Absent: Skipton,,Rieb Staff Present: Robert Erickson, City Administrator, Arlyn trussing, Director of :Community: and Economic Development; .Daryl Morey, City Planner; Ron Mullenbach, Associate Planner; Tim Hanson, Assistant City Engineer, Andrea McDowell Poehler, Assistant City Attorney;. and Penny Brevig, Recording Secretary. The September 21,..2000 Planning Commission meeting minutes were approved as presented. The September 21, 2000 Planning Commission Work Session Minutes were approved as presented. Item 4A: Announcements: Community & Economic Development Director, Arlyn trussing welcomed Penny Brevig as the new Planning Commission Recording .:Secretary. Item 4B: Award from MnAPA Associate Planner, Ron Mullenbach addressed the Planning Commission and stated that he accepted, on behalf of the City of Lakeville the Communications. Strategy for the Comprehensive Plan award from the Minnesota Chapter of the American Planning Association at the 2000 Upper Midwest Regional Planning conference last month.. Mr. Mullenbach stated that the program. recognizes projects and programs of .exceptional merit in the field of planning. Lakeville's award was earned in the Public-Education category. Mr. Mullenbach indicated that the communications strategy involved individual mailings, publicity on the Messages page and in Airlake Park News and 22 neighborhood meetings. Culminating the Comprehensive Plan Update process, the citizen's guide was designed and distributed to all residents andbusinesses in the community. • Planning Commission Meeting October 19, 2000 Page 2 -ITEM 5. PUBLIC HEARING: ZWEBER FARM NINTH Chair Drotning opened the public:. hearing for consideration of the application. of D.R. Horton for a preliminary and final plat of 26 single family lots to be known as Zweber Farm Ninth, located north of Dodd Boulevard (CSAH 9) .and west of Highview .Avenue. Assistant City Attorney Poehler attested that the legal notice had been mailed and published in accordance with state statutes. Mr. Don Patton, from D.R. Horton, indicated the preliminary and final plat of Zweber. Farm Ninth consists of 26 single family lots on land located east of Hyde Park Avenue and north of Dodd Boulevard. Mr. Patton stated than the key element to Zweber Farm Ninth will be .linking Hickory Trail through the subject property in order for the school bus route to be as safe and efficient as possible. ..Daryl Morey, .City Planner, presented an overview of the details of .the .Zweber Farm Ninth preliminary and final plat applications as outlined in the October.-13, 2000 planning report. D.R. Horton representatives have submitted applications for the. preliminary: and final plat of Zweber Farm Ninth, which consists of 26 single:. family lots on land located east of Hyde Park Avenue. and North of Dodd Boulevard... The. property within the proposed Zweber Farm Ninth was .platted as Outlot B with the Zweber Farm Seventh final plat. Mr. Morey gave a history of the Zweber Farm subdivision. City Planner Morey stated that the City.. Council approved the first phase of the Zweber Farm development in August of 1997. Zweber Farm Ninth is the final phase of the Zweber Farm development. The preliminary and .final plat .are proposed to be developed in one phase. Mr. Morey stated that the preliminary and final plat had been forwarded to ISD 194 officials for review and they responded favorably. As their letter states, their major concern was the `importance of linking Hickory Trail through the subject property in order that student transportation routes were safe and efficient. Mr. Morey indicated that the proposed grading, drainage, erosion control and utilities construction for the Zweber Farm Ninth preliminary and final plat is shown on the grading, .drainage and erosion control plan and the utility plan, and that these plans have been reviewed by the Engineering Department staff and they recommend approval of the preliminary and final plat. Mr. Morey stated that the Parke and Recreation Advisory Committee is • recommending a .cash contribution to satisfy the park dedication requirement for Zweber Farm Ninth.. Planning Commission Meeting October 19,.2000 Page 3 City Planner Morey stated that if the Planning Commission chooses to recommend approval. of the preliminary and. final. plat of Zweber Farm Ninth, Community. and Economic Development Department staff recommend that the approval be subject to the recommendations listed in the October 13, 2000 .planning report. Nays: 0. .Commissioner 'Wulff stated that this plat was fairly routine due