HomeMy WebLinkAbout01-18-01 CITY OF LAKEVILLE Planning Commission Meeting Minutes JANUARY 18, 2001 The January 18, 2001 Planning Commission meeting was called to order by Chair Drotning in the City Hall Council Chambers at 6:00 p.m. Roll call of members was taken: Present: Michaud, Bellows, Drotning, Comer, Detjen, Wulff, Ex-Officio Commission Member Puncochar. Absent: Kot Staff Present: Arlyn trussing, Community & Economic Development Director; Daryl Morey, Assistant Community Development Director; Ron Mullenbach, Associate Planner; Tim Hanson, Assistant City Engineer; Andrea McDowell Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. The January 4, 2001 Planning Commission meeting minutes were approved as presented. ITEM 4. Announcements Assistant Community Development Director Daryl Morey indicated that a revised agenda was given to the Commission adding 6(c), the vacation of existing • easements, under the HOM Furniture public hearing, along with minutes from the Park and Recreation Advisory Committee meeting from January 17, 2001 regarding HOM Furniture. Also distributed to the Commission was a corrected copy of the Rock Island Townhomes Association resolution which includes the two internal private trails proposed to be eliminated as part of the PUD amendment request. ITEM 5. Public Hearing: Rock Island Association Chair Drotning opened the public hearing for consideration of the application of John C. Sullivan, representing the Rock Island Association for a planned unit development (PUD) amendment to allow the elimination of planned internal private trails in Rock Island Townhomes, located south of Klamath Trail and adjacent to Kings Court. Assistant City Attorney Poehler attested that the legal notice had been mailed and duly published in accordance with state statutes. Mr. Bill Jorgenson was in attendance and presented the application to amend the Rock Island Townhomes planned unit development (PUD) to not require the construction of two internal private trails that are shown on the PUD plans approved by the City Council on November 6,1995. Planning Commission Meeting January 18, 2001 Page 2 Mr. Jorgenson stated that the homeowners association feels that the. trails are not functional and wori t meetthe needs of the Rock Island Townhomes residents. The homeowners association also feels that there are security, liability -and privacy issues associated with the planned trails, Assistant Community Development Director Daryl Morey, presented an overview of the Planning Report regarding Rock Island Townhomes for a planned unit development (PUD) amendment. Mr. Morey stated that the Rock Island Townhomes development consists of 42 townhouse. units located south of Klamath Trail across from the Chart House restaurant. Forty of the 42 townhouse units ..have been built or are under .construction. Mr. Morey stated that the two private internal .trails were proposed by the developer, the Sienna Corporation, on the Rock Island Townhomes PUD plans approved by the City Council. As such, Mr. Morey. indicated the request not to construct the trails requires City Council approval of an amendment to the Rock Island Townhomes planned unit development. Mr. Morey pointed out the trail • locations on a map of the site. 1VIr. Morey indicated that the two trails were proposed by the developer for the benefit of the residents of the Rock Island Townhomes development. They were planned purely for leisurely use by the townhome residents.. Mr. Morey stated that they do not provide a public benefit nor .are they a vital link to the City's trail system. Mr. Morey stated that there is an existing sidewalk on the west side of Kings Court that connects tothe city trail located on the south side of Klamath Trail. This trail extends to the west and north to Orchard Lake Elementary School and to the east to connect with the trails located along Kenwood Trail (C.R. 5). Mr. Morey indicated that the homeowners association feels that the two trails will offer little benefit to the Rock Island Townhome residents. In addition they feel that the trails will infringe upon the privacy. of the townhouse units located in close proximity... - Mr. Morey indicated that at .its October 25, 2000 meeting,. the Rock .Island Townhomes Association voted to eliminate the private trails and obtain; the necessary approvals :from the City to accommodate the recommendation of the association.. Planning Commission Meeting ^ . - January 18,' 2001 , Page 3 Mr. Morey stated that the resolution in the Planning Commission packets .does not reference both trails. The corrected copy of the resolution, which includes both trails, has been handed out at tonight's meeting. Mr. Morey also indicated that the Parks and Recreation Advisory Committee supports the elimination of the two planned, internal trails. Mr. Morey stated that Community and Economic Development Department staff recommends approval of the amendment to the Rock Island Townhomes planned unit development not to construct the two internal privatetrails. Chair Drotning opened the hearing to the public for comment. There were no comments from the audience. .01.08 MOTION by Bellows, Second by Comer to close the public hearing at 6:10 p.m. Ayes: Michaud, Bellows, Drotning, Comer, Detjen, Wulff. Nays: 0. Chair Drotning confirmed. that these trails. are not a vital link to the City's. trail system in any way. Mr. Morey stated that this was correct. 01.09 MOTION by Detjen, Second by Comerto recommend. to the City Council approval of the planned unit development (PUD) amendment to allow the elimination of planned internal private trails in Rock Island Townhomes, located south of Klamath Trail and adjacent to Kings Court. Ayes: Bellows, Drotning, Comer, Detjen, Wulff, Michaud Nays: 0 I'rE1~ 6: Public Hearing: HOM Furniture Chair Drotning opened the public hearing for consideration of the application of HOM Furniture for a Preliminary and Final Plat of One Lot and. Two. Outlots to be known as HOM Furniture, Conditional Use Permits to allow: 1. Building Height in excess of 35 feet in-the C-3, General Commercial District. 