Planning Commission Meeting Minutes
• NOVEMBER 16, 2000
The November 16, 2000 Planning Commission meeting was called to order by Chair
Drotning in the City Hall Council Chambers at 6:00 p.m.
Roll call of members was taken:
Present:: Bellows, Kot, Drotning, Rieb, Comer, Wulff.
Absent: None
Staff Present: Arlyn trussing, Director of Community and Economic

The .November 2, 2000. Planning Commission meeting minutes were approved as
presented.
ITEM 4. ANNOUNCEMENTS
City Planner Daryl Morey noted. that he had provided a handout to each Planning
Commission member identifying current and pending residential projects proposed
• in the City of Lakeville.
ITEM 5. PUBLIC HEARING: TWIN CITIES HARLEY DAVIDSON
Chair Drotning opened the public hearing for consideration of the applications of
.Leo Kuelbs for the following: 1) a preliminary and final plat of one lot and one
block to be known as Harley. Davidson Addition, and 2) a Conditional Use Permit
to allow the. expansion of the existing. building, located at 10770 - 165 Street.
.Assistant City Attorney Poehler attested that the legal. notice had been mailed and
published in accordance with state statutes.
Mr. Charles Novak, the architect for Twin Cities Harley Davidson, presented the
applications for the preliminary and final plat to be "known as Harley Davidson
Addition and a Conditional Use Permit to allow a loading dock on the front of .the
building on a corner lot in the C-3, General Commercial District.
Mr. Novak stated Harley Davidson was adding a 16,000 square foot storage and
.service :area. There would not be any addition to the :sales and parts .department.
They will be going from 12 to 24 service bays,.. tripling the parking lot area and
possibly adding 12 or 13 full-time employees.: Mr. Novak indicated that there
would be no wall openings facing the east, where the .residential neighborhood is

located. In addition, they will be providing landscape screening to the east with the
installation of 7, twelve foot tall spruce trees.
.Associate Planner Frank Dempsey presented an overview of the .planning report
regarding the applications for a preliminary and final plat to be known as Harley
Davidson Addition and a Conditional Use Permit to allow a loading dock on the:
front of the building in the C-3 District.
Associate Planner Dempsey stated that. Twin Cities Harley Davidson is proposing
to construct a 15,940 square foot addition onto their existing 23,296 square. foot
building. The addition would be used primarily as additional service and storage.
area for the growing. business. The existing building was constructed in 1989 and
Twin Cities Harley Davidson has occupied the building since 1997.
Mr. Dempsey stated. that the Twin Cities Harley Davidson property consists of two
parcels. One is a metes and bounds .described parcel, the other was preliminary
and final platted in 1988 as the Rademacher Addition.
Mr. Dempsey indicated that the proposed building addition by Twin Cities .Harley
s Davidson requires the property be preliminary and final platted into a single parcel
to eliminate the property line that currently divides a portion of the building.
Mr. Dempsey stated that the surrounding land uses .are: to the north, 165 Street,
KFC Restaurant and Gopher Mini Storage (C-3 District); to the south, undeveloped
commercial property (C-3 District); to the east, storm water pond and single family
homes (RS-2 District); and to the west, Kenrick Avenue and Interstate 35.
Preliminary and. Final Plat-
Mr. Dempsey indicated that the existing Twin Cities Harley Davidson. property is
guided as Commercial in the 1.998 Comprehensive. Land Use Plan and the proposed
building expansion complies with the Land Use Plan.
Mr. Dempsey noted that no public funded. street or utility construction is required
with the Harley Davidson Addition preliminary and final plat.
Mr. Dempsey stated that the Harley Davidson.Addition preliminary and final plat
proposes one lat and .one block on the 3.87 acre property. Lot 1, :Block 1, Harley
Davidson Addition exceeds the minimum lot area and width requirements in the C-
3, General Commercial District.

