Residential Developer Meeting Notes

Director Daryl Morey, City Attorney .Roger Knutson, .Assistant City Engineer Tim Hanson,
Associate Planner Ron Mullenbach, and planning consultant David Licht of Northwest
Associated Consultants,
Planning Commission Chair Karl Drotning opened the neighborhood meeting at 3:00 PM and
welcomed all those in attendance. Mr. Drotning then introduced staff in attendance and stated
that the purpose of the meeting was to review the draft zoning ordinance and draft zoning map.
(A copy of the draft zoning ordinance and map, comparison of the current and proposed zoning
districts, and a draft use matrix was distributed to those at the meeting.)
David Licht of Northwest Associated Consultants, the City's planning consultant, reviewed .the
Zoning Ordinance for those in attendance: The Zoning Ordinance has three basic sections, the
administrative sections, performance standards, and zoning districts:
The draft zoning ordinance contains enhanced performance standards related to landscaping,
building materials, and townhouse design standards. Residential developers should read
through these performance standards and submit their comments on them prior to April 7cn.
• Mr. Licht then highlighted some areas of the residential zoning districts. The AP and RA District
have stayed basically the same, but a new RAO, Rural/Agricultural Overlay Districf is proposed
to be applied over all areas within the Staged MUSA Expansion Areas A, B, and C. The RS-1,
RS-2, RS-3, RS-4 and RST Districts are proposed consistent with the current R-1, R-2, R-2A,
R-3, and R-4 Districts. Anew RS-CBD District is proposed to be applied for existing lots in the
historic downtown. The District will bring a majority of the downtown residential properties into
conformance with lot area requirements.
Mr. Licht stated that the new zoning ordinance also will include new RM-1, RM-2, RH-1 and RH-
2 zoning districts. The RM-1 and RH-1 zoning districts set specific development densities and
performance standards for townhouse and apartment dwelling units, respectively. The RM-2
and RH-2 Districts contain .development density bonus features allowed as conditional use
permits. All properties guided for medium, medium/high, and high density .residential land uses
will be zoned either RM-1 or RH-1. Developers will. have the option of requesting a rezoning to
RM-2, RH-2 or PUD at the time of development in order to gain more flexibility. Mr. Licht added
that requests to gain additional flexibility .must include benefits to the City. The development
density bonus feature identifies what those specific benefits could be.
City Administrator Bob Erickson stated that the Metropolitan.. Council recently reaffirmed their
policy regarding MUSH staging plans. The Met Council expressed that areas with adequate
transportation and wastewater treatment facilities. could allow growth in the staged MUSA
expansion areas. Mr. Erickson added that the area served by the Empire Wastewater
Treatment Plant, which includes Lakeville, is not an area where development in the staged
• MUSA expansion areas can be allowed at this time due to a lack of capacity at the treatment
plant to accommodate the additional development. The Empire Wastewater Treatment Plant
must be expanded to accommodate Staged MUSA Expansion Area A.

Jim Stanton of Shamrock Development asked whether the proposed zoning ordinance will allow
zero lot line. housing: and whether the densities identified in the development density bonus.
feature was based on net or gross area. Mr. Licht responded that a rezoning to PUD in any of
the multiple family residential districts would provide the flexibility needed for zero lot line
housing. The densities in the bonus feature are net densities.
AI Schackman of Asset Management Consultants asked what uses will be allowed in the RAQ
District. Mr. Licht stated .that the RAO District uses will be allowed until such time as the
property comes into the MUSA.
Kelly Murray of Wensmann Homes and Terry Matula of DR Horton asked whether a PUD will be
allowed in an area zoned RST. Mr. Licht stated that staff would not support a rezoning to PUD
in these .areas.. Developers with property zoned RST on the draft zoning .map should submit
written comments to the City by April 7cn if they would like a different zoning considered.
Mr. Schackman asked whether some revision. to the boundary of zoning districts will occur. Mr.
Licht stated that some minor. shifting of the zoning district boundaries within single parcels of
land can be expected when development occurs.
Mr. Erickson directed those in attendance to review a new requirement in the draft zoning
ordinance that would require a minimum of 50% masonry exterior on multiple family buildings.
This percentage would be exclusive of doors and windows. Mr. Erickson asked that the
.residential developers review this requirement in relation to their products and provide feedback
on whether the 50% benchmark is appropriate.
Mr. Licht urged those in attendance to review the draft zoning. ordinance that was distributed
and return comments to the City_no later than Friday, April 7m
.There being no further questions, the meeting was adjourned at 4:15 PM. Mr. Licht invited all in
attendance to speak individually with staff members regarding their site-specific concerns and
questions.