2. Outdoor Sales in the C-3, General Commercial District. 3. Loading Docks Adjacent to Kenyon Avenue; and the Vacation of Public Easements. Assistant City Attorney Poehler attested that the legal. notice had been. mailed and duly published in accordance with. state. statutes. Planning Commission Meeting - January 18, 2001 -Page 4 Wayne Johansen and ,Ralph Kloiber from HOM Furniture, Michael Diem,. the project architect, and Harold Ericksen, the project. engineer were in attendance to represent HOM Furniture. Mr. Johansen stated that. the proposed. store will be the largest HOM Furniture store in the state of Minnesota. Mr. Johansen indicated that traffic should not be a problem due to the. fact that they don't open until 9:30 a.m., which is after the morning rush hour ends and they close by 9:00 p.m., which. is after the evening rush hour ends.. The store will. face Interstate 35 and the parking lot .lights will be turned .off by 10:00 p.m. Mr. Johansen stated that HOM Furniture owns the property and HOM takes pride.. in it's ownership... The building has a .signature look, with the tilt up panel construction and the high store front. Associate Planner Ron Mullenbach presented an overview of the Planning Report regarding S & J Partnership's application for a Preliminary. and Final Plat, Conditional Use Permits and vacation of Public Easements. • Mr. Mullenbach. stated that S & J Partnership, L.L.P. is proposing to construct. an approximately 151,000 square foot furniture store on six acres of land, .located between County Road 5 and Kenyon Avenue north of AmericInn. In conjunction with this project, S & J Partnership, L.L.P. representatives have submitted applications for the preliminary and final plat of one lot. and two outlots to be known as HOM Furniture and three conditional use permits to facilitate the design of the project and the realignment of Kenyon Avenue. Mr. Mullenbach stated that the existing home, farm buildings, and related structures will be removed with the development. Mr. Mullenbach stated that the proposed HOM Furniture commercial development. is consistent with the commercial land use identified on the 2020 Land Use Plan and Planning District 1 recommendations of the 1998 comprehensive Plan Update. Mr. Mullenbach indicated .that the proposed development includes an important .segment of the recommended interchange improvements at Interstate 35 and County RoadSO/5. HOM Furniture is dedicating over 2 acres of right-of-way from their 10.41 acre parent parcel to accommodate the realignment of Kenyon Avenue to access C.R.- 5 north of AmericInn. January 18, 2001 ^ . .Page 5 • The City of Lakeville and Dakota County are proposing a public improvement project to reconstruct Kenyon Avenue to an urban section from Celebration Church to County Road 5 along the new. alignment... In addition, the current Kenyon Avenue access to County Road 5 would .be removed and. replaced by a cul-de-sac adjacent to the' Cracker Barrel restaurant. HOM Furniture representatives and the two property owners directly to the north (Russell Streefland and Lowell Lundstrom Ministries) have tentatively agreed - to enter into special assessment agreements to support the public improvement project.. In addition, representatives of Cracker Barrel and AmericInn have agreed to 'the proposed realignment and cul-de-sac street in front of their properties. Mr. Mullenbach stated that the proposed furniture store use is required to provide one parking space/400 square feet of building floor area for the first 25,000 square feet and one parking space/600 square feet of building floor area thereafter. The developer is proposing a .total of 300 parking spaces, .far exceeding minimum . parking requirements.. The required parking for furniture stores is approximately 1/3 the requirement for general retail uses, consistent with the lower intensity use of a furniture store. Mr. Mullenbach indicated that the developer is proposing two driveway accesses to Kenyon Avenue for Lot 1, one driveway access for Outlot B, and one joint driveway access between Lot 1 and Outlot B. The westerly driveway, which is intended for truck traffic only, is 35 feet in width. The second proposed HOM Furniture driveway access which is intended for customer traffic, is 24 feet in width and is located. approximately 85 feet from -the westerly .driveway. The driveway locations have been designed to segregate truck. and customer parking, provide reasonable access and circulation on Lot 1 and Outlot B, and to provide .maximum separation of the driveways. from the new "T" intersection that will be created.. by the Kenyon. Avenue realignment and the new cul-de-sac leading to AmericInn and Cracker Barrel. Mr. Mullenbach stated that Engineering Department. staff has determined that the .proposed driveways are acceptableprovided ashared driveway access easement is provided fora the joint driveway .access between Lot 1 and Outlot B, the customer traffic driveways are expanded from 24 feet to 32 feet in width,. and the .joint driveway is constructed with development of the furniture store. Mr. Mullenbach- stated .that the developer has submitted a landscape plan which identifies building foundation plantings, corridor plantings along Kenyon Avenue • and County Road 5 (Kenwood Trail) and staggered evergreen screening .adjacent to Planning Commission Meeting January 18, 2001 Page 6 • the Kenwood Park and single family homes to .the north and the AmericInn site to :the south. Mr. Mullenbach