to the other 8 additions, .but she had -.one .question regarding the extra wide utility easement between Lots 7 and 8, Block 1 on the map. Commissioner Wulff noted that when you look at the drainage plan, it looks like the drainage should be between Lots and 9. Assistant City Engineer, Tim Hanson, stated that between Lots 7 and 8 is where the storm sewer pipe is located. Public Hearin: Marion Fields Fourth Addition Chair Drotning opened the public hearing for. consideration. of the application of Shamrock Development, Inc. for a preliminary and final plat of 87 single family residential lots to be known as Marion Fields Fourth Addition,. located south of ..202nd Street .and east of Lakeview Elementary School. Assistant City Attorney Poehler attested that the legal notice had. been mailed and published in accordance with Minnesota State Statutes. Mr. Jim Stanton, representing Shamrock Development, Inc. submitted applications i for the preliminary and final plat of Marion Fields Fourth Addition. Mr. Stanton .stated that the 8 foot bituminous trail running parallel to the Lake Marion outlet Planning Commission Meeting October 19, 2000 Page 4 channel. will be reconstructed to a 10 foot width as part of the Marion Fields. fourth Addition development. Mr. Stanton stated that he met with the Environmental Affairs Committee. on Tuesday night and they were satisfied with the: preliminary and final .plat, grading, erosion control and tree plans for the Marion Fields. Fourth Addition. City Planner. Daryl Morey presented an overview of the.. preliminary and final plat application of Marion Fields Fourth. Addition as detailed in the October 13, 2000 Planning Report . Mr. Morey stated the preliminary and final plat consists of six metes and bounds description parcels as well. as 0utlot A, Country Creek Estates,.. which is currently owned by the City. Mr. Morey stated that the existing Lake Marion outlet channel and two trails that extend to Antlers Park lie. within the subject property boundaries. The existing - eight foot wide .trail that runs adjacent to the outlet channel and north of 202nd Street and the Antlers Park crossing will be reconstructed to a ten foot width as part of ;the Marion Fields Fourth Addition development. Mr. Morey noted that the Marion Fields Fourth Addition. development .includes the extension of Ipava Avenue south of 202nd Street to connect with 207 Street as a minor collector that extends to Dodd Boulevard: a Mr. More indicated that the Marion Fields Fourth Addition reliminar and final y p y ...plat was forwarded to ISD 194 officials. for their review.. A copy of the October 10, 2000 letter from Tom Coughlin, .ISD 194 Director of Administrative. Services, is attached to the planning report for the Planning Commission s review. Mr. Morey stated that the developer has submitted a Certificate of Survey with the preliminary and final plat plans. The survey identifies a number. of easements that are scheduled to be vacated in conjunction with the Marion Fields Fourth Addition preliminary and final plat.. Mr. Morey indicated that the. easements to be vacated will be replaced by right-of-way and permanent easements .dedicated with the Marion .Fields Fourth Addition final plat. The Public Hearing .for the easement vacation is scheduled for the November 2, 2000 Planning Commission meeting. Mr. Morey indicated. that the survey shows building and fence encroachments on the north side of the preliminary and. final .plat boundaries.... These encroachments must be removed as part of the Marion Fields Fourth Addition development. Mr. Morey stated that the Marion Fields Fourth Addition preliminary and final plat consists of 87 single .family lots on 8 blocks. The subject property is zoned RS-3 with a portion lying within .the Shoreland Overlay District for Lake Marion. Mr. Morey stated that the Certificates of Survey submitted with the building permits for the 19 lots that are located within the Shoreland Overlay District. and are subject to .Planning Commission Meeting October 19, 2000 Page 5 a maximum impervious surface coverage of 25%, must indicate the proposed impervious surface coverage of the portion of each lot;located within the Shoreland Overlay District. Mr. Morey indicated that Lot 1, Block 3 and Lot 1, Block 4 are oddly configured lots located adjacent to a segment of the trail that runs adjacent to the. outlet channel. Mr. Morey indicated that staff is recommending that the trail located within Outlots E and F adjacent to these two lots. be shifted to .the north, further away from