APRIL 20, 2000
The April 20, 2000 Planning Commission meeting was called to order by Chair Drotning in
the City Hall Council Chambers at 6:00 p.m.
Roll call of members was taken:
Present: Skipton, Drotning, Rieb, Comer,. Wulff, Ex-Officio Commission Member
Knutson.
Absent: Bellows, Kot.
Staff Present: Robert Erickson, City Administrator; Daryl Morey, Acting Community and
Economic Development .Director; Frank Dempsey, Associate Planner; Ron Mullenbach,
Associate Planner; Tim Hanson, Assistant City Engineer; David Licht, Planning
Consultant; Roger Knutson, City Attorney; and Donna Quintus, Recording Secretary.
ITEM 4: PUBLIC HEARING: City Code/Zoning Ordinance Update:
Chair Drotning opened the public hearing to consider the amendment to the following.
ordinances: 1) Title 9, Chapter 3 of the Lakeville City Code, the Sign Ordinance; 2) Title
10 of the Lakeville City Code, the Subdivision Ordinance; and 3) Title 11 of the Lakeville
City Code, the Zoning'Ordinance and Zoning Map. City Attorney Roger Knutson attested
that the legal notices had been duly mailed and published in accordance with state
statuses.
ChairDrotning indicated that the purpose of this public hearing is to receive public
comment from Lakeville residents, property owners, developers, contractors and .other
interested persons regarding proposed amendments to the City's Zoning Ordinance,
Zoning Map, Sign Ordinance and Subdivision Ordinance. Chair Drotning indicated that
the Planning Commission will accept all comments this evening with no final action on the
draft ordinances until City staff finalizes responses to all received written comments on
these documents. All comments and staff responses will then be discussed at a Planning'
Commission work session on a date to be determined later in this meeting.
David Licht, Northwest Associated Consultants (NAC), stated that Citystaff and NAG have
been working. on the update to the City's Zoning Ordinance, .Zoning Map, Sign Ordinance
and Subdivision Ordinance for the past eight months. State statute mandates that these
documents must be brought into consistency with the new Comprehensive .Plan Update
which was approved in 1999.
Mr. Licht provided an overview of the draft documents. He indicated that the update to the
Sign Ordinance includes no proposed policy changes with revisions limited to referencing
new district nomenclature in the draft Zoning Ordinance. Similarly, the proposed
Subdivision Ordinance has been revised to reference the new district nomenclature in the
draft zoning ordinance, as well as to incorporate some new policy changes proposed in
conjunction with the draft Zoning Ordinance.

• Mr. Licht also reviewed the draft Zoning Ordinance, which has three basic. components:
administrative procedures, performance standards and zoning districts. Modifications to
the Administrative section include:
1) Chapter 4 (Conditional Use Permits) includes general performance standards which
will be applicable to all conditional uses;
2) organizational changes such as the division of variances and appeals into two
chapters;
3) the. addition of a section authorizing administrative approval on general requests that
are technically oriented and which can be reviewed by in-house technical staff. The
use of Administrative Permits is designed to expedite specific applications;
4) specific site plan information requirements;
Modifications to the performance standards include:
1) general performance standards such as parking requirements, building height,
landscaping and other elements for uses in all districts;
2) detailed erosion control and drainage standards are now included in the City Code;
3) off-street parking requirements which are based on current studies and are reflective of
current vehicle sizes (vans, compact vehicles, etc.);
• 4) .performance standards for temporary structures;
5) standards for cellular communication towers in response to new technical apparatus;
and
6) standards for specialized housing including `bed & breakfast' or residential shelter
facilities, such as for battered women.
Mr. Licht stated that some new zoning. districts have been added and some existing zoning
districts have been removed based on changed philosophies for the various districts. Mr.
Licht indicated that current legislation obligates the City to make the Zoning Map
consistent with the approved 2020 Comprehensive Land Use Plan. Mr. Licht indicated
that the draft Zoning Map attempts to identify the most appropriate zoning of each
.property based on the approved Comprehensive Land Use. Plan.
.Chair Drotning opened the public hearing to receive comment from those in attendance.
Chair Drotning reiterated that all written comments will be discussed at a Planning
Commission work session. All those in attendance at this public hearing and all who have
submitted written comments regarding the draft Zoning Ordinance, Sign Ordinance,
Subdivision Ordinance and Zoning Map will receive written notice regarding the date and
time of the Planning Commission work session and the continued public hearing.

Dave Sellergren, representative for Nordic Square Limited Partnership,. which owns a 320-
acre site located in the northeast corner of County Road 46 and Pilot Knob Road -have a
Planned Unit Development (PUD) agreement with the City. Mr. Sellergren indicated that
the draft Zoning Map does not identify this areas as PUD. Mr. Sellergren requested that
the subject property be zoned PUD, Planned Unit Development.
Daniel Laun, 8625 - 206t" Street, indicated he had submitted written comments and no
one had responded to those comments as of this date. The Planning Commission
members acknowledgedthat Mr. Laun's comments had been submitted to them for their
review and they would be discussing those at the work session.
Mr. Licht noted for the record that in fairness to all persons who had submitted written
..comments, the Planning Commission and staff are preparing all responses and will be
responding to all parties within the same timeframe.
Jeff Carpenter and Gary Shamp, representing Midway National Bank, identified Midway
National Bank as the fee owner of the property located in the northwest corner of Cedar
Avenue and Glacier Way (Lot 1, Block 1, Shady Oak Shores 8t" Addition) which is in a
foreclosure action. Mr. Carpenter stated that the .property .had been accepted as collateral
based on the current zoning. The proposed O-R, Office-Residential Transition District
zoning of the property dramatically affects the value of the property.

Chair Drotning requestedthat Mr. Carpenter and Mr. Shamp submit their comments in
writing for further review by staff and- the Planning Commission.
Leonard Mallery, representing Francis and Laura Mallery, indicated that, in addition to
previous written comments, they do not support the suggested O-R, Office-Residential
Transition District zoning of their property, located in the northwest corner of 185th Street
and Kenyon Avenue. Mr. Mallery indicated that Mr. and Mrs. Francis Mallery feel the best
use of the subject property would be C-3, General Commercial District.
Robert Peterson, owner of Lakeville Storage on Dodd Boulevard and County Road 70,
indicated that he had not received notices regarding the impending update to the City's
Zoning Ordinance and Zoning Map until a week ago. Mr. Peterson stated he had
submitted written comments dated April 11, 2000 and the issues identified in his letter still
stand.
Leo Tutewohl stated that approximately a year ago staff had indicated to him that his
property located along Pilot Knob Road would. be zoned for medium density residential
land uses. He noted that the draft Zoning Map does not identify his property for this use.
There was no additional comments from the public.
~.38 MOTION by Rieb, Second by Skipton to continue the public hearing for the Zoning
Ordinance, Sign Ordinance, and Subdivision Ordinance update to a future date.
Ayes: Skipton, Drotning, .Rieb, Comer, Wulff.
Nays: 0.
City Administrator Robert Erickson indicated that all responses to written comments will be
sent by May 1St and the letters will include the date, time and place of the Planning
Commission work session.
The Planning Commission agreed to hold a work session on Tuesday, May 9, 2000 at
6:00 p.m. at the Lakeville City Hall.
There being no further business, the meeting was adjourned 7:10 p.m.