Mr. Dempsey .indicated that there are no outlots proposed with the Harley
Davidson Addition preliminary and fnaY plat.
Associate Planner Dempsey stated that he Harley ..Davidson Addition preliminary
and final plat abuts Kenrick Avenue and 165 Street. An additional 10 feet of
Kenrick Avenue right-of-way will be dedicated with the Harley Davidson. Addition
plat in compliance :with the Comprehensive Transportation Plan. Additional. right-
of-way is also being dedicated from the metes and bounds parcel for 165 Street to
be consistent with the 'right-of-way dedicated with the existing Rademacher
Addition. The :right-of-way for the entire property will be consistent with the
Comprehensive Transportation -Plan .requirements. The City's Comprehensive
Transportation Plan classifies Kenrick Avenue and 165 Street as major collectors.
Mr. Dempsey indicated that a bituminous trail is located on the south side of 165
Street and a concrete sidewalk. is located on the east side of Kenrick Avenue. No
.additional trails or sidewalks are required.
Mr. Dempsey stated that the Engineering Department recommends approval of the
preliminary and. final.. plat plans subject to the recommendations outlined in Mr.
Hanson s 'report which is attached to the Planning .Report.. The Fire Marshal is
:requiring that an on=situ fire .hydrant be installed at the end of the landscaped
parking lot island near the northeast corner of the building, which is shown on the.
proposed plans.
Mr. Dempsey stated that the .Twin Cities Harley .Davidson property is located
within the Crystal Lake. Watershed District and is subject to a maximum allowable
impervious surface area of 70%. The plans propose an impervious surfacearea of
63.2%.
Mr. Dempsey indicated that no significant trees are being removed with the
proposed preliminary and final. plat. Nine significant honeylocust and ash trees,
four greenspire linden trees and seven, 12 foot :tall black hills spruce trees. are
proposed to be installed on-site along with a large. number of :smaller shrubs near
the foundation of the building.
Mr. Dempsey stated that there are no wetlands within the boundaries of the Harley
Davidson Addition preliminary and final plat.
Mr. Dempsey indicated the underlying .Rademacher Addition boundary drainage
and utility easements were. not identified until after the "preliminary plat and
conditional use permit. public hearing notices were published and mailed. The

public hearing for the easement vacation will be scheduled for the December 7, 2000
Planning Commission meeting. The City Council will consider the preliminary and
final plat, conditional use permit, easement vacation .and minor .variance for the
existing building setback to the new Kenrick Avenue right-of-way dedication at
.their December 18, 2000 meeting, The minor variance, which results from a public
action, requires consideration by the City Council only.
Conditional Use Permit
Associate Planner Dempsey presented the conditional use requirements listed in
the November 16, 2000 Planning Report. A conditional use. permit is required to
allow a loading dock to face the public right-of-way in the C-3 District.
Mr. Dempsey stated that the Harley Davidson building will require a total of .142
parking spaces on-site and distributed as listed in the November 9, 2000 Planning
Report. 140 of the spaces will be provided as part of the building expansion and
two,additional spaces will be created when the pylon sign is relocated in the future
when Kenrick Avenue is expanded.
• Mr. Dempsey stated that the developer proposes to relocate. 9 existing trees located.
within the parking lot and east of the existing building to the: south and east
perimeter. of the expanded parking lot. Additional shrubs and new. sod. are. also
proposed over the graded hillside. Also, if any of the landscape materials, new or
transplanted, do not survive after the first growing season, the materials shall be
replacedwith a like size and species.. Mr. Dempsey stated that a $5,000.00 escrow
shall be submitted by the developer to guarantee installation of the approved
landscaping..
Mr. Dempsey stated that the proposed trash and recyclables container will be
placed 4 feet below grade and the remainder will be screened with the: proposed 7,
twelve foot tall spruce trees. The proposed trees will be staggered and planted 30
feet apart. These trees will: provide additional. screening from the existing single
family homes located approximately 400 feet to the east.
Mr. Dempsey indicated the building .addition will be constructed of decorative
concrete -block with colors and materials to match the existing building. The
building addition will be 31 feet in height which is within the maximum 35 foot
height .allowed by the Zoning Ordinance in the C-3 District. Mr. Dempsey added
that. the `proposed building height, .exterior materials and colors are compatible with
other. buildings in the area. and in .the city.

