Present; Brandss, Jensen., E~ndand Clarkson. Absent; Matra. ~1ao present; Robert Frgasrd, City Hngineer, Pa~'Farrell and Roger gsutson, City Attorney's and Richard Hogan., .City Administrator. 74.x+52 Motion.. by Bramdes seconded by Clarkson to accept the mira~tea of the Augti~at 5 1974 meeting as presented. Hrandes, Jensen,,H~and and Clarkson "aye", matic9n carried. Mr'Ackerman presented his building report for July and presentetdvarious other items such as obtaix~iing easements. and weeds t~.ich-were discussed. Mr. Frigaard presented his current engineering report and explained it to the Council. The minutes of the Special Plabnix~g Commission meeting of Aug. 2,_were presented..... It was decided to discuss these later in the meeting as Mr. €ssphart was not present, A letter from Qreo. M. Mr. Leonard Bentson, representing,the persons requesting the rezoning for the warehouse, explained the reasons ~W tl?is is being asked.. ~ ~eph~rt's planner-explanedwhat is proposed for the addition. Mr. Bentson explained that all necessary easements would be furnished the City if a railroad erc~saing could be abed on ~liday Ave. Thin wfluld furnish another route to FLighteay ~j© from-the col-de-sae. Mr. Na~alkenburg, representibg the concerned homeowners, questicrnQd the legality of this hearing,.before:.the Council. Fie feels that a warehouse does not .belong in a residential area. Mr. Clint Czbss asked how the city planner could justify this type of building in a residential area. Fie also. stated that this is a fire ha$ard`as no spinkl.er system had eYer been installed. He also feels this would redoes the valuation of the homes and that this crossing wi~.l not help the traffic situation. Mra Lewis cad Mrs. Webber questi€aned the use of Flghwap for the children to school. Audrey Johnson is concerned about Qephart's dondueting a Levitz type operation... Mr. t~ephart said that only one. or two sales are cesdaeis~d ~ year. kRr " Bentson said that if the road is constructed, the. Gepharts would be willing is pay a fair share. Mr. Farrell advised the Coumcil of the followi.x~a 1. a 4/5th vote is necessary for a rezoning, 2. application is for B-4 which does riot restrict this as a special use p®rmit would and 3. iri the event of a denial,. the Couaeil should enumerate as clearly as possible cad list as reasons for denial as necessary. Mr. Clarkson and Ab". Jensen felt thatthe railroad evossing would have to be a prerequisite fc~r this rezoning... Dr. O'Brian salted.: where the Ciepharts would go from here if thin warehouse proves inadequate. Mr. VanVal.kenburg acid he is not optimistic about a crossing.and he also stated that-he would not change la.is position .regarding this re$oaing seen if there , is a railroad crossing.. N~yrtle Sorenson acid that she felt. the valuation of her home would drop if this land were rezoned and Mrs. Webber said that shy: feels the Council should consider. the feelings of the. people 3.n-the'matter. ~l) o CITY OF LAKEVZLLE COUNCIL ME~:FTING AUGUST 12, 197 Marianne Curry* felt that thin rezoning. does not hinge on this option and Mr. VanValkenburg said he'would not change his position even if there is a railroad erosaing. 7~+.~+55 Motion by Brandes seconded by fond to table this matter for one week. Clarkson:, Brandes,.Jensen and fond "aye", motion carried. The Peddlers Ordinance was read and discussed with sosae corrections suggested to the attorney. Mr Radermacher was present and stated what the. problems are in the City and why he is requesting this ordinance. This ordinance was plated on the September..3 Agenda fgr consideration. Phgliss Jojade presented a Bi-Centennial report and asked if the Coucil would authorize funds for ..stationery-andstamps. 7~+.~56 Motion by Clarkson seconded by Brandes to authorize the expenditure of up to 5a by the Bi-Centennial Committee for atatianery and stamps.. Brandea, Jensen,:Emendand Clarkson ".aye", motion carried. Mr.- Steve`f~ ski requested information. from. the Council regarding Lakerid,~e Plat and whether aby action could be taken at this time.. Mr, Robinette said that he had filed assessment with the Eavironmental Qnalty. Council and the end result is that they do not feel a statement..will be required and that: theretomndations of the assessment should be complied with and any ether estate :agency requirements also. should. be complied with by G & G Builders. 74.x+57 Motion. by Jensen. seconded: by Emend to grant a eontnu.ax~ce of .this Witter for one week so that the attorney and the Public. Mr. Steve Qrohoski said that they had net expected a d+eeision at this time but :would like to know what the continuing ab~ectionswereand also what the bonding ~quirements for sidewalks, sewer and water would be. Mr. Robinette feels. that something should be done. quickly about the erosion problem. 7~+.~+~£3 l+~otion by Pmond seconded by Brandes to approve the list of the election judges as presented.
