Present; Friedges, Clay, Mako, Sullivan and Taft. Also present; R. Frigaard, Village engineer and Dave Grannis, attorney. 888. Motion by Taft seconded by Clay to accept. the minutes of the June 21, 1971, meeting as redd. Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried. The. Planning Commission minutes for June 24, 1971, were presented. Joe Stevens appeared with an objection to giving Frank Farrell a variance for lot size. He felt that as he had not. been able to build on this lot, no one .else should be. The lot is .only 50' wide. 889. Motion by Sullivan seconded by Friedges to follow the Planning Commission .recommendation and grant a variance to lot size to Frank Farrell. Mako, Sullivan, Taft and. Friedges "aye", Clay opposed, motion carried. 890. ~ Motion by Clay seconded by Friedges to grant LAD Holding Co. a conditional use permit and a variance to the ordinance for Outlot E, Valley Park 3rd Addition. .Mako, Sullivan, Taft, Friedges and .Clay "aye", motion carried. Mr. Blue presented plans. for a townhouse complex which would be placed on land they would like to have rezoned. 891. Motion by Friedges seconded by Taft to follow the Planning Commission recommendation and grant this rezoning from R-1C to R-3B subject to perimeter set back of buildings and phase markings on site plan. A special use permit. is granted subject.. to the Plannning Commission approval. 5% of cost of undeveloped land is accepted by the Village in lieu of park land on this and future multiple developments. Sullivan, Taft, Friedges, Clay and rlako "aye", motion carried. Dynasty Corp. represented by Mr. Beaumont and Pete: Sterling, presented a plan for the development of property they wish to acquire. 892. Motion by Clay seconded by Friedges to deny the rezoning from R-1C to R-3C to Dynasty Investment Corp. Friedges. and Clay."aye°', Taft, Mako and Sullivan opposed, motion failed. 893. Motion by Mako to postpone a decision on Dynasty Investment Corp. until this matter is checked out with Midwest Planners and reconsider the zoning of the North section of Lakeville and to have Dynasty Corp back ~r the first Monday in Aug. Taft seconded the motion. Friedges, Clay, Mako, Sullivan, and Taft "aye", motion carried: 894. Motion by Mako seconded by Friedges to follow the Planning Commission recommendation and approve the final plat for L & -0 Inc. subject to the engineer's acceptance of the proper drainage from the street to the swale behind 'houses going to the lake in Oak 'Shores 2nd Addition more properly described as being between lots 7 and 8 and lots 12 and 13, Oak Shore Drive. Clay, Mako, Sullivan, Taft and Friedges "aye.", motion carried. 895. Motion by Clay seconded by Friedges to hold the public hearings of plats on the preliminary plat 'rather than on the final plat. Mako,. Sullivan, Taft, Friedges and Clay "aye" motion carried. Motion by Clay seconded by Sullivan to accept this. letter of resignation. Sullivan, Taf Friedges, Clay and Aiako "aye", motion carried. 897. Motion by Mako seconded by Taft to take the recommendation of the P.C. to appoint Michael Edwards under advisement. Taft, Friedges, Clay, Mako and Sullivan "aye", motion carried. Art Leibfried presented two petitions, one-for sewer into his property in Sec. 32 and the other for water and sewer into his lots at Clay's Acres. =898. "Motion by Friedges seconded by Sullivan to accept these. petitions. Friedges, Clay, 1~1ako, Sullivan and Taft "aye11, motion carried. Robert llavies of Metro Cable Inc. presented some informative material to the council. It was stated that. there would have to be an ordinance passed to :cover this-cable. 