Mr. Dempsey stated that two new light poles will be installed within the expanded
parking area. Each pole will contain two .light fixtures and the new light fixtures
will match- the existing fixtures. A photometric plan shall be submitted. by the
developer for staff review prior to City Council. consideration on the preliminary
and final plat and conditional use permit.
Minor Variance
Mr. Dempsey stated that a minor variance for the setback of the west side of the
building to the new .Kenrick ..Avenue right-of-way dedication will be considered by
the City Council. He indicated the preliminary and final plat of Harley Davidson
Addition requires the dedication of 10 additional feet of Kenrick Avenue right-of-
way to conform to the Comprehensive Transportation Plana The dedication of the
additional road. right-of-way.. will reduce .the building setback from the required 30
feet. to 20 feet at the southwest corner of the Harley Davidson building. Sinee the
non-conforming setback is ,created by a .government action, ..the variance is
considered a minor variance... The existing Harley Davidson pylon (freestanding)
sign will also be anon-conforming structure as a result of the 10 foot right-of-way
dedication for Kenrick Avenue. `The sign will remain non-conforming and will not
be considered part of the minor variance. Mr. Dempsey stated that the property
owner has agreed to sign an encroachment agreement that would allow the pylon
sign to remain in its present location until such time that Kenrick Avenue is
upgraded.. The sign would then be relocated atthe property owner's expense.
Mr. Dempsey stated that should the Planning Commission recommend approval of
the Harley Davidson Addition .preliminary and final plat .and conditional .use
permit, Community & Economic Development Department staff recommends the "
eight. stipulations listed in the November 9, 2000 Planning Report.
Chair Drotning opened the hearing to the public-for comment.
Carl Skeps,16528 Kentucky Avenue, lives east of Harley Davidson. Mr. Skeps first
wanted' to thank the Planning .Commission for listening to himself and his
neighbors. Second he wanted to thank Harley Davidson for being good neighbors.
Mr. Skeps agreed and was aware that Harley Davidson had every right to improve
their property, but he wanted to be sure they .did it in a .responsible way. Mr.
Skeps' concerns were as follows:
1. Height of the Harley Davidson building
2. Easement vacation requirements
3. Early morning-noise from deliveries and trash removal

4. Loading dock location
5. Parking along 165 Street during large events
6. Screening of the east side of the building
Gerry Rainford, 16547 Kentucky Avenue, lives east of Harley Davidson. Mr.
Rainford stated that Harley Davidson has been a good neighbor. Mr. Rainford's
concerns were:
1. Where are the pallets going to be stored?
2. Trucks -storage and hours of delivery
3. Parking lot lighting
4. Making sure the trucks are not backing into the site from 165 Street
5. Installation of a retaining wall by the delivery area to reduce the noise
6. Impact to property values
Gary Tohnson, 16659 Kentucky Avenue, lives east of Harley Davidson. Mr.
Johnson's concerns were:
1. Landscaping on the south side of the Harley Davidson building
• 2. Taller trees due to the fact that the houses on the east side are two-story homes
3. Hours of delivery
Craig Weber, 16579 Kentucky Avenue, lives east of Harley Davidson. Mr: Weber
thought that expanding the parking lot was a good idea. Mr. Weber's concerns
were:
1. Trees and landscaping
2. Wanted to be sure the delivery trucks would access the parking lot from
Kenrick Avenue
3. Site visibility at the intersection if trees are planted on the corner of Kenrick
and 165 Street
4. Screening of dumpster and storage of pallets

Commissioner Comer made the suggestion to table the Public Hearing on Harley
Davidson due to the fact that the owner, Mr. Leo Kuelbs, was not in attendance.

Commissioners Wulff, Kot, Rieb, and Bellows agreed that the Public Hearing
should continue since the neighbors had taken the time to .attend the Planning
Commission meeting. Mr. Novak stated that he .could not commit to any
additional stipulations. in Mr. Kuelb's absence.
..Chair Drotning stated that the Planning Commission will discuss each .one of the
concerns that the: neighbors brought up for discussion.
Chair Drotning clarified that the compactor is currently located on-site.. The plans
propose that the trash container will be inside the building. Mr. Novak stated that
- the compactor will continue to be located outside, however, the noise from the
compactor is internal.
City Planner Daryl Morey. stated that the Zoning Ordinance requires screening the
compactor from public view. Mr. Morey" stated'. that there must be an adequate
landscape screen for the existing homes to the east.
Commissioner Wulff: stated there should be no outside storage and the pallets
should be stored inside. the building. Mr. Morey indicated that the Planning
Commission could add a stipulation that there be no outside storage.
Regarding the height of the building, Mr. Novak stated that the building height is
on average 20 feet high because .part of the building addition will be below grade.
Mr. Novak indicated that the building addition will be 11 feet high at the south' end
and there will be no openings on the east side, which face the neighbors.
Regarding the .vacation. of easements and the dedication of new easements, Mr.
Dempsey stated that. ali platted properties must provide a 10 foot perimeter
boundary easement.. On the Harley .Davidson- Addition plat, there are 10 foot
drainage -and utility easements located on the north, south and .west .boundaries
and a 20 foot drainage and utility easement located on the east 'boundary. Mr.
Dempsey stated that it is the City's policy to vacate .all underlying: easements and
re-dedicate them on the new plat whenever property is re-platted.
Due to the fact that 1VIr. Kuelbs was not in attendance, Mr. Dempsey and Mr. Morey
indicated that the Planning Commission could add a stipulation to their
recommendation that deliveries. shall not occur between the hours of 10:00 p.m and
7:00 a.m., consistent with City code.

