HomeMy WebLinkAbout05-18-00 CITY OF LAKEVILLE Planning Commission Meeting Minutes MAV 18, 2000 The May 18, 2000 Planning Commission meeting was called to order by Chair Drotning in the Gity Hall Council Chambers at 6:00 p.m. Roll call of members was taken: Present: Bellows, Kot, Skipton, .Drotning, Rieb, Comer, Wulff, Ex-Officio Commission Member Knutson. Absent: 0. Staff Present: Daryl Morey, Acting Community and. Economic Development Director; Frank Dempsey, Associate Planner; Andrea McDowell Poehler, Assistant City Attorney; and Donna Quintus, Recording Secretary. Chair Drotning requested that the draft May 4, 2000 Planning Commission minutes be amended to clarify that the Apple Valley residents attended a neighborhood meeting and expressed their concerns regarding the proposed realignment of Highview Avenue in Lakeville with Garden View Drive in Apple Valley and that the Apple Valley City Administrator and staff and Lakeville staff were also in attendance at the neighborhood meeting. The May 4, 2000 Planning Commission Meeting minutes were approved as .amended. • The May 9, 2000 Planning Commission Work Session Notes were received and are hereby entered into the permanent record. ITEM 4; Announcements Acting Community and Economic Development Director Daryl Morey reminded the. Commissioners of the Special Work Session scheduled for Wednesday, May 24, 2000 at 5:OO p.m. in the north meeting room of City Hall for discussion of the March 28,2000 draft of the Zoning Ordinance update. Also, a coaching session wrap-up will be presented by Marilou Thibault on Thursday, June 1, 2000 at 5:00 p.m. prior to the regularly scheduled Planning Commission meeting. ITEM 5. Public. Hearing: Comprehensive Park, Trail and Open Space Plan Update Steve Michaud, Parks and Recreation Director, presented the details of the draft update of the current Comprehensive Park, Trail and Open Space Plan. Mr. Michaud indicated that the purpose of this document is to develop a coordinated, updated plan for park, trail and open space facilities based upon community characteristics, an assessment of existing facilities, and the community's projected needs.. The 1998 Comprehensive Land Use Plan Update placed strong emphasis on several goals relating to parks, trails and open space, including the following: 1) .Development of a natural resources inventory and management plan and identify financing mechanisms for the acquisition of significant environmental areas. Planning Commission Meeting May 18, 2000 Page 2 • 2) Establishment of greenway corridors as a means to protect environmentally sensitive areas, maintain natural open spaces, define neighborhoods, provide for pedestrian trails, increase storm water infiltration and provide wildlife corridors. 3) Design facilities to maintain a sense of community identity and recognition. 4) Provide an appropriate balance between active,. passive and :cultural recreational areas and activities tailored to the needs of the population throughout the community. Mr. Michaud stated that the initial Lakeville Park System. Plan was completed in 1979, updated in 1985 and updated again in 1992. These plans inventoried existing faclities- and assessed the needs of different park types based on future. growth as it was projected. The Lakeville Trails System. Plan, prepared in 1987 and updated in 1992, established .guidelines for identifying future pedestrian and bicycle trail corridors and outlined policies for their design, acquisition, development and maintenance. These two documents have been combined to create the proposed Comprehensive Park, Trail and. Open Space Plan for purposes of guiding the City in recreation facility planning through 2020. Through the proactive implementation of the Lakeville Park, Trail and Open Space Plan, the City has established a comprehensive network of recreational spaces that contribute to the quality of life within the community as well as to the community's overall identity. • Mr. Michaud provided the Commission with some general information regarding future park and trail locations that have been identified in the proposed plan update. He noted that there will be opportunities for park and trail construction as the City develops that will benefit current, as well as future, residents. Mr. Michaud indicated that the. City is actively seeking to acquire properly in areas identified for future park and trail development as it • becomes available. Mr. Michaud responded to specific questions from the Commission regarding existing and proposed park and trail locations, future. connections to Ritter Farm Park, the Casperson Park amphitheater, and the layout and design of a future community center. Mr. Michaud also described the joint venture of the City and school districts to develop school/park complexes for dual use of outdoor and indoor facilities for use. by both City and school organizations. The Commission concurred that the. proposed update to the Comprehensive Park, Trail, and Open Space Plan was an impressive document that is consistent with the City's Comprehensive Land Use Plan Update. At the request of Chair Drotning, Parks and Planning Commission Meeting May 18, 2000 Page 3 Recreation Director Michaud acknowledged the individuals and associations for their support and participation in the preparation of the plan. 00.52 MoTioN by Wulff, Second by Comer that the Planning Commission finds that the proposed .Park, Trail and Open Space System Plan is consistent with the City's Comprehensive.. Land Use Plan and to recommend to City Council approval and adoption of the 2000 Park, Trail and Open Space System Plan. Ayes: Kot, Skipton, Drotning,. Rieb, Comer Wulff, Bellows. ..Nays: 0. ITEM 6. Public Hearing: Duke Adamski Conditional Use Permit and Variance ~®4'~® Chair Drotning opened the public hearing for consideration of the application of Duke Adamski for a conditional use permit to allow the expansion of an existing non-conforming single family dwelling in the R-2, Single Family Residential District and within the .Shoreland Overlay District of Orchard Lake. Assistant City Attorney Poehler attested that the legal notice had been mailed and published in accordance with state statutes, .Duke Adamski, property owner, presented his request for a conditional use permit (CUP) to allow the construction of an addition onto his non-conforming single family home located at 17361 Kodiak Avenue.. The plan includes a 224-square foot addition onto the second floor master bedroom with an enclosed storage area below the'master bedroom expansion. Associate Planner Frank Dempsey presented the Planning Report and provided details regarding the conditional use permit application of Mr. Adamski. Mr. Dempsey noted that the subject property, platted in 1961, is a legal non-conforming lot of record in the Ken Con Estates subdivision. In reviewing the property survey for the proposed addition, staff .identified one non-conforming issue related to the property. The non-conforming item pertains to the existing 9.56-foot side yard building setback to the north property line. A 10-foot setback is required in the R-2, Single Family Residential and Shoreland Overlay Districts. All other setback requirements are being met, including that of the proposed addition. .There were no comments from the audience. 00:53 MOTION by Kot, Second by Rieb to close the public hearing at 6:40 p.m. Ayes: Skipton, Drotning, Rieb, Comer, Wulff, Bellows, Kot. Public Hearing: Tim and Tracy Radtke Conditional Use Permit Amendment Chair Drotning opened the public hearing for consideration of-thee application of Tim and Tracy Radtke for. an amendment to Conditional Use Permit No. 97-22 to .allow the.. expansion of an existing non-conforming single family dwelling located at 19713 Jersey Avenue in the R-2, Single Family Residential District and within the Shoreland Overlay District of Lake Marion. Assistant City Attorney Poehler attested that the legal notice had been mailed and published in accordance with state statutes. Tim Radtke, property owner, presented his request for a conditional use permit (CUP). amendment to allow him to construct an addition onto his existing non-conforming single family home located at 19713 Jersey Avenue. Mr. Radtke indicated that in 1997 he was granted a CUP for the construction of an addition onto the rear (west) of his .house toward Lake Marion. His .current request represents the final phase of his home improvement plan that includes the construction. of additional living space to the east .(street side) of his existing home. Associate Planner Frank Dempsey presented the Planning Report and provided details regarding Tim. and Tracy Radtke's request for an amendment to Conditional Use Permit No. 97-22. Mr. Dempsey noted that the subject property, platted in 1908, is a legal non- . conforming lot ofrecord located in the Lenihan's Lots, Antler's Park subdivision. On November 17, 1997, the City Council approved a CUP to allow the Radtkes to construct an addition onto the rear of the house. At that time, the property survey indicated four non-conforming issues related to the property.. The non-conforming items included: 1) the .lot did not meet the minimum 100-foot lot width; 2) the existing house did not meet the required 10-foot side yard setback to the north property line; 3) the existing detached garage did not meet the minimum 10-foot side yard setback; and 4) the driveway was not paved. Mr. Dempsey indicated. that the current revised survey submitted with the CUP amendment application indicates that the driveway has been paved consistent with the. previously approved CUP. However, in addition to the existing detached. garage, a second detached accessory structure (shed) has been constructed since 1997 without a building or site plan permit. Mr. Dempsey indicated that the current Zoning Ordinance does not permit two detached accessory structures on a single lot. Mr. Radtke indicated that he wishes to keep the shed on his property until his project is underway. He agreed to bring the shed into compliance with Zoning Ordinance requirements by September 1, 2000. Staff has agreed to Mr. Radtke's request and is recommending an amendment to Stipulation d) to read as follows: "The existing non-conforming detached storage shed • located behind the garage shall be brought into compliance with Zoning Ordinance requirements by September 1, 2000." Planning Commission Meeting May 48, 2000 Page 5 Associate Planner Dempsey stated that if the Planning Commission chooses to recommend approval of the conditional use permit amendment as requested by Tim and Tracy Radtke, Community and Economic Development Department staff recommend the four stipulations as outlined in the May 12, 2000 Planning Report with the modification to Stipulation d) as discussed above. There were no comments from the audience. 00.55 MOTION by :Bellows, Second by Skipton to close the public hearing at 6:50 p.m. Ayes:. Rieb, Comer, Wulff, Bellows, Kot, Skipton, Drotning. Nays: 0. Chair Drotning clarified for Mr Radtke that the Zoning Ordinance states that alterations may be made on legal non-conforming buildings and residential units via a conditional use permit. However,. a dwelling may .not be demolished beyond fifty percent (50%) of its fair market value and a new dwelling constructed unless the new dwelling is in full compliance with current Zoning Ordinance requirements. Mr. Radtke indicated his awareness of this requirement.. *1.56 MoTioN by Bellows, Second by Kot to recommend to City Council approval of the application of Tim and Tracy Radtke for an amendment to Conditional Use Permit No. 97- 22 to allow the expansion of an existing non-conforming single family dwelling located at 19713 Jersey Avenue, legally described as Lot 17, Block 23, Lenihan's Lots, Antler's Park, subject to the four stipulations as listed in the May 12, 2000 Planning Report with an amendment to Stipulation d) as referenced above and approval of the Findings of Fact dated May 18, 2000. Ayes: Comer, Wulff, Bellows, Kot, Skipton, Drotning, Rieb. Nays: 0.
