Detjen, Wulff, Puncochar .Absent: Grenz Staff Present: Arlyn trussing, Director of Community and Economic Development; Daryl Morey, Assistant Community Development Director; Frank Dempsey, .Associate Planner; Tim Hanson, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. ITEM 3: APPROVAL OF MEETING MINUTES: The -June- 21, 2001 Planning Commission meeting minutes were .approved as presented. Commissioner Grenz arrived and took his seat at 6:03. ITEM 4: ANNOUNCEMENTS:- Mr. Morey stated that the following items were distributed to the ..Planning Commission members and staff before tonight's meeting: L Copy of a letter sent to MUSA Expansion. Area "B" Property Owners, regarding the interim ordinance temporarily prohibiting approval of interim use permits for mining in MUSA Expansion Area "B." 2. July 17, 2001 Environmental Affairs Committee Meeting motion and recommendations regarding The Greenway 1St Addition final plat. 3. July. 18, 2001 Parks and Recreation Advisory Committee meeting minutes including their approval .and recommendations for The Greenway 1St Addition final plat. 4. Copy of the. section of the sign ordinance regarding Institutional, Noncommercial Public And Semipublic Uses of signs, specifically electronic and non-electronic reader boards. 5, Letter from Ron Mullenbach to Ruth Deneen regarding seating at Ipava Java. 6. Dakota County Plat Commission letter regarding the preliminary and final plat of The Greenway 1St Addition. Planning: Commission Meeting July 19, 2001_ Page 2 ITEM 5. PUBLIC HEARING: CITY OF LAKEVILLE RIGHT-OF-WAY VACATION Chain. Drotning opened the public hearing for consideration of the vacation of a portion of Ipava Avenue right-of-way platted in Marion Fields Fourth Addition and located south of 202nd Street. Assistant City Attorney Poehler, attested that the legal notice had been duly published in accordance with state- statutes and City Code. Assistant Community Development Director Daryl Morey presented the planning report. Mr. Morey stated that in conjunction with the Marion Fields Fifth Addition preliminary and final plat,- Shamrock Development, Inc. and City staff are requesting approval of the vacation of a portion of Ipava Avenue right-of-way platted in Marion Fields Fourth Addition. Mr. Morey indicated that the developer, Jim Stanton, replatted the: Ipava Avenue right-of-way: dedicated in .Marion Fields Fourth Addition with the Marion Fields Fifth Addition preliminary and final plat by shifting the right-of-way to the west to eliminate a building setback non-conformity for the adjacent homeowner to the east (Schmit): Mr. Morey stated that the vacation of the excess Ipava Avenue right-of-way created by the re-plat will formally eliminate this setback non-conformity. The Schmit's existing house and detached garage will meet- the 20 foot .side yard setback requirement following the vacation of the excess Ipava Avenue right-of-way, Mr. Morey stated that Community & .Economic Development Department staff recommends approval of the Ipava Avenue .right-of-way vacation. Chair Drotning opened the hearing to the public for comment. ITEM 6: PUBLIC HEARING: THE GREENWAY 1ST ADDITION Chair Drotning opened-the public hearing to consider the application of Lundgren Brothers Construction .for the A) vacation of a portion of an existing public .roadway, trailway, drainage ;and. utility easement, located along the west side of Ipava Avenue, north of 192nd Street, and B) consideration of the Final Plat of The. Greenway 1St Addition, located east of Kenwood Trail (C.R. 50), north of 192nd Street, andwest of-Ipava Avenue. f4~sistant City Attorney Poehler, attested that the legal notice had been duly published in accordance with state statutes and .City Code. Mr. Mike Burton from Lundgren Brothers Construction was in attendance to answer any questions that the Planning Commission or the public may have. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that. Lundgren Brothers Construction representatives have submitted an application for the final plat. of The Greenway 15t Addition, which consists of 67 single family residential lots on 8 blocks and 10 outlots on land .located north of 192nd Street and west of Ipava Avenue. Mr. Dempsey indicated that approval of the final -plat will allow the recording of The Greenway 1St Addition plat and the construction of phase one of the project. Phase two will include the development of the remaining 107 single family lots. The Greenway preliminary plat was approved by the City Council on June 18, 2001. Mr. Dempsey stated that a stipulation of the approval of The Greenway preliminary plat required that the existing public and private easements underlying the. proposed Greenway plat be vacated prior to final .plat approval by the City Council. Mr. -Dempsey .indicated that the Ipava Avenue Roadway, trailway, drainage and utility easement will be replaced by street right-of-way on the final plat. The private. Northwestern Bell easement shall be vacated .prior to final plat approval of Outlot A. The 192nd Stree# prescriptive rights roadway will also be vacated with The Greenway 1St Addition final plat. Planning Commission Meeting July 19, 2001 Page 4 Mr. Dempsey` stated that The Greenway 1St Addition final plat area is zoned PUD, Planned .Unit Development District.