Planning Commission Meeting Minutes
MAY 17, 2001
The May 17, 2001 .Planning Commission meeting was called to order by Chair
Drotning in the City Hall Council Chambers at 6:00 p.m.
Roll call of members was taken:

ITEM S: APPROVAL OF MEETING MINUTES:
The May 3, 2001 Planning Commission meeting minutes were approved as
presented.
The May 3, 2001 Planning Commission Work Session minutes were approved as
presented.
ITEM 4: ANNOUNCEMENTS:
Assistant Community Development Director Daryl Morey stated that Planning
Commission Secretary Sharon Kot has given her resignation, effective May 17, 2001.
Mr. Morey stated that. the following items were distributed to the Planning
Commission members and staff before tonight's meeting:
1. Memo from Arlyn Grossing regarding Exterior Building Materials for
the RST-2 and RM-1 Zoning Districts.

ITEM 5. CONSENT AGENDA
Chair.. Drotning .asked the developer about the repair of Highview Avenue. Mr.
Mike Suel, Project Manager for D.R. Horton was in attendance and gave the
.Planning Commission members a timeline for completing the grading, street, and
utility work in Vermillion Springs.
01.44 Motion by Wulff, Second by Comer to recommend to City Council approval of the
May 17, 2001. Planning Commission Consent Agenda as follows:
A. Approve the application of D. R. Horton for a final plat of 7 single family lots to
be known as Vermillion Springs Second, located west of Highview Avenue and
south of 160 Street (C.S.A.H. 46), subject to the repairs to Highview Avenue
being substantially completed prior to City Council consideration of the final
plat.

ITEM 6. PUBLIC HEARING: LAKE PLACE PRELIMINARY PLAT AND CUP FOR 5O'
RIGHT-OF-WAY AND STREET WIDTH (continued from the May 3, 2001 Planning
Commission Meeting)
Chair Drotning opened the public hearing for consideration of the .Conditional Use
Permit. Application to allow a local street with a 50 foot right-of-way width and a 28
foot. street width in the RM-1 District for the preliminary plat of Lake Place.
Assistant .City Attorney Poehler attested that the legal notice .had been duly
published in accordance with state statutes and City Code for the Plat and CUP for
reduced right-of-way and street width.
.Planning Consultant Mr. Mike Gair was in attendance to represent L.A. Donnay,
along with developer Paul Donnay. Mr. Gair stated that they revised Street B from

a cul-de-sac to a loop street consistent with the Planning Commission s
recommendation at the May 3, 2001 meeting.
Assistant Community Development. Director Daryl Morey stated that L.A. Donnay,
Inc. representatives have submitted an application for a conditional use permit to
allow a local street with a 50 foot right-of-way width and a 28 foot street width for
proposed Street B in the Lake Place preliminary plat.. Mr. Morey indicated that a
public .hearing was held on May 3, 2001 to review and receive input. on the
application of L.A. Donnay for the Lake Place preliminary plat. The public hearing
was closed because there was no public comment and action on the Lake Place
preliminary plat was continued to allow the developer time to consider looping
Street B west of Street C as recommended by the Planning Commission and
so the Conditional Use Permit .could be considered simultaneously with the
preliminary plat.
Mr. Morey stated that the Zoning Ordinance allows .local public streets to reduce
the right-of-way width from 60 to 50 feet and to reduce the street width from 32 feet
to 28 feet by conditional use permit in the RM-1 District.

convert the segment of Street B located west of Street C from a public cul-de-sac
street to a public loop street as recommended by he Planning Commission of the
May 3, 2001 meeting. He stated that the attached townhouse buildings on Blocks
29, 30 and 31 have been shifted to the south and several guest parking spaces have
been relocated to accommodate the loop street.
Mr. Morey stated that the ghost platted future 5-unit attached townhouse building
has been relocated to align with. the loop street and the developer has added a unit
to this building to achieve a 6-unit row townhouse building as permitted in the RM-
1 District. Mr. Morey indicated that, with the exception of a small portion of a
deck/porch option on the southerly (added) unit, this entire townhouse building
now lies outside Zone A of the 1998 Flood Insurance Rate Map (FIRM). As such,
Mr. Morey indicated that this townhouse building is now. included in Phase 2 of the
Lake Place preliminary plat.
Mr. Morey stated that Community and Economic Development staff recommends
approval. of the revised Lake Place preliminary plat plans and the conditional use
permit subject to the 18 recommendations listed in the May 10, 2001 Planning
Report.

