• Planning Commission Work Session
February 15, 2001

Present: Chair Karl Drotning; Commissioners Thomas Michaud, Sharon Kot, Jerry
Comer, Gerald Grenz, Wendy Wulff, and ex-officio Jim Puncochar.
Absent: Commissioners David Bellows and Dale Detjen.
Staff: Assistant Community Development Director Daryl Morey; Assistant City
Attorney Andrea McDowell Poehler and. Recording Secretary.. Penny Brevig.
Chair Drotning called the work session to order at 7:00 p.m.
Mark and Anita Sprung e-mailed the attached memo, dated February 15, 2001 to the
Community and Economic Development staff, which was distributed to the Planning
Commission before tonight's meeting.
Chair Drotning stated that the purpose of the work session was to give the Planning
Commission an opportunity to informally discuss with Mark and Anita. Sprung, and
• their architect Geoffrey Warner, the proposal for expanding their non-conforming.
house located at 9878 -199 Street West.
Chair Drotning explained the conditional use permit and variance process as .well. as
Shoreland Overlay District requirements to Mark and. Anita Sprung and to Mr. Warner.
Chair Drotning indicated to the Sprungs and Mr. Warner that conditional use permits
have been approved around Lake Marion and Orchard Lake since 1990 only in
situations that met Shoreland Overlay District requirements and where existingnon-
conformities were brought into conformance with Zoning Ordinance requirements.
Chair Drotning. explained the undue hardship criteria that must be met .for all variance
requests. The Planning Commission members. felt that. the Sprungs are unable to
demonstrate an undue hardship for. this proposed addition.
The Planning Commission discussed the six existing non-conformities related to the
Sprungs property as identified in Associate Planner Frank Dempsey's February 9, 2001
memo to the Planning Commission.
1. The existing porch does not meet the minimum 30 foot setback to the front property line.
The corner of the porch encroaches into the required front yard setback by
approximately 6 feet. The Sprungs questioned whether the porch was
constructed before the 199 Street cul-de-sac was constructed. Mr. Morey stated

that is irrelevant because the setback is from the platted property line, not the
street surface. The Planning Commission members stated that they would
support the conditional use permit to expand the house provided the Sprungs
meet the 30 foot setback requirement to the front property line.
2. The house does not meet the minimum 10 foot setback to the west side property. line.
Chair Drotningstated this. is not an issue as long as the proposed addition meets
setback requirements.
3. The property has an existing impervious surface area of 29.2
Chair Drotning stated that a maximum impervious surface area of 25% is
allowed in the Shoreland Overlay District. The Sprungs plan to reduce existing
impervious surface areas to meet this requirement..
4. The detached garage does not meet the minimum 10 foot side and rear yard setback..
Chair Drotning stated this is not an issue as long as the Sprungs are not adding
onto the garage. The Sprungs stated. that they plan only on re-siding the garage..
• 5. There is an above-grade patio deck located within 75 feet of the Lake Marion OHWL.
Chair Drotning and Mr. Morey stated that staff and the Sprungs surveyor will
need to verify the elevation of this patio to determine compliance with Shoreland
Overlay District. requirements.
6. The lofarea is 15,398 square feet. The minimum lot area requirements 20,000 square
feet for lots that abut the. lake.
Lot area is not. an issue with this request because the lot is an existing parcel o£
record.
Chair Drotning and the Planning Commission members stated that they would support
a Conditional Use Permit request for a house addition provided the addition meets all
setback requirements and the impervious surface area is reduced to a maximum of 25%.
The work session was adjourned at 8:15 p.m.