stated that the developer is proposing a combination of white oak and pin oak trees along Kenyon Avenue .and. County. Road 5. Both species of trees are identified as signature plants in the Corridor and Gateway Design Study. As recommended by residents at the neighborhood meeting, the developer and .city staff agreed that some of the Colorado Blue Spruce trees proposed adjacent to Kenmore Park will be planted on the .top of the slope within the park. The location of the plantings will be agreed -upon between the developer and City staff at the time of installation. Mr. Mullenbach stated that the developer is proposing an outdoor .sales area approximately 2,500 square feet in size.. The developer is requesting to utilize the outdoor sales area for the display and sale of seasonal patio furniture from Apri115 November 15. A modification to the wording of stipulation m. of the January 12, 2001 Planning Report is necessary to incorporate.. the developer's. requested time frame. • Mr. Mullenbach stated that there .will. be a 3-stall loading area with a maximum ..height of the loading dock doors of 12 feet on the south sideof the building facing. Kenyon .Avenue. The developer is proposing a 13 foot high masonry screening wall and a row of techny arborvitae shrubs to screen the loading area. Mr. Mullenbach stated. that the developer is proposing to vacate underlying public drainage and utility and roadway easements in conjunction with the final plat of HOM Furniture. The easements will be replaced by platted right-of-way on the final plat. Mr. Mullenbach stated that .there was a neighborhood meeting for the proposed development hosted by the .developer at the .Chart House restaurant on Tuesday, January 9, 2001. Approximately 20 people were in attendance. He indicated that there was one stipulation that was recommended based on .the .input provided at he neighborhood meeting: The row of Colorado blue spruce trees adjacent to Kenmore Park shall be planted within Kenmore Park.. The specific location shall be determined by the City Parks and Recreation Director at the time of installation. The Park & Recreation Advisory Committee reviewed the plat at their January 17, • 2001 meeting and recommended. approval, subject to a cash contribution. Planning Commission Meeting - January 18, 2001 Page 7 Mr. Mullenbach stated that should the Planning Commission recommend approval of the HOM Furniture preliminary and final plat and conditional use permit, Community and Economic `Development- Department staff .recommends .the 14 stipulations listed in the January 12, 2001 Planning Report with a modification to recommendation. MOTION by Comer, Second by Wulff,. to close the public hearing at 6:30 p.m. Ayes: Drotning, Comer, Detjen, Wulff, Michaud, Bellows Nays:. 0. :Commissioner Wulff asked .about access to the .non-conforming homes located in the C-3 District north of the HO1VI Furniture .site :when they redevelop to a conforming use.. • Mr. Mullenbach stated that the four lots are owned b two eo le. The lots will. Y P P most likely be combined in some fashion and will be allowed to only access 170 Street. Commissioner Wulff wanted to know if there will be trees to screen the outside sales area. Mr.1Vlullenbach stated that a vinyl, white picket fence would go around the outdoor sales area. The combination of the proposed vinyl fence and evergreen trees will effectively screen the outdoor sales area. .Commissioner Detjen asked. if a no through traffic sign will be installed for the proposed cul-de-sac street. Mr. Mullenbach confirmed that there will be a dead end sign placed at the entrance to the new eul-de-sac street. Commissioner Detjen asked if there. will be adequate space between the delivery area and the public driveway access. Mr. Mullenbach stated that there is 85 feet of maneuvering room. Atypical loading area is 70 feet long. The developer will be softening curbs to improve turning movements and site circulation. Commissioner Comer questioned the speed limit and the curve of proposed .Kenyon Avenue in front of AmericInn. Mr. Hanson stated .that Kenyon Avenue • Planning Commission Meeting ^ - Januaryl8, 2001 Page 8 will .:have a 30 mph. speed.. limit after the road realignment and designed to .accommodate 30 mph traffic. Commissioner Michaud asked about HOM Furniture wall sign #2. Mr. Mullenbach stated that the visual preference is 150 square feet (10' x 15') of sign area. The ~ - developers. have agreed to this reduced size. Chair Drotning asked about the extension of the trail to 170 Street. Mr. Mullenbach stated that some residents in the area have requested that the trail on County Road 5 be extended all the .way to 170~_Street. The City Engineer has agreed to pursue this connection, which will require acquisition of easements from adjacent property owners... Chair Drotning asked if there is enough room to add a right turn lane on Kenyon Avenue. Mr. Hanson stated that the road- design will allow right-turn lanes in the striped shoulder area. . 01.11 MOTION by Wulff, Second. by Comer to recommend to the City Council approval of the HOM Furniture .preliminary and final plat of one lot and two outlots to be known as HOM Furniture, located between County Road 5 and Kenyon Avenue, south of 170 Street, the Conditional Use Permits to allow: 1) building height in excess of 35 feet in the C-3, General. Commercial District; 2) outdoor sales in the C-3, General Commercial .District; 3) and allow loading :docks adjacent to Kenyon Avenue, and the. vacation of public easements, subject to the 14 stipulations listed in the January 12, 2001. Planning Report, with a modification to stipulation m., changing the dates of operation for the outside sales area to April 15 through November 15, and approval of the Findings of Fact dated January 18, 2001.
