Present; Friedges, Clay, Jensen, Sullivan and Emond. Also present; Robert Frigaard, Village Engineer and Pat Farrell, Village Attorney. 72.306 M©ton by Friedges, $eeonded by Emond to ae~ept t~.e minutes of the May 8, 1972, meeting with the correction of motion 72.298 to read as follower Motion by Sullivan seconded by Jensen to grant a variance tt~ the ~.bdvision ordinance .th no platting required providing that a 60' right of way be dedicated through the ~Fth let with the street to be built up to the ~Fth let with a temporary cui-de-sac. Said street to meet the Village speeifieations with the exception of bituminous surfacing. Developer shall post bond based on engineer's estimate. This .will be known as the Dean Maser pro~jeet. Sullivan, Emond and Friedges "aye', motion carried. 72. 8 Motion (436-398 sc5~9-566) 30 by Fredges seconded by .Clay to ply the claims against the liquor store, Clay, Jensen, Sullivan Emond and Friedges "aye", motion carried. 72,309 Motion by Emond seconded by Friedges to pay the claims against the Village. (800-80+5 8051-811~F 8122-8131 & x+86-517) Jensen, Sullivan, Emond, Fredges .and Clay "aye", motion carried. The Planning Commission minutes for April 27, 1972, were presented. 72..314 Nation by Clay seconded by Fredges to grant a variance to side yard set-back at I,c>t 24, Block 1, Fr~rest Hills Add. to Duane Gurneau, This variance allows a 6' set-beak instead of 1®l~st-back. Sullivan, Find, Friedges, Clay and Jensen "fie", motion carried. 72.311 Motion by Friedges, seconded by Su1l:ivara to grant a variance to side yard set-back at Lot 2, Block 6, Valley Park, to Timot~ J. Careen.` Variance pis for 6' set- beak instead of 10' set-back.: Ana, Fr3.edgs~, Clay, Jensen and Sullivan "aye", motion carried. 72.312 Motion by Emond, Seconded by Clay to table item 12, regarding Lakeville Sehaol Board request for a permit until the Board ceps in with mere inforutation. Friedges, Clay, Jensen, Sullivan and Emond "aye", motion carried, 72.313. Motion by Fredges seconded by Emend to accept the bids on Sidewalk, Curb:rR & Gutter Replacement Holyoke Avenue and S-t~eet Lights on Holyoke Ave. Clay, Jensen, Sullivan, Emond and Friedges "rays",.motion carried. 72.31+ Motion by Sullivan seconded by Fredgea to accept the low bid of Collins Electric whose: base bid. was X11,650.00. Jensen,. Sullivan, Emond, Friedges and Clay "aye", motion carried. 72.315 I~ton by I~riedges, seemnded by Clay to award. the Sidewalk, Curb &.Gutter Replacement contract to the low bidder, Minnesota State Curb & Gutter whose bid was X6,557.50.. Sullivan, E~uond, Friedges,.Clay and Jensen "aye", .motion carried. A discussion wan held on the telephone pole on 208th & Holyoke as there is some difficulty as to property lines. It was decided to have Mr. Sullivan and. Mr. Emo~.d contact Mrs. Lorentson to see if some agreement could be reached.. 72.3.6 Motion by Sullivan seconded by Clay to have "no parking" signs placed east from the Luthern Church on Highway #50 past the third house. VILLAGE OF LAKEVTL~ COUNCIL A+~ETING / Mai 15~ 1972 72.317 Motion by Sullivan seconded by Clay to accept the quotation of the County Highway^ Dept. for chloride at ~~+3 per ton picked up at Rosemount. Fifteen tone will be ...ordered. Friedgco, Glay, Jensen, Sullivan and ~3nond "aye", motion carried. The maintenance department will see that some bushes blocking the view of vehicle traffic on County and the Village road are cut down. .The Clerk was instructed to write to the Railroad and tell them that they feel the repairs on Dodd Blvd, are not satisfactory. The Clerk was instructed to write to the Department of Natural Resoures .and for its opinion on what the Pumping of 5 million gallons out of the Crystal Lake .would. do to the level of the lake.. Thin information will be brought back to the council by June 8. 