After Planning Commission discussion, Mr. Gair and Mr. Donnay stated that they
will consider providing additional landscaping on the south side of Lot 15, Block 13
adjacent to Street D.
01.46 MoTION`by Wulff, Second by Michaud to recommend to the City Council approval
of the .application of L.A. Donnay, .Inc. for a preliminary plat of 190 .attached
townhouse units, l4 twinhome units, and 6 detached townhouse units to be known
as Lake Place, located south of 170 Street (C.R. 58),1/4 mile east of Pilot Knob Road
(C.R. 31), and for a Conditional Use Permit to allow a local street with a 50 foot
right-of-way width and a 28 foot street width in the RM-1 District for the
preliminary plat of Lake Place, subject to the 18 stipulations listed in the May 10,
2001 planning report and approval of the Findings of Fact dated May 17, 2001.

ITEM 7: PUBLIC HEARING:. KENNETH AND JANET PRICE -VARIANCE
Chair Drotning opened .the public hearing for consideration of the application of
Kenneth and Janet Price for a side yard building setback variance for an existing
single-family home, located at 16742 Farrago Trail. Assistant City Attorney Poehler
attested that the legal notice had been duly published in accordance with state
statutes and City Code.
Kenneth,and Janet Price were in attendance to answer any questions that the public
or members. of the Planning Commission may have.
Zoning Enforcement Coordinator Leif Hanson presented an overview of Kenneth
and .Janet. Price's variance request. Mr. Hanson stated that Kenneth and Janet Price
have submitted an application for a building setback variance for their existing
house located at 16742 Farrago Trail. He indicated that the house was constructed
in 2000 by Country Joe Builders and was one of the first homes constructed in
Harris Acres Third Addition.

Mr. Hanson stated that during construction of the house, an error was made .and a
section of the east side of the house was built within the minimum side ..yard
setback on the east side of the property. The error, Mr. Hanson indicated, was not
discovered until after the house was completed by the builder and the property to
the east was staked for construction.

ITEM 8: PUBLIC HEARING JILL MILLER -SPECIAL HOME OCCUPATION PERMIT
Chair Drotning opened the public hearing to consider the application of Jill Miller
for a Special Home Occupation Permit to allow the operation of a hair salon
business in asingle-family residence, located at 18040 Cedar Avenue. Assistant
City Attorney Poehler attested that the- legal notice had been duly published in
accordance with state statutes and City Code.
Ms. Jill Miller presented her application for a Special Home Occupation Permit for
the purpose. of operating a hair salon business from her home.
Zoning .Enforcement Coordinator Leif Hanson presented the staff report. Mr.
Hanson indicated .that Ms. Miller is proposing to operate the hair salon out of her
single family residence located at 18040 Cedar Avenue which is zoned RM-1,

Medium Density Residential District, and is located outside of the 2000 MUSA. The
property is owned by Joe Miller Farms, Inc. Mr. Hanson stated that on June 18,
1990, the City Council approved a conditional use permit that. allowed Joe Miller to
move a previously occupied single-family residential dwelling onto the property.
Mr. Hanson stated that Ms. Miller has submitted detailed information for the
consideration of her special home occupation permit application which is included
in the May 11, 2001 planning report. A hair salon- home occupation. is classified as a
.Special Home. Occupation requiring a .public hearing with a permit issued for a
:period of one year, after which the permit may be re-issued for periods of up to
three (3) years.
Mr. Hanson noted that Ms. Miller is required to have a salon license and
cosmetology license. Ms. Miller currently has a cosmetology license. One
stipulation of the special home occupation permit will require Ms. Miller to obtain a
salon license before commencing operation of the hair salon. Mr. Hanson stated
that the .proposed hours of operation will be Monday through Saturday between
the hours of 10:00 a.m. and 4:00 p.m.
Mr. Hanson stated that the subject ro er is located off of .Cedar Avenue. An

