WORK SESSION MINUTES MARCH 16, 2000 The March 16, 2000 Planning Commission work session was called to order by Chair Drotning in the City Hall North Meeting Room at 5:00 p.m. The following Planning Commission. members were present: Dave Bellows (6:00 p.m Jerry Comer, Karl Drotning, Sharon Kot, Chris Moates, Laurie Rieb, Bruce Skipton, Wendy Wulff and Ex-Officio Member Tim Knutson. The following staff were present: City Administrator. Robert Erickson, .Acting Community & .Economic Development Director Daryl Morey, City Attorney Roger Knutson, Associate Planner Frank Dempsey, Associate Planner Ron Mullenbach, and planning consultant David Licht. City Council Member David Luick was also present. The Planning Commission discussed the following issues related to the draft Zoning Ordinance update: .Chapter 1 Title and Application. • Throughout the document, we should reference the actual date of adoption of the new zoning ordinance, rather than July 1, 2000. Chapter 2 Rules and Definitions • A definition for non-retail landscape nurseries is needed to address issues related to retail garden centers/nurseries. Staff will discuss this issue with the City Attorney's office. • The definition. for commercial equipment currently does not reference seasonal property .maintenance equipment (snow plows and lawn care equipment used .for commercial purposes). .The Planning Commission. agreed that lawn care equipment used for commercial.purposes should be prohibited from being stored in residential zoning districts._ • Should the definition of motels/motor hotels allow-.for. a manager quarters? Mr. Licht indicated that this regulation would more appropriately be handled in the districts sections. • Staff will ensure that there is consistency between the Zoning Ordinance and the Uniform Building-Code definitions forbuilding height and story? • Mr. Licht will clean-up the definitions for motor fuel stations, sign and private garages.. Chapter 3 Administration -Amendment • Section 11-3-3.E. will be revised to include a requirement for consistency with the City Code. Chapter 4 Administration -Conditional Use Permits • • Sectionl1-4-7.A. was reviewed and determined to be acceptable in its current form. • Section 11-4-7.K. was reviewed and determined to be acceptable in its current form. • Section 11-4-3.E. will be revised to include a requirement for consistency with the City Code. .Planning Commission Work Session Minutes March 16, 2000 Page 2 Chapter 5 Administration -Interim Use Permits • Section 11-5-1.A. -change"brief' to "temporary". Chapter 6 Administration -Variances • No changes were proposed. Chapter 7 Administration -Appeals' • No changes were proposed. Chap#er 8 Administration -Administrative Permits and Approvals • No changes were proposed.. Chapter 9 Administration -Site Plan Review • Section 11-9-7.B. will be revised to read: Proof of Ownership or Authorization: The applicant shall supply proof of title and the legal description of the property for which the site plan approval is requested and as applicable supply documented authorization from .the owner(s) of the property in question to proceed with the requested site plan application. • Section 11-9-19 -the. Planning Commission discussed when the financial guarantee should be submitted to the City. Staff stated that the current practice of collecting the financial .guarantee prior to City Council consideration of a request as opposed to at the time of temporary certificate. of occupancy works well by identifying. the cost up-front for the. applicant and removing the responsibility from the Inspections Department staff to collect the guarantee. There was no consensus to change the practice. • The following should be added to Section 11-9-19. D. -All trees shall be warranted to be alive, of good quality, and disease free for twelve (12) months after planting. Any replacement shall be warranted for twelve (12) months from the time of planting. Chapter 10 Administration- General • Section 11-10-5. B. -The Planning Commission discussed whether a quicker turn-around period be applied. for issuance of a CO? Staff stated that the current practice is to issue a certificate of occupancy within one business day of final inspection. Mr. Knutson recommended that paragraph A of this section be moved to the City Code and that paragraph B be dropped. Chapter 15 Non-Conforming Buildings, Structures and Uses • Staff recommended that Sections 11-15-3.B. and C. be removed per the direction of the City Attorney's office due to the new State law regarding amortization. Mr. Licht will discuss the removal of paragraph C with Mr. Knutson. • Section 11-15-9 -The City Attorney's office is drafting lot combination requirements to be included in this section.. This process would replace the current practice of having Planning Commission Work Session Minutes March 16, 2000 Page 3 applicants request combination from Dakota County. The City Attorney has informed us that we need to change the method currently being used. Chapter 16 General Performance Standards • Section 11-46-7.A. should reference the Vermillion River WMO, the Black bog WMO and EPA standards. • The.l4-day time frame in Section 11-16-7.J. was discussed. The provision will be .revised to seven (7) days to be consistent with the City's standard development contract. • Section 11-16-7.N. will be revised. to be consistent wi#h .the City's standard development contract. • Chapter 16 or 17 should include a provision allowing no more than 70% impervious surface coverage in the Crystal Lake Drainage Area, as defined in the- Stormwater Management Plana Chapter 17 General Yard, Lot Area and Building Regulations • Section. 