the house pads :proposed on these two lots in order to lessen impacts. Mr. Morey stated that the lot lines of these two lots and outlots .should be modified to reflect .the revised trail location. Mr. Morey stated that Marion Fields Fourth Addition preliminary and final. plat proposes eight outlots. Of these eight, 4 of them (A,B,C, and D) are located on the north side of the preliminary and final plat. and range in size from 4,470 square feet to 9,069 square. feet.: Mr. Morey stated that these outlots are remnant parcels that can be utilized if the existing single family lots that front 202nd .Street east of ' proposed Ipava Avenue redevelop in the future. Mr. Morey indicated .that the developer will retain ownership of these four outlots and will install sanitary sewer and water stubs to each of the four possible future redeveloped lots. Mr. More indicated that Outlots E F G and H are located within an existin y g pedestrian/bike. easement that will be vacated in conjunction with the Marion Fields Fourth Addition preliminary and final. plat. Mr. Morey also indicated that the developer will deed Outlots' E, F, G, and H to the City with the Marion Fields Fourth Addition final plat. Mr. Morey stated that the City will reimburse the developer for the equivalent cost per acre.. ($28,000) that the developer paid for the land located within. Outlot E. In addition, the developer will remove the existing concrete slab and driveway located within Outlot E. Mr. Morey .indicated that the City will credit the developer's storm sewer area charge requirement for Marion Fields Fourth Addition at $28,000/.acre. for the. two sedimentation basins to be constructed within Outlot F. Mr. Morey stated that the Marion Fields Fourth Addition preliminary and finalplat includes the extension of Ipava Avenue south of 202nd Street to connect with 207 Street.. The segment of 207 Street located within .Country Creek Estates intersects with Dodd Boulevard and is stubbed at the east boundary of the Marion Fields Fourth Addition preliminary and final plat.. Existing 207 Street. extends east of Dodd Boulevard into. downtown Lakeville.. Ipava Avenue/207 Street is designated as a minor collector in the City's. Comprehensive Transportation Plan. - .Planning Commission Meeting October 19,:2000 Page 6 Mr. Morey indicated that there is a 66 foot right-of-way that is designated on the Marion Fields Fourth Addition preliminary and final plat for the segment of Ipava Avenue north of the 207 Street/204th.Streetntersection. Mr. Moreyindicated that this will accommodate. the possible future construction of a sidewalk between 204 and. 202nd Streets, which will provide residents. living on the north .side of the Marion Fields Fourth Addition development .with a pedestrian connection to Antlers. Park without having to travel south to the trail located .adjacent to the outlet channel. Mr. Morey indicated this sidewalk would not be constructed until after 202nd Street is upgraded to an urban street section with trails. Mr. Morey stated that the segment of proposed Ipava Avenue that extends from the intersection of 202nd Street south to the north boundary of the preliminary and final plat was not included in the Marion Fields Fourth Addition preliminary and final plat because this segment. is located on an adjacent. lot that the developer is attempting to purchase. The existing house located on this lot must be removed for the Ipava Avenue extension south of 202nd Street required with the Marion Fields. Fourth Addition development. Mr. Morey: indicated that staff recommends .that .this segment of Ipava Avenue be included in-the preliminary. and final plat as right- of-way instead of as a separate.. roadway easement located outside the plat • boundaries.: Mr. Morey indicated that the development of the Marion Fields Fourth Addition preliminary and final plat includes the construction of three local streets Mr. Morey indicated the proposed street names in Marion Fields .Fourth Addition do not meet. Dakota County Street Naming Guidelines and are subject to .Dakota County review and comment. Mr. Morey. stated that staff, recommends that the: developer. consider installing a berm and landscaping at the rear of Lots 2-5, Block $ to screen .the homes. from the. adjacent Friedges landscaping site, even though a landscape plan is not required for Marion Fields Fourth Addition. Mr. Morey indicated that Assistant City Engineer Tim Hanson and Environmental Resources Coordinator Tim Brown. have reviewed the preliminary and .final plat plans and recommend