Planning Commission Meeting Minutes

The July 20, 2000 Planning Commission meeting was called to order by Vice Chair Rieb in the
City HaI1 Council Chambers at 6:00 p.m.
Roll call of members was taken:
Present: Bellows, Skipton, Rieb, Comer, Wulff, Alternate Moates, Ex-Officio Commission
Member Knutson.
Absent: Kot, Drotning.
Staff Present: Daryl Morey, Acting Community and Economic Development Director; Tim
Hanson, Assistant City Engineer; Andrea McDowell Poehler,-Assistant City Attorney; and
Donna Quintus, Recording Secretary.
Commissioner Wulff indicated that page 8 of the June 29, 2000 Planning Commission
meeting minutes attributed two statements to her that should have been credited to other
Commission members. Paragraph 3, page 8 will be amended to indicate Commissioner
Bellows as the speaker and paragraph 7, page 8 will be amended to indicate Chair Drotning
as the speaker. The June 29, 2000 Planning Commission meeting minutes were approved
as amended.
• ITEM 4: Announcements
Acting Community and Economic Development Director Daryl Morey noted that ThisWeek Life
& Times, the City's official paper, inadvertently omitted publishing three public hearings:.
originally scheduled to be held at this meeting. Because the public hearing notices were not
published in accordance with Minn. State Statute #462.3595, Subd. 2, the notices have
been revised and will be published and mailed to property owners within the required
notification area advising them of the new public hearing date. These hearings will be held at
the August 3, 2000 Planning Commission meeting.
ITEM 5.A. Public Hearin: Ray Brandt, RHB Enterprises, Inc.: Howland Avenue Right-of-
Way Vacation; and
ITEM 5B. ..Vermillion Springs Final Plat
Vice Chair Rieb opened the public hearing for consideration of the application of RHB
Enterprises, Inc. for the vacation of a portion of street right-of-way. Assistant City Attorney
Poehler attested that the legal notice had been mailed and published in accordance with
state statutes.
Mr. Ray Brandt, RHB Enterprises, Inc., requested approval of the final plat of Vermillion
Springs which consists of 90 single family lots, one church lot, and seven outlots on an
approximately 79-acre parcel of land located north of 165th Street, south of 160th Street
• (C.S.A.H. 46), and primarily west of Highview Avenue. In conjunction with the final plat, Mr.
Brandt requested the vacation of a portion of Howland Avenue right-of-way, which lies
adjacent to the west of the Vermillion Springs final plat.

Acting Community and Economic Development Director Daryl Morey presented an overview of
the details of the final plat and street right-of-wayvacation requests as outlined in the July
14, 2000 Planning Report. Mr. Morey noted that the Howland Avenue right-of-way was
platted with Trotters Ridge 2nd Addition in 1988 for the future realignment of Highview
Avenue. The northerly portion of the existing Howland Avenue right-of-way will be retained to
accommodate the realignment of Highview Avenue as proposedwith the Vermillion Springs
final plat. However, due to the current design of the Highview Avenue realignment as
proposed in the Vermillion Springs final plat, aten-foot wide strip of the southern segment of
the Howland Avenue right-of-way is not needed.
The portion of the street right-of-way proposed to be vacated will be combined with the
adjacent single family lots in Trotters Ridge 2nd Addition.
Mr. Morey noted that the electric, gas, telephone and cable TV utility companies have
reviewed the easement vacation request and have responded that they have no objections to
the vacation of the right-of--way proposed to be vacated. Community and Economic
Development Department staff recommend approval of the application for the vacation of
street right-of--way, as submitted. This street right-of-way vacation is subject to approval of
the Vermillion Springs final plat.
• Mr. Morey noted that the subject property is zoned RS-2, Single Family Residential District
and the proposed use is consistent with the 2020 Land Use Plan. The 90 single family lots
and the church lot (Lot 8, Block 9), created to accommodate the existing Minnesota Valley
Free Lutheran Church, meet lot area, width and depth requirements for the RS-2 District. The
final plat of Vermillion Springs is consistent with the preliminary plat approved by the City
Council on May 15, 2000.
Acting Community and Economic Development Director Morey noted that an existing
homestead, located within the final plat boundaries, will be located on a lot and the existing
house will meet building setback requirements. The seven accessory buildings will be
removed as required by the Zoning Ordinance update which was approved and adopted by
City Council on July 17, 2000. The developer will be required to submit a cash security to
guarantee the removal of the accessory buildings and the relocation of the driveway to serve
the existing house.
Mr. Morey discussed the details of the proposed realignment of Highview Avenue at 160tH
Street (C.S.A.H. 46) with Garden View Drive in Apple Valley. A second connection to 160th
.Street is at the existing Highview Avenue intersection. This segment of the former Highview
Avenue is proposed to be renamed to Hawthorn. Path. The 160th Street/Hawthorn Path
intersection will be aright-in/right-out only intersection.
. Mr. Morey also identified proposed trail segments and sidewalk locations within the
Vermillion Springs development.

The Vermillion Springs final plat and street right-of-way vacation have been reviewed by
Engineering Department staff, the Dakota County Soil and Water Conservation District, and
the Environmental Affairs Committee (EAC). Community and Economic Development
Department staff recommend approval of the Vermillion Springs final plat subject to the 12
stipulations as listed in the July 14, 2000 Planning Report.
There were no comments from the audience.
00.79 MOTION by Bellows, Second by Skipton. to close the public hearing at 6:15 p.m.
Ayes: Bellows, Skipton, Rieb, Moates, Comer, Wulff.
Nays: 0.
Commissioner Skipton noted that the plans indicate aright-of-way for Highview Avenue at
160t" Street (C.S.A.H. 46) of 120 feet. However, the right-of-way on the plan does not
measure at 120 feet.. Assistant City Engineer Tim Hanson indicated that the developer will be
required to revise the final plat plans to accurately measure the minimum 120-foot right-of-
way at this location. The Commission agreed to include an additional stipulation for final .plat
approval to read as follows:
Stipulation No. 13: "Prior to City Council consideration, the Vermillion Springs final plat
shall be revised to include a 120-foot right-of--way for Highview Avenue
at C.S.A.H. 46."
00.80 MOTION by Wulff, Second by Bellows to recommend to the City Council approval of the
applications of RHB Enterprises, Inc. for the Vermillion Springs final plat the vacation of a
portion of Howland Avenue right-of-way located in Trotter's Ridge 2nd Addition, as requested,
subject to the 12 stipulations listed in the July 14, 2000 Planning Report with the addition of
Stipulation No. 13 as written above.
Ayes: Skipton, Rieb, Moates, Comer, Wulff, Bellows.
Nays: 0.
Acting Community and Economic Development Director Morey indicated that the moratorium
on new residential plats was lifted on Monday, July 17, 2000 upon adoption of the new
zoning and subdivision ordinances by the City Council. Community and Economic
Development-staff anticipate several residential plats to be submitted in the next few weeks.
There being no further. business, the meeting was adjourned 6:28 p.m.