existing left-turn lane on Cedar Avenue allows vehicles traveling south on Cedar
Avenue direct access to the property.
Mr. Hanson indicated that the existing driveway is not paved. One of the
stipulations will require the driveway to be paved with. materials listed in the May
11, 2001 planning :report. Ms. Miller indicated in the special home occupation
permit application that only one customer will visit the home occupation at any one
time.
Mr. Hanson .stated that. the subject property is not located within the MUSA
boundary and is not connected to City sewer or water service.. One of the
stipulations will require the existing septic system located on the property to be
tested to verify that the system is working properly.
Mr. Hanson .stated that should the Planning Commission recommend to City
Council approval of the Special Horne Occupation Permit for Jill Miller,
Community and Economic Development Department staff recommends approval
subject to the 11 stipulations listed in the May 11, 2001 planning report.

Chair Drotning confirmed that the subject property is located in MUSA Expansion
Area A.
Chair Drotning wanted to know if it was necessary for Ms. Miller to pave her
driveway. Mr. Leif Hanson confirmed that the Zoning Ordinance requires that the
driveway be paved.
01.50 Motion by Detjen, Second by Comer to recommend to City Council approval of the
application by Jill .Miller for a Special Home.. Occupation Permit to allow the
operation of a hair .salon business in asingle-family residence, located at 18040.
Cedar Avenue, subject to the eleven (11) stipulations listed in the May 11, 2001
planning report and approval of the Findings of Fact dated May 17, 2001.

9. PUBLIC HEARING MARION FIELDS FIFTH ADDITION PRELIMINARY AND FINAL PLAT
Chair Drotning. opened the public hearing to consider the application of Shamrock
Development, Inc. for a preliminary and final plat of 17 single family lots to be
known as Marion Fields Fifth Addition, located on the south side of 202nd Street,
east of Ipava Avenue. Assistant-City Attorney Poehler attested that the legal notice
had been duly published in accordance with state statutes and City Code.
Ms. Angie Zajac was in attendance to present the application of Shamrock
Development, Inc. and to answer any questions the Planning Commission may
have. The developer for Marion Fields Fifth Addition, Mr. Jim Stanton, was unable
to be in attendance at tonight's Planning Commission meeting.
Assistant Community Development Director Daryl Morey presented the planning
report for the Marion Fields Fifth Addition preliminary and final plat.
Mr. Morey stated that representatives from Shamrock Development, Inc.. have
submitted applications for the preliminary and final plat of Marion Fields Fifth
Addition, which consists of 17 single family lots on 6.81 acres of land located south
of 202nd Street and east of Ipava Avenue.

