VILLAGE OF I,AKFFFILLE COUNCIL MEETING DECEMBER 1>r.1971 The meeting was called to order by Mayor Mako:at 8 P.M. Flag pledge ` followed. Present; Mako, Sullivan, Taft, Friedges and Clay. Also present; Robert Frigaard, Village .Engineer. 2ogg. Motion by Sullivan seconded by Taft to accept`the minutes of the Dee. 6, 1971, meeting as read. Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried. 2101. _ Motion by Taft seconded by Friedges to accept the minutes of the- Dee. 8, 1971, canvassing meeting as read. Clay, Mako, Sullivan, Taft and. Friedges "aye", motion carried. The Park and Recreation minutes for Dec. 8, 1971, were presented.` 2102. Motion ,by Sullivan seconded by,Friedges to follow the Park & Recreation recommendation and accept the X1,000.00 donation in lieu of land from Wakely Investment. Sullivan, Taft, Friedges, Clay and Mako. "aye motion carried. The Planning Commission minutes for Dee. 9, 1971, were presented. 2103. Motion by Friedges seconded by Sullivan to follow the Planning Commission. recommendation and grant Paul J. and Bonnie Clark a variance to lot size subject to the County engineer's recommendation as to water drainage. Sullivan, Taft, Friedges, Clay and Mako "aye",.emotion carried. 210~F. Motion by Clay seconded by Friedges to .follow the Park & Recreation and Planning Commission recommendations that lots 10, 11 of Block 2, of preliminary plat of Dakota Reigh'ts 1st Addition be accepted as park land subject to future development; that the 10,000 feet shortage be made up when additional land is donated. The intention is to have lots 10 & 11 traded for package park when entire 80 acres is developed. Based on 5~ of total area because of thedensity..and 1,-~ units peraeree and to approve preliminary plan. Taft, Friedges, Clay, Mako and Sullivan "aye,', motion carried. 2105. Motion by Sullivan. seconded by Clay to allow Mr. Laddasaw to rough, in the roads in Dakota Heights. Friedges, Clay, Mako, Sullivan and Taft "aye", motion carried. 2106. Motion by Sullivan seconded by Friedges to table recommendation re preliminary plat of Johnson.Subdivision..until. the .20th of Dec. Clay,. Mako, Sullivan, Taft. and Friedges "aye", motion carried. 2107. Motion by Taft. seconded by Sullivan to follow the Planning Commission recommendation and grant a building permit to Mr. Lynn Peterson subject. to a better set of plans & specs being provided the building inspector. Mako, Sullivan, Taft, Friedges and Clay "aye", motion carried. The building inspector's report was presented to the council. 2108. Motion by Mako seconded by Taft to authorize the building inspector to attend the school for inspectors for which there is a fee of $35. Sullivan, Taft, Friedges, Clay and Mako "aye'', motion carried. The public hearing on sewer extensions on Howland Avenue was opened at g P.M. A list of property owners present is attached to these minutes. A resume of the project was .given by Robert Frgaard who estimated the cost at X1304 per home. Mr. & Mrs. Auen'asked if they would be obligated to pay for the lateral as their home was already connected to the sewer. Mr. Frigaard said that he felt they would have to pay`as they had never paid their fair share for existing lines, they would now be obligated to pay. He alto explained that this was improving the system. w ~ • T.~. Three homes. on he south end of this. project would .not be assessed. There are nine homes to be serviced. 2109. Motion by Friedges seconded by Taft to order the project and authorize the engineer to prepare the plans and specs. Taft, Friedges, Clay, Mako and .Sullivan "aye", motion carried. 2114. Motion by Clay seconded by Taft to close the hearing. ~riedgeg, Clay, Mak©, Sullivan and Taft "aye", motion carried.. Mr. Ray Skelton of Nordic Square. presented the council with an agreement for the rights of both parties in re his operation on the northeast corner of Lakeville. He said that the land would eventually be .used for prime development after the 1D to 20 year limitation bf his operation. He said there would further industrial exp~oiton. dir. Lambert and Mr Clarkson were concerned about the reaction of Apple ~Ta_"x.ley /~~iis rezoning and wanted to know if Mr. Skelton had contacted Apgle Valley regarding his proposal. They were also concerned about. the traffic on the roads. 2111. Motion by Sullivan seconded by Taft to rezone the land for Nordic' Square from R-1C tv I-2 and to grant them the special. use permit. subject to the attcarney going over the contract anal approving the same with a hold harmless clause inserted. Clay,.Mako, Sullivan, Taft anc3 Friedges „aye":, .motion carried. A group of residents who own hobby .farms, .were present to .object to' the amendment to ordinance #1+2. Mr. & Mrs. Fm sberg, Ron Ley, and Fran Olson felt that this would be a detriment in selling their homes as they had bought them with the purpose of having animals, Dirs. Olson felt that the cost of getting a special use permit would be exhorbitant. It was suggested that a committee beset ug to study this problem. 2112. Motion by Clay seconded by Taft to set up a seven member committee with Mr. Sullivan from the council and Ron Ley, Mrs. Richard Forsberg, and Benny VanCleve as.a nucleus. This committee will meet with the Planning Commission on Dec. 30 and corns back tv the council with a recommendation for the amendment. Action on .this amendment will be tabled until after this recommendation comes in. Mako, Sullivan, ...Taft, Friedges and Clay "aye", motion carried. Mr. Elferng came before the council~,etxplain that he did not feel that enough repairs. had been done on jersey Way as he still could. not get supplies into his lot for construction purposes. He was told that the. road had-been inspected by the engineer, members of the.. council and -thee maintenance department, after which the road. had been bladed.. .2113. Motion by Mako seconded by Sullivan .that since the council had followed the committee recommendation and bladed this road, the situationwould have to .wait until spring for..further correction. Sullivan, Taft, Friedges, Clay and Mako "aye", motion carried. 2111+. _ Motion by Clay seconded by Sullivan to hire Ron Leibfried as of-the, "lst of Dee., at the first pay step after 9D days.. Taft, Friedges, Clay,.'. Motion by Mako seconded by Taft to empower the Chief of Police to set up the criteria to hire up to 2 patrolmen and to advertise. Friedges, Clay, Mako, Sullivan and Taft "'aye", motion carried. 2116.. Motion by .Friedges second by Clay to establish a hearing on the budget on the 20th of Dee. at g P.M. Clay, Mako, Sullivan,. Taft Friedges "aye", m©tion carried. The water problem on 206th St. was discussed. Mr. Frigaard will try to remedy the situation. .2117. Motion by Taft seconded by Clay to approve the excavating permit of Fischer Construction. Mako, Sullivan, Taft, Friedges and. Clay "aye", motion carried. 2118. Motion by Taft see©nded by Friedges to renew the on and off beer licenses for ~T. Dayton Kempson at The Place. Sullivan, Taft, Friedges,. Clay anal. Mako "aye"', motion carried. 2119. Motion by Friedges seconded by Sullivan to renew the garbage permit for Dick's .Sanitation. Taft, Friedges, Clay, Mako and Sullivan "aye", motion carried. 2120. Motion by Clay seconded by Friedges. to adopt the resolution re Establishing ~'tunicipal State Aid Hi~hway~-Village of Lakeville, Rti.nn. as presented by the engineer.
