Planning Commission Meeting Minutes .
APRIL 5, 2001
The April 5, 2001 Planning Commission meeting was called to order by Chair
Drotning in the City Hall Council Chambers at 6:00 p.m.
Roll. call `of members was taken:
Present: Michaud, Bellows, Grenz, Drotning, Comer, Detjen, Wulff, Puncochar
Absent: Kot
Staff Present: Arlyn Grossing, Director of Community and Economic
Development; .Leif Hanson, Zoning Enforcement Coordinator; Dennis Feller,:
Finance Director; Andrea Poehler, Assistant City Attorney; and Penny Brevg,
Recording Secretary.
ITEM 3: APPROVAL OF MEETING MINUTES:
The March 22, 2001 Planning Commission meeting minutes were .approved. as
presented.
Commissioner Jerry Comer formally apologized to the Planning .Commission "for
my critical and. harsh comments I made at the last .meeting."

ITEM 4: ANNOUNCEMENTS:

staff before tonight's meeting:

resource of Lake Marion and the surrounding property.
ITEM 5. TIF DisTRicT No. 9 AND No. 10

B. Tax Increment Financing District No. 10
-consideration of the Resolution of the Lakeville Planning Commission Finding
the proposal for Amendment to Tax Increment Financing Plan for Tax
.Increment Financing District No.10 to be consistent with the Lakeville
Transportation Plan andthe Comprehensive Plan of the City.
Finance Director Dennis Feller addressed the Planning Commission..
Mr. Feller stated that the House File .187 and Senate File 73 states that any
amendments for .the tax increment plans certified prior to .May 1990 can only be
amended up to April. 30, 2001. All spending and/or issuance of debt must be
completed by April..30, 2002.
Mr. Feller indicated .that Tax Increment Financing (TIF) District No. 9, which is also
known as Argonne Plaza, was created in May 1988. The increments from the
Argonne Plaza (Taco .Bell and adjoining .parcels) are pledged to financing future
public improvements within the Redevelopment Project Area..
• Mr. Feller stated. that the proposed Amendment No. 1 to TIF District No, 9
authorizes the appropriation of the tax. increment revenues for the acquisition of a
parcel for future right-of-way on 175 Street and Junelle Path. The proposed right-
of-way acquisition. is an integral part of .the County Road 50/175 Street/I-35
interchange improvement. project.
Mr. Feller indicated that the future improvements to the I-35/County Road 50
interchange are consistent with the Comprehensive Transportation Plan.
Mr. Feller stated that TIF District No. 10, also referred to as Fairfield Business
Campus, was created in April 1989. Mr. Feller stated than the proposed
Amendment to TIF District No. 10 authorizes the appropriation of the tax
increment .revenues, to the extent that such revenues are available after the.
payment of the existing debt and fiscal disparities, for improvements to the I-35 and
County Road 70 intersection. The proposed improvement project, Mr. Feller
indicated, will eliminate unsafe conditions and reduce traffic hazards.
Mr.- Feller stated that all infrastructure improvements for Fairfield Business
Campus are complete. The Iast tenant, D.R. Horton, will complete their facility this
year. Mr. Feller indicated .that the proposed I-35/County Road 70 improvements
are consistent with the Lakeville Transportation Plan and the Comprehensive Plan.

01.29 MoTION.by Wulff, Second by Comer to recommend to the City Council approval of
.the Resolution of the Lakeville Planning Commission Finding the proposal for
Amendment to Tax Increment Financing Plan for Tax Increment Financing District.
No. 9 and District No. 10 to be consistent with the Comprehensive Plan of the City.
Ayes:. Michaud, Bellows, Grenz, Comer, Detjen, Wulff.
Nays: 0.
Chair Drotning abstained from the vote due to an interest in one of the adjacent
parcels.
ITEM 6: PUBLIC HEARING: INDEPENDENT SCHOOL DISTRICT NO.194 CUP
AMENDMENT
Chair.. Drotning opened the public hearing. for consideration of the application of
Independent School District No. 194 for an amendment to Conditional Use Permit
No. 93-02 to allow the construction of driveway turn-lanes and a sidewalk. at
• Lakeview Elementary, located at 20500 Jacquard. Avenue. Assistant City Attorney
Andrea Poehler attested that the legal notice had been duly published in
accordance with state statutes.
Mr. Stan Fredrickson, Head Grounds Keeper for ISD #194, was in attendance to
represent the .school.. district and Lakeview Elementary for an amendment to
Conditional Use Permit No. 93-02. Mr. Fredrickson stated that the reason they
were proposing to .add the driveway. turn-lane was because of the .heavy traffic
.back-ups during peak hours of the school day. He indicated the. reason for the
proposed sidewalk construction on the south side of the existing parking .lot is so
the children walking to school from the neighborhood to the south wori t have to
cross the school's driveway access at Jacquard to enter the school .building.
Mr. Leif" Hanson, .Zoning Enforcement Coordinator presented an overview of the
Planning Report regarding an amendment to Conditional Use Permit No. 93-02 to
allow the construction of a driveway turn-lane and a sidewalk at Lakeview
Elementary.
Mr. Hanson stated that Lakeview Elementary School was constructed in 1994.: A
Conditional Use Permit was approved by the City Council in 1993 to allow the
school to be located in the RS-3, Single. Family Residential District.

