Present; Friedges, Mako, Jensen, Emond and Edwards. Also present; Robert Frigaard, Village Engineer and Pat Farrell, Village Attorney. 73.23+ Motion by Friedges seconded by Emond to approve the minutes of the April 16,'1973: meeting as presented. Friedges, Mako, Jensen, Emond and Edwards "aye", motion carried. 73.35 Motion by Mako seconded by Friedges to pay the claims against the Village, copy attached. Mako, Jensen, Emond, Edwards and Friedges 'raver',. motion carried. The Planning Commission minutes for April. 12,.1973, were presented. 73.236 Motion by Mako seconded by Edwards to deny the request of Harold Smith for a variance to build a home on Orchard Lake. Edwards and Mako "aye"', Jensen, Emond and Friedges opposed, motion failed. 73.237 Motion by Jensen seconded by Emond to follow the Planning Commission recommendation and grant Harold Smith a variance to set-backs, 25 feet at the road and 3O feet at lakeshore sub~eet to the plumbing inspector's approval and percolation tests. and subject to septic tanks being built toward the road. Emond, Friedges and Jensen "aye", Edwards and Mako opposed, mot ion carried. 73.238 Motion by Mako seconded by Emond to follow the Planning Commission recommendation and grant James Lorenzen a variance to build below grade , 2 feet, on Lot 13, Block 2, Clay's Acres. Edwards, Friedges, Mako, Jensen and Emond "aye", motion carried. 73.239 Motion by Jensen seconded by Friedges to continue the hearing for Glenn Kre,jee until May 1~F ao that the pret~etive covenant can be examined to see if it does not prohibit ax~y business in the home. This matter will be considered at that time. Friedges, Mako, Jensen, Emonc3 "aye", Edwards opposed, motion carried. The April 26, 1973, Planning Commission minutes were presented. The final plat for Jackson Heights grid Addition was presented. It was mentioned that there is a road that should be vacated. Mr. Wes Bailiff said that it appeared that the plat encroached on his father's property. It was. also mentioned that a building is on the road, 73.2+4 Motion by Jensen seconded by Edt~rares that this..matter be turned over to the Village attorney and the Dakota County surveyor for review. Mako, Jensen,. Emond, Edwards and Friedges "aye", motion carried. Mr. John MesCartt~v appeared with his plan showing the rezoning he requested. 73.21 Motion by Mako seconded by Edwards requesting that the area where the rezoning is requested be developed as a planned unit development. Jensen, Emond, Edwards, Friedges and Mako "aye", motion carried. 73.2+2 Motion by Emond seconded by Edwards to deny the recommendation of the Planning Commission and den~r the rezoning to Prairie Investment Corp for property bounded by Hwy Holyoke Ave, Emond, Edwards, Friedges, Mako and Jensen "aye", motion carried. The minutes of the Park & Recreation Com~ni.ttee for April 25, 1973, were presented. 73.2+3 Motion by Jensen seconded by Emond to .approve the recommendation of the Park Recreation Committee and authorize the expenditure of X500 for the summer community recreational program. Edwards, Friedges, Mako, Jensen and Emond "aye", motion carried. 73.2~+~+ Motion by Emend seconded by Mako to follow the Park & R~creation.Committee recommendation to dispose of the pump house on the Fischer property sub,jeet to a cover being built over the pump. Friedges, Mako, Jensen, Emond and Edwards "aye", motion carried. ~1) i VILLAGE OF L~AI~'VI COUATCTL MEETING ' MAY 7~ 1973 73.25 Motion by Mako seconded by F~mond to authorize the purchase of the necessary chemicals for the treatment of the lakes. Mako, Jensen, Emond, Edwards and Friedges "aye", motion carried. 73.2x6 Motion by Friedges seconded by ~+lalso to follow the recommendation of the Park & Recreation Cormm~ttee and purchase a grass seeder by next fall at an expenditure of up to X700. Jensen, Emond, Edwards, Friedges and Mako "aye", motion carried. The Park do Recreation minutes for April 11 were presented. 73.27 Motion by Jensen Seconded by Mayo to deny the recomm~nciation of the Park & Recreation Committee and keep the park land in Bassett`s Addition. Emend, Edwards, Friedges, Mako and Jensen "aye", motion carried. The Water & Sewer Committee report for April 18, 3973, was presented. 73.2#$ Motion by .Edwards seconded by Jensen to extend the moratorium on new plats for 15 days. Edwards, Friedges, Mako, Jensen and Emond "aye", motion Qarred. 