HomeMy WebLinkAbout05-24-00 work session • CITY OF LAKEVILLE PLANNING COMMISSION WORK SESSION MINUTES MAY 24, 2000 The May 24, 2000 Planning Commission work session was called to order by Chair Drotning in the City Hall North Meeting Room at 5:05 p.m. The following Planning Commission members were present: Dave Bellows, Jerry Comer, Karl Drotning, Sharon Kot (5:45 p.m.), Laurie Rieb, Bruce Skipton, Wendy Wulff,. and Ex-Officio Member Tim Knutson. The following Planning Commission members were absent: None. The following staff were present: City Administrator Robert Erickson, Acting Community & Economic Development Director Daryl Morey, City Attorney Andrea McDowell Poehler, Associate Planner Ron Mullenbach, planning consultant Daniel Licht, and planning consultant David Licht. Chair Drotning stated that the purpose of the work session was to .provide staff with final .comments on the draft Zoning Ordinance, draft Zoning Map, draft Sign Ordinance,. and draft Subdivision Ordinance. The Planning Commission began their discussion with outstanding issues from the May Stn Rlanning Commission work session. These issues were as follows: • OUTSTANDING ISSUES FROM THE MAY 9T" PLANNING COMMISSION WORK SESSION Antenna Ordinance: Daniel Licht of Northwest Associated Consultants stated that he had spoken with Mr. John Bellows, Jr. regarding the proposed Antenna Ordinance. Mr. Bellows is in agreement with the latest draft of the proposed ordinance except for two issues: retraction requirement and the maximum size of antenna equipment. The proposed ordinance and the retraction requirement reflects the policy decision made by the City Council as part of the .Paul. Ramey conditional use permit. Mr. Ramey is required to retract his antenna when not in use to a height not to exceed 35 feet. This requirement has been difficult to administer due to the factthat it is not, clear for people viewing the antenna from outside the home when the antenna is actually in use. The general consensus of Planning Commission members was that the draft ordinance should be changed to allow a maximum height of 50 to 70 feet. This would remove the administrative difficulties of enforcing a retraction requirement. Commissioner Wulff indicated that she was less willing to support a revision to the draft ordinance due to consideration for the neighbors of Mr. Ramey. Acting Community & Economic Development Director .Morey indicated that it may be appropriate for the Planning Commission to keep the current ordinance language, but to forward a formal recommendation regarding the retraction requirement with a motion at the continued .public hearing on the Zoning Ordinance Update. After some discussion, Planning Commission • members agreed to consider a motion regarding the retraction requirement at the continued public hearing. Planning Commission Work Session Minutes May 24, 2000 Page 2 The Planning Commission also discussed the maximum size antenna for ham radio equipment. Daniel Licht stated that the antenna come in various shapes. The Planning Commission stated that a limit should be put on the allowable size antenna for such equipment, and that the size of typically used antenna should be considered. Mr. Licht will forward a recommendation on this item at the continued public hearing. Daniel Licht added that he will be discussing with the City Attorney whether certain antennas should be allowed by interim use permit or conditional use permit. Loading Space Requirements: Associate Planner Ron Mullenbach stated that the draft of the Zoning Ordinance increases the requirements for loading spaces significantly over the current Zoning Ordinance. David Licht of Northwest Associated Consultants stated that this change is necessary to ensure the long-range viability and re-use of industrial buildings in a redevelopment scenario. Mr. Licht has experienced problems associated with industrial building with inadequate loading facilities in other communities. It is important to note that the Zoning Ordinance allows a reduction in the required number of loading spaces by administrative permit. The Planning Commission directed' staff to review requirements in other communities and forward a recommendation at the continued public hearing. Regulation of Landscape Nurseries: Mr. Morey indicated that staff received comments from Tarrell Friedley, representing Eisele Greenhouses, related to the regulation of .landscape nurseries. Mr. Friedley has recommended changes to the requirements which would allow • Eisele Greenhouses to increase retail uses at their business on County Road 46. City Administrator Robert Erickson indicated that staff is recommending that such wholesale nurseries be .limited to wholesale operations only. These uses are allowed in the RA, Rural/Agricultural District. It is not the intent of the Zoning Ordinance #o have high .intensity retail uses in this zoning district. The City Attorney's office is drafting language to more clearly define the type of uses allowed for wholesale nurseries and to provide for retail nurseries and garden centers in the C-3 District. .After some discussion, Planning Commission members directed staff to finalize language per the recommendations of the City Attorney's office for consideration at the continued public hearing on the Zoning Ordinance. Low/Medium Density Residential Districts: Mr. Morey stated that Northwest Associated Consultants has provided a draft of a new RST-2 District in response to comments received from