a • r VILLAGE OF LAKEtTILLE COUNCIL MEETING ' JAIUUARY 17 ~ 1972 The meeting was called to order by Mayor Jensen at BP.M. Flag pledge followed. Present: Friedges, Clay, Jensen, Sullivan and Emond. Also present: Robert Frigaard, Village engineer and Pat Farrell, Village attorney. 72.31 Motion by Clay seconded'by Sullivan to accept the minutes of the January 10, 1972, meeting as corrected. Friedges, Clay, Jensen, Sullivan and Emond "aye", motion carried. 72.32 Motion by Sullivan seconded by Emond to accept the minutes of the special January l#, 1972, meeting as read. Clay, Jensen, Sullivan, Emond and Friedges "aye'; motion. carried... 72.33 Motion by Friedges seconded by Sullivan to pay the claims against the Liquor Store. Jensen, Sullivan, Em©nd, Friedges and Clay, ".aye",motion carried. 72.3+ Motion by Friedges seconded~by Clay to pay the claims against the Village. Sullivan, Emond, Friedges, Clay and Jensen "aye", motion carried. 72.35 The Park & Recreation report was presented. .Motion by Friedges seconded by Emond to accept the recommendation«,of the Park & Recreation Committee as presented on the attached list but striking the recommendation for the new warming house.,. the.... rink .attendants. and having one or two. other people use the new equipment. These recommendations to be turned over to the maintenance personnel. Emond, Friedges, Clay, .Jensen and Sullivan "aye", motion carried, 72.36 Motion by Emond seconded by Friedges_to follow the recommendation of the Parke anal Recreation Committee .and appoint Herb Lambert and John Hrkal for. the three year ter~zns and Howard Lovelace for"the remainder of James Emond's term of 2 years... Friedges, Clay, Jensen, Sullivan and Emond "aye",.motion carried. The Planning Commission report for Jan. 13,:1972,`were presented. 72.37 Motion by Clay seconded by Emond to follow the Planning Commission recommendation and deny the request of John Raplinger for a trailer permit. Clay, Jensen, Emond and Friedges "aye", Sullivan opposed, motion carried. Many residents from Oak-Shores were in attendance to present the. council with a petition against the Jesco rezoning (copy attached) and also a formal`` recommendation of why they are opposed to this rezoning. Mr. Fred Seitz asked the council to invoke the Jan. 1 decision to remove Jeseo. Moet of the homeowners present felt that there would be too much commercial traffic. on this .road which would endanger the children. Jesco, Inc. asked for a postponement of this: rezoning until the 7th of Feb. as they. were unable to attend this meeting. 72.38 Motion by Clay seconded by Friedges that this be carried over until the 7th of Feb. at 9 P.M. with the clerkato notify Jesco by certified mail and the attorney to be instructed to take legal action to enforce the council's motion of Nov. 1,.1971. Jensen, Sullivan, Emond, Friedges and Clay "aye", motion carried. 72.39 Motion by Emond seconded by Jensen to table Item until the Park & Recreation Committee: comes in with a recommendation on the park land.on Feb. 7. Sullivan, Emond, Friedges, Clay and Jensen "aye", motion carried. 72.~F0 Motion by Friedges seconded by Emond to .set a public hearing on the 15th of Feb. for the proposed amendment to the Zoning .Ordinance at 9 P.M. Emond, Friedges, Clay, Jensen and Sullivan "aye", motion carried. 72.x+1 Motion by Jensen seconded by Emond to include Item 8 in the same hearing. VILLAGE OF I,AKb_'VILLE COUNCIL MEETING JANUARY 17, 1972 Friedges, Clay, Jensen, Sullivan and Emond "aye", motion carried. 72.x+2 Motion`by Friedges seconded by Emond to accept the plans for the Crystal Lake Park as presented to the council. Clay, Jensen, Sullivan, Emond and Friedges "aye", motion carried. 