Planning Commission Meeting Minutes

The March 2, 2000 Planning Commission meeting was called to order by Vice Chair Rieb
in the Gity Hall Council Chambers at 6:00 p.m.
Rolf call of members was taken:
Present: Bellows, Kot, Rieb, Comer, Wulff,.Ex-Officio Commission Member Knutson.
Absent: Drotning, Skipton.
Staff Present: Daryl Morey, Acting Community and .Economic Development Director;
Frank Dempsey, Associate Planner; Ron Mullenbach, Associate Planner; Tim Hanson,
Assistant City Engineer; Andrea McDowell. Poehler, Assistant City Attorney; and Donna
Quintus, Recording Secretary.
The minutes of the February 3.,.2000 Planning Commission Meeting were approved as
presented.
IrEnn 4: Announcements
Acting Community and Economic Development Director Daryl Morey. indicated that the
minutes of the February 29,:.2000 Environmental Affairs Committee (EAC} .meeting had
been distributed to the Commission outlining the EAC discussion and recommendations
on the Hosanna 2"d Addition applications. Also distributed to the Commission is a copy of
an a-mail to staff from a Lakeville resident stating concerns regarding the site p an for the
proposed Hosanna! Lutheran Church expansion project. Mr. Morey noted that tonight's
meeting is the first to be televised live on local cable TV.
ITenn 5: Public Hearing: Hosanna! Lutheran Church
Vice Chair Rieb opened the public hearing to consider the applications of Hosannat
Lutheran Church for the following:. 1) vacation of public easements; 2) a preliminary and
final plat for Hosanna 2"d Addition, and 3) a Conditional Use Permit Amendment to allow
an expansion to the Hosanna! Lutheran Church building and parking lot. Assistant City
Attorney Poehler attested that the legal notices had been duly mailed and published in
accordance with state statutes.
Mr. Jim Hayes, Hosanna! Lutheran Church Building Committee Team Leader, presented
the applications for easement vacations, preliminary and final plat, and Conditional Use
Permit Amendment to allow the expansion of the existing Hosanna! Lutheran Church
building and parking lot. Mr. Hayes introduced Mr. Dick Brownlee of Station Nineteen
Architects and project engineer Laurie Johnson from HTPO who were in attendance to
answer questions :regarding the Hosanna! Lutheran Church proposal
Mr. Hayes presented a brief history of the 50+ acre Hosanna! Lutheran Church campus
site located at 9600 - 163~d Street and. described the existing. and proposed physical
developments for the site.. The existing Phases I and II consists of approximately 54,500

square feet of buildings, including a 750-seat sanctuary, lobby, classroom space, activity
centers, and administrative offices. There are currently 515 parking stalls with access to
both 163`a and 165t" Streets.
Mr. Hayes indicated that Hosanna! Lutheran Church currently has 1,800 Sunday School
students, 505 students in their Confirmation class, and 200 students in their high school
program. Due to the current and expected growth rate, the Building Committee
representatives are now prepared to move forward with Phase III of their development
plan for their site. Phase III consists of the construction of additions to the existing
building, including a 51,.279 square foot, 1,500-seat capacity sanctuary and gathering area
atrium to the west of the existing sanctuary and a 2,665 square foot administrative wing
and kitchen addition on the northeast corner of the existing building. Also, included in
Phase. III is the construction of 513 additional parking spaces proposed to be located west
of the new sanctuary addition.
Mr. Dick Brownlee, architect,. presented drawings of the existing church building and
proposed additions and identified the designated functions for each area. Mr. Brownlee
also presented color renderings showing the proposed exterior and interior of the building.
Associate Planner Frank Dempsey presented the planning report regarding the
applications of Hosanna! Lutheran Church which would allow a church building expansion
and parking lot improvements on the Hosanna! property. Mr. Dempsey indicated that
• planning actions needed for the proposed expansion include the vacation of existing
drainage and utility easements, a preliminary and final plat, and an amendment to
Conditional Use Permit No. 96-01.
Easement Vacations
Associate Planner Dempsey noted that all existing .public easements associated with the
Hosanna Addition plat are proposed to be vacated and re-established with the proposed
Hosanna 2nd Addition final plat. Telephone, electric, cable and gas utility companies have
reviewed the easement vacation applications and have responded that the proposed
easement vacations will not impact existing utility locations and they expressed no
opposition to vacating the easements as requested.
Preliminary/Final Plat
Associate Planner Dempsey indicated that the preliminary and. final plat of Hosanna 2nd
` Addition consists of the replatting of the existing Hosanna Addition plat by combining Lot
1, Block 1, Hosanna Addition with a portion of the unplatted property to the west into one
lot. The proposed Lot 1, Block 1, Hosanna 2nd Addition wilt be 25.6 acres in area and will
accommodate the proposed expansions of the existing church building. and parking lot.
Mr. Dempsey noted that the Hosanna 2nd Addition includes the platting of two outlots.
Outlot A (approximately 23 acres. in size) is proposed along the northwest and west side of
the property and is conceptually planned for future medium density residential