- Mr. Dempsey stated that the RS-3, Single Family Residential District lot size requirements are being followed for The Greenway 1St Addition plat and. are listed in the July 13, 2001 planning report. He indicated that the City Council approved the preliminary plat with a lot width deviation as part of the PUD zoning for one of the included, in the phase one final plat (Lot 3, Block 6). All of the other. lots meet lot area, width and depth requirements. Mr. Dempsey stated that there are 10 Outlots proposed in The Greenway 1St Addition final plat. Their uses are listed in the July 13, 2001 planning report. Mr. Dempsey stated that .The Greenway 1St Addition final plat abuts 192nd Street and Ipava Avenue. A 120. foot right-of-way width is shown on the final plat plans for Ipava Avenue. No driveway access. is allowed. The Ipava Avenue easement dedicated as part of the Ipava Avenue Improvement Project is proposed to be vacated as a stipulation of the approved preliminary plat and in conjunction with the approval of the final plat. Mr. Dempsey indicated that a 40 foot north half right-of-way is shown on the final plat for 192nd Street.. No driveway access is allowed. The developer will be required to upgrade J92nd Street to an urban section with The Greenway development. To accommodate .the upgrade of 192nd Street, the developer must obtain easements from the property owner's on the south side of 192nd Street prior to City Council consideration of the final plat. Mr. Dempsey .stated. that two local streets will access 192nd Street and two streets will access .Ipava Avenue. There are 3 cul-de-sac streets to be constructed in phase one. A1T 3 cul-de-sacs have 50 foot rights-of-way with a 60 foot turnaround radius. The other. local streets have 60 foot right-of-way widths in compliance with subdivision ordinance requirements. Mr. Dempsey .stated that 190th Street is a Minor Collector roadway with two proposed accesses, one of which will be constructed in the first phase. A 100 foot wide right-of-way is shown for 190th Street. No driveway access will be allowed on 190th Street for this plat. Mr. Dempsey indicated that temporary turnarounds will be required at the west ends of 190th Street, Ireton Way and Ireton Avenue within Outlot C. PlaruZing Commission Meeting July 19, 2001 Page 5 Mr. Dempsey .stated that proposed grading, :drainage and erosion control for The Greenway 1St Addition final plat has been reviewed by Assistant City Engineer Tim Hanson and Design/ Development Engineer Alyson Morris and they. recommend approval of the final plat. The Environmental Affairs Committee reviewed the final plans at their July 17,.2001 meeting and their recommendation for approval was handed out to the Planning Commission. at tonight's meeting. Mr. Dempsey stated that a final tree inventory and preservation plan has been submitted by the developer. 56 percent of the significant trees located within Phase One will be saved. Mr. Dempsey indicated that the developer will be required to provide a $21,500.00 security for tree .preservation purposes. Mr. Dempsey indicated that Stipulation 13 should read $21,500 for the entire First Addition, not per lot. Mr. Dempsey stated that a landscape plan was approved with the preliminary plat that showed extensive buffering along Ipava Avenue,. 192nd. Street and Kenwood Trail (CR 50). Staff- recommends that a landscape security of $2,000 per lot be submitted for. each lot of The Greenway 1St Addition abutting Ipava. Avenue and 192nd Street. The developer will be required to submit a $48,OO~:flO surety to guarantee the installation of the approved landscaping and buffer yard sod on the 24 lots that abut 192nd Street and Ipava Avenue. Mr. Dempsey stated that the developer submitted. a wetland inventory and mitigation plan with The Greenway. preliminary plat. The details are discussed. in the July 13, 2001. engineering report. He indicated -that the final plat. plans show that the house setbacks will meet the minimum 33 foot buffer setback. Mr. Dempsey stated that the area of the final plat located within 300 feet of the centerline of the tributary creek within Outlot B is subject to Shoreland Overlay District. requirements. The application indicates that the impervious surface area will be approximately 14.3 well within the Shoreland Overlay District requirements of no more than 25%. Mr. Dempsey stated that the City's 1999 Park and Open Space Systern Plan. identifies a public open space greenway corridor within The Greenway. development. He indicated that the developer .will deed Outlot B to the City to meet park land dedication requirements for the entire Greenway development. Mr. Dempsey stated that the developer will construct the segment of the greenway corridor that extends from the northwest corner of Ipava Avenue to 192nd Street to the Iteri Avenue street stub. The remaining portion of the greenway corridor will Planning Commission Meeting July 19, 2001 Page 6 be constructed. in phase two. In addition, the developer will be required to construct a trail on the west- side of Ipava Avenue and the norfh side of 192nd Street. The July 18, 2001 Parks and Recreation Advisory Committee meeting minutes, with their recommendation and motion were handed out at tonight's Planning Commission meeting. Mr. Dempsey indicated that there will be two homeowner associations within The Greenway 1St Addition final plat. The homeowner's association will be responsible .for owningand maintaining Outlots F, G, J and K for monument signage and Lot 3, Block 4 for the proposed homeowner association swimming pool. Staff has received copies of the homeowner association documents which wi1L be reviewed by .the City Attorney prior to City .Council consideration of The Greenway 1St Addition. final plat. Mr. Dempsey stated that should the Planning Commission recommend to City Council. approval of the easement vacation and the final plat of The Greenway 1St Addition, Community & Economic Development Department staff recommends approval subject to the 13-stipulations listed in the. July 13, 2001 planning report, as amended. Chair Drotnng opened the hearing to the public for comment. There were no comments from the audience. 