72.318 Motion by Jensen seconded by Emond to have a street light installed at the print shop on 185th and #50. Clay, Jensen, Sullivan, E~nond and Far3e dges r'at'e,', motion carried. 72.319 Motion by Clay seconded by ~nond to acknowledge the claim of H. t~ertrude Lyden against the Liquor Store. Jensen, Sullivan, Il~?onc, Friedges and Clay "aye", motion carried. Mr. Farrell advised the Council that it should aQt as qu~.ckly as possible to appoint the members of the Human. Rights Comsai.ssion who .should be directed to present an-equal opportunity program to the Village Council within a reasonable time, develop a purchasing program to purchase from a min©r~.ty organisation, develop an equal housing program and have at least one minority person on the commission. 72.324 Motion by Sullivan seconded bx Haond to pass this resolution as prepared by NLr. Farrell containing the directives listed above for the.Human Rights Commission. Sullivan, Emond, Friedges, Clay and Jensen "aye", motion carried. 72.321 Motion by Clay seconded by Jensen to reefer thene~'~suggested access and parking lot in the 70 Acre Park to the Park & Recreation Committee for redesign. F.~ond, ~'riedges,. Clay, Jensen and. Sullivan "aye", motion carried, The access at Crystal Lake Park was discussed. Mr. Frigaard, Village II3gneer, explained to the council that the construction crew for the new sewer line had trespassed on property belonging to Chris Austad. He felt that a reasonable compensation for this trespass would be: 1 free hookup. Mr. Austad feels that he is entitled to two free connections. 72.322 Motion: by Jensen seconded by Clay to follow the reeomatendation of the Village Engineer and give Chrs~Austad one free eonneetion due to our trespassing on his property. Friedges~ Clays Jensen and. Emonci "aye", Sullivan opposed, motion carried. 72.323 M©ticra by Sullivan. seconded by Hnond to approve the-plans and epees for Park Terrace 3rd water and sewer.. Clay, Jensen, Sullivan, nnond and Friedges R'at'e", motion carried. The road in Bassett~s Addition was discussed. It was paved. last .fall and ie deteriorating already.. The road committee will check this out. Mr. Lambert brought up various matters such as the holes in the road system in Valley Park. He felt that something should be done about the manholes which have sunk below the street level. Bill Larson requested information regarding a ball field.. A committee of Mr. Lovelace, Mx°. Fr3.sdges and Mr, Emond will check to see if a field could be used in the new park without damaging the grass too much. ~2) i i i VILI.~GE ~F h~KEVILLE COUNCIL MEETING MAY 15, 1972 1~r. Richard Todd advised the council that he had contacted the people who were buying or had bought lots in his hobby farm and apprised them of what had taken place prior to this meeting. Different alternatives were discussed as to how this. situation could be handled. Mr. Fredges felt that there should be some assurance from the people buying these iots that they know they are not buying black top roads. M~. Todd explained that Mr. Siga~-foss needed a house as soon as possible and ~.sked the council if a building permit°~weould be granted for this one house if an affidavit is presented at the same time, 72.32 Motion by Sullivan seeonc3.ed by Clay to grant l building permit to Mr. Sgfa~foss subject to the reQeipt of an affidavit that he does not want black topped roads. .Jensen, Sullivan, Frmond, Friedges and Clay "aye", motimn carried. Mr. Todd and Mr. Farrell will meat to d~seuss the solving of this problem. William H~ffbeek presented a, sketch of a decal he would like. to order for the Village vehicles. It was decided to have Mr. Eauond cheek t13..s out to see if something acceptable to the whole council could be worked out. Motion by Clay seconded by Friedges to adjourn carried unanimously.
