Present; Friedges, Clay, Mako, Sullivan and Taft. Also present; Robert Frigaard, Village engineer, and Pat Farrell, Village attorney. 2028. Motion by Sullivan seconded by Friedges to accept the minutes o€ the Nova 1, 1971, meeting as read. Friedges, Clay, Mako, Sullivan and Taft "aye", - motion carried. The building inspector presented his report. The minutes of the Water & Sewer Committee for. Nov. 3, 1971, were presented. 2029. Motion by Taft seconded by Sullivan to deny. the recommendation of the Water & Sewer Committee to re-submit the claims. of Father Rowan and Ken Hullett to the insurance company. Clay, Mako, Sullivan, Taft and Friedges."aye",.motion carried. 2030. Motion by Clay seconded by Friedges to follow the recommendation of the Water & Sewer: Committee to replace the water hydrant on 167th St. in `Valley Park. Mako, Sullivan,.: Taft, Friedges and Clay."aye", motion 'carried. 2031. Motion by Clay seconded by Sullivan. to table the decision to set a time for a public hearing fore sewer laterals on Howland Ave. until 'Nov. 15th.: Sullivan, .Taft,. Friedges, Clay and Mako "aye", motion .carried.. 20.32.. Motion by Mako seconded by Taft to table the decision to set a time for a public hearing on the sewer and. water. laterals in Clay's Acxes until the 1Sth. Taft, Friedges, :Clay, Mako and.Sull~van "aye", motion carried. 2033. Motion by Friedges seconded by Taft that Whereas a petition has been received by the Village Council: requesting water: main extension in, Forest Hil s Addition;-And Whereas the Engineer has reported to the Council thatsald project is feasible, Whereas.. the Sewer & Water Committee of the Village of Lakeville. has recommended sad..pro3ect, now therefore it being resolved°as follows: 1. that said"petition is valid and complies-with,-the statutory requirement 2. that said. Improvement as described. by the. Village Engineer be and the same. hereby is ordered 3. that the Village Engneer`is authorized to negotiate with Austin Keller Construction':Co. to proceed with the installation of said project under the ex fisting contract with Austin Kellerfor work being.. performed. in Glenn's Addition: Friedges, Clay, Mako, Sullivan and Taft "aye.",..motion:carried. 2034. Motion by Clag seconded by Friedges to follow the Water & .Sewer Committee recommendation to have the engineer install a water meter in the Forest Hills , Add. pump house and to investigate the possibility-of installing fluoride and chlorine equipment for such house.. Clay, Mako, Sullivan, Taft`and Friedges ,..aye.. motion carried. Mr. Harold Malmanger appeared before the council to request a letter to present to the.R:R as he thought that he might be able to get a crossing into his proposed addition. He was instructed to check the easements for the`road with Mr. Tillges. Mr. Skelton presented a resume. of the operation he is proposing in the northeast corner of Lakeville under the name of Nordic Square. A decision on the rezoning. should be postponed for a performance or development contract. • 2035.. Motion by Friedges seconded by .Clay to table this matter until the lsttmeeting in Dec.. NOVEMBER 8, 1971 ~r!vin Hagen and Roger Duff presenteda petition signed by about 50 peaple_ zequesting thaC the Lakeville Council continue its appeal to the MMC ee$arding the annexation. .2036.. Motion by Clay seconded by Friedges to accept this petition. Sullivan, Taft, Friedges, Clag and Mako "aye", motion carried. Mr. Farrell explained to .the council that he had been at the hearing on the Crystal Lake suit and that the matter. had been dismissed. The court had ordered Burnsville to report within 2 weeks on a proposal-fer the temporary contxol of the level of Crystal Lake. A permit has been issued by the state Chat. the lake can be pumped and maintained at the level of 934 feet. Mr.- Farrell felt that close contact should be kept with `the Department of Natural Resources. He also asked for direction from"the council . 2037. Motion by Friedges seconded by Clay endorsing the_maintainence of the level of Crystal Lake at 934.feet. Taft, Friedges, Clay, Mako. and Sullivan "aye", motion 'carried. 2038, ~tesolution by Sullivan seconded by Friedges to authorize the release of Homeowners Insurance bonds, numbers 4788, 4789, 5791 and 5792. Friedges, Clay, Mako, Sullivan and Taft '.'aye", motion carried. 2039. Motion by Friedges seconded by Taft to accept the bid of Carlson Equipment Co. for a tractor and accessories with the type of mae~r left up to-the road. committee and maintenance dept. Clay, Mako, Sullivan, Taft and Friedges "aye", motion carried..: 2040. Motion by Taft seconded by Clay to accept the recommendation of the engineer and accept thelow bid of Midway Ford for the truck withthe automatic transmission. Mako, Sullivan, Taft, Friedges and C1sy "aye", motion carried. 2041. Motion by Clay seconded by Friedges to accept the lmw bid of Arcon Construction Co. for the trunk and sewer trunks as recommended by the engineer. The bid was for $218,445.80. Sullivan, Taft, Friedges, Clay'and Mako "aye", motion carried. 2042. Motion by Friedges seconded by Taft to ok the list of election judges as presented, Taft, Friedges, Clay, Mako and Sullivan "aye"', motion carried. :Mike Edwards explained to the council .that he represented the 2nd. annual snowmobile festival in-Valley Park with a tentative date set at Feb. 33, 1972. He asked if there were any permits needed to hold this race. The clerk was instructed to write to Nicollet Nursery and Wren Inc. thanking Chem for a building and the moving of the. same. 2043. Motion by Sullivan seconded-by Clay-ta release all.-the certified checks of the rejected bids for the tractor and the truck:. Friedges, Clay, .Mako, Sullivan and Taft. ':'aye", .motion. carried. 2044. Motion by Taft seconded by Clay to transfer $1750 from the Utility Fund Co the 71-2 Fund. "Clay,'Mako, Sullivan, Taft and Friedges "aye", motion carried. 2045. Motion by Clay seconded by Friedges to transfer :$10,674:43 from the Utility Fund to the 71-3 Fund. Mako ,Sullivan, Taft, Friedges and Clay "aye", motion carried. 2046. Motion by Clay .seconded uy Taft accept the sewer and water project of Country. View Homes .Community, Phase .i as recommended by Che engineer / Sullivan, Taft, Friedges, Clay and Mako "aye" motion carried..; subject to maintenance bonds 'being ..posted. C2) • A VILLAGE OF LAKEVILLE COUNCIL MEETING NOVEMBER 8, 1971 .Ken Larson asked the council: if something could-be done to expedite the vacation of a portion of Howland Ave. 2047. Resolution by Sullivan seconded by Friedges calling for a public hearing on he proposal to-vacate aportion-of street as described on the enclosed legal notice. There will be two weeks. published .notice. -Taft, Friedges, Clay, Makoand Sullivan "aye",..motion carried6 It was suggested that a letter be written to the PEA xequestingthat the Village be notified regarding .any hearings for the landfill operation in Scott County.
