)anuary 22, 1998
The January 22, 1998 Planning Commission meeting was called to order by Chair Rieb at
6:00 p.m. in the City HaII Council Chambers.
Roll: call of members was taken:
Present: Miner, Kot, Wanner, Rieb, Cecchini, Wulff.
Absent: Amborn, Ex Officio Member Bellows.
Also present: Michael. Sobota, Community and Economic Development Director; Tim
Hanson, Assistant City Engineer; Roger Knutson, City Attorney; Heidi Hamilton,
EnvironmentaC Engineer; Bob Nicholson:, Environmental Affairs Committee; Alan Brixius,
Planning Consultant; Madhulika Singh, Planning Consultant; and Ron Mullenbach,

ITEM 4A: ANNOUNCEMENTS
Community and Economic Development Director Michael Sobota. requested a correction to
the January 8, 1998 minutes involving the removal of motion 98-15, which was a duplicate
motion to close :nominations for Planning Commission Secretary for 1998.
The minutes of the January 8, 1998 Planning Commission Meeting were approved as
.amended.
ITEM 5: DISCUSSION
Community and Economic Development Director Michael Sobota presented an overview of
the Comprehensive Guide Plan Update, including the Rural Service Area planning process.
Sobota indicated that staff is requesting that the Planning Commission review and discuss.
proposed ultimate land use plans for each of the community's three rural service area
neighborhoods.
Planning Consultant Alan Brixius opened his presentation with an overview of the City's
Expansion Areas map, Transportation Plan, and the 1988 Land Use Plan. He explained that
the expansion areas were identified based on existing utilities and infrastructure, such as the
Apple Valley interceptor and generally consisted of a 5-year supply of vacant developable
land. It was also explained that the ultimate urban land uses proposed on the plans would
only develop as MUSA becomes available.
NORTHWEST RURAL SERVICE AREA
Consultant Brixius presented three areas proposed for MUSA amendments. in the ultimate
land use plans 1) the entire Northwest Rural Service Area is proposed to be removed from
Expansion Area C and designated as Rural Residential; 2) the Deer Park neighborhood
• adjacentto the Northwest Rural Service Area is proposed to be removed from the current
2010 MUSA; and 3) the portion of the Orchard Lake Elementary. School .properly outside
the MUSA is proposed to be placed into the current 2010 MUSA..

• Consultant Brixius presented the development constraints in the Northwest Rural Service
Area, including: 1) limitation on extending sanitary sewer into the area except by lift station;
2) site topography and other natural physical constraints; and 3) compatibility with
surrounding land uses and the City of Burnsville land use plan. The proposed ultimate land
uses in the area consist of Permanent Rural Residential at 1 dwelling unit per ten acres and
Public/Semi-Public uses covering the Trinity Lutheran Church and. YMCA properties
adjacent to County Road 5 and Klamath Trail.
Chair Rieb questioned as to the minimum lot sizes that would be permitted. in the
Permanent Rurat area. Consultant Brixius explained that while the minimum lot size would
be ten acres based on the'one dwelling unit per ten acres dens; ,lots of record would still
be buildable. ("grandfathered-in"). Community and Economic Development Director Sobota
added that most, if not all, of the area is built-out and the majority of lots are less than ten
acres in size.. The rural residential designation is consistent with existing and planned land
uses in Burnsville immediately to the. north.
Commissioner Miller inquired as to the lot sizes in the Deer Park neighborhood.
Consultant Brixius indicated that lot sizes in the area are. inadequate for development, some
having approximately twenty feet of frontage, and that no roads have been constructed to
serve development.
City Attorney Roger Knutson asked whether Public/Semi-Public would be the ultimate use
of the church and YMCA properties. Consultant Brixius indicated that the designation was
• based on current uses. In relation. to the YMCA property, the use could only be amended if
the YMCA followed detailed procedures outlined in the deed restriction currently on their
.'property to develop the site for residential uses.
Commissioner Cecchini identified an area near the northerly City boundary in the
Northwest. Rural Service Area that may have site. topography conducive to extending City
services. Community and Economic Development Director Sobota noted that the area
identified cannot be served by gravity sanitary sewer and would require force mains and a
Lift station due to surrounding topography.
Commissioner Miller expressed concern over the potential proliferation of pole sheds and
similar structures that would be allowed under thepermanent rural designation of the
Northwest Rural Service Area. Community and Economic Development Director Sobota.
agreed that this was a concern and may warrant revisiting zoning ordinance standards. upon
completion of the comprehensive guide plan update.
Commissioner Cecchini questioned as to why Orchard Lake water quality was listed as an
issue in the Northwest Rural Service Area. Community and Economic Development
Director Sobota. noted that the Permanent Rural designation would reduce degradation of
Orchard Lake by reducing storm water runoff levels.. The Permanent Rural designation also
reduces the need for storm water outlets and minimizes nutrient loading of Orchard Lake.
Commissioner Cecchini questioned whetherthere were any additional issues related to
• BracketYs Crossing water quality. Community and Economic Development Director Sobota
introduced Heidi Hamilton, Environmental Engineer. Engineer Hamilton discussed the
Orchard Lake Water Quality and Management Study and the studies being done at
Bracken's Crossing. She also noted that alum treatment was completed last year to reduce..

