VILLAGE OF T.ax~vi-r,r.F SPECIAL COUNCIL MEETING ASSESSMEIJT HEARING OCTOBEfi 12,1972 The meeting was called ~ order at 8 P.M. by Mayor Jansen at the High School Cafeteria. Present; Friedges, Clay, Jensen, Sullivan and kind. Also present; Robert Frigaard, Village Engineer acid Pat Farrell, Village Atorney. The hearings were opened at 8 P.M. and a list of interested property owners is attached. Hearing No. 1--~ialy4ke Ave~aue, Pro~eat 72.3. The Notice of Hearing was read and the engineer, Mr. Friffisard presented a brief resume of Chia project. No questions were asked. 72.68 Motion by Sullivan .seconded by Emond resolution tc> adopt the e,ssess~snt roll for project 72.3, Holyoke Avenue be approved. Friedges, Clay, Jsn~en, Sullivan ax~.d Emond "aye", motion serried. Full ,resolution attached.. Hearing Ido. 2•-Hughes Avenue--72.1 Project. The Notice of Hearing was read and Mr. Frigaaxd presented a resume of this project, Richard Whittier asked why the .three lots on Hughes and 205th St.a had not been backfilled or sodded and alsEt where the water will drain. Robert Mahowa~ld was s.1.so interested in the drainage probleffi. Mr. Frigaard will cheek the drainage problem cad said that the backfilling and sodding were done independently.. 72.69 Motion by Emond seconded by Fredges to adopt the assessment roll as presented by the engineer for Hughes Avenues 72.1 Project. Ciaq, Jensen, Sullivan, Emond and Fredges "aye", motion carried. Full resolution attached. Hearing No. 3--Phase II and Clay's Acres, 72.1 Project. .The Notice of Hearing ~~as read and Mr. Frigaard gave a resume of this project. He also explained the area covered. Mr. Farrell explained the time limit for pay3.ng these ~ssessmer~ts was thirty days fx^a>m the date of this hearing if the council apprQVes them. After this, they will.. be certified to the county auditor and the first years interest then becomes due with the first year's principal. Mr. DeVimney, attorney for the Weichselbaums, presented a written objection to this assessment, letter attached to these minutes.. Mrs. William Sullivan and Rola~nde Simones s~.id that they were Apposed to these charges for the same reason. Paul Hammer. asked regarding the green sates Iaw. Mrs. Janet Meadows asked why the assessment was for both sides of the railroad tracks. Robert Furth asked for the time period to file any objections and also how the bids ware set up. Jerry Ackerman asked about the interest charges and why they are so high when the bond interest is lower. Joe Nedermayr asked where the lines went atzd how his property is affected. Robert Nicholson asked the council about the charge the Metro sewerBoard ways going to assess against .every home that hooks on to the asewer after the first of the year. Sam Testa asked regarding the lateral costs and Richard Sullivan asked for the amounts that are being charged for water and sewer. 72.60 Motion by Eatond seconded by Jensen to adopt the assessment.rolls for Phase TS and Clay's Acres, Project 72.1. The Notice cf gearing wa,s read and Mr. Frgaard gave a brief resume of this project, Mr, Donald Tatge awed. w2~y the shargee..are different that what was estimated and wby the whale protest is split evenly between the benefitted property owners. Tt wa,. explained that it was felt that every one benefitted the same. Mr. Richard Weber. felt that the other three home orsners should have been-accessed although they were already connected to tze city sewer, Mr. Tatge felt that these property ownere should help pay for the manhole t11at was metalled affi it was for their benefit also. '72.652 Motion by Clay seconded by Sullivan to adopt the assessment ro11s for Howland Avenue, Pro3ect 72..1 sub3eet to braking out the costs for 1flfl feet of iirie amd as amended to exclude this 10fl fast of line. Emond, Friedges, Clay,...J~nsen and Sullivan "aye", motion serried. 7-l resolution attached..... No.6--Highway 54 --Airls~e Water Main. The Noti de of Hearing axed a review of this pro jest ;~ta:s presented. Robert Elferng felt that cost for this project was too high and also saa.d that the sontractc>r had taken some fill. from one of the lots for the road. Mr. Frigaard`will check this out. 72.65 Motion by Clay seconded by Sullivan to adept the assessment rolls as'presented for the Forest Hi11s, 71 Protest.
