City Of Lakeville • PLANNING COMMISSION MEETING MINUTES August 21, 1997. .The August 21, 1997 Planning Commission meeting was called to order by Chair Rieb at 6:00 p.m. in the City Hall Council Chambers. Roll call of members was taken:. Present: Bellows, Kot, Rieb, Amborn, Cecchini, Wulff. Absent: Miller, Wanner, Alternate Member Luick. Also present: Robert Erickson, City Administrator; Michael Sobota, Community and Economic Development Director;. Frank Dempsey,. Associate Planner; Tim Hanson, Assistant City Engineer; }im Walston, Assistant City Attorney; and Donna Quintus, Recording Secretary. The minutes of the August 7, 1997 Planning Commission Meeting were approved as printed. ITEM 5: PUBLIC HEARING: D.R. Horton Easement Vacation (Zweber Farm) Chair Rieb opened the public hearing to consider the application of D.R. Horton, Inc. for the vacation of existing roadway, drainage, and utility easements in conjunction with the • final plat of Zweber Farm First. Assistant City Attorney )im Walston attested that the legal notice. had been duly published and mailed as required by state statute. Comm Wily and .Economic Development Director Michael Sobota provided details of the application from D. R. Horton, Inc.. for the vacation of existing roadway, drainage and .utility easements located within the boundaries of the Zweber Farm First final plat. The existing metes and bounds easements are located on the northerly boundary of the plat along 175th Street. These easements are being replaced by permanent drainage and utility .easements and public street right-of--way on the Zweber Farm First final plat consistent with current City policy. There was no public comment. 97.109 MOTION by Wulff, Second by Amborn to close the public hearing. Roll cal vote was called on the nation. Ayes: Kot, Rieb, Amborn, Cecchini, Wulff. Nays: 0. 97.110. Regular Planning Commission Meeting Minutes August 21, 1997 Page 2 ITEM 6: PUBLIC HEARING: Arden International Kitchens Easement Vacation Chair Rieb opened the public hearing to consider the application of Arden International Kitchens#or the vacation of an existing drainage and utility easement on land located at 21150 Hamburg Avenue. Assistant City Attorney }im Walston attested that the legal notice had been duly published as required by state statute. Community and Economic Development Director Sobota presented an overview of the application. from-Arden International Kitchens requesting the vacation of an existing drainage and utility easement currently located across the southern portion of tot 1, Block 1, Airlake Industrial Park First Addition. This easement was established in the 1930s and .placed over a sanitary sewer pipe that. conveyed treated wastewater from the wastewater treatment facility to south creek. The wastewater facility has since been abandoned and demolished and the established easement is no longer needed for public purposes. A proposed Arden International Kitchens expansion project and replat of this property has prompted the easement vacation request. Community and Economic Development Department staff recommends approval of the easement vacation as requested. • There was "no public comment. 97.111 MonoN by Wulff, Second by Kot to close the public. hearing. Nays: 0. 97.142 MOTION by Wulff, Second by Amborn to recommend to City Council approval of the vacation of the existing drainage and utility easement located on Lot 1, Block 1, Airlake Industrial Park First Addition (21150 Hamburg Avenue) as requested by Arden International Kitchens. ITEM 7: PUBLIC HEARING: Lakeville Family Housing Addition Chair Rieb opened the public hearing to consider the applications. of Lakeville Family Housing Limited Partnership to: 1) rezone property from R-A, Single Family Residential - Agricultural District and R-2, Single Family Residential District to PU'D, Planned Unit Development District; and 2) a preliminary and final plat to allow the construction of 30 townhouse units on property located north of Dodd Boulevard and east of Cedar Avenue. Assistant City Attorney }im Walston attested that the legal notices had been duly published and .mailed as required by state statute. Regular Planning Commission Meeting Minutes August 21, 1997 Page 3 • Associate Planner Frank Dempsey presented an overview of the proposal submitted by Dakota County HRA on behalf of Lakeville Family Housing Limited Partnership for development of an affordable housing project in the .proposed Lakeville Family Housing Addition. REZONING. Associate Planner Frank Dempsey noted that the property is currently zoned R-A, Single Family -Agricultural District and R-2, Single Family Residential District. The developer is requesting a rezoning to PUD, Planned Unit Development District to accommodate the proposed townhouse development. A .1989 study of the Cedar/Dodd area resulted in an amendment to the City's Comprehensive Land Use Plan designating medium density residential as an appropriate use for this specific site. The proposed rezoning is consistent with the Comprehensive Land Use Plan. PRELIMINARY AND FINAL PLAT Associate Planner Dempsey indicated that the proposed Lakeville Family Housing Addition development consists of 30 units on eight townhouse lots and one common lot on a 5.63-acre site located north of Dodd Boulevard and east of Cedar Avenue. The resulting gross density is 5.32 units per acre which is consistent with past projects and • ordinance standards for mid-density