NOVEMBER 15, 1971
The :meeting was called to order by Mayor Mako at 8 P.M. Flag pledge followed..
Present; Friedges, Clay, Mako, Sullivan and Taft.. Also present; John Todd,
Attorney, Pat Farrell, Village attorney, and Robert Frigaard, Village engineer.
2048. Motion by Taft seconded by Sullivan that the minutes of the Nov. 8, 1971,
meeting stand-as read, Friedges, Clay, Mako, Sullivan and Taft "aye",
motion carried.
2049. Motion by Friedges seconded by Clay to pay the Liquor claims. Clay, Mako,
Sullivan, Taft and Friedges "aye", motion carried.
2050. Motion by Sullivan seconded by Friedges to pay the Village claims. Mako,
Sullivan, Taft, Friedges and Clay "aye", motion carried.
The Planning Commission report for November 11, 1971, were presented.
2051. Mofion by Sullivan seconded by Clay to follow the 'Planning Commission recommendation..
and grant a permit to Airlake Park to erect a building llb'Oi," X.172'8" for
Aeroquip Corp. Sullivan, Taft, Friedges, Clay and. Mako "aye", motion .carried.
2052.. Motion by Friedges .seconded by Sullivan to follow the Planning Commission
recommendation and grant Klotz Contruction Co. a variance to the subdivision
ordinance as to lot size subject `to a Certificate of Survey being submitted.
Taft, Friedges, Clay, Mako and Sullivan "aye", motion carried.
2053. Motion by Clay seconded by Taft to follow the Planning Commission recommendation
and grant Round-Up Corp a especial use permit for gasoline storage. Friedges,
Clay., Mako, Sullivan. and Taft "aye", motion carried.
2054. Motion by Sullivan seconded by Friedges to follow the Planning Commission..
recommendation and approve the final plat for. Valley Park 6th ..Addition
subject~to the attorney`s title opinion, the deed. to the park given to the
Village, the improvement bonds and the development. contract.
Clay, Mako, Sullivan, Taft and Friedges "aye°', motion carried.
2055. Motion by Clay seconded by Taft to follow-the Planning Commission recom~endation
and approve the final plat for Valley Park 7th subject to the development contract
and the attorney's title opinion. Mako, Sullivan, Taft, Friedges and Clay..
"aye", motion carried.
2056. Motion by Clay seconded by Friedges to`follow the Planning Commision recommendation
and approve the final plat for Valley Park 8th Addition subject to the attorney's
title opinion, the deed to the-park, the development contract, and the
improvniement bonds. Sullivan, Taft, Friedges, Clay and Mako "aye", motion
carried.
Mr. John Todd, attorney for the annexation proceedings, gave a summary of
what had taken place since the court proceedings had started. He explained that
.the petition as presented to the Village Council on Nov. 8, 1971,.: could not
be presented todistrict court. There were about 20 residents from the
.ten square mile area represented in the audience. Mr. Howard Haffner explained
that some of the residents of this area had not. known what they were signing.
Mr. Todd told them that if they could get enough affidavits regarding this,'
it could probably be introduced as evidence. Robert Sayers thought the
Village of Lakeville should pursue this matter as they could be losing much
tax revenue otherwise. Al Patenaude asked how long this matter would take
in court and was advised it could take up to two and one half years to settle.
2057. Motion by Clay seconded by Friedges to make a decision regarding pursuing :the
matter of the annexation further_by the third meeting in December. Taft,
Friedges, Clay, Mako and Sullivan "aye", motion carried.

2058. Motion by Clay seconded by Taft to follow the Park & Recreation recommendation
and accept the bid of D. H'. Gustafson & Assoc. for the Crystal Lake area
not to exceed $475. Friedges, Clay, Mako, Sullivan and Taft "aye",motion carried..
.2059. - Motion by Friedges seconded by Clay to accept the donation of $250 from Glenn
Klotz in lieu of .park land. Clay, Mako, Sullivan, Taft and Friedges "aye",
motion carried.
There was a discussion pro and con hiring a supervisor for rink maintenance.
2060. Motion by Mako seconded by Friedges to follow the Park & Recreation recommendation
for the hours of the warming house being open but changing he time from 4 P.M. to
3:30 P.M. Mako, Sullivan,.Taft, Friedges. and Clay "aye", motion carried.
2061. .Motion by Clay seconded by Taft to leave the question of opening and closing
of the rinks to the maintenance and police departments. If problems .arise.
the Village will take care of extra supervision as the :case may need.

