HomeMy WebLinkAbout0755 ORDINANCE NO. 755 CITY OF LAKEVILLE DAKOTA, COUNTY, MINNESOTA AN ORDINANCE AMENDING-TITLE 9, CHAPTER 2 OF THE LAKEVILLE CITY CODE CONCERNING THE CONDITIONS FOR MOVING BUILDINGS THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Section 9-2-2(A) of the Lakeville City Code is amended to read: A. Any person desiring to move buildings or structures into and/or within the limits of the City shall first apply for a building permit so to do to the Building Official, and shall at the time of the making of such. application pay to the City a fee. Fees -shall be established pursuant to the Ordinance Adopting Fees. SECTION 2. Section. 9-2-2{C) of the Lakeville City Code is amended to read:- C. At the time of the filing. of the application for a building permit to move any building and/or structure(s), as herein contemplated, the applicant shall file with the Building Official, the age, type of construction, height, accurate outside measurements, the number of rooms and descriptions thereof (e.g., living room, dining: room, kitchen, bedroom, etc.), number of baths, etc. of the structure(s) proposed to be moved, the route used to move the structure and the address of the location where the building or structures} maybe personally inspected by the .City Building Official or his designated representative. After such inspection, if, inthe opinion of the Building Official, the building or structure(s) does not meet the conditions as outlined in subsection B above, he shall refuse to issue the permit; provided however, that if the building or structure(s), in the opinion. of the .Building Official, can be remodeled, altered and/or reconditioned so as to comply with all the requirements of the City Building Code, then the Building Official may issue a permit conditioned on the requirements as set forth by the Building .Official's inspection. When such permit is issued, it shall $e a further requirement. that the applicant shall at the time of the issuance of said permit(s), sign a statement acknowledging acceptance of said conditions and, :further, shall post a cash escrow or letter of credit in favor of the City, guaranteeing compliance with said conditions. All. permits shall be for the duration of one year from date of issuance. Any moving, remodeling, alteration or reconditioning of any building. ar structure(s) must be completed within that period; and in the case of a conditional permit, said cash escrow or letter of credit shall remain in full force and effect until all conditions are fully complied with. SECTION 3. This ordinance shall be effective immediately upon its passage and publication. ADOPTED this 5`h day of January 2004 by the City Council of the City of Lakeville, Minnesota.