01.86 Motion by Comer, Second by Michaud to close he public hearing at 6:13 p.m. Ayes: Drotning, Comer, Detjen, Wulff, Michaud, Grenz. Nays: 0 The Planning Commission .members questioned the Dakota County Plat Commission's recommendation regarding preserving additional right-of-way for the possible use of 192nd/195th Street as a future county East/West principal arterial. Mr. Morey indicated that City staff met with Dakota County staff a few months ago and stated that the City does not support the use of 192nd/195th Street as the East/ West principal arterial. Commissioner Wulff agreed that the Planning Commission should disregard Dakota County Plat Commission s recommendation. Planning Commission Meeting July 19, 2001 Page 7 Commissioner Detjen wanted staff to elaborate on the need for additional right-of- way for County Road 50 as stated. in the Dakota County Plat Commission letter. Mr. Morey stated that the final plat includes 60 feet of half right-of-way for County Road 50 consistent with Dakota County guidelines.. City Staff will contact Dakota County to clarify this issue. Commissioner Comer asked about the noise .levels that the Dakota: County Plat Commission refexred to in their letter. Mr. Morey indicated that this. is a standard statement which the Plat Commission includes in their review of residential plats. The Zoning Ordinance addresses this issue with the buffer yard lot depth, setbacks and berming/landscaping requirements adjacent to major collector and. arterial streets. Chair Drotning confirmed with staff that .all the, stipulations .from the preliminary plat approval have been. addressed. Mr. Hanson stated that in their motion to recommend approval of The Greenway 1St Addition, the Environmental Affairs Committee (EAC) made it subject to staff working with the developer on alternative ways to save over 100. inches diameter of -oaks on Lot 8, Block 6. Mr. Hanson indicated that staff has looked at this in detail. There are 8 inch, 9 inch, and 36 inch Oak trees on this lot which the EAC did not want removed. Mr. Hanson stated that the city forester .has .analyzed these trees and. found that the 36 inch Oak had several scars and breaks and looked less hearty than the smaller two trees. Staff is recommending that.. the 8 inch and 9 inch Oak trees should be saved and the 36 inch Oak tree should be removed. 01.87 Motion by Grenz, Second by Comer to recommend to City Council. approval of the application of Lundgren.Brothers Construction for A) the vacation of a portion of an existing public roadway, trailway, drainage and utility easement, located along the west side of Ipava Avenue, north of .192nd Street, and B) the Final Plat of .The Greenway 1St Addition, subject to the 13 stipulations listed in the July 13, 2001 planning report, as amended. Ayes:. Corner, Detjen, Wulff, Michaud, Grenz, Drotning. Nays: 0 Item 7. NEW BUSINESS Chair Drotning asked staff about the trees that were suppose to be kept for screening the HOM Furniture store under construction on the east side of County Road 5. Mr. Hanson indicated that this was a field decision that was made by staff Planning Commission Meeting July 19, 2001 Page $ after the manager of AmericInn indicated that he would prefer that all the trees on .the south side of the site be removed due to their poor quality. Seven evergreen trees will be planted by HOM Furniture to replace the trees that were removed. Chair Drotning stated he would like. staff to review the section of the sign ordinance related to reader board signs. Mr. Morey indicated that the main concern with commercial electronic reader board signs. is one of traffic safety because they can be a distraction for drivers. It is a safetyissue and the sign ordinance only allows electronic time/temperature signs for commercial uses and small non-flashing electronic read boards for institutional and public uses. Chair Drotning wanted to hear. from each Planning Commission member regarding commercial electronic reader boards. All. members agreed that electronic reader board signs would be acceptable provided. they didri t blink, flash or scroll- and were not too big or too brighf. IVIr. Morey indicated that ataff will research this issue and present their findings at an upcoming Planning Commission meeting. Item 8. STAFF NOTICES Chair Drotning reminded the Planning Commission members about the joint meeting with. the Planning Commission and Environmental Affairs Committee on July 26, 2001 at 6:00 PM. The meeting will provide for a presentation and review of the Timbercrest at Lakeville Environmental Assessment Worksheet (EAW), which ..was handed out at the June 21St Planning Commission meeting.