2062. Motion by Clay seconded by Friedges to accept the low bid for the heaters
for the warming houses at a size applicable for the building. Taft, Friedges.,
Clay, Mako and Sullivan "aye", motion .carried.
2063. Motion by Friedges seconded by Taft to close the applications for maintenance
man.. Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried.
Wm. Moffett requested some information as to when his road at 170th and
Kenwood Trail is going. to be fixed. This matter was turned over to the
maintenance department. and the road committee..
2064. Motion by Taft seconded by Friedges to approve the Liquor Licenses for
the Chart'House, Minnreg°s Inc.. and the V.F. W. subject to the insurance
be ng turned in before. the first of the year. -Clay, Mako, Sullivan, Taft
and Friedges "aye", motion carried.
A letter from the Metro Sewer Board re: Comprehensive`Sewer Plan was read.
20b5. Motion by Clay seconded by Taft to instruct the clerk to write the Metro
Sewer Board stating that the Village comprehensive Sewer Plan: will be
prepared by January 1 and that we hope .this will expeditethe Sewer Board's
planning because the Village is concernedaboutthe proposed) Mako,
.Sullivan, Taft, Friedges and Clay ''aye", motion carried. interceptor and sewer
plant.
2066. Motion by Taft seconded by Sullivan to acknowledge receipt of the letter from
Mr. Gabiou regarding Cedar Ave. Sullivan, Taft, Friedges, Clay and Mako "aye",
motion.. carried.
2067. Motion by Taft seconded by Sullivan to approve the two permits for Minnegasco,
Job s-269 and Job 5-264. Taft., Friedges, Clay, Mako and .Sullivan "aye",
motion carried.
2068. Motion by Taft seconded by Sullivan to acknowledge the petition for "Caution
Children" sign from the Valley Park residents. This matter has been turned
over to the maintenance department. Friedges, Clay, Mako, Sullivan and
Taft "aye", motion carried.
A letter from Apple Valley re the fire contract was read. This matter will
be resolved later.
2D69. Motion by Taft seconded by Sullivan to adopt the attached resolution re the
sale of park bonds. Clay, Mako, Sullivan, Taft and Friedges.."aye", motion carried.
A letter regarding. a notice of class action law suit was explained to tha
council by Mr. Farrell. He felt that the Village should wait and see what
the state does regarding this matter and the .council will be advised as
to what takes. place. The Village engineer would probably have to: check
out every piece of pipe and what this will costa

Mr. Frigaard reported that he and Mr. Mako had attended the meeting of
Village officials at Burnsville regarding the Crystal Lake problem. The
.temporary pum~aing of--the. lake was-estimated at $25.,000 and Burnsville would
like Apple Valley and. Lakeville to participate in this cost, The total area
was figured at 5.43 square miles with 1.81 in Lakeville, 2.40 inBurnsville
and 1.22 in Apple Valley. Burnsville would like the cost sharing on the
basis of these figures and requested a letter from Lakeville as to what
their feelings were on this matter..
Mr._Clay asked that if these figures were agreed upon, would the othet two
.municipalities agree to pump into the lake-if it drops below the 934` figure.
.2070. Motion by Sullivan seconded by Friedges to stay out of parCicipation in this
.cost as he does not feel the Village of Lakeville is responsible for this
problem. Mako, Sullivan, Taft,. Friedges and Clay "aye", motion carried.
2071 Motion by Mako seconded lay Sullivan to set a hearing on Clay's Acres Sewer
and Water Extensions for 8 P.M. on Dec. 16, 1971, at the high school, and
a hearing for Sewer Laterals on Howland Ave. at 9 P.M. on the 13th of December.
Sullivan, Taft, Friedges, ..Clay and Mako "aye", motion carried.
2072. Motion by Friedges seconded by Sullivan to .correct the drainage prol3lem
at Lakeville Warehouse by having the engineer do the staking, the Village
cut the ditch down and remove-and replace the culvert and Airlake restore
the ditch with sod and blacktop." Taft, Friedges, Clay, Mako and Sullivan
"aye", motion .carried.
An increase in garbage rates will checked out.
2073.:. Motion by Clay seconded by Sullivan to allow the Village truck with a maintenance
man to drive, to haul sawdust out to the nature site for the school students.
Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried.
Motion by Friedges seconded by Taft to adjourn carried unanimously.
