Commercial/Industrial Developer Meeting Notes
3:00 PM -Thursday, March 30, 2000

Staff Present: City Administrator Bob Erickson, Acting Community & Economic Development
Director Daryl Morey, City Attorney Andrea McDowell-Poehler, Assistant City Engineer Tim
Hanson, Associate Planner Ron Mullenbach, and planning .consultant David Licht of Northwest
Associated Consultants.
Planning Commission Chair Karl Drotning opened the meeting. at 3:00 PM and welcomed all
those in attendance. Mr. Drotning then introduced staff in attendance and stated that the
purpose of the meeting was to review the draft zoning ordinance and draft zoning map. (A copy
of the draft zoning ordinance and map, comparison of the current and proposed zoning districts,
and a draft use matrix was distributed to those at the meeting.)
David Licht of Northwest Associated Consultants, the City's planning consultant, .reviewed the
Zoning Ordinance for those in attendance. The Zoning Ordinance has three basic sections, the
administrative sections, performance standards, and zoning districts.
The administrative section includes a section containing all performance standards common to
.conditional use permit requests, a new administrative permits section, and a section containing
all site plan information requirements. The requirement for site plans to be reviewed by the
• Planning .Commission and City Council has been removed in lieu of staff review. Mr. Licht
stated that the new zoning ordinance will include .certain uses that will. be allowed by
administrative permit.. Administrative permits are approved by the Zoning Administrator, a
position that is filled by the City Administrator.. The administrative permit process is intended to
reduce the time and money needed for some commercial development in the City.
The performance standards include requirements related to landscaping, building materials,
erosion and .drainage, wetlands, parking, and loading. The zoning districts include a new RAO,
RuraUAgricultural Overlay District and new multiple family residential districts. The current B-1
and B-2 Districts have been- combined into the C-1 District. Otherwise, the commercial and
industrial zoning districts include few changes from the current zoning ordinance.
Mr. Licht urged those in attendance to .review the draft zoning ordinance that was distributed
and return comments to the City no later than Friday, April 7m
City Administrator Bob Erickson stated .that the Metropolitan Council recently reaffirmed their
policy. regarding MUSA staging plans. The Met Council expressed that areas with adequate
transportation and wastewater treatment facilities could allow growth in the staged MUSA
expansion areas. Mr. Erickson added that the. area served by the Empire Wastewater
Treatment Plant, which includes Lakeville,. is not an area where development in the staged
MUSA expansion areas can be allowed at this time due to a lack of capacity at the treatment
plant to accommodate the additional development. The Empire Wastewater Treatment Plant
must be expanded to accommodate Staged MUSA Expansion Area A.
. Jack Matasosky of APPRO Development questioned the reasoning behind a 33 foot structure
setback from wetlands, since wetland boundaries change over time. City Administrator Bob
Erickson stated that the 33 foot (2 rod) setback is consistent with best managementpractices:

To address the concern regarding wetland boundaries changing overtime, the zoning ordinance
could be revised to determine setbacks "at the time of development". This would permanently
establish the setbacks on the approved site and grading plans.
Roger Derrick of Bridlewilde, Inc. asked the criteria for applying specific zoning districts to
properties.. Mr. Licht stated that the basis of the draft zoning map is the new 2020 Land Use
Plan. Planning Commission Chair Drotning added that attention was also given to the
surrounding properties.
John Dietrich asked if the City had priorities for upgrading the freeway interchanges at County
Road 50, 185`h Street, and County Road 70. City Administrator Erickson stated that the City
Council has .placed improving the 185'h Street interchange as its highest priority, followed by
County Road 70 and then County Road 50. The timing of such improvements is dependent on
the availability of state and federal funding. Mr. Erickson also added that the County Road 50
interchange will most likely be improved in stages, as development projects are proposed:°
There being no further questions, the meeting was adjourned at 4:15 PM. Mr.'Licht invited all in
attendance to speak individually with staff members regarding their site-specific concerns and
.questions.