Mr. Hanson. indicated that ISD 194 wants to add an exclusive. right turn-lane to
their existing driveway onto Jacquard Avenue, which is located on the west side of
the school's property, and also to add a sidewalk that will run along the south edge
of the school's existing driveway.
Mr. Hanson stated that Lakeview Elementary School is located at the southeast
corner of 205 Street West and Jacquard Avenue. The only driveway to the school
is located on jacquard Avenue, which borders the west side of the school's property.
and is designated as a major collector in the City's Transportation Plan. The
driveway currently has one entrance lane and one exit lane.
Mr. Hanson stated that the school is proposing to widen the driveway and install
an additional exit lane designated for right-turns onto Jacquard Avenue. The
existing. exit .lane will then be designated for left-turn exits onto. Jacquard.. .The
purpose of the additional exit lane, Mr. Hanson stated, is to help ease traffic
congestion within the school's site.
• Mr. Hanson stated that there is an existing Iight pole located on the north side of
the driveway that will interfere with the addition of a right'turn-lane and will be
moved approximately fifteen feet. to the north.. Mr. Hanson also stated that the
existing light poles, located in the middle of the new sidewalk on the proposed
plan, will be moved to the south edge of the new sidewalk.
Mr. Hanson indicated that the sidewalk that currently runs along the north edge of
the driveway will be relocated to accommodate the new .right turn-lane with the
.relocated sidewalk adjacent to the north edge of the new right turn-lane.
Mr. Hanson stated that Lakeview Elementary is also proposing to install a sidewalk
that will run along the south edge of the driveway. The purpose of the proposed
sidewalk is to provide a safe access for pedestrians to the school site.
Mr. Hanson. stated that the new sidewalk (8' asphalt) will connect the existing
sidewalk that borders Jacquard Avenue to an existing City .trail located on the east
side of the school's parking lot.

Mr. Hanson indicated that the coniferous trees that were required to be installed
along the south edge of the school's site with the original Conditional Use Permit
must be replaced if they are removed due to the construction of the sidewalk.
Parks and Recreation Director Steve Michaud and Assistant City Engineer Tim
Hanson. have reviewed the applications for. Lakeview Elementary and recommend
-approval of the school's request.
Mr. Hanson stated that .should the Planning Commission recommend to City
Council approval of the Conditional Use Permit Amendment for Independent
School District #194, Community and Economic Development staff recommends
than the approval be subject to the three stipulations listed in the March 30, 2001
Planning Report.
There were no comments from the audience.

Nays: 0
Commissioner Wulff disclosed that the school district was a client of hers, but was
assured by the City Attorney that there is no conflict of interest.
Commissioner .Wulff asked why this school district item had to be brought to the
Planning Commission?
Community and Economic Development Director. Arlyn trussing stated that when
there is a change proposed to the site plan of an approved Conditional Use Permit,
an amendment, with a public hearing before the Planning Commission, is required.
Assistant City Attorney Poehler confirmed, that if there is an approved Conditional
Use Permit or Planned Unit Development and a change is proposed by the
property owner; it must go through the City's amendment process.
Commissioner Grenz wanted to know where the snow was going to be piled along
the new sidewalk. Mr. Fredrickson indicated that they would use a bobcat and
push the snow farther south onto the grass.

01.31 Motion by Comer, Second by Grenz to recommend to the City Council approval of
the application of Independent School District No. 194 for an amendment to
Conditional Use Permit No. 93-02 to allow the construction of driveway turn-lanes
and a sidewalk at Lakeview Elementary, located at 20500 Jacquard Avenue, subject
o the three stipulations listed in the March 30, 2001 Planning Report and the
Findings of Fact dated Apri15, 2001.
Ayes: Grenz, Drotning, Comer, Detjen, Wulff, Michaud, Bellows.
Nays: 0.

PLAN FOR TAX INCREMENT FINANCING
DISTRICT NO. 9 TO BE CONSISTENT WITH THE
COMPREHENSIVE PLAN OF THE CITY.
WHEREAS, the Housing and Redevelopment Authority in and for the City of
Lakeville (the "Authority") has proposed Amendment to Tax Increment Financing Plan
for Tax Increment Financing District. No. 9 all located within the jurisdictional limits of
the City of Lakeville, Minnesota (the "City") pursuant to Minnesota Statutes, Sections
469.001 and 469.047, inclusive, and:Minnesota.Statutes, Sections 469.1.74 to 469.179,
inclusive; and
WHEREAS, the Redevelopment Plan and Financing Plan have been submitted to
the Lakeville Planning Commission pursuant to Minnesota Statutes, Section 469.027 and
Minnesota Statutes, Section 469.175, Subd. 3(3); and
WHEREAS, the. Planning Commission has reviewed the proposed
Redevelopment Plan and Financing Plan to determine the consistency of the Plans to the
Comprehensive Plan of the City.
NOW, THEREFORE, BE IT RESOLVED b "the Lakeville Planning