73.2~F9 Motion by Mako seconded by Friedges to pay Mrs. Oxley $6.40 for typing the sewer and water minutes. Friedges, Mako, Jensen, Ehwnd and Edwards "aye", motion carried. Joe Williamson appeared before the council to request that something be done as Lake Marion is rising and flooding out some homes and drain fields.. Mrs. Rudiger mentioned that the lake could rise more as it had been higher at one time than it is now. The council explained that a storm sewer study would be made but this would have to wait until the cost had been included in the budget.. Mr. Maynard Johnson presented Mr. Bob Miles to the council. Mr. Miles is with Rosemount Partitions of Ariake Industrial Park and they are requesting approval of X725,000 in Industrial Revenue Bonds for purchase of their building and for expansion. .73.250 Motion by Msko seconded by Friedges to adopt the resolution giving. Preliminary approval to issue industrial revenue bonds for Rosemount Partitions. Mako, Jensen, Emond, Edwards and Friedges "aye", motion carried. Mr. Robert .Sayers gave a brief resume .regarding the colored contour maPP of Lakeville.. 73.251 Motion by Friedges seconded by Emond to purchase the basic section maps in color at a purchase price of $500, Jensen, Emond, Edwards, Friedges and Maki "aye", motion carried.: 73.252 Motion by Emond seconded by Friedges that Lakeville will take part in the Metro Rate Authority and that the resolution be adopted. Eanond, Friedges, Mako and Jensen "aye", Edwards. opposed, motion carried. Mr. Asbury from Lakeville Hills requested information as to what had been dons to enforce the building code in that ,addition. Mr. Ackerman advised that Mr. Qrohoski has promised to have the work all done by June 1. 73.253 Motion by Mako seconded by Friedges that the Village enter into discussion with George Grohoski to purchase Lots ~ ~c 5, 81oek 2, Lakeville Hills. Edwards, Friedges, Mako, Jensen and Emond "aye", emotionearr3ed. 73.25+ Motion by Jensen seconded by Edwards to appoint Mako and Friedges as a negotiating committee to purchase these two lots. Jensen, Emond and Edwards "aye", Friedges opposed and Mako abstsned, motion carried. Mr. Edwards left the meeting at 11s30 P.M. Mrs. Eleanore Wagner appeared before the council in regard to keeping boarders in her home. Mako, Jensen, Emend and Fraedges "aye", motion carried. Mr. Frigaard recommended that the council accept the bids for Glenn Addition street improvements and award the bid to the low bidder. 73.256 Motion t>y F'riedges seconded by_Msko to accept the bids on the street imps°ovemen;ts in Glenn Addition, Jensen., Emend, Friedges and Mako "aye", motion carried. 73.257 Motion by Emend seconded by' Friedges to award the bid to the low bidder, Northwest Bituminous whose bid. was $29,G42.5a. Emend, Friedges, Mako and Jensen "aye", motion carried. 73.258 Motion by Jensen seconded by Mako to approve change order No. l for the fire station extension in the amount of X155.00. Friedges, Mako, Jensen and Emend "eye", motion carried. Mr. Emend reported that the Softball Association was not goi to pursue a beer license as the cost is too high. Mr. IJicholson who presented s building plan i'or an addition to Aquarius Pools was advised 'to take them to the Planning Comression and come back 2n next Monday evening with them. . Mr. Frgasrd advised the council that it would cost approacimstely I~~~`~ to survey the road in Grshard ,ke• 73.259 Motion by Mako seconded by Jansen to authorize the Village Engineer to hire a surveyor to survey this road, Mako, Jensen, Emend and Friedges "eye", .motion carried. 73.26 p Motion by Mako seconded by Emend to approve the plans end specs for street improvements in Clay's Acres and to set a letting date for Thursday, May 31 at 2 P.M. Jensen, Emend, Fredges and Mako "aye", motion carried. .73.261 Motion try Emend seconded by Mako tc3 approve the preliminary plans for street improvements in Lakeville Hills and Sewer and Water Extension in end around the eastern shoreline of Lake. Marion. and to set a hearing dat,~ for May 30th at 8 P.M. for one and 8a3~ P.M. for the other. Emend, Friedges, Mako and Jensen Wage", motion parried. .73.26'2 Motion by L~ako seconded by Jensen to ac?snowledge receipt of the summons and complaint of Eugene Psttet. Friedges, l~ako, Jensen and Emend "aye", motion carried. 73.263 Motion by Jensen seconded by ~nond to approve payment of $940.DO to A. Leonard Bentson and Albert Kre,jce and Evelyn Krejce and ~250.DD tt> Eldred Wiley for appraisal fees in ~e matter of Lakeville vs. Kre~ce. Mako, Jensen, Emond and Friedges "aye", motion carried. 73.26?+ Motion by Emend seconded by Jensen to approve two Utility permits for the telephone company #'s 22+67. Jensen, Emend, F'riedges and Msko "aye", motion carried. .73.265 Motion by Emend seconded by Mako to make keys to the Village offices available to any council members who so desires.
