Absent; Clarkson. Also preaent; Richard Hogan, Administrator, Robert Frgaard, City Engineer and Pat Farrell and Roger Knutson,..City..Attorneys. 7+•553 Motion by Brander seconded by Mako to accept the minutes of the Se~atember 17, 197 meeting.- Brander, Mako, Jensen and Emond "aye", motion carried. 7~,55~ Motion by M~ako aeconded by Brander to accept the minutes of the special October 2, 197+ meeting. Brander, Mako, Jensen and Emend "aye", motion. carried. 7.566 Motion by E~ond seconded by Breeder to adopt the following resolution: Whereas the Council has been informed by the City Attorney that the publication relative tm the vacation of .that portion of 209th Street, formerly known as Elm Street and also formerly knovm as Front Street, lying Northerly of Lots 5, 6, 7, 8, 9. and 10 of Sorenson's Addition, lying southerly of the St. Paul railroad right of wag, lying Easterly. of the Northerly. extension of the Westerly .Lot. line of Lot 5 of Sorensen's Addition, and lying Westerly of the Northerly extension of the Easterly Lot line of Lot 10 of Sorensen's Addition, all in 'the City of Lakeeille, Dakota C~+urity, Minnesota for Wren, Inc. was not according to state statute, and .Whereas,. the City Attorney has advised that said earlier vacation is invalids.. ~l) ~ CITE OF LAIO?V1:LLE COUATCIL M' ING OCTOBER. 7, 197+ NOW THEREFORE Be it it .resolved the .City Council of Lakeville reconsider the .resolution vacating the abo4e described street dated September'17,, 197+, and appearing as item 7~+.54~2~, be and hereby is revoked. Mako, Jensen, Emond and Brands "aye", motion carried. 7+.567 Motion by Mako seconded by Brander to adapt .the resolution vacating a portion of 20gth Street as dereribed on the attached resolution. Jensen, Emond, Brander, and Mako "aye", motion carried. 7+.568 Motion by Eo~ond seconded by Mako to authorise the ffiayor to sign the lettere and adopt thexesolutian supporting the continuation of general revenue shara~g funds. resolution attached.. Brander, Mako~ Jensen and Emond "aye",.motion carried. 74.570 Motion by Mako seconded by Brander to authorize. the administrator and the clerk to investigate the possibility of plaea.ng the City money in a bank other. than. the First National Bank of Lakeville if to the advantage of the City and to report back by the. first meeting in December. Mako, Jenren~ Emond and Brander "aye"~ motion carried. 7.571 Motion by Mako seconded by Emond to grant the new owners of Sea Girt Iran, Richard Holetz and James F. Brake , a set-up license and on and ofY sale beer licenses subject to the bond. Jensen Em~+nd, Brander and I~ako "aye", motion carried. 74.572... Motion by E~?nd seconded by Mako to accept the petition of C. N. Peterson of Oak Shares with.. the request to hook. up to the Burnsville water system. Emond, Hrandes, Mako and Jensen "aye", motion carried. 74.573 Motion by Mako seconded by Brander to refer the above petition to the Water & Sewer Committee for a recommendation. Brander, Mako, Jensen and Eiaaond "aye", motion carried. 74.574 Motion by Emond seconded by Brander to adopt as policy that all petitions for water and sewer be referred immediately to the Water and Sewer Committee for recoms~ndation. Mako, Jensen, Emond and Brander "aye", motion carried. The matter of the City financing of water and sewer laterals to new additions was discussed. It waa decided that the administrator would channel this matter -to the proper committees for a recommendation. Mr. Walters of the First A~ilwaukee Bank appeared in regard to the valley Park matter. He reported that the blacktop contract-.had been awarded to Alexander Coast. Cc. He also: reported that the swimming pools are owned eoliectvely bq three different firma. Mr. Farrell advised that this could be declared a public health hazard and the Rtblic Works Director could sign a complaint er the City ,could proceed. to take the x~ecesrarq steps to improve. the properties. e amendment to Ordinance No. 73 was read. The proposed 'budget for 1975 was read and discussed. 7+•575 Motion by Mako seconded by Brander to adopt the proposed budget with the actual adoption on the budget to be on the 15th of October. Jensen Emond, Brander and.Mako "aye", motion carried. The amendment to Ordinance No. 33 was read. 74.576 Motion by Emond seconded by Mako to place the remaining items on the agenda on the October"15 agenda...