Mr. Novak stated that constructing a retaining wall by the loading dock area to
reduce noise may. affect access to the loading dock area. Mr. Novak thought that
serviceability might be a problem. Commissioner Kot asked if it would be possible
to construct a berm. instead. Assistant City Engineer Hanson stated that it would
not be possible due to the maximum allowed 3:1 slope. He stated that it would. be
better to install the landscaping grades as shown on the plans.
Commissioner Rieb wanted to confirm the proposed plan for lighting the parking.
lot.. Mr. Novak stated that a photometric plan will be submitted to City staff for
review. prior to City Council consideration of the preliminary and final plat and
conditional use permit.. Two additional light poles will be installed. Each pole will
contain two light fixtures and these will match the existing fixtures.
Commissioner. Kot asked if there would be any. lighting on the east side of the.
building. Mr. Novak stated there would not be any new lighting on the east side of
the building. He stated that there is one security light on the door on the south side
of the building.`
The Planning Commission .asked if more and taller pine trees could be put along
the east side of the building to help with noise and screening.
Mr. Morey stated that the Zoning Ordinance requires six feet tall evergreen trees.
Harley Davidson is proposing using 12 foot tall trees which are .twice as high as is
required. Anything larger might not survive the planting. ' He suggested installing
a mixture of deciduous and coniferous trees to help screen the building, loading
dock and compactor. Mr. Morey stated additional landscaping could be installed
south of the loading area.
Chair Drotning asked Assistant City Engineer Tim Hanson about 'ordinance
requirements pertaining to landscaping at street intersections.. Mr. I-Ianson stated
that landscaping cannot be installed withinthe site visibility triangle.
Chair. Drotning asked about the turning. radius for delivery .trucks accessing the
loading docks from. the west side of the site. Mr. Hanson indicated that City. staff
requested that the developer verify the truck turning radius.. He stated that the
turn around radius appears adequate.
Chair Drotning requested that the .owner inform their delivery truck: drivers to
access the loading docks from Kenrick, not 165 Street.

Commissioner Rieb asked the timeframe for constructing the building addition.
Mr. Novak stated that bids will be taken in March or April. There will be a 21/z to
3 month construction period. Mr. Novak indicated the building addition
construction should be complete by the end of July, 2001.
Assistant City Attorney Poehler stated that the Harley Davidson use of .the
property is a permitted use and impacts to property values are not a criteria for
consideration of a preliminary and final plat or conditional use permit request.
The Commissioners agreed to .add four stipulations to the eight stipulations listed
in the November 9, 2000 Planning Report.
9. Deliveries shall be prohibited between the hours of 10 pm and 7 am.
10. No outside storage shall be permitted.
11. The landscape plan shall be revised to include a mixture of 4 inch caliper
deciduous trees and 6 foot tall evergreen trees planted along the entire length
of the building addition and along the driveway toward 165 Street.
12. The compactor shall be screened on the east side with a minimum 6 foot tall
masonry wall to match the color of the building.
00.126 MOTION by Wulff, Second by Comer to recommend to the City Council approval of
the Harley Davidson Addition preliminary and final plat and conditional use
permit subject to the eight stipulations listed in the November 9, 2000 Planning
Report and the addition of Stipulations 9-12 by the Planning Commission, and
approval of the Findings of Fact dated November 16, 2000.
Ayes: Kot, Drotning, Rieb, Comer, Wulff, Bellows.
Nays: 0.
Item 6. NEw BUSINESS
City Planner Daryl Morey, indicated that he handed out a list of 19
current/pending residential projects, which includes a breakdown of the total
lots/ units proposed.
Mr. Morey stated that the December 21, 2000 Planning Commission Meeting will
be cancelled.
