HomeMy WebLinkAbout0751 ORDINAlvCE N0. ~5 ~ CITY OF LAKEVII.LE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING ORDINANCE N0.733 BY EXTENDING THE TEMPORARY PROHIBITION OF APPROVALS OF CERTAIN RESIDENTIAL DEVELOPMENTS FOR AN ADDITIONAL .FOUR MONTH PERIOD. THE CITY COUNCIL OF THE CITY QF LAKEVII L E URDAINS` SECTION 1. Background. On April 15, 2002, the City adopted Interim Ordinance No, 71 T which temporarily. prohibited approval of certain-residential development within the City of Lakeville. On March I7, 20Q3, the City adapted Ordinance No. 733, extending the effective date of Ordinance No. 711 to December 15; 2003. The Lakeville Planning Commission and City staff initiated a review of the Zoning Ordinance approximately two years following the Zoning Ordinance Update approved by the City. Council on July 17, 2000, consistent with the direction of the City Council at the time the Zoning Ordinance Update was adopted. The Planning Commission has held twelve work sessions to review the scope of work, to receive and discuss proposed amendments from City staff, and to receive comments from townhouse developers regarding performance standards for townhouse uses. The Planning Commission and City staff need to hold additional work sessions to discuss proposed amendments to townhouse performance standards and to evaluate comments received from townhouse developers. The. Planning .Commission will then finalize their comprehensive review and update. of the City's Zoning Ordinance pertaining to the performance standards .for townhouse dwellings andupdate of the City's comprehensive sanitary sewer and water plans. The City Council believes that the .Planning Commission will not have sufficient time to complete these revisions to the Comprehensive-Plan and Zoning Ordinance or sufficient time far the.... . City Council to review the .recommendations of the Planning: Commission before the expiration of -the moratorium provided in Ordinance No. 711, as amended by Ordinance No. 733. The City is authorized under Atiinn. 'Slat. § 462.355, subdivision 4, to extend the Interim Ordinance for additional periods not to exceed 18 months. The City Council has determined that an additional four month extension of Interim Ordinance No. 711 is necessary for the City Council to review and - adopt appropriate amendments to the City's: zoning ordinance concerting .appropriate controls for townhouse subdivisions. SECTION 2. Section 2 of Ordinance No. 733 is hereby amended to read as follows: Pending the completion of the above referenced activities and adoption of appropriate official controls, no plat for residential development in the RST-2, RM-l, RM 2, RH-1 and RH: 2 zoning districts or for medium, medium/high, and high density residential developments as designated on the 2020 land use plan. in the PUD zoning district shall be processed or approved and no applications for such approval will be accepted. This ordinance shall not apply to the following: 1U9142.02 Rev:12/1/03 (1) Plats which fiave been preliminarily approved by the City Council prior to -the adoption of-this ordinance, unless that' approval is void pursuant to Sections 10-2-2 and 10-2-3 of the Lakeville City Code. (2) Plats for senior housing. (3} Plats far which a sketch plan or preliminary plat application has been completed and `filed with the City prior to April 11, 2002. (4} Plats for manufactured homes as defined in Minn. Stat. § 327.31, Subd. 6: (5} Plats for churches. (6} Plus for schools. (7) Plats for single family developments. (8) Administrative subdivisions. -(9) :Flats located within District 7 (Central Business District} of -the 1998 Comprehensive Land Use Plan Update. (10) Multiple family dwelling (apartment) structures in the RH-1 and RH-2 districts. SEC"I'ION 3. Section 5 of Ordinance No. 711 is hereby amended to read as follows: This ordinance shall take effect upon passage and shall remain in effect until it is repealed in conjunction with the date of the adoption of the official controls contemplated hereunder or April 21, 2004, whichever occurs first.