. phosphorous loading.. The results of the Orchard Lake study are due in Summer, 1998.
Engineer Hamilton expects the study to show a reduction in phosphorous levels which will
prevent further degradation of Orchard .Lake.
Environmental Affairs. Committee Member Bob Nicholson questioned vvhat the City's plans
were for extending County Road 46 west of Interstate 35. Community and Economic
Development Director Sobota indicated that the City Council has taken a strong stance
against any extension of County .Road 46 west of County Road 5 through Murphy-Hanrehan
Park. An overview of the current County Road 42 study was provided. 185th Street in
Lakeville has been raised as a possible six-lane principal east-west. arterial. County Road 70
may"be located too:far south to meet Metropolitan Council, spacing requirements.
EAST RURAL SERVICE AREA
Consultant Brixius presented the East Rural Service Area development constraints,
including: 1) hydric soils; 2) wooded areas; 3) future park search areas; 4) linear parks and
trails; 5) Model Stone reclamation plan; and 6) the transportation system. Consultant Brixius
continued on to present the proposed ultimate land uses with the East Rural Service Area.
Commissioner Miller questioned the reasoning behind locating high density residential in
the area of future 179th Street and Cedar. Consultant Brixius cited functional classification.
of streets in the area, including: 1 }future Gerdine Path (minor collector}; 2) future 179th
Street (major collector); 3) Cedar Avenue (arterial); and 4} Dodd Boulevard (arterial). Future
commercial uses planned for the Dodd/Cedar. intersection. was also mentioned as services
available to high density residential development.
Commissioner Cecchini requested an explanation for the commercial designation of
property at the northwest corner of future 179th Street and Cedar Avenue. Consultant
Brixius indicated that it would be an extension of commercial. uses identified in the
Cedar/Dodd Land Use Study and. was seen as a suitable location. for commercial lying at the
'rntersection of several high. traffic streets.
Commissioner Wanner questioned whether the City was planning to .upgrade Dodd
Boulevard, citing current high. traffic levels. Community and Economic .Development.
.Director Sobota explained that the extension of Ipava Avenue south of 185th Street was
planned to handle someof the trafficcurrently utilizing Dodd Boulevard. Community and
Economic Development Director Sobota also stated that the Dodd Boulevard upgrade has
not been-scheduled in .Dakota County's 5-year capital improvements program.
.Commissioner Wulff questioned the location-of medium and high density residential uses
along Pilot Knob Road. Consultant Brixius explainedthat the land uses are proposed as a
suitable transition between existing low density residential. uses and Pilot Knob Road.
Commissioner Wulff emphasized that this type of development may require increased
setbacks from right-of-ways for screening purposes, possibly based upon the functional
classification of the street. Community and Economic Development Director Sobota
indicated that Commissioner Wulff's suggestion will be noted by staff. However, the study.
of setback requirements, along with other aspects of the zoning ordinance, is most
appropriately pursued upon completion of the comprehensive guide plan update .

Environmental Affairs Committee Member Bob Nicholson raised storm water drainage
concerns related to the high density residential development planned near Pilot -Knob Road.
Assistant City Engineer Tim Hanson responded by saying that the storm water management
plan will be revisited upon completion of the comprehensive guide plan update. Any
necessary amendments would be made at that time.
CommissonerCecchini asked what types of high density residential land uses near future.
T79th Street and Cedar Avenue would be possible. Community and Economic
Development Director Sobota described what type of development could beexpected with
a high densitydesignation,'including apartments, townhomes, and other housing styles.
SOUTHWEST RURAL SERVICE AREA
Consultant Brixius presented the development constraints in the Southwest Rural Service
Area, including: 1) hydric soils; 2) wooded areas; 3) flood plains; 4) future park search areas;
5) trailways, and; 6) the transportation system.
Alan Brixius continued, describing the ultimate land use plan for the Southwest Rural
Service Area. Areas near Ritter Farm Park and Soberg Wildlife Preserve have been
identified-on the plan as park search areas. Property adjacent to County Road 70 will be
serviced by utility extensions from the east. He noted that sanitary sewer is currently within
Golden Pond Subdivision.
• Commissioner Miller asked staff to describe the quality of commercial development that is
anticipated in the Shiely gravel mine area. Brixius responded that the more broad
commercial designation allows for multiple zoning possibilities, including BC, Business.
..Campus, and B-4, General. Business. City Attorney Knutson explained that the land uses on
the proposed plan are considered ultimate land uses rather than guided land uses. The
ultimate wand use would not be realized. until sanitary sewer became available.
Environmental Affairs Committee member Bob Nicholson pointed out that South Creek has
been designated by the DNR as a Trout Stream and questioned the appropriateness of
Commercial Office land. uses adjacent to the creek. Brixius noted that staff had considered
the Trout Stream designation in planning the ultimate land use, Commercial Office uses
were determined to be the least intensive commercial use, especially in terms of 'rrnpervious
surface concerns. The commercial use was needed as a transition between industrial uses
immediately to the south and planned residential uses to`the north.
Commissioner Wanner questioned=the High Density Residential designation in the Shiely
.Gravel Mine. property. Brixius explained that high. density: residential. was part of a concept
reclamation plan approved. by the City and also directly north of the Muller Theater and
adjacent R-6, Medium Density Residential zoned property.

ITEM 8: STAFF NOTICES
There being no further discussion of the Rural. Service Area Proposed Ultimate Land Use
Plans, Community and Economic Development Director Sobota reminded the Planning
Commission of upcoming neighborhood meetings to be held as part of the Comprehensive
Guide Plan update. The dates, times and locations of the meetings are as follows:
Southwest Area: )anuary 27 7:30 - 9:00 PM Super 8 Motel
Northwest Area: January 28 5:00 - 6:30 PM Orchard Lake Elem.
..East Area: )anuary 28 7:30 - 9:00 PM City Hall
Community and Economic Development Director Sobota also presented the Planning
Commissioner Registration Information for 1998 Government Training Service Planning
Workshops.
.The next Planning Commission Meeting will beheld at 6:00 p.m. on Thursday, February 5,
1998.
There being no further business, the meeting was adjourned at 8:00 p.m.