72•x+3 Motion by Emond seconded by Jensen to authorize the engineer to prepare plans and specs for the grading of the Crystal Lake Park,:ball diamond. Jensen, Sullivan,. Emond, Friedges and Clay "aye"',.motion carried. Mrs. Eugene Romeo with a group of :neighbors from Valley Park presented the council with some pictures of the fence that surrounds the sump hole on Franchise Ave. She and her neighbors feel that this is a threat to the children and would like to see a better f~:nce replace this one. It was mentioned that this hole should be filled in by next summe~°. 72.4 Motion by Jensen seconded by 'Friedges to write Mr. Donnay a letter requesting a fence that will prevent children from going into this sump a~°ea with the fence. approved by the engineer. A request was to be made as to the ultimate completion of this project. Sullivan, Emond, Friedges, Clay and Jensen "aye", motion carried. Mr. Sloan of NSP and Mr. Soderland of Dakota Electric appeared to request the council to reconsider their decision of a five year limit on the franchise agreement. They did not feel that this would help them in obtaining long term loans in the money market. Mr. Sloan said that the NSP would withdraw from the franchise agreement if .they could not get a longer term. 72.x+5 Motion by Clay seconded by Jensen to table the franchise ordinance`for 60 days until the 3rd meeting in March. Emond, Friedges, Clay, Jensen and Sullivan "aye", motion carried. 72.6 Motion by Clay seconded by Friedges to authorize the engineer to authorize plans and specs for the construction and installation for a new trunK sewer line to replace the oldfline. Friedges, Clay, Jensen, Sullivan and Emond "aye", motion carried, Village 72.x+7 Motion by Friedges seconded by Emond to table. the unit charge schedule until the next meeting. Clay, Jensen, Sullivan, Emond and Friedges "aye", motion carried. 72.x+8 Motion by Sullivan seconded by Friedges to close the applications for ,part time help in the police department. `~ensen, Sullivan Emond, Friedges and Clay "aye", motion carried. 72.x+9 Motion by Glay seconded by Sullivan to follow the recommendation of Chief of Police Richard Rademacher,. and hire Jan Graff as part time help at the same rate of pay as the other part time help. Sullivan, Emond, Friedges, Clay and Jensen"aye", motion carried. 72.50 Motion by Emond seconded by Friedges to have one more telephone line installed into the police office. _ Emond, Friedges, Clay, Sullivan and Jensen "aye", motion carried. A meeting was set for 1 P.M. Friday the 21st of January to interview police applicants. The council instructed the clerk to write the Commissioner of Highways to see if Highway ~ 50 can be resurfaced. The council mentioned that they felt that there are enough 235 homes in Valley Park now and feel that the Planning Commission should. review this matter. • VII.~IrAGE OF LAKF~'VTLLE COUNCIL MEE'T'ING • JANUARY 17: 1972 72.51 Motion by Friedges seconded by J~n.sen to turn over the matter of the 235 homes to the Planning Commission and ask that .they bring in a,'recommendation by the first meeting in Feb. Friedges, Clay, Jensen, Sullivan and Emond "aye", motion carried. 72.52 Motion by Clay seconded by Sullivan to approve the abatement for Richard Crosse on parcel ~ 20391.. Clay, Jensen., Sullivan, Emond and Friedges "aye", motion carried. 72.53 Motion by Emond seconded by Jensen to approve the garbage license for T) & M Hauling.. Jensen, Sullivan, Emond, Friedges and Clay "aye", motion .carried. 72.5+ Motion by Sullivan seconded by Clay to approve the off sale beer license fore Buck Hill Meats. Sullivan, Emond, Friedges, Clay. and Sullivan "aye", motion carried. 72.55 Motion by Clay seconded by Emond to approve the on sale beer license for the Ole Piper Inn Again, zne. Emond, Friedges, Clay.,~_ Jensen and Sullivan "aye", motion carried. A letter re County State Aid Highway 5 and County State Aid Highway 9 was referred to the streets and roads committee. 72..56 Motion by Sullivan seconded by Friedges to ael~owledge receipt of the letters from NSP regarding the contracts.
