AN ORDINANCE AMENDING TITLE 11 (ZONING ORDINANCE) OF THE
!:LAKEVILLE CITY CODE ALLOWING FOR"PRIVACY FENCES FOR
DETACHED TOWNHOME DEVELOPMENTS WITHIN THE RST-2 QtSTRICT
ARPROVED PRIOR TO 5 APRIL 2004.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS:
Section 1. Section 11-57-5.A of the. Lakeville City Code is hereby
amended to read as follows:
A: All.:permitted accessory uses as Mowed within the RST 1 zoning
district, except, that:
1. Except as provided #or by Section 11-57-5.A.2 of the
Zoning Ordinance, only those accessory'buildings,
structures, or fences owned and maintained by a
:homeowners association shall be .erected on a
.common base lot for detached townhouse or two-
family dwellings.
2. For detached. townhome .unit lots of record or
preliminary .platted prior to 5 April 2004, fences may
be erected on an individual unit lot subject to the
following standards:.
a. The unit lot `has a minimum width of sixty {60}
feet and minimum area of seven thousand five
'hundred (7,500) square feet.
'b. The fence shall only be constructed of steel or
coated steel chain-link, :plastic, vinyl or other
maintenance-free material :approved by the
Zoning Administrator.
c. No fence may exceed a :height of six {6} feet.

d. If the fence,. or a combinaton.of the fence and
other structures, fully. encloses any :.portion of
the unit lot, a gate shall be :provided such that
the yard is accessible within the area of the
unit lot, but outside any,access internal to the
principal building, for maintenance access.
e. The fence shall comply with the .provisions of
Section 11-21-5 0# the Zoning Ordinance.
Section 2. Effective Date. This Ordinance hall be effective immediately
:upon its passage and publication according fio law.