developers during the public review period. The current RST District would be renamed RST-1 and would apply to existing R-4 .District lots. The new RST-2 District would allow detached townhomes on 9,000 square foot lots with a homeowners association on undeveloped. .land guided for low/medium density residential land uses. Planning Commission members reviewed the proposed RST-2 District and recommended that it be finalized and incorporated into the draft Zoning Ordinance. CC District Uses: Mr. Morey stated that Byron Watschke has requested that freestanding • medical uses, hotels/motels, restaurants, and banks be added as permitted uses in the CC District. Mr. Morey stated that adding these uses could potentially result in a CC District Planning Commission Work Session Minutes May 24, 2000 Page 3 development being developed for general commercial uses, in conflict with the intent of the CC District. The consensus of the Planning Commission was to not add these uses as freestanding uses in the CC District. Townhouse Performance Standards: The Planning Commission reviewed the following issues related to townhouse developments: .Garage Sizes - Mr. Mullenbach stated that staff is recommending that the minimum garage size for aslab-on-grade townhouse be divisible by 20 feet, which is the minimum required width for townhouse garages. The proposed minimum of 576 square feet was based on a 24' x 24' garage, which probably will not be built. The consensus of Planning Commission members was to required a minimum garage size of 540 square feet (e.g. 20' x 27') for slab-on-grade townhouses to accommodate additional storage area. This will result in a storage area of 100 square feet for slab-on-grade townhouses based upon the 440 square foot minimum garage size for a townhouse with a basement. Setbacks - Mr. Mullenbach stated that the Planning Commission discussed at their May Stn work session whether a reduction to the front yard..setback for townhouses would be acceptable. Discussion generally addressed that fact the a setback less thane 30 feet. on a private street would not be supported as there is already a limited area for snow storage, parking, and traffic visibility. Chair Drotning .indicated that he has concerns related to the width of private drives. Commissioner Skipton stated that aturn-around should be required for private drives. Turn- . around areas could also provide an opportunity for locating guest parking stalls. The consensus of the Planning Commission was that public streets shall be a minimum. of 28 feet in width (back of curb to back of curb), aturn-around for each private driveway shall be provided, the setback from private driveways and public street rights-of-way should be 30 feet. Exterior Building Materials - Mr. Mullenbach indicated that a review of townhouse projects in the community has been completed and that none of the projects surveyed has a minimum of 25% of the exterior facade finished in brick or stone. The Orchard Meadows townhouses have approximately 20% brick and the Lake Villa Stn detached townhomes have a combined 30% in brick, stone or stucco. After some discussion, the consensus of the Planning. Commission was to add stucco to the list of exempted materials, require a minimum of 25% of the exterior facade to be brick, stone and/or stucco, limit the amount of one building material to 60% of the total, and add a requirement that the brick, stone, and/or stucco be distributed evenly across the building facade. Affordable Housing -The City Attorney has recommended the addition of language that would provide the opportunity for affordable multiple family .housing to be built in the RM and RH Districts by waiving certain design and construction standards. The Planning Commission directed staff to incorporate the proposed language into the draft Zoning Ordinance. 10 and 12 Unit Townhouse Buildings - Mr. Mullenbach stated that staff is recommending that • 10 and 12 unit townhouse buildings (5 or 6 units back-to-back) are being recommended to be Planning Commission Work Session Minutes May 24, 2000 Page 4 allowed in the RH Districts. The units would have the same appearance from the curb as 6 unit townhouse buildings and would offer an alternative to apartment buildings in the RH Districts. The consensus of the- Planning Commission was to allow up to a 12 unit. (6 units back to back) townhouse building in the RH Districts only. Transition Requirement -The Planning Commission .reviewed the proposed transition . requirement for multiple family. housing .developments. After some discussion, the Planning Commission directed staff to make the following. revisions to the proposed language: • Add railroads to the list of acceptable transition exemptions. • Require a minimum of 100 feet of width for open spaces (e.g. wetlands, parks) to meet the transition requirement. • Eliminate the proposed stipulation that would exempt properties "not of sufficient size". CHAPTER 37: MOTOR VEHICLE FUEL FACILITIES Planning. Commission members reviewed the draft Chapter 37: Motor Vehicle Fuel Facilities that combines the performance standards for fuel facilities and truck stops into one area. Planning Commission members directed .staff to incorporate the new Chapter 37. DRAFT SIGN ORDINANCE Planning Commission members had no comments regarding the proposed sign ordinance update. DRAFT SUBDIVISION ORDINANCE Commissioner Skipton submitted written comments to be incorpora#ed into _the proposed subdivision ordinance update.