Mr. Morey indicated that the developer originally proposed a preliminary and final
plat for Marion Fields Fourth Addition that included 87 single family lots. The
developer revised the Marion Fields Fourth Addition preliminary and final plat. as
recommended by the Planning commission by taking 16 single family lots and a
cul-de-sac street proposed north of 204 Street and east of Ipava Avenue out of the
plat and designating the area as an outlot (Outlot A) for future development. The
Planning Commission made this recommendation to allow the developer time to
explore the possibility of purchasing the four existing single family residences.
fronting on 202nd Street, east of the Ipava Avenue extension and incorporating them
into .the preliminary and final plat.
Mr. Morey stated that the developer has concluded that it is not financially feasible
to purchase these four existing residences and include them in the Marion Fields
development; however, the Marion Fields Fifth Addition preliminary and final plat
plans propose looping Indio Path to provide double street frontage for the four
existing lots currently fronting on 202nd Street. Mr. Morey indicated that this will
allow homeowners the opportunity to reorient their garages so that their driveway
access is off of the proposed local street (Indio Path) instead of the existing major
• collector (202nd Street).
Mr. Morey stated that one of the existing metes and bounds parcels with. a single
family home fronting on 202nd Street, owned by Jason. and Patricia Lamont, has
been included in the Marion Fields Fifth Addition preliminary and final. plat as Lot
6, Block 2. Mr. Morey indicated that in order to accommodate a future driveway
relocation for this existing single family home, the developer is proposing an
eyebrow cul-de-sac off of Indio Path. Also, the developer is proposing to add a
portion of his property to the south side of the Lamont parcel. The Lamonts will
deed a narrow strip of the west side of their parcel to the developer to achieve the
85 foot minimum lot width for Lot 7, Block 2, which is measured at the front yard
building setback off of Indio Path.
Assistant City Engineer Tim Hanson and Development/Design Engineer Alyson
Morris have reviewed the preliminary and final plat plans and they recommend
approval in their report dated May 11, 2001.
Mr. Morey noted that the developer hosted a neighborhood meeting on April 23,
2001. at City Hall to present the Marion Fields Fifth Addition preliminary and final
plat plans to the .four existing homeowners fronting 202nd Street, east of Ipava
Avenue. Three of the four homeowners attended the neighborhood meeting.

Mr. Morey stated that if the Planning Commission recommends aproval to the City
Council of the Marion Fields Fifth preliminary and final plat, Community and
Economic Development Department staff recommends compliance with the 5
stipulations listed in the May 11, 2001 planning report.
Chair Drotning opened the hearing to the public for comment.
Mr. Duane Zaun, 9586 202nd Street, stated that his home is one of the existing homes
fronting on 202nd Street. Mr. Zauri s concerns were:
• .Creation of non-conformities with the Indio Path loop .street proposed
with. this plat.
• Future driveway relocation.
• Future street assessments.
• He would like to encourage the developer to make some sort of
transition between the existing and future houses.
Mr: Ron Schmit, 9594 202nd Street, indicated his concerns:
• His home will be surrounded by three roads.

Commissioners Wulff and Detjen agreed with staff that there needs to be
landscaping on the lots .adjacent to Friedges Landscaping.
Commissioner Wulff stated that more time should be taken to be sure. everyone's
questions are answered. She requested clarification of the non-conformities that
would be created for the existing lots with the platting of Indio Path..
Mr. Morey indicated that a statement in the Development Contract could indicate
thaf the homeowners on 202nd Street would not be assessed for the future upgrade
of 202nd Street. Commissioner Bellows asked if this was consistent with previous.
plats. Mr. Morey stated that this is a unique situation.
The Planning Commission agreed that there has been much progress regarding the
design of this plat, but they want the developer, Mr. Stanton, in attendance to
answer. questions raised by the public and the Planning Commission.

Chair Drotning summarized what issues should be addressed by staff and/or Mr.
.Stanton at the next Planning Commission meeting:
• Non-conformities that would be created by this plat.
• Future assessments for 202nd Street.
• Re-orientation of the existing homes/ driveways.
• Transition between existing and future houses (berming/landscaping).
01.52 Motion by Wulff, Second by Bellows to continue the preliminary and final plat of
17 single family lots to be known as Marion Fields Fifth Addition, located on the
south side of 202nd Street, east of Ipava Avenue, until the June 7, 2001 Planning
. Commission meeting, at which time Mr. Stanton will be in attendance to address
the neighbors' and the Planning Commission s comments.

