Present;..Friedges, Mako, Jensen and Emond. .Absent; Edwards. Also present; Pat Farrell,. Village Attorney sad Robert Frigaard, Village Engineer. 73.48 Motion by Mako seconded by Friedges to approve the minutes of the August 6, 1973, meeting. Friedges, Nlako, Jens®n and Emond "aye", motion carried. The Building Inspector's report was presented by Margaret Klotz. 73.485 Motion by Emond seconded by Friedges to have lighta installed at Hiway #5o and the 35 W service 1at~e- and 175th St. and Highway Malco, Jensen, Emond and Friedges "aye?', motion carried... The Engineer presented his report and told of the progress on each project. .73.486 Motion by Friedges seconded by Mako to order a public hearing. on the water & sewer extensions tc> the new.. restaurant on Highway 5D for Septa 1973s at 8:3E) P.M. Jensen, Emond, Friedges and Mako "aye", motion carried. Mr. Frigaard reported that the water level at Lake Marion is now at 981)).2 feat ..and that the high was reached is Aug. of 1945 when the lake was at 985 feet and running across the outlet. which is across County Road 64. 73.487 Motion, by Jensen seconded by Mako to refer thia information on the elevations of Lake Marion to the Planning Commission asking them to consider an ordinance regulating the building elevations on Lake Marian. Emond, Friedges, Mako Gad Jensen "aye", motion carried.: The hearing for the road in the Fourth Addition,. Minnesota (3rchard Gardena, .was reopened, There were .:some questions. on the location of this road. Mr. Frg~ard reported that mast of the property owners were agreeable to the road.. It was asked if the. methodot' assessing these paaoperties could be decided at this time but Air. Farrell said there is no provision i.n the,law for this. 73.4 Motion by Mako seconded by Emond tt~ order the street improvement for the Fourth Addition, Minnesota Crehard aardena and authorize the engineer to prepare the plans and epees. Friedges, Mako, Jensen and Emend "aye", ration carried. 73.489.. Motion by Jensen seconded by Friedges to authorize the clerk and Village auditor to set up the books in the modified accrual form. Mako, Jensen, Ea~nd and Friedges'"aye", ntiotion carried. 73.490 Motion by Emend seconded by Friedges to grant Denny Dunham are excavating permit for a farm gas line tap. Jensen, Emond, Friedges and Mako "aye",.motion carried. .73.491 Motion by Friedges seconded by Emoad to purchase the cash register from. the low. bidder, Victor, whose bid was X1,885.50.:.. EmESnd, Fredges, Mako and Jensen "aqe", $~tion carried. 73.492 Motion by Friedges seconded by Mako to approve t~~ lake improvement permit for Gary D.;Krook. Friedges, Mako, Jensen Gad Emcmd "aye", ~,tion carried. 73.493 Motion by Mako seconded by Friedges to name the First National Bank of St. Paul as the Village of Lakeville auxiliary Bank depository. Mako, Jensen, Emond and Friedges "aye", m©tion earriea. It was decided that some members of the council. would inspect the roads in Dakota Heights 1st and 2nd Additions with Mr. Frigaard before they are accepted. Mr. Magnus Sivertsen of C3rchard Lake felt that persons buying dog licenses should. be given dog ordinances at the time the licenses. are bought. He said that he is havixrg trouble with some large dogs in his neighborhood. The clerk was instructed to call the .dog. catcher to go out there and. check on .these dn$s. These roads are all in the Kingswood Estates plat. 73.~+9~+ Motion by Emond seconded by Friedges to vacate the streets as .listed on the attached legal description. Jensen, Emond, Friedges and Mako "aye", motion carried. 73•x+95 Motion by Friedges seconded by Mako to approve the final plat of Kiaigswood Estates. Emond, Friedges, Mako and Jensen "aye", motion carried. Mr. Farrell advised the council that he has the street bond for Kingswood Estates. 3.x+96 Motion by Mako seconded by Emond to follow the recommendation of the police- chief and purchase the radios from the low bidder, Aircomm, whose bid was X7,989.44 for Total system less .trade fur the Public Works Dept. and $^,x+91.55 for the Fire Dept. Equipment. A list of additions or changes as recommended by the police chief' is also approved. Bid lists attached. Federal Revenue funds will be used for these radios. Friedges, Mako, Jensen and Emond "aye", motion carried. Mr. James Robinette reported to the council that he had checked other communities for their requirements on park donations and found that most of them are higher than Lakeville. The utter pertaining to the ai~wing of private property will be discussed with... the owner of the property. The hes~g for water and sewer extensions to.Aquarius Swimming Pool Co. was opened at 9=~ P.M. No ir:terested persons were present. Mr. Frigaard reviewed the preliminaay report. 73.97 Motion by Frisdges seconded by Mako to continue this hearing until Monday, the 24th of Aug. at 9:15 F.M. Mako, Jensen, E+mnd and Friedges "aye", motion carried. M~. John McCarthy of Prairie Investment presented their new plans for a PUD. He said that the county and state. have approved it and letters should be sent to the Village to this effect this week. Mr. Frigaard felt that the state hydraulic department should review thie plan. 73.98 Motion by Jensen seconded by Friedges to approve the PUD for Prairie Development Corporation subject to the approval of the County Engineer's office and the State hydraulic Dept and the State Highway Dept. Jensen, Emond, Friedges and Mako "aye", motion carried. Mr. Grohoska. of G presented some plans for a new plat and asked the council where he could go from here as the Planning Commission were not in favor of this plat. 73.99 Motion by Mako seconded by Emond to refer this matter tc> the attorney for his direction and proper scheduling.