development. This is consistent with the Comprehensive 2020 Land Use Plan. Outlot B
(2.0 acres) located in the northwest corner of the. site will contain a proposed regional
stormwater pond. The location of the ponding area is consistent with the City's
stormwater Management Plan.
Conditional Use Permit Amendment
Associate Planner Dempsey stated that Conditional Use Permit No. 96-01 was approved
and issued to Hosanna! Lutheran Church on March 4, 1996 for the construction of the
existing. church. An amendment to Conditiona Use Permit No. 96-01 was approved. by
the City Council on March 2, 1998 to allow the construction of Phase II for additional
classroom space and parking lot expansion. Because of the high rate of growth of the
Hosanna! Lutheran Church. congregation, the church representatives are requesting to
move forward with Phase 111 of their development proposal. This requires another
amendment to Conditional Use Permit No. 96-01.
Mr. Dempsey presented details of the Hosanna! Lutheran Church Conditional Use Permit
Amendment proposal as outlined in the February 25, 2000 Planning Report, including the
following:
church building addition setbacks;
parking lot expansion location layout and design;
• ? existing and proposed access to the site;
site lighting; and
landscaping and parking lot screening.
Mr. Dempsey noted that the proposed site design and layout meets or exceeds the
minimum zoning ordinance requirements for development of this site.
Associate Planner Dempsey noted that he had received an a-mail from Marcia Nelson,
16224 Jatos Circle, dated February 24, 2000 expressing concern regarding the removal of
an existing stand of trees located on the west side of the pond which borders the property
line between the church and the Town and Country residential neighborhood. In her
correspondence,. Ms. Nelson stated that the existing trees provide a natural habitat for
wildlife and expressed her desire that this area remain natural. She requested that City
staff and the church research the possibility of moving the proposed pond to the east
thereby preserving the trees that currently exist in the northwest corner of the church
property.
Mr. Dempsey indicated that the area under proposed Outlot B is an abandoned and
unrestored grave! pit which was mined approximately 20 years ago. The existing trees in
this area are volunteer trees within the old gravel pit area. The plans propose. to
completely excavate the gravel pit area~for use as a required stormwater pond for the site.
While the proposed grading plan includes the removal of the entire stand of trees in and
• around the existing gravel pit, Community and .Economic Development Department staff
recommends a modification to the proposed. landscape plan that will provide in-fill

screening to maximize landscape screening and to save some existing trees on the west
side of the ponding area.
Mr. Dempsey noted that he had attended a neighborhood meeting hosted by
representatives of Hosanna! Lutheran Church on Monday, February 28th. The three
residents that attended this neighborhood meeting requested additional information on the
traffic study completed by the. City in this area and expressed concerns regarding the
proposed new driveway across from Jackdaw Path.
Associate Planner Dempsey noted that the proposed Hosanna 2"d Addition is adjacent to
a county road and, therefore, must be reviewed by the Dakota County Plat Commission.
Mr. Dempsey requested that the Planning Commission consider a modification to the staff
recommended conditions for approval of the applications of Hosanna! Lutheran Church by
.adding Stipulation No. 10: "The recommendation of the Dakota County Plat Commission."
Also, staff is .requesting that the. Planning Commission consider establishing a deadline for
constructing additional on-site parking spaces when the need is identified and the church
is notified of the need. A modification to Stipulation No. 8 to reflect a deadline for on-site
parking. space construction is proposed to read: "If the City determines that on-site
parking is not deemed adequate following the completion of Phase lll, the church shall
construct additional parking spaces to meet the parking demand within one year after
written notification. from the City."
• Associate Planner Dempsey stated that if the Planning Commission recommends
approval of the Hosanna! Lutheran Church applications for vacation of existing drainage
and utility easements, the Hosanna! 2"d Addition preliminary and final plat, and an
amendment to Conditional Use Permit No. 96-01, Community and Economic Development
Department staff recommends compliance with the nine stipulations listed in the February
25, 2000 Planning Report with the modification to Stipulation No. 8 and the addition of
Stipulation No. 1-0 as discussed above.
The Commission concurred with staff's recommendation to modify Stipulation No. 8 to
establish a deadline for additional parking stall construction if deemed necessary.
Commissioner Wulff asked if additional parking can be accommodated within the current
plat boundaries. Acting Community and Economic Development birector Daryl Morey
indicated that the church would have to replat to incorporate property from Outlot A into
the Phase IJI site development for additional parking.
Commissioner Wulff indicated her agreement with Ms. Nelson that the developer strive to
preserve the existing trees between the existing Town and Country townhomes and the
proposed ponding area. Commissioner Wulff also expressed her opinion that additional
trees should be provided in this .area to fill in the gaps between the existing trees.
Commissioner Comer stated his concern for the proposed 100-foot cross and whether it is
wind. resistant. Architect Dick Brownlee responded that the proposed cross will be
designed by their structural engineers to meet state and local building codes.