1O. PUBLIC HEARING: CORNERSTONE LAKE PRELIMINARY PLAT
Chair Drotning opened the public hearing to consider the application of Town and
County Homes for a preliminary plat of 164 attached townhouse units to be known
as Cornerstone Lake, and a Conditional. Use Permit for a Planned Unit
Development in the. Shoreland Overlay District, located south of 170 Street (C.R.
58) and east of Pilot Knob Road (C.S.A.H. 31). Assistant City Attorney Poehler
attested that the legal notice had been duly published in accordance with state
statutes and City Code.
Mr. Art Plante, President of Town and Country Homes was in attendance to
present their application for the preliminary plat of Cornerstone Lake, which
proposes. the development of 164 attached townhouse units on 39.5 acres of land
located in the southeast corner of 170 Street (C.R. 58) and Pilot Knob Road
(C.S.A.H. 31).
Also in attendance to answer any questions were Scott McMahon, Director of Land
Development and Wayne Lamoreaux from Pioneer Engineering.
Assistant Community Development Director Daryl Morey stated that three
townhouse buildings (22 units) are shown only conceptually on the preliminary
plat. plans and are not to be included in the preliminary plat. These buildings lie
partially or totally within Zone A, which is the 100 year floodplain with an

undetermined elevation, on the 1998 Flood Insurance Rate Map (FIRM). Mr. Morey
indicated that Barr Engineering has recently completed a detailed study of the
floodplain elevation for the north branch of North Creek. The Barr Engineering
study determines the 100 year floodplain elevation as 920.0 feet. The lowest floor
elevation. of the three townhouse buildings is 927.5 feet, well above the three foot
elevation separation required by the Zoning Ordinance; however, these three
townhouse buildings cannot be included in the preliminary plat until a Letter of
Map Revision (LOMR) is formally adopted by FEMA.
Mr. Morey. stated that the subject property is a zoned RM-1, Medium Density
Residential District. The easterly portion of the property lies within the Shoreland
Overlay District for the north branch of North Creek. Mr. Morey indicated that the.
developer has submitted a conditional use permit application for a planned unit
(townhouse) development to be considered in conjunction ..with the Cornerstone
.Lake preliminary plat.
Mr. Morey stated that the 164 townhouse units in the Cornerstone Lake
preliminary plat are .proposed to be developed in one phase as shown on the
preliminary plat plans. The three townhouse buildings (22 units) shown
conceptually. on the preliminary plat plans will constitute the second phase of the
Cornerstone Lake development. Mr. Morey indicated that these townhouse units
are proposed to be included in 6 and 8 unit condominium ownership buildings. As
such, each of these attached townhouse buildings is identified. as one separate lot on
the preliminary plat. The developer plans to create a Common Interest Community
(CIC) plat for the units in each of the attached townhouse buildings.
Mr. Morey stated that the Cornerstone Lake preliminary plat proposes 4 outlots.
Outlot A includes the north branch of North Creek/wetland area located on the
east side of the preliminary plat. A public trail is located on both sides of the
creek/wetland within Outlot A, which will be deeded by the developer to the City
with the Cornerstone Lake final plat.
Mr. Morey stated that Outlots B, C, and D include the three townhouse buildings
located within Zone A on .the 1998 Flood Insurance Rate Map and. shown
conceptually on the preliminary plat plans. Outlots B, C, and D must be
preliminary and final platted prior to the construction of these three townhouse
buildings.
Because the Cornerstone Lake development abuts Pilot Knob Road (C.S.A.H. 31)
• and 170th Street (C.R. 58), Mr. Morey indicated that the developer has submitted the