housing. Associate Planner Dempsey provided details regarding the following: • Lot/Block and Street Configuration: The proposed plat includes the dedication of the north half right-of-way for the minor collector. street, Glacier Way. An extension. of Glacier Way is proposed to be constructed between Cedar Avenue and Dodd eoutevard as a Public Improvement Project by the City in conjunction with the Lakeville Family Housing Addition plat. • Property Line and Building Separation Setbacks: Proposed setbacks are consistent with ordinance requirements.. A staff evaluation of proposed building separation setbacks will support tong term redevelopment opportunities should the property be converted to private housing/owner occupied in the future. • Guest Parking: 28 guest parking spaces are proposed in addition to 30 garage spaces .and 3o driveway spaces. • Building: Elevations: Proposed exterior bailding treatment is residential in character and is compatible with surrounding residential land uses. • Landscaping: Staff has identified issues related to plantings within the 30-foot sight visibility triangle at street intersections and proposed species of plantingsand is recommending a modification to the landscape plan. Staff recommends replacing the Scotch Pines with Spruce. The developer has agreed to submit a revised plan reflecting staff recommendations prior to City Council review of the project. • Park and Trail Location/Dedication: The Parks and Recreation Committee has reviewed the proposed preliminary and final plat and has recommended a cash Regular Planning Commission Meeting Minutes August 21, 1997 Page 4 • contribution to satisfy the park dedication requirements. The developer is proposing a center courtyard which will contain playground equipment, a gazebo, and a hard surface play area. The play area will be maintained and managed by the developer. • Project Identification Sign: The proposed sign meets code with the exception of setbacks within the site visibility triangle. The plan will. be amended prior to City Council consideration of the applications. Associate Planner Dempsey noted that the Lakeville Family Housing Addition preliminary and fins! plat plans have been reviewed by the City Engineer, the Dakota County Soil and Water Conservation District and the Environmental Affairs and Parks and .Recreation. Advisory Committees and all have recommended approval. Associate Planner Dempsey indicated that the Dakota County HRA and Lakeville Family Mousing limited Partnership held a neighborhood meeting in February, 1997 to discuss the proposed project. Comments and concerns expressed by the residents have been addressed and incorporated into the final development proposal.. Kari Gill, Deputy Executive Director, Dakota County HRA, and Mr. Kim Bretheim, Architect, Pauf Madson and Ass©ciates, were in attendance and indicated agreement to staff recommendations and conditions for approval of the proposed townhouse development. . Ms. Gill and Mr. Bretheim responded to several questions from the Commission regarding site design, landscaping, project amenities, building and grounds maintenance, law .enforcement, tenant screening procedures, tenant regulations and controls, and property management. Mr. Robert Ketterling, 17342 Goldenrod Avenue, expressed opposition to the proposal of rental housing in this area. Mr. Terrence Rice, 17333 GlencoeAvenue, also expressed concern fora public housing project located in a single family residential neighborhood noting his opinion that .this would have a negative impact on housing values. Mr. Rice also requested information regarding Lakeville Family Limited Partnership's ability to provide low cost rent. Ms. Grill responded that financing is achieved through a combination of loans, grants,. and equity raised from federal housing tax credits. Because of below market financing, the partnership is able to offer units to low/moderate income fami ies at affordable rates. City Administrator Robert Erickson stated that the City of Lakeville is a participant in the Minnesota Livable Communities Act Program which requires that cities provide. a diversity of housing opportunities for their residents. The Lakeville Family Housing project represents an effort by the City t4 meet i#s' obligations to provide for this type of housing. Further, Mr. Erickson indicated that staff views this development proposal as a :positive for the community because it is being proposed by the Lakeville family Housing Limited Partnership/Dakota County HRA who has established a reputation for responsible ownership and good management practices as demonstrated in similar projects located throughout Dakota County. Nays: 0. .Commissioner Wulff indicated that. initially she fiad concerns with the project, but is now supportive of the proposed townhouse development because of project design, knowledge about the developer's track record, and location next to the church and park. 97.114 MoriON by Cecchini, Second by Wulff to recommend to City Council approval of the Lakeville family Housing Addition preliminary and final plat subject to the eight stipulations as listed in the August 15, 1997 Planner's Report and recommend approval of the requested rezoning from R-A, Single Family Residential -Agricultural District and R-2, Single Family Residential District to PUD, Planned Unit Development in accordance with the Findings of fact and Recommendation dated August 21, 1997.
