HomeMy WebLinkAbout11-19-98 City of Lakeville PLANNING COMMISSION MEETING MINUTES November 19, 1998 The November 19, 1998 Planning Commission meeting was called to order by Chair Rieb at 6:00 p.m. in the City Hall Council Chambers. Roll call of members was taken: Present: Miller, Wanner, Rieb, Drotning, Cecchini, Wulff, Ex Officio Bellows. Absent: Kot. Staff present: Michael Sobota, Community and Economic Development Director; Tim Hanson, Assistant City Engineer; Roger Knutson, City Attorney; and Donna Quintus, Recording Secretary. The November 5, 1998 Planning Commission meeting minutes were approved as submitted. ITEM 5: PUBLtC HEARING: Cooperative Power Association/Northern States Power Company Conditional Use Permit Chair Rieb opened the public hearing for consideration of the application of Cooperative Power Association and Northern States Power Company for a Conditional Use Permit to allow the construction of a 115 kilovolt (kV) electric transmission line. City Attorney Roger Knutson attested that the legal notice had been duly mailed and • published as required by state statute. Community & Economic Development Director Michael Sobota presented an overview of the application of Cooperative Power Association (CPA) and Northern States Power (NSP) for a Conditional Use Permit to allow the construction of a 115 kilovolt (kV) electric transmission line on property generally located on the west side of Cedar Avenue (C.R. 23) beginning at the Dodd Park electric substation south of Dodd Boulevard (C.R. 9); then south along the west side of Cedar Avenue (C.R. 23) to C.R. 50; then west on the north side of C.R. 50 to the Airlake substation west of Hamburg Avenue; then south along the west side of Hamburg Avenue to 215th Street (C. R. 70); then west on the south side of 215th Street (C.R. 70); then the transmission line .proposes to move to the north side of 215th Street west of C.R. 70 to the west side of Kenrick Avenue (C. R. 5) then south to the city limits of Lakeville. Sobota indicated that City staff and Assistant City Attorney Jim Walston have worked with the businesses along Hamburg Avenue to obtain roadway, drainage and. utility easements for eventual widening of Hamburg Avenue. Mr. Sobota further stated that CPA withdrew a previous Conditional Use Permit application following a public hearing held at the September 17, 1998 Planning. Commission meeting. CPA needed .additional time to address a number of issues raised at that public hearing regarding the original proposal. After meeting with City staff, NSP and the Dakota County Highway Department, CPA and NSP representatives submitted a new Conditional Use Permit application and revised plans.. The. revisions include the following: 1) -the identification of proposed locations of the transmission lines and poles in relation to parcels and structures along Cedar Avenue. The Dakota County Highway Department has realigned the Cedar Avenue improvements to be more Regular Planning Commission Meeting Minutes November 19, 1998 Page 2 • consistent with existing terrain. The CPA proposed pole locations are consistent with the realignment. 2) CPA's proposal to place their transmission line within an existing NSP transmission line corridor on new pole structures that would be shared with NSP on the north side of County Road 50 between Cedar Avenue and Hamburg Avenue. Sobota also noted that a third 115 kV transmission line will be installed sometime after 2001. Dave Callahan, Senior Right-of-Way Manager with NSP, responded to questions from the Commission and provided details of the proposed double pole configuration. Mr. Callahan indicated that the proposed design provides safer working conditions for electrical line installers and repairmen and does not require that the lines all be taken out of service when servicing is needed. There were no comments from the public. 98.169 MorioN by Wulff, Second by Cecchini to close the public hearing at 6:30 p.m. Roll call vote was called on the motion. Ayes: Miller, Wanner, Rieb, Drotning, Cecchini, Wulff. Nays: 0. Commissioner. Wulff requested clarification of the location of poles related to the • proposed trail along Cedar Avenue. Mr. William McGoldrick, Cooperative Power Association, responded that MnDOT minimum standards require atwo-foot minimum separation between transmission poles and trailways. He indicated .that there is five feet between property lines and proposed pole locations. Placement of the poles will meet or exceed minimum MnDOT standards. Mr. McGoldrick further indicated that the necessary easements for the transmission lines will be acquired along Cedar Avenue after the project is approved by the City Council Community and Economic Development Director Sobota discussed the triple circuit line proposed to be located from Hamburg Avenue to Cedar Avenue along County Road 50. Mr. Sobota indicated that NSP had proposed some language to clarify the proposed project. After consultation with City Attorney Roger Knutson, staff is recommending the language in paragraph 1 of the draft Conditional Use Permit be amended as follows: 1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville grants a conditional use permit to Cooperative Power Association CPA and Northern States Power Company (NSP) to: (a) allow the construction b_y CPA of a 115 Kilovolt electric transmission line from the Dodd Park substation to the Airlake substation to the south city limits. • ~ allow the construction of the above 115kV line from Hamburg Avenue to Cedar Avenue along the north side of County Road 50 on the triple circuit structures to be owned by NSP and to allow NSP to occupy the other two Regular Planning Commission Meeting Minutes November 19, 1998 Page 3 circuits with its existing 69kV line and a new 115kV circuit to be installed sometime after 2001. The Commission members concurred with Community and Economic Development staffs. recommendation. Commissioner Miller inquired about the proposed location of poles near future collector roadway intersections. Mr. McGoldrick stated that CPA will place poles within right-of- way in locations that would not require moving them in the future when collector roads are built. Mr. McGoldrick further stated that CPA understands that if the poles located in highway rights-of-way need to be moved it would be at no cost to the City or County. 98.170 MorioN by Miller, Second by Drotning to recommend to City Council approval of the Conditional Use Permit for Cooperative Power Association and Northern States Power Company subject to the six stipulations listed in the November 13, 1998 Planning Report and with amendments to the Conditional Use Permit noted above and approval of the Findings of Fact dated November 19, 1998. Roll call vote was called on the motion. Ayes: Wanner, Rieb, Drotning, Cecchini, Wulff, Miller. Nays: 0. Community and Economic Development Director Sobota informed the Planning:. Commission that, due to a lack of agenda items, staff recommends canceling the December 3, 1998 Regular Planning Commission Meeting. Instead, a Special Planning Commission Meeting will be .held at 6:00 p.m. on Thursday, December 10, 1998. Projected agenda items for the December 10th meeting include public hearings for the Ames Ice Arena expansion preliminary and final plat and easement vacation and the Comprehensive Land Use Plan Update. If needed, the land use plan hearing could be continued to December 17th, otherwise staff recommends canceling the December 17, 1998 Regular Meeting. The Commissioners concurred.