preliminary plat plans to the Dakota County Plat Commission for their review and
comment.
Mr. Morey stated that Engineering Department staff recommends approval of the
preliminary plat of Cornerstone Lake. The DCSWCD report prepared by Urban
Conservationist jay Riggs lists six recommendations concerning erosion and
sedimentation control for the Cornerstone Lake development. The Environmental
.Affairs Committee minutes, with their recommendation for approval, were
distributed at tonight's. Planning Commission meeting.
Mr. Morey stated that there are six Black Willow trees, which will be saved,
identified on the preliminary grading plan, located in the wetland. The wetland,
the 17 foot wetland buffer, and the greenway trail corridor is located within Outlot
A, which will be deeded by the developer to the City with the Cornerstone Lake
final plat.
Mr. Morey stated that .the 2000 Comprehensive Park, Trail and Open Space Plan
identifies atrail/greenway corridor along the creek/wetland located on the east
• side of the preliminary plat. A ten foot wide bituminous trail will be constructed by
the developer within a greenway corridor on the west side of the creek/wetland.
The park dedication will be credited for the area of the trail/greenway corridor
located outside the 17 foot wetland buffer. The City will reimburse the developer
for the cost of this trail connection.
Mr. Morey stated that the developer will construct a ten foot wide bituminous trail
on both the west and east sides of the creek/wetland. There will also be a 10 foot
wide bituminous trail on the east side of Pilot Knob Road and an eight foot wide
bituminous trail on the. south side of 170 Street across the entire frontage of the
preliminary plat. The City will reimburse the developer for the .cost of this trail
construction.
Mr. Morey indicated that the developer is proposing to construct an eight foot wide
bituminous trail around the pond to be constructed in Block 4 and tying into Streets
A and B for use by the Cornerstone Lake residents.
The Parks and Recreation Committee meeting minutes from their May 16, 2001
with their recommendation of approval were distributed at tonight's meeting..
Mr. Morey. stated that the exterior building finish calculations are shown on the
building elevation plans and the .calculations indicate that the exterior building
.finish requirements will be met for the attached and detached townhouses.

Mr. Morey indicated that the attached townhouse units in Cornerstone Lake are all
slab-on-grade and will have garages 20 feet in width and 568 square feet in area in
compliance with Zoning Ordinance requirements. He also stated that there will. be
"safe rooms' .for storm .shelter purposes constructed to FEMA standards, on the
main floor behind the garage.
Mr. .Morey stated that the development of Cornerstone Lake includes the
construction of three local public streets which are described in the May 11, 2001`
planning report. Street names have not yet been assigned by Dakota County:
Mr. Morey stated that the Cornerstone Lake development proposes. private drives
to serve 136 of the 164 townhouse units. The other 28 townhouse units have access
directly off of the internal public streets serving the project. The proposed private
drives are.28 feet wideand. serve a maximum of two buildings or six units per side.
Mr. Morey stated that the developer is proposing to provide. 93 off-street .guest
parking ..spaces to .serve the 186 townhouse units. 78 guest parking spaces will be
constructed in the first phase of the Cornerstone Lake development ..and an
• .additional 15 guest parking spaces will be constructed when the three townhouse
buildings in Outlots B, C, and D are preliminary and final platted with the second
phase of development.
Mr. Morey indicated that the developer has submitted a preliminary landscape
plan, including a foundation planting plan, with the Cornerstone Lake preliminary
plat. The developer must. submit project and landscape value figures with the
Cornerstone Lake final plat.
Mr. Morey stated that the east side of the preliminary plat lies within the Shoreland
..Overlay District for the north branch of North Creek. The Shoreland Overlay
District section of the Zoning Ordinance requires aconditional -use permit for a
planned unit (townhouse) development (PUD). Mr. Morey indicated that the
Cornerstone Lake development complies with all of the Shoreland Overlay District
requirements.
Mr. Morey stated that Community and Economic Development Department staff
recommends .approval of the Cornerstone .Lake preliminary plat and conditional
use permit subject to the 21 stipulations listed in the May 11, 2001 planning report.

Commissioner Detjen asked what the build out time frame for Cornerstone Lake
will be. Mr. Plante stated that the build out time will be approximately 3 years,
with 50-60 units expected to be constructed each year.
Commissioner Wulff thought there should be more screening, such as a fence or a
continuous .line of evergreen 'trees, on Pilot Knob Road due to 2020 traffic
projections.
Commissioner Bellows was in favor of a continuous line of evergreen trees on Pilot
Knob Road, but against putting in a fence.
Chair Drotning stated that the Zoning Ordinance requires the fence to be planned
and approved with the plat, with .continued ownership and upkeep by .the
homeowners association.

landscaping along Pilot Knob Road.
Commissioner Bellows wanted to know if the school district had been notified. Mr.
Morey indicated that he notified Mark Beltz of the Farmington School bistrict. He
stated that the school district is still analyzing the. impacts of the Cornerstone Lake
and Lake Place developments.
The Commissioners wanted to know about snow removal. Mr. McMahon stated
that they hire a management company to plow the snow. They use pick-up trucks
to remove the snow :from the driveways and the snow is pushed. to the end of the
private drives.