approval. in their report dated October 13, 2000, which was included in the Planning Commission packets. Mr. Morey also indicated that a copy of the Dakota .County Soil and Water Conservation District report was handed out for tonight's Planning Commission meeting with their recommendations. Also handed out at tonight's .meeting were .the Environmental Affairs Committee meeting motion regarding Marion- Fields Fourth Addition. Planning Commission Meeting October 19, .2000 Page 7 Mr. Morey stated that there are mostly perimeter trees within the Marion Fields Fourth Addition preliminary and final plat. The plan indicates that all. but one of the identified- significant trees are designated to be saved. Mr. Morey stated that the City's 2000 Comprehensive Park, Trail and Open:Space. Plan does not identify the need for any parks in the area of Marion Fields Fourth Addition. Staff and the .Parks and Recreation Committee are recommending a cash contribution to .satisfy the park dedication requirement for Marion Fields Fourth Addition. Mr. Morey stated that the developer hosted one neighborhood meeting on August 23, 2000 for residents that live within 500 feet of the development. Discussion at this neighborhood meeting centered around the possible redevelopment of the nine existing single family homes that front on 202nd Street adjacent to Marione Fields Fourth Addition. There was, as a follow-up, a second neighborhood meeting hosted by the developer. and City staff on October 16, 2000 with these nine homeowners:.. Mr. Morey `stated .that the preliminary plat plans include a ghost plat for the redevelopment of the existing single family lots .fronting 202nd Street east of proposed Ipava Avenue. City.Planner Daryl Morey stated that should the Planning Commission recommend approval of the Marion Fields Fourth Addition preliminary and final plat, Community and Economic Development Department staff recommend compliance with the fifteen stipulations listed in the October 13, 2000 Planning Report. Chair Drotning opened discussion for public comment. Robert Staupe, 9652 - 202nd Street West, and Tason Lamont, 9500 - 202nd Street West brought with .them copies of a memo they had drawn up itemizing their concerns about .Marion Fields Fourth Addition, which they ' distributed to the Planning Commission. 00.117 .Motion by Comer, Second by Wulff to receive the memo dated October 19, 2000 .from Robert Staupe and Jason Lamont with their concerns regarding Marion Fields Fourth Addition and enter it into the. permanent record. Ayes; Drotning, Moates, Comer, Wulff, Bellows, Kot. Nays: 0 Mr. Staupe and Mr. Lamont are residents who border the proposed plat on its • northern boundary.. Their memo outlines some of the issues that resulted from the October 16, 2000 neighborhood meeting. Planning Commission Meeting October 19, 2000 Page 8 A short video was shown that gave the view of the existing homes on 202nd Street from existing Ipava Avenue/202nd Street to the north. Mr. Staupe wished to acknowledge the efforts of Mr. Stanton to accommodate the neighboring properties as to the impact of his development on the .existing homes. Mr. Staupe stated that Mr. Stanton s outlots A, B, C, and D are an honest attempt to resolve some of those problems. Mr. Staupe stated that this biggest concern is the traffic on 202nd Street and the existing driveways that access 202nd Street. Mr. Staupe feels the existing driveways create a traffic problem for an already busy 202nd Street and with 87 homes proposed in Marion. Fields Fourth Addition, it will create a real burden on 202nd Street. Mr. Staupe feels it is difficult to get out of his driveway now, and it will only get worse once this development is complete. Mr. Staupe stated that the. City does not allow driveways on major collector streets. Mr. Staupe stated that the Marion Fields fourth Addition preliminary and final plat will not eliminate all of the existing driveways. of the nine .single family homes fronting.202nd Street to the north. He feels the. Planning Commission needs to take a look at the traffic that will be generated by the new development accessing 202nd Street. Mr. Lamont is re resentin the ou of four homes that border the lat east of p g p P Ipava Avenue. Mr. Lamont's home is on the far northeast corner. Mr. Lamont agrees with the issues that Mr. Staupe has identified. Mr. Lamont stated that Mr. Stanton might want to pursue. the .idea of purchasing and removing the existing homes to build townhomes to create a buffer from existing and future commercial uses. Mr. Lamont