Mr. Mark McAfee, 9834 - 166tH Street West, indicated that his. home. located south of 165tH
Street overlooks the church parking (ot. Mr. McAfee indicated his initial concern was that
the parking lot would be unattractive, but was encouraged that the church is proposing to
include trees and landscape. plantings in the parking lot area and is proposing subdued
parking lot lighting. Mr. McAfee expressed reservations as to the safety for the distance
between the two church parking lot driveway accesses to 165tH Street.
Mr. Brownlee indicated that the traffic study that had been completed for the City
examined the layout of the proposed driveways for the Phase III expansion. No safety
issues were .identified with this study. Assistant City Engineer Tim Hanson noted that the
driveway access design and layout was completed by SRF and the proposed 300-foot
spacing between the two driveway accesses is consistent with the City's Driveway Spacing
Guidelines onto a major collector street (165tH Street).
Mr. Reed Bolander, 9823 166tH Street West, stated he initially had a concern regarding
traffic,.but he felt that the church had addressed the issue by havingtraffic control
personnel on the site during major church events. However, Mr. Bolander expressed
concern regarding headlights onto his property as vehicles exit the church site onto 165tH
Street at Jackdaw Path.. Mr. Bolander requested that the developer consider additional
landscape plantings along 165tH Street to .block headlight glare onto residential properties.
He also expressed concern for the potential glare onto residential property if a street light
is installed at the proposed driveway access at 165tH .Street across from Jackdaw Path.
Assistant City Engineer Tim Hanson responded that a security will be posted by the
developer for street light installation at driveway intersections should they be determined
to be necessary in the future. If street lights are added in the future, they would be
directed on site and should not impact neighboring properties.
There were no further comments from the public.

Commissioner Wulff suggested that additional landscape plantings or a berm be installed
between the parking lot and 165tH Street to furtherscreen parking at the west end of the
site. Commissioner Rieb also suggested. that more trees be added to screen the ponding
area from the residential townhouses to the immediate west. Commission members also
questioned whether the pond could be shifted to the east and additional trees be provided
along. the. property line. between the Town & Country townhouse development and the
ponding area.
Assistant City Engineer Tim Hanson noted thaf the westerly portion of Lot 1 and Outlot A
. has its runoff flow to the northwest to an existing natural depression located within

proposed Outlot B. An outlet is already constructed and in-place within the proposed
Outlot B and, from an engineering standpoint, this is the best location fior the ponding
area. There may be some opportunity to shift the pond area slightly to the east. Mr. Jim
Hayes indicated that the developer would be willing to modify the location of the pond to
provide additional. landscaping along the west side of the pond area. The degree that the
pond can, be shifted to the east will be determined by the developer's civil. engineer.
The Planning Commission discussed tabling action on the Hosanna! Lutheran Church
applicationsto allow the developer and staff time to research. whether additional
landscaping can be accommodated along the west side of the pond and along 165t"
Street. Mr. Hayes indicated that the developer is willing to work with staff to address the
issues raised at this meeting and to determine the best design for the ponding area and to
provide additional landscaping, as discussed.
00.26 MOTION by Wulff, Second by Comer to table action on the applications of Hosanna!
Lutheran Church and directed that a revised landscape plan be completed that addresses
the concerns raised by the Planning Commission regarding additional landscaping along
the westerly property line between the proposed ponding area and the existing residential
townhome development and along 165t" Street.

Acting Community and Economic Development. Director Daryl More indicated that there

were no planning actions to come before the Planning Commission at the March 16, 2000
regular meeting. Therefore, Community and Economic Development Department staff.
recommends canceling the regular meeting and holding a Planning Commission Work
Session for March 16~" to review the proposed Zoning Ordinance Update. Staff. will
contact the Commission members who are absent at this meeting to inform them of the
Work Session and a time that is convenient for all members will be determined. Staff will
then forward a copy of the draft Zoning Ordinance Update along with information
regarding the time and place for the Work Session.
There being no further business, the meeting was adjourned 7:15 p.m.