Mr. Plante addressed the Planning Commission. On Pilot Knob Road, Town &
Country is willing to install an interior 3-4 foot keystone retaining wall to increase
the berm height by 1 to 2 feet. In addition, Towne& Country will install a staggered
row of 8 foot tall evergreen trees on the berm along Pilot Knob Road.
Mr. Morey suggested adding the following wording under Stipulation 19: "A
detailed landscaping plan, including cross section drawings of the berming and

landscaping along Pilot Knob Road, shall be submitted with the Cornerstone Lake
Final Plat."
01.54 Motion by Bellows, Second by Comer to recommend to City Council approval of
the application by Town and County Homes for a preliminary plat of 164 attached
townhouse units to be known as Cornerstone Lake, and a Conditional Use Permit
for a Planned Unit Development in the Shoreland Overlay District, .located south of
170 Street (C.R. 58) and east of Pilot Knob Road. (C.S.A.H. 31), subject to the 21
stipulations listed in the May 11, 2001 planning report, with the amended
Stipulation 19 as listed above, and approval of the Findings of Fact.

11. PUBLIC HEARING: 2001 - 2005 CAPITAL IMPROVEMENT PLAN (continued. from the
May 3, 2001 Planning Commission Meeting)
Chair Drotning. continued the public hearing for consideration of the application of
the City of Lakeville for the.. adoption of a Five Year Capital Improvement Plan for
2001- 2005.
Tim .Hanson, Assistant City Engineer, stated that the Capital Improvement Plan
(CIP) is a long-range program that identifies the City's infrastructure, development
objectives and the allocation of financial resources. It provides policy makers and
the community with a strategic approach. to implementation and administration of
construction.. projects.
Mr. Hanson noted that the City Council reviewed the proposed CIP at its March 24,
2001 retreat. The 2001 - 2005 CIP takes into consideration the City .Council's
previous actions relating to transportation and the I-35 improvement program.
Mr. Hanson provided an overview of the proposed 2001 - 2005 CIP .and briefly
described the significant projects and/or major changes and their timetable.
Mr. Hanson stated that the 2001 - 2005 CIP provides a foundation for construction
of the City's infrastructure in such a manner to enable development to occur in an
orderly and fiscally responsible manner.
Mr. Hanson indicated that the Planning Commission review is to determine the
consistency of the CIP with the City's Comprehensive Land. Use Plan. Community
and Economic Development Department staff have reviewed the proposed CIP

document and find it to be consistent with the City's 1998 Comprehensive Plan
Update.
Mr. Hanson responded to questions from the Commissioners and provided
clarification of the proposed projects and their relationship to land use.
City Administrator Robert Ericksonstated that the reason staff requested the CIP
public hearing be continued at the previous two Planning Commission meetings
was to allow City staff time to meet with Dakota County to discuss funding and the
timeline for improvements to the I-35/CSAH 60 interchange. As a result of the
meetings with Dakota County, the timing for the interchange for improvements
was moved up and the funding was put in place as follows:
• The CSAH 60 ramps to southbound I-35 and the Kenrick Avenue realignment
be constructed in 2002.
• CSAH 60 from I-35 to CSAH 50 be improved to a four-lane divided highway in
2002.
• The I-35/CSAH 60 bridge be replaced and CSAH 60 from I-35 to Scott County
be improved to a four-lane divided highway in 2004.
Mr. Erickson stated that the Planning Commission and. the City Council sent staff a
strong message with their .consideration of the TimberCrest at Lakeville
Comprehensive Plan amendment that traffic safety must be the highest priority.
The agreement with Dakota County for funding the I-35/CSAH 60 interchange.
improvements is unprecedented and addresses the traffic safety concerns raised
during. the TimberCrest at Lakeville public hearings.