felt that by purchasing the homes on 202nd Street, the existing driveways. could be eliminated. Mr. Lamont suggested Mr. Stanton plat the northeast corners as an outlot to allow further discussion with existing homeowners regarding this possibility. Mr. Lamont and Mr. Staupe felt that the existing driveway issue needed to be addressed, along with some kind of buffer between the commercial property and the single. family homes. They felt this was a definite problem in terms of the impact if would have on the quality of living and the cost of homes. They also felt that the traffic problem on 202nd, Street must be addressed. Ron Voll, 9681 Upper 205 Street, lives on the south side of the development. Mr. Voll was concerned that there had been no mention of the trees on the south side. . Planning Commission Meeting October 19, 2000 Page 9 Mr. Stanton stated that if there are any trees that need to be removed on the south side: of the plat, he will tree spade them to another location on the site.. Mr. Voll also questioned who owned the former railroad property on the south side of the site. Mr. Stanton stated that the abandon railroad was. sold to the Hammer family and he is purchasing it now. 00.118 Motion by Comer, Second by Bellows to close the public hearing at 7:00 pm. Ayes: Drotning, Moates, Comer, Wulff, Bellows, Kot. Nays: 0 Commissioner Moates questioned how the street names were picked. Mr. Morey stated that the street names are not final .and that the preliminary plat has been forwarded to Dakota County, who assigns the. street names in Lakeville. We have not heard back from. them to date, buff name changes are. expected. .Commissioner Wulff asked when 202nd Street was going to be upgraded? Mr, Morey stated that the upgrade of 202nd Street to an urban street section is not in the current .2000-2004 CIP. Commissioner .Wulff was .concerned about the statement in the planning report stating Ghat the sidewalk on the proposed.. Ipava Avenue extension would. not be .installed with the Marion Fields Fourth Addition development.. Commissioner Wulff stated that it would make. more sense to put the sidewalk in with the development because residents dori t like the inconvenience of having the sidewalk installed .after their homes are built. Commissioner Wulff wanted to know if the .sidewalks could be put. in up front with this development. Staff .felt the safety issue of installing. a sidewalk on Ipava Avenue when there is no trail on 202nd Street is paramount to the future inconvenience of installing a sidewalk. on Ipava Avenue after 202nd Street is upgraded. Chair Drotning stated that he went to the neighborhood meeting. He asked City Administrator Robert Erickson to explain in more detail the recent and .proposed safety enhancements along 202nd Street. Mr. Erickson stated that Ipava has changed. dramatically in the last 30 days withthe opening of Ipava Avenue from County Road 50 all the way to County Road 46. Mr. Erickson added that residents have appreciated this connection in our community.. • The City is .concerned .for .pedestrian safety in this .area, especially .people crossing 202nd Street to get to Antlers Park and at Kensington: Boulevard to the west.. Mr. Planning Commission Meeting October 19, 2000 Page 10 Erickson stated: that the City's traffic. consultant has worked in conjunction: with Public Works, Engineering, and the Police Department to prepare a plan which was presented at a recent City.. Council work session. This plan was supported by area residents, Mr. Erickson stated that next year a crossingsignal will be installed at the 202nd Street crossing to Antlers Park. The. signal will .include a motion detector. In addition, Mr. Erickson stated that afour-way stop will be .installed at Kensington Boulevard and 202nd Street. Mr. Erickson .reiterated staff's recommendation not to install a .sidewalk along Ipava Avenue until 202nd Street is upgraded to an urban section. Mr. Erickson stated that the. existing. trail system and the proposed signalized crossing to Antlers Park insufficient until 202nd Street is upgraded to an urban section. Mr. Erickson indicated that the upgrade of 202nd Street will require more right-of- way on the north side of 202nd Street. There are significant trees in this area. When 202nd Street is: upgraded to an urban. section, a decision .will have to be made whether the street will be two or three lanes and how the city is going to do this "surgically' to meet everyone's individual expectations as far as maintaining the amenities they have on their