Klingelhut and Vincent Grant appeared before the 'Council to discuss the future use of their land north of Ritter Park .and west of the Freeway,. They both said that. they. had no plans for the. property at present. 7~+.~F11 Motion by Jensen seconded by Mako to authorize the .Park Committee to appear at the Metro Council meeting to make a-request for. funds in regard to the possible purchase of this land, Emond, Clarkson, Brander, Mako and Jensen "aye", motion carried. Mr.' Frigaard presented the tennis court plans to the Council and said they would have four alternate bids and that the Council can select whichever one they wish. `7.412 Motion by Eanond seconded by Brander to approve the plans and specs for the tennis courts and to set the bid letting date for Thursday, August 1. Clarkson, Brander, Mako, <Jensen and Ehnond "aye", emotion carries. 7~+.~+13 Motion by E~nond seconded. by Clarkson to .use Utility Trunk Funds to finance future bonded-improvements. Brander, Mako, Jensen, Emond and Clarkson."aye", motion carried. 7~+.~+1# Motion by Mako seconded`by Clarkson to`instruet the developers of Wildwood Ponds to resubmit their plat to the Planning Commission, Park Committee and Sewer and. Water Committee.. Mako, Jensen, ~nond,:Clarkson and Brander "aye", motion carried. 7~+.~+15 Motion by Jensen seconded by Clarkson to set the policy of reading the proposed ordinances at one meeting and adopting the same at the next meeting. Jensen,.,, FYnond, Clarkson, Brander and'Mako "aye", motion. carried. Mr. Farrell recommended that the Highview Avenue bids be held over until the first meeting. in August. He also told the Council that he had written to the Rosemount School Board regarding the. joint powers-agreement but. had .not. heard back. The boat traffic on Lake Marion and the. safety problems were discussed. The.. Public Works Director said that it was the responsibility of the County Sheriff's' Department o patrol the lake but they were not doing anything about enforcing the`lawr. It was mentioned that an ordinance could be passed to regulatethe. use of he lake. Joe Selmer said that it is dangerous to be'out on 'the lake. He'also said that he would be willing to help.. patrol. It was felt that the Public Works Director and the Antler's Parke Administrator should make a report and see -`what can be done to take care of this situation. Mr. Jensen will contact the County Commissioners regarding the patrolling of the lake: 7~+.~+16 Motion by`Jenren seconded by Mako to authorize a study of the boat situation:' on the two lakes and return by the 15th of September with this report. Mr. Farrell reported that the City is being sued by G & G Builders, Inc, and that a hearing is being held on Tuesday at which time-it is expected that the Ehvronmental,Qualty Committee would. probably. move for a change of 'venue. ~2) } CITY OF L.AI~TIT.T.F COUNCIL MEETING JULY 15, 197+ 7~+.~+17 Motion by Brandes seconded by Clarkson that the-City approve the purchase of the tapes and films which were taken by Mr. Paul Oxley at a cost of approximately $60.00.