89y. Motion by Clay econded by Friedges to table this matter until the 2nd meeting in August and to request that the Village attorney bring back a p~'~iposal and the Village engineer an opinion: all by the first meeting in August. Clay, Mako, Sullivan, Taft and Friedges "aye" motion carried. Mr. grueger appeared with the plat for Donnay's Valley Park 5th Addition. It was stated .that the storm sewer is needed in Valley Park before winter and that LAD .should be granted 90 days to complete-the storm sewer project, fond will be filed and if this project is not completed in 90 days, the bond mon€ees-will be applied by the Village to complete the project. The park in College Park 1s~6 is going to be leveled out and Mr. K~aueger was asked to :contact Ray .Henry in correction with this. 900. Motion by Sullivan seconded by Clay to order the engineer to prepare storm sewer plans as per .the original Flagstaff sewer study. Mako, Sullivan, Taft, Friedges and Clay 11aye",.motion carried. 901. Motion by Clay seconded by Sullivan to approve Valley Park 5th plat .contingent on the signing of bonds for the 90 day completion date of storm sewer and subject. to the attorney's title opinion and the development bonds. Sullivan, Taft, Friedges, Clay and Mako 11aye", motion carried. 902.. Motion by Clay seconded by Taft to authorize the engineer to go ahead and prepare plans and specs for water-and sewer in Valley Park 5th Addition. Taft, Friedges, Clay, Mako and Sullivan `°aye", motion carried. Myrtle Sorenson appeared in respect to the purchase of 1 or 2.acres of land for the Lakeville Grove Cemetary. Miss Sorenson will return on the 12th to discuss this matter further. Air. Donald Tatge presented a petition for a sewer line extension up Howland Ave. to seven homes. 903. Pioton by Taft seconded by Friedges to accep this petition from Mr. Tatge. and order a preliminary study for the same. Friedges., Clay, Mako,... Sullivan. and Taft "aye", motion carried. Mr. Robert'Sykes, Jim Smith and Glenn Kirkeby appeared to request that the council'do omething about the proposed pumping of"Crystal Lake by Burnsville to lower the level of the water in the lake.. They. feel that ..this would be detrimental to their property. 904. Motion by Clay seconded by Sullivan to instruct the Mayor and the clerk towrite letters to the Conservation Dept. and Burnsville Council and to PAGE TWO i VILLAGE OF LAKEVILLE COUNCIL MEETING JULY 6, 1971 call both these departments to hold judgement until Lakeville is advised as to what is happening at Crystal Lake regarding the elevation of the water. Clay, Mako, Sullivan., Taft and Friedges "aye", motion carried. It was mentioned that Mr. Bassett should be contacted and .advised .that the road in his addition should be put in. The Mayor informed the council that. there is to be a workshop on Federal funding of park land and the cost is $6. 905. Motion by Taft seconded by Sullivan to authorize anyone of the council that is `available to go to this workshop. Mako., Sullivan, Taft, Friedges.. and Clay "aye", motion carried. 906. Motion by Clay seconded by Taft to instruct`a11 Village consultants that they are.not to'discuss Village problems with anyone unless authorized by the Village, council. Sullvan,'Taft, Friedges, .:Clay and Mako ".aye", motion carried. 907... Motion by Taft econded by Clay to turn the matter of Tom MoFir not obtaining a garbagehauling germit over. to the legal counsel for action.. Taft, Friedges, Clay, Mako and Sullivan.. `Faye", motion carried. A letter requesting an easement .release by Donna Klotz was read. This will 'be checked out before a decision is made. Clint Cross' J.P. report was reviewed by the council. 908. Motion by Taft seconded by Clay to grant Lester Frank a garbage hauling permit. Friedges, Clay, Mako, Sullivan and Taft ''aye", motion carried. 909. Motion by Taft seconded by Sullivan to grant a set-up license to the Lakeville Bowl. Clay, Mako, Sullivan, Taff and Friedges "aye", motion carried. 1000. Motion by Friedges seconded by Taft to accept the summons served on the Village. Copy attached.. riako, Sullivan, Taft, Friedges and Clay "aye", motion carried. 1001. Motion by Clay seconded by Friedges to turn this. summons over to the legal counsel, Sullivan, Taft, Friedges, Clay and Mako "aye", motion carried.