properties. Mr. Erickson stated that it is premature to decide this. right now. Commissioner Bellows asked if the crossin si al will be at I ava Avenue. Mr. g ~ P Erickson stated that the signal will be at the crossing to Antlers Park and it should be in place by next summer. Mr. Erickson stated that residents are crossing at 202nd Street and Jacquard to the lake side of 202nd. Street where they walk along the narrow road next to the lake. This is a very unsafe situation. This was identified as an .ongoing .problem. by traffic consultants along with the speed of the vehicles traveling. on 202nd Street. Commissioner Bellows asked. if the Ipava Avenue and 202nd Street intersection will be an all-way stop. Mr. Erickson stated that the traffic .consultant hasri t analyzed. this intersection. A traffic study must be conducted before stop signs would be .installed at this intersection. Chair Drotning asked what the traffic counts were for 202nd Street. Assistant City Engineer Tim Hanson estimated current traffic on 202nd Street at 4,000 to 5,000 vehicles per. day. At it's. current design, 202nd Street can handle 8-10,000 vehicles per day. Mr. Hanson stated that capacity is not a problem, it is the mixture of pedestrians and vehicles that make it a safety concern. Mr. Erickson. explained that 202nd Street was a county road up until about 6 years ago. The: City wanted to take 202nd Street back so the road would not be expanded • and so traffic volumes could be kept relatively low. Planning Commission Meeting October 19, 2000 Page 11 i .Chair Drotning questioned whether residents traveling to the high school and ice arena on Ipava Avenue will cause a safety concern at the 202nd Street/Ipava Avenue intersection. He asked: Mr. Hanson to clarify the qualifications for installing 4-way. stop. signs. Mr: Hanson explained that MnDot has criteria for installing stop signs at intersections. Traffic safety, traffic volumes, and cueing times are primary considerations. Mr. ,Hanson agreed with Mr. Erickson that the Ipava Avenue/202nd Street intersection is a logical spot for afour-way stop. Commissioner Wulff agreed with staff on that the entire. segment. of the Ipava Avenue extension should be included in the preliminary and final plat. Mr. Stanton stated he will be closing with the Olson s (owners of the house..to be taken down due. to the extension of Ipava. Avenue) on Thursday, October 26, 2000.. Mr. Stanton stated that he would like to start. grading the. site because. the Lake .Marion outlet channel is currently dry. He stated that the Environmental Affairs Committee recommended that a grading permit be issued prior to preliminary plat approval in order. tominimize environmental impacts. Commissioner Wulff stated her reference for a landsca ed berm at the rear of the P P lots abutting Friedges Landscaping. In response to the resident comments regarding rezoning a portion of the property for townhouse development, Chair Drotning stated. that the Planning Commission spent more than two years preparing the new Zoning Ordinance, which designates the subject property. for single family .homes. He was not in favor of amending the Comprehensive Plan and Zoning Ordinance. Mr. Erickson stated that the City .purchased and removed existing single .family homes adjacent to the Raven Lake subdivision as .part of the on County Road 50 upgrade. These properties. were then redeveloped and included in the: Raven Lake single .family plat. Mr. Erickson stated that the discussion at Monday night's neighborhood meeting included the value of the existing homes and the feasibility of redeveloping them and. including them in the Marion Fields Fourth Addition plat..- The.. ghost plat shows that redevelopment of the lots on the east. side fo the Ipava Avenue extension would meet RS-3 District requirements. Mr. Erickson stated that he appreciates Mr. Stanton s cooperation to work with the. adjacent homeowners. Mr. Erickson stated that Mr. Stanton did draw up a townhome sketch for the north side of the. plat. The townhouse sketch indicated that zoning ordinance requirements could not be met for the project to be financiallyfeasible. • Planning Commission Meeting October 19, 2000 .Page 12 Mr. Stanton stated that the neighbors have been very cooperative. He stated that redevelopment of the existing homes on the west side of the Ipava Avenue extension .does not work :economically due to the limited depth of the. existing. lots. On .the east side of .Ipava Avenue he is close economically, depending upon the asking prce`of the homes.. Mr. Stanton