11-17-9.A.3.c. should be revised to allow only brick, stucco, vinyl,. natural stone and natural and composite wood building finishes in residential districts. • :Section 11-17-9.C.1. -the Planning Commission discussed whether up to 50% metal wall. finishes should be allowed in the commercial districts. The consensus was to eliminate the 50% allowance in favor of 100% brick, natural stone, concrete block or pre-cast concrete finishes. A separate section for commercial finishes will be added. • .Section 11-17-15 -Staff will contact the Dakota County Community Development Agency regarding the percentage of efficiency apartments to permit in apartment buildings.. • Section 11-17-23 should be handled in individual zoning districts. • "The Planning Commission agreed to the removal of Section 11-17-29.A.3. which. is not consistent. with the Comprehensive Land Use Plan density of one unit per ten acres and conflicts with the base lot requirement in the R-A District. • The Planning Commission discussed whether a hierarchy of setbacks' from collector and arterial streets should be added to this section. Staff stated that enhanced screening, rather than setbacks, would be more. effective in .addressing the impacts of these roadways on adjacent development. Unique property .characteristics (i.e. significant grade changes) will make it difficult to implement strict berming requirements. Staff will draft language for the subdivision ordinance to address this concern. • Staff has previously discussed .rear yard setback applications for single family corner lots with the home"fronting" on the side yard. The Planning Commission discussed whether we want to require that rear yard setback (30 feet) be required in the "back" of the house.in these situations. The requirement will be implemented administratively on a case-by-case basis rather than within the Zoning Ordinance. Chapter 18 Accessory Buildings, Structures, Uses and Equipment • Section 11-18-5.C.3. -The Planning Commission agreed that all accessory buildings in the RS-CBD District should have a five (5) foot side yard setback. • Section 11-18-5.C.4 -The Planning Commission agreed that detached accessory buildings not exceeding 120 square feet could be setback a minimum of six (6) feet from other buildings or structures on the same lot. Planning Commission Work Session Minutes March 16, 2000 Page 4 • • Section 11-18-7.C.1. -need to add a 15 foot height restriction for detached accessory buildings. in the RS-CBD District. • Section 11-18-7.D.1. -need to add floor area limitations for the RS-CBD District.. (same. as RS-3 would be acceptable). We also need to differentiate between accessory building floor areas "per unit" in the RST District. The RS-4 District floor area should be reduced. Chapter 19 Off-Street Parking Requirements • Sections 11-19-7.J. and 11-19-21 -Should include statements that a parking deferment will not be granted in the C-CBD District or for commercial and institutional uses. • The Planning Commission discussed whether parking deferments in excess of 50% should be allowed for automated manufacturing uses. There was no consensus to allow parking deferment in excess of 50% as the current requirements have worked well • The table on .Page 19-11 includes increased parking setbacks for commercial. uses. Staff will review recent commercial development in relation to these setbacks. • New C-CBD District parking requirements are included in the table on Page 19-14. The requirement should be three (3) spaces per one thousand (1,000) square feet for office/retail uses. • The .parking requirement for elementary schools should be one (1) space per (7) students based on'building designcapacity. • The planning consultant will review the parking requirements for golf driving ranges and racquetball/tennis courts. • Section 11-19-19:F. should contain a requiremenf that the off-site parking be located on an adjacent property. The Planning Commission questioned the feasibility of a privateshuttle. service. Chapter 20 Off-Street Loading • No changes were proposed. .Chapter 21 Fencing/Screening/Landscaping • The Planning Commission agreed to the removal of Section 11-21-7.B. All properties complied with this requirement. Any replacement of trees at these sites will be subject to the new landscaping requirements. Chapter 22 Outdoor Storage • The Planning Commission agreed to the removal of Section 11-22-3.C. Chapter 23 Signs • Staff will be completing "housekeeping" changes to reference new district nomenclature only. A comprehensive revision is not being considered at this time. Chapter 24 Land Reclamation and Mining • The City Attorney will be drafting a new Chapter 24 which will .prohibit gravel mining in Expansion Area A. Planning Commission Work Session Minutes March 16, 2000 Page 5 Chapter 25 Public Property/Rights-of-Way • The City Attorney's office `is revising this chapter. Chapter 26 Essential Services • This chapter does not allow essential services as a permitted use, but the zoning districts allow essential services as a permitted use. Chapter 27 Model Homes • The Planning Commission agreed to allow the use of model homes for the display and sale of general merchandise and crafts only if approved by administrative permit. Chapter 28 Temporary Structures • No changes were proposed. Chapter 29 Wind. Energy. Conversion System (WECS) • No changes were proposed. Chapter 30 Antennas • No changes were proposed. Chapter 31 Day Care Facilities • No changes were proposed. Chapter 32 Home Occupations • Staff will review the City of Burnsville home occupation ordinance. • Section 11-32-7.A.10 will be revised to read "...unless said occupation will not require any off-street parking facilities." • Section 11-32-7.B.2 should require parking in guest parking areas for multiple-family developments. • Section 11-32-1 will be revised to include wording to encourage telecommuting. Chapter 33 Specialized Housing • Residential shelters should be an interim use, as opposed to a conditional use. • The number of occupants should be limited. • The definition in Chapter 2 should clearly state. the types of residential shelters that are acceptable. • Planning Commission Work Session Minutes. March 16, 2000 Page 6 Chapter 34 Sexually Oriented Uses NAC will submit a proposal (work. program and cost estimate) for an update/study of this .Chapter following completion of the Zoning Ordinance update. • NAC will complete a quick survey on the geographical effects of the new 2020 Land Use Plan on Sexually Oriented Uses. • The City Attorney .will draft an ordinance extending the moratorium on sexually .oriented uses until this chapter carr be reviewed. Chapter 35 Animals • No changes were proposed. Chapter'36 Airport Zoning. • No changes were proposed.