stated that_he would have to purchase all of the homes on the east side of Ipava Avenue for the proposed redevelopment to work.... He .stated that he is willing to continue working with the residents, but an agreement will have to be reached. fairly quickly.. Mr. Lamont stated that all four of the homeowners on the east side of Ipava Avenue have expressed interest in .pursuing the idea of selling their homes. Commissioner Wulff stated her preference for the redevelopment as single family lots consistent with the Comprehensive Plan and Zoning Ordinance.. Commissioner Wulff agreed to allow the developer to start grading with the. preliminary plat. The developer could work out the details regarding the possible redevelopmenf prior to ..final plat approval. Commissioners Bellows and Comer agreed that the redevelopment. occur as single. family lots.. . Mr. Stanton,suggested that he could take. Blocks 7 and 8 out of the final plat. and designate .them as outlots while he continues to work with .the residents .east of Ipava Avenue regarding the purchase and redevelopment of their homes. Commissioner Kot stated that the preliminary and final plat should be tabled so the developer. could spend more time looking at redevelopment solutions for the existing .homes located on both sides of the Ipava Avenue .extension. She stated that the existing driveways on 202nd Street are not safe. Mr. Lamonte reiterated that traffic on 202nd Street is a problem. The driveways on the west side are more of an issue due to the fact they are on the .curve of road rather than on the straight away. He also: stated. that there is a lot of heavy truck. traffic on 202nd Street. Commissioner Wulff asked Mr. Erickson if the City can do anything about the truck traffic. Mr. Erickson stated that the River City gravel mine CUP expires in two years. If 4 way stop signs .are installed at the Kensingon/ 202nd and Ipava/.202nd intersections, this could discourage the trucks from using this route. Commissioner Bellows. wanted to know if there was a weight restriction .fore 202nd i Street. Mr. Hanson stated that it was a 7 ton road. Robert Staupe jason Lamont DATE: October 19, 2000 RE: Marion Fields Fourth Addition We would like. to speak in regard to the Marion Fields Fourth Addition. We are residents who border the proposed Plat on its northern boundary. We would like to acknowledge the effort of the developer to accommodate our properties and address the impact the development will have on the existing homes. The outlots included in the Plats northern border are an honest attempt to reduce that impact. In a meeting held. on Monday, Oct.16~ at City Hall, further discussion of the proposed Plat resulted in a dialogue about other possibilities for this development. 2. The existing driveways of our homes create a problem for the traffic flow on 202nd Street and are definitely a safety issue. 2. We feel very strongly that the proposed Plat, which adds approximately 87 homes to the area, will create a significant traffic burden on 202nd Street. 3. It was our understanding that a concern already existed regarding driveways entering on to collector streets. This is not resolved by the currentproposal. 4. The orientation of some of the existing homes do not lend themselves to the overall plan. 5. The Northeast corner containing 4 exiting structures and 4 platted lots are adjacent too and across the street from two sites currently zoned commercial. Because of these issues a discussion ensured regarding the possible rezoning of a portion of the ..Plat. This rezoning would allow the developer to pursue the purchase of some of the existing homes and replace them with detached townhomes that would border the Plan. This: would. eliminate a portion of the driveway problem on 202nd Street, correct the orientation problem by facing the townhomes inward, and provide a buffer between the commercial properties and the proposed single family dwellings in the rest of the Plat. Two remaining issues are the existing driveways west of Ipava and increased traffic from the development on to 202nd Street. We expect the city staff will take steps to address these issues prior to granting approval to the preliminary Plat. Particularly the issue of future expansion or upgrading of 202nd Street and its impact on our properties. These issues need further discussion and resolution. Therefore, we endorse the idea of granting an outlot or exception to the area in questions.. This would allow the developer opportunity to excavate the remaining property